Staff report:
The Administration and City Council, in concert with the community, developed the City's first-ever Strategic Plan from March 2018 to May 2019. The development of the Strategic Plan followed a three phase approach focusing on "Who We Are, Where We Want to Go, and How We Will Get There." Throughout development, extensive community engagement occurred with dozens of engagement activities in a variety of forms and more than 1,600 survey responses. The plan produced by this process reflected the City's desire for a more focused and disciplined approach to meeting community goals. The City Council adopted this plan through Resolution 2019-04on May 6, 2019.

2021 Unclaimed Property Report Unredeemed City Checks AB 8280

Staff report:
On an annual basis, RCW 63.29 requires the City of Issaquah to report to the Washington State Department of Revenue (DOR) all checks that meet the definition of unclaimed property. Unredeemed checks are considered cancelled by statute (RCW 39.56.040) after one year and the underlying liability due the owner of the unredeemed check is reportable as unclaimed property after two years. Utility refunds and payroll checks are reportable after one year. All checks listed in Exhibit A to the proposed resolution are older than one year.

In the codification process, the City's codifier, Code Publishing, and City staff identified a few provisions of other IMC chapters (18.07, 18.19B, 18.19C) that have cross references that are no longer correct or sign code language that duplicates provisions in the new Sign Code.

3:54 to the mayor and to the council
3:56 and thank you for allowing me
3:58 the time to address a concern that i
4:00 have
4:01 um as uh the host stated my name is
4:04 nicole miller i'm a resident and
4:06 homeowner here in issaquah
4:08 my husband mike and i live up in the
4:10 isla highlands
4:12 we have one son who is a sophomore at
4:14 esqua high school and a recent graduate
4:16 of this squad high school who's in
4:18 college
4:19 because the allotted time is fairly
4:21 small i want to jump right to my bottom
4:23 line
4:25 based on my observations over the past
4:27 three plus years of living here in
4:29 issaquah i think it is pretty obvious
4:32 that we have a serious crime problem
4:35 theft has been and continues to be a
4:37 source of stress irritation
4:40 frustration and loss for so many of our
4:43 residents
4:44 but also one that we as a community seem
4:46 to have grown desensitized to and i
4:49 include myself in that group
4:51 without deterrence in place to reduce
4:53 theft and you know i understand that it
4:55 can't be completely eliminated
4:57 i really fear that issaquah will
4:59 continue to feel welcoming not only the
5:01 families who desire a beautiful place to
5:03 live
5:04 but also to criminals who view it as an
5:06 opportunity to take and to take whatever
5:09 they want whenever they want to
5:12 give you a little bit of background
5:13 about myself i'm a military brat which
5:15 means i grew up as
5:16 a child of somebody who served in the
5:18 military i served in the u.s air force
5:21 for seven years
5:22 i'm married to an air force pilot who
5:24 served for 23 years
5:26 i've lived in 10 states and two foreign
5:29 countries and i've moved 18 times over
5:31 the course of my adult life
5:33 i'm almost 50 years old and i can tell
5:36 you that i have never in all the places
5:38 that i've lived witness the amount of
5:40 preventable crime
5:42 that i have seen here in issaquah
5:44 and what has shocked me more than the
5:46 crime itself is the response to it there
5:49 doesn't appear to be any outrage there's
5:51 no calls to the police there just seems
5:54 to be this acceptance
5:56 acceptance by store managers acceptance
5:58 by neighbors i'm not quite sure i
6:00 understand why
6:04 about two weeks ago now i stepped out of
6:07 that
6:08 acceptance role and
6:10 that happened because i was at the
6:12 target in issaquah on october 28th and i
6:15 witnessed four people
6:17 all men in the span of an hour still
6:19 hundreds if not thousands of dollars
6:21 worth of electronics and alcohol from
6:23 target
6:25 i confronted the first thief just as he
6:27 was leaving the store
6:29 another who left the store about 10
6:31 minutes after the first one while i was
6:33 speaking with the store manager and she
6:35 was explaining to me
6:36 why she couldn't intercede or why she
6:39 couldn't call 9-1-1
6:41 and then
6:42 i actually confronted
6:44 the third criminal who i saw that day
6:47 and as embarrassing as it may sound i'm
6:50 going to admit that i verbally harassed
6:52 him in the alcohol aisle
6:54 i harassed him as he exited the store
6:58 around the registers and out into the
7:00 parking lot where i told him that if he
7:02 proceeded out of the store i would call
7:04 9-1-1
7:05 he didn't seem to care and i did call
7:08 9-1-1
7:09 so there i was in the parking lot of
7:11 target shouting for someone to come and
7:13 stop the thieves soak to the bone
7:15 because it was raining and all i could
7:17 think of is how can this be happening
7:20 the 9-1-1 operator is telling me that
7:23 she cannot send the police
7:25 and what i screamed into the phone at
7:28 her is that this is anarchy
7:30 and the definition of anarchy is a state
7:32 of disorder due to the absence or
7:34 non-recognition of authority
7:37 so i'm very close to the end of my
7:39 allotted time
7:41 i hope with that story
7:44 and some of the background information
7:46 that i provided
7:48 you can allow me to ask the following
7:51 four questions of the council
7:53 and i know that this is something that
7:55 can't be addressed in one meeting
7:58 and i know that it's not fully
8:00 your responsibility that we as citizens
8:03 of iskwa and the city council and the
8:05 mayor and the police force all have a
8:07 role to play
8:08 my first question is this
8:10 what is the city council's position on
8:12 the amount of theft in our stores and
8:13 neighborhoods
8:15 and are you at all concerned that we are
8:16 following in the footsteps of
8:18 well-publicized cities like seattle and
8:20 san francisco or seeing businesses
8:22 shuttered
8:23 knowing that that leads to a decrease in
8:25 tax revenue
8:26 and a loss of gainful employment for our
8:28 citizens
8:30 the second
8:31 do we even know how much crime is
8:32 occurring if no reports are being filed
8:34 because police aren't responding
8:38 third are we allowing an underground
8:40 market if you will of goods to be sold
8:42 on the internet
8:44 i'm pretty sure i that we are doing that
8:46 by the amount of alcohol i saw lead
8:48 target that day
8:50 and fourth
8:52 why are the police not pursuing
8:53 criminals because the store won't
8:55 prosecute
8:56 as i understand it the job of the police
8:58 force is to serve and protect
9:01 i have never heard of a caveat and again
9:04 i'm you know i'm not in criminal justice
9:05 so i don't know but i'm not familiar
9:08 with the caveat
9:09 that
9:11 the police only respond if there's going
9:13 to be a prosecution
9:14 i believe that the presence of an
9:16 officer a threat of an arrest sends a
9:18 powerful message to a criminal
9:20 so in conclusion i really feel that it
9:22 is a responsibility of the mayor this
9:24 council the police force and the
9:26 citizens of iskwa
9:28 to be united on how to confront this
9:30 problem and we need the leadership of
9:32 this council to get the message to the
9:34 citizens and criminals alike that crime
9:36 will not be tolerated in a cigua
9:39 thank you very much for your time

9:46 tough to listen to

11:25 uh thank you council members and mayor
11:27 paulie for being here this evening
11:29 i would like to address agenda bill 821
11:32 the title
11:33 18 ad hoc committee
11:35 and as a member
11:37 of the community i've been following the
11:38 land use code change process
11:41 since may
11:42 and i applaud all the work the ad hoc
11:45 committee has devoted to this process
11:47 but i am in full support of the proposal
11:51 to eliminate the title 18 adopt
11:52 committee
11:54 and as noted by the community and staff
11:57 one of the big concerns is increasing
11:59 public transparency but without adding
12:02 any extra administrative support and i
12:04 and i believe this option works the best
12:08 in addition
12:09 the title 18 change issues of importance
12:12 we go directly to city council work
12:14 sessions which are public and very
12:17 inclusive
12:18 and i i really want to say i am very
12:21 grateful to the ad hoc committee for
12:22 creating a strong framework to begin the
12:24 title 18 process
12:26 but adopting this new approach to
12:28 eliminate the committee would be in the
12:30 interest of all and that would be the
12:32 administration
12:33 the various committees
12:35 all the council members and the public
12:37 and i appreciate your consideration

12:51 all those residents who came in to speak
12:53 this evening
12:54 first on
12:56 crime issues in issaquah the need for
13:00 additional deterrence and the need for a
13:02 focused plan on how to proceed
13:05 also uh comments on the title 18 ad hoc
13:08 grateful for their work um and believing
13:11 their work is wrapped up
13:14 and recommends having future work done
13:16 at study sessions so thank you both for
13:19 coming in to talk this evening
13:21 just anybody else who might be watching
13:23 or watching on video i want to remind

13:32 council president hunt i'd like to take
13:34 the opportunity right now to see if you
13:35 have any email comments that you wish to
13:37 summarize on tonight's agenda topics
13:40 thank you madam mayor we do have one
13:43 email comments that is specific to
13:45 tonight's agenda items and um while
13:48 we've been having virtual meetings i've
13:49 been summarizing those email comments
13:51 that comment was regarding ab-8291 title
13:55 18 ad hoc committee the residents
13:58 spoke to a preference for
14:00 focused council committees also spoke to
14:02 the benefits of sending items to council
14:06 work sessions and dissolving the title
14:07 18 ad hoc committee
14:09 and that that was the only comment that
14:11 specifically referenced tonight's items
14:13 thanks
14:14 thank you council president hunt
14:16 so we will now move on to committee and
14:18 regional reports and let's start with
14:20 council member hall
14:23 thank you mayor paulie this is council
14:25 member zach hall
14:27 i have a somewhat lengthy report tonight
14:29 so apologies to the council in advance
14:32 um so first off last wednesday i
14:35 attended an east side fire and rescue
14:37 board meeting
14:38 uh significant agenda items included
14:40 moving forward with a contract to
14:42 provide interim fire administrative
14:44 services to the city of mercer island
14:46 reviewing the board's draft legislative
14:48 agenda for the 2022 legislative session
14:51 a briefing on the progress of efer's
14:53 pfox committee and a briefing on efer's
14:57 new narcan leave behind kit pilot
15:00 program that will begin soon
15:02 and there are just two things that i
15:03 want to
15:04 highlight um for the council because i
15:06 think that they're
15:07 important for astaqa to know
15:09 first with regard to pfos we've been
15:12 officially notified by the state that
15:14 pfos is now categorized as a hazardous
15:16 substance
15:17 meaning we'll be expected to follow
15:19 what's called the model toxics control
15:21 act or modka
15:23 in our mitigation work
15:25 so we're just beginning to get into what
15:27 that means with our attorneys but one
15:29 outcome is that we'll have access to new
15:31 macca specific grant funding
15:33 opportunities that we didn't have
15:36 available to us in the past so that's
15:38 interesting to note um
15:41 i was also really impressed and moved by
15:44 the staff presentation on our new
15:47 naloxone or narcan leave behind kit
15:49 pilot program
15:51 so just some data i want to run by you
15:53 all that i thought was um
15:55 interesting to note
15:56 in 2020 the number of overdose deaths
15:59 involving fentanyl in king county was
16:01 171
16:02 and as of last week the number of
16:05 overdose deaths this year was already at
16:07 282
16:09 100 more and we haven't even finished
16:11 out the calendar year
16:12 so this obviously highlighted in
16:14 emergent and large need in king county
16:17 and efer is stepping up for the plate so
16:20 this leave behind pilot program was
16:22 modeled after successful pilot programs
16:24 both in tacoma and in maryland in the
16:26 state of maryland
16:27 and efer will now be the only fire
16:29 department in king county to be working
16:31 in this specific leave behind space so
16:33 what does that mean so essentially
16:36 narcon kit snark hand kits will be
16:39 on every front line efer unit and after
16:41 responding to an overdose call kits will
16:44 be offered to surviving patients
16:46 bystanders and family members and those
16:48 kids will also include information on
16:50 how to connect with substance use
16:52 prevention resources but the really
16:54 amazing thing that they mentioned to the
16:55 board was that in maryland studies show
16:58 that the kits that were left behind with
17:00 families of surviving individuals led to
17:03 a five times greater likelihood that
17:05 that individual would seek treatment and
17:07 recovery services
17:08 um so that's pretty outstanding
17:11 uh so after a year we'll evaluate our
17:13 data and consider future programming
17:15 like potentially providing narcan kits
17:17 for city halls libraries or other public
17:19 spaces but
17:21 i wanted to make sure everyone here knew
17:23 about this exciting program and also the
17:24 active leadership from eva in our
17:26 community
17:28 uh next up for the next meeting of the
17:31 growth management planning council's
17:32 affordable housing committee is this
17:34 wednesday from 1 to 3 p.m over zoom
17:38 some significant agenda items include
17:40 adopting the committee's legislative
17:41 agenda for the 2022 legislative session
17:45 in olympia we're going to get a briefing
17:47 on the housing chapter of the
17:48 county-wide planning policies uh and
17:50 then we're going to have a discussion
17:52 about drafting what's what they're
17:54 calling a challenge letter to
17:56 jurisdictions regarding the 2024
17:58 comprehensive plan update cycle and the
18:01 opportunity that it presents localities
18:03 to scale up their response to the
18:05 affordable housing crisis in the region
18:07 so i think that this last topic in
18:09 particular would be really interesting
18:10 to bring back to the council the mayor
18:12 and the administration so stay tuned uh
18:14 for my notes and comments from that
18:16 discussion
18:19 and then the next meeting of the cascade
18:20 water alliance board is also this
18:22 wednesday uh but from 3 30 to 5 pm over
18:25 zoom
18:26 the most significant agenda item
18:27 includes a discussion about the proposed
18:30 water supply development fund which we
18:32 discussed here um at a study session

18:44 wednesday discussion it's possible we

18:54 with regard to reports is that this week
18:56 i am attending the
18:58 national league of cities
19:00 city summit which is a week-long like
19:03 virtual summit of city council members
19:05 and mayors from across the country um so
19:08 i'm hoping to take notes on interesting
19:10 things that might be we want to bring
19:12 back here to issaquah and i'll be sure
19:13 to share that all with you when it's
19:15 finished and that concludes my report

19:24 on thursday november 4th i attended the
19:27 healthier here governing board and we
19:29 had a discussion about a new movie
19:31 entitled power to heal
19:34 this movie documents the decades-long
19:36 efforts to integrate hospital services
19:39 and staff in the united states
19:41 culminating in the introduction of
19:43 medicare during the johnson
19:44 administration
19:46 president johnson declared that medicare
19:48 reimbursement funding would only be
19:50 provided to hospitals that convincingly
19:52 demonstrated that they were integrated
19:54 and thus within a single year nearly 90
19:57 of us hospitals integrated both staff
20:00 and patient services
20:02 the movie's producer barbara bernie was
20:04 our guest speaker and it was a
20:05 fascinating discussion about a history
20:08 of our medical
20:11 services that very few people know and
20:14 if you can catch that movie on netflix
20:18 again it's called the power to heal it's
20:20 very well worth watching
20:22 um and then on friday november 12th uh
20:25 last friday i attended the eastside
20:27 transportation partnership
20:29 and we had a presentation on the k4c
20:31 climate action plan items related to
20:33 transportation a presentation on the
20:36 electrification of metro's bus fleet
20:39 in the placement of electric vehicle
20:41 charging stations in the puget sound
20:43 region and then finally a presentation
20:45 from washington state university's green
20:47 washington program
20:49 and that program is working with
20:51 the office of superintendent of public
20:53 construction
20:55 to begin the dialogue about the
20:57 electrification of school bus fleets
21:00 so it was a very informative meeting
21:03 with lots of lots of uh good information
21:08 and then finally tomorrow at uh tomorrow
21:10 afternoon there will be a connect to
21:12 community meeting that i'll be attending
21:14 and that concludes my report

22:53 report and one upcoming meeting
22:56 um the title 18 ad hoc committee which
22:59 is a title 18 is our municipal land use
23:02 code the title 18 land use committee met
23:05 november 10th 2021 and we started the
23:09 meeting at 4 15. the attendees were
23:11 andrea snyder minnie daly wall and lucy
23:14 sloman from the
23:16 city staff and then council attendees
23:18 were council members goodman walsh and
23:19 hunt who are the three
23:21 members of the title 18 ad hoc committee
23:23 we had three topics the topic one was
23:26 code amendments for the tod project
23:29 specifically we discussed
23:31 the discussion was limited to whether
23:33 these can or should be processed on a
23:35 separate schedule and track than the
23:37 comprehensive title 18 updates
23:40 um per resolution 2021.06 the ad-hoc
23:43 committee will make a recommendation to
23:45 the council before any topics within
23:47 title 18 scope of work will be placed on
23:48 a separate schedule of track which is
23:50 why we were talking about this
23:52 and the council members on the committee
23:54 agreed that in our opinion this topic
23:56 does meet the criteria for considering
23:58 it on a separate track those committee
24:00 those criteria are
24:02 public
24:03 and um
24:05 are now making that recommendation to
24:07 the council this be on a separate track
24:10 this presentation and committee comments
24:13 took about 20 minutes then topic two was
24:15 the sign code uh there were some minor
24:17 edits that are needed to different
24:19 sections of the sign code
24:21 um these were identified by the code
24:22 publishing
24:24 um the people that publish the code and
24:27 unanimously agreed that in our opinion
24:29 these changes are not substantive and
24:31 are basically housekeeping and are
24:32 appropriate for being on the consent
24:34 agenda where they are this evening
24:36 so they are on our consent agenda as
24:39 item j
24:41 and this topic took about 10 minutes and
24:43 then topic three andrea describes the
24:46 agenda bill that will be on tonight's
24:48 agenda this evening regarding the future
24:50 of the ad hoc committee this is regular
24:52 business
24:53 item c on our agenda and the committee
24:56 received this information we didn't we
25:00 knew that this was coming to council so
25:01 council will discuss it this evening
25:03 looking forward to hearing that
25:04 discussion that topic took about five
25:05 minutes
25:06 and the committee adjourned 10 minutes
25:09 before 5 pm
25:11 we do not have any upcoming meetings
25:13 scheduled the november 25th meeting of
25:15 the title 18 ad hoc committee is
25:17 cancelled due to the holiday and there
25:19 are no other meetings for 2021 for this
25:21 committee that have been scheduled as of
25:23 today
25:24 and then i have one upcoming meeting the
25:26 rye eight salmon recovery council
25:28 meeting will be
25:29 this thursday on the 18th
25:32 and that concludes my report

25:37 the next item on the agenda this evening
25:39 is the mayor's report and i would like
25:41 the
25:43 city administrator to come on camera for
25:46 a bit and talk about
25:48 we heard from nicole miller
25:51 during public uh comments this evening
25:53 about her encounters with
25:56 theft in issaquah and her observations
25:59 about what's going on and she also had
26:02 four questions for the council
26:04 which i think will be a little staff
26:05 assignment for council president and
26:08 to work on to make sure we get those
26:10 questions answered and sent back out in
26:11 writing but this has been an ongoing
26:14 issue over the last eight weeks and has
26:16 been reported by numerous residents and
26:18 i wonder if you could take this
26:19 opportunity to provide the community
26:21 information
26:22 on what has been going on and what steps
26:25 have been taken in the last little while
26:27 the administrator
26:29 yes thank you mayor members of the
26:30 council good evening uh yes
26:32 unfortunately we have seen a
26:35 a rash of shoplifting at some of our
26:37 large national retailers
26:40 we have spoken
26:42 the police department has spoken with
26:43 those national retailers and we've
26:45 learned a lot
26:47 we've learned that mostly national
26:49 retailers have a much higher tolerance
26:51 of this kind of activity than i think
26:53 any of us would likely imagine and and
26:56 the reasons for it as you learned about
26:57 them kind of make sense that they are
26:59 first and foremost concerned about the
27:01 safety of their employees
27:03 of their customers and
27:05 their general direction to their local
27:08 store managers from their regional and
27:09 national offices are not to confront
27:12 shoplifters
27:14 we of course are concerned by this as a
27:16 community because as the public speaker
27:19 mentioned there has been a rash of this
27:21 and so mayor paulie and our police chief
27:23 have bet with regional
27:25 leaders of at least one of those
27:27 national retailers target
27:29 and really have expressed the concern
27:31 that while they may have policies that
27:33 work regionally and nationally under
27:35 particular circumstances here in isqua
27:38 you know they need to call 9-1-1 and
27:40 they need to
27:41 file charges if individuals are
27:44 apprehended with stolen goods
27:47 these stores have been very reluctant in
27:49 the past to do that and i think as the
27:52 public speaker had mentioned um
27:55 she witnessed this firsthand
27:58 we continue to work with target we have
28:00 been called now
28:01 by target
28:03 management
28:04 we have confronted individuals we have
28:06 arrested individuals
28:08 so that is now happening unfortunately
28:10 because
28:12 those national chains have to weigh the
28:14 safety of their employees and their
28:15 customers
28:16 they see this as largely a
28:19 cost of doing business certainly what
28:20 we're seeing however it is quite beyond
28:22 that and i think we've been getting some
28:24 good cooperation
28:26 from
28:27 the national retailers against specific
28:29 to target on this and so madam mayor if
28:31 i maybe just quickly go through the four
28:33 questions that you may save having to
28:35 provide uh answers in writing you know
28:37 first was are we concerned and the
28:39 answer is of course we're concerned uh
28:41 but it's important for everyone to
28:42 remember
28:44 that
28:45 for a crime to happen there has to be a
28:48 complaint
28:49 the property that's being stolen the
28:51 owner of that property in the case of a
28:53 retail store the management of that
28:55 store has to be willing to file charges
28:57 if they're unwilling to file charges
28:59 that there is nothing the police can can
29:02 do there's no arrest that can be made
29:04 certainly when a police officer arrives
29:06 at a store
29:07 and confronts an individual
29:09 many times that individual very smartly
29:12 says yes and leaves the property and
29:15 leaves the premises and so the issue is
29:17 is taken care of but you know an arrest
29:19 cannot be made unless there is a
29:21 complaint filed
29:22 and that and that has not happened but
29:25 is happening more now with our national
29:26 retailers so certainly we are concerned
29:29 second question do we know how much
29:31 crime is occurring in this squad
29:34 you know that that's a difficult
29:35 question on any day
29:37 we certainly encourage people to call
29:39 9-1-1 always if they feel that there's a
29:41 crime in progress if they've had a
29:43 property crime we want them to call we
29:45 want to be able to file the report we
29:46 want to be able to gather information
29:49 that is a long-standing policy of the
29:51 esquire police department and we want
29:52 people to do that um
29:55 have some individuals uh taking this as
29:57 a cost of doing business if you have an
30:00 amazon package lifted from your uh porch
30:03 do people every time call the police
30:05 department my guess is probably not
30:07 again we would encourage people to do
30:09 that
30:10 it's important that we understand what
30:11 these trends are it's important for our
30:13 officers to investigate because we do
30:15 find people we do arrest people
30:18 and that is a great deterrent if people
30:21 don't report these crimes that makes it
30:23 very difficult for us to enforce
30:26 the next question regarding an allowing
30:28 an underground market
30:30 you know that's probably something
30:32 beyond
30:33 our our ability to to regulate
30:36 individuals
30:38 take property and do things with it
30:41 outside the jurisdiction and it's very
30:44 difficult for us to manage that again as
30:45 we've said we're certainly aware this is
30:47 going on we're working closely with
30:49 those businesses to make sure
30:52 that that that's taken care of and then
30:54 finally
30:55 why aren't police making an arrest just
30:57 because they see someone go down the
30:58 street
30:59 with a basket full of televisions again
31:02 we need to have someone that's be able
31:04 to press charges we are all often able
31:06 uh to
31:08 engage with the individual and that
31:11 engagement oftentimes will lead to that
31:13 person
31:14 either leaving the material as we find
31:17 it or
31:18 we then return that material other times
31:20 they
31:21 will say i bought it and move on and so
31:23 our police officers have limited ability
31:26 beyond that again unless the store is
31:28 prepared to to enforce that so we are
31:31 taking this very seriously we are taking
31:33 steps i really commend our acting chief
31:35 paul schlond she's been very aggressive
31:37 uh in working with those national
31:39 retailers she has instructed our
31:41 officers uh to respond to every single
31:43 call uh that has received and if we are
31:46 able to do something um without charges
31:49 being filed uh we can and certainly the
31:51 information that i've heard and i've
31:52 also seen on social media and many of
31:54 you may have as well individuals in the
31:56 community who have seen our police
31:58 officers confront individuals leaving
32:00 the store and those those individuals
32:02 then
32:04 died not to take the goods so
32:06 it's a complicated situation we're going
32:07 to continue to be aggressive madam mayor
32:09 i hope i think that answers the question
32:11 of the public commenter and hopefully
32:13 that covers the issue
32:15 thank you wally i just want to add one
32:17 personal note from the mayor is that i
32:19 have reached out to economic development
32:21 staff and to our police force and said
32:23 that i'm willing to participate in any
32:25 conversation
32:26 where the story or the the reason we're
32:29 coming up against is because it's a
32:31 corporate policy
32:33 i think this was an amazing place i
32:35 think the businesses we have here are
32:36 amazing
32:37 but it's not acceptable to have a
32:40 corporate policy that allows this kind
32:42 of activity to occur and that's been my
32:44 message and it will continue to be my
32:45 message so i want to thank not only
32:48 nicole for coming and sharing her story
32:50 tonight but i have spoken to does a
32:53 dozen other folks who have provided
32:56 anecdotal information or called the
32:57 police or made observations
33:00 and i appreciate that eyes on the street
33:02 is what we need and as our city
33:04 administrator said please please if you
33:06 see something say something sometimes we
33:09 can connect the dots because
33:11 three of you are calling about the same
33:13 thing and it it helps everything that
33:15 you can do to help us is so much
33:17 appreciated but also thank you so much
33:18 for keeping your eyes on our wonderful
33:20 community
33:21 i appreciate it
33:22 i'm going to move on to the mayor's
33:25 report for this evening
33:27 as soon as i find it
33:30 there it is
33:32 uh there will not be an executive
33:34 session scheduled to see there is no
33:36 executive session scheduled this evening
33:38 they'd want to talk a little bit about
33:40 some weather related events because
33:42 we're at that time of year i wanted to
33:44 thank our staff and partner agencies for
33:47 their efforts that
33:49 over veterans day and over the weekend
33:51 and into today in response to various
33:54 weather related events
33:56 and again thank you to emergency
33:58 management our communications team
34:01 public works police parks and community
34:04 services eastside fire and rescue and
34:07 king county emergency management
34:10 last week the house passed the largest
34:13 infrastructure bill in american history
34:15 which will invest 1.2 trillion over 10
34:18 years
34:19 much of this funding will be provided to
34:21 cities and states through competitive
34:22 grants then this bill will help issaquah
34:25 continue to build renew and plan our
34:27 infrastructure for the future
34:30 the capital finance community task force
34:32 last met on november 2nd to discuss
34:34 infrastructure priorities across
34:36 israel's needs in transportation
34:39 parks and trails and facilities
34:42 the task force will continue to develop
34:44 its recommendations and priority on
34:46 priorities at the next meeting which is
34:48 tomorrow november 16th at 6 p.m
34:52 and the city of issaquah's community is
34:55 emergency response team or also known as
34:58 cert
34:58 provided 26 volunteers and
35:01 159 hours of support to the children
35:04 vaccination site sponsored by costco and
35:08 the esqua school district
35:09 the cert volunteers help with reception
35:12 and attestation
35:14 check-in areas line control management
35:17 recovery room and goodie bag handout
35:20 at this recent multi-day event
35:22 approximately 2300 children between the
35:25 ages of 5 and 12 received their first
35:27 dose of the coven 19 vaccine and a
35:30 second dose is scheduled in early
35:31 december we are so grateful for the work
35:34 of our cert volunteers their high energy
35:37 professionalism and enthusiasm was
35:39 noticed by our partners thank you again
35:42 all cert members for your outstanding
35:44 contribution to our community
35:46 there are a couple of upcoming events

35:51 partnering with worksource seattleking
35:53 county and other eastside cities to

39:09 ab-8198 which is the proposed 2022
39:12 budget and salary ordinance
39:14 and the action this evening will be to
39:17 conduct the public hearing and to adopt
39:20 the ordinances
39:21 this item came before council at the
39:23 october 4th council meeting for the
39:25 first public hearing and was deliberated
39:27 at council study sessions on october 12
39:30 26 and november 9th and i'd like to
39:33 invite interim finance director autumn
39:35 monahan to present this item autumn
39:38 thank you madam merriman members of the
39:40 city council
39:51 all right so tonight is the second
39:53 public hearing on our proposed 2022
39:55 budget
39:56 along with the proposed adoption of the
39:58 budget and salary ordinances
40:01 so rcw requires cities to hold two
40:03 public hearings prior to adopting the
40:05 budget the preliminary public hearing
40:07 was on october 4th and the final public
40:09 hearing is this evening
40:12 here is our timeline that we've seen
40:14 throughout the budget process and we are
40:15 at the end on november 15th
40:19 a quick overview of the budget the 2022
40:22 proposed budget now totals
40:24 149.3 million dollars
40:28 the largest uh fund of the city is the
40:30 general fund it's also the most flexible
40:32 this is where the city accounts for most
40:34 of its day-to-day government services
40:36 such as public safety and parks and
40:38 community services
40:40 the 2022 proposed general fund totals
40:42 62.8 million dollars
40:46 the proposed budget adds 18.5 ftes and
40:49 reclassifies others the 2021 adopted
40:52 budget had us at 250 ftes right around
40:56 our post-recession minimum of 250 back
40:59 in 2016.
41:00 and the 2022 proposed budget brings us
41:02 back up to 269
41:05 though that's still below our
41:06 pre-pandemic maximum 285
41:09 and below the pre-recession maximum of
41:12 278.
41:15 following deliberations as well as
41:17 updates to the forecasts during our
41:19 budget season there were several
41:21 adjustments made to the proposed budget
41:22 including some increases to several
41:24 general fund revenues
41:26 the addition of the police
41:27 communications coordinator as a limited
41:29 term position
41:30 the reduction of employee medical
41:32 premium costs
41:33 the partial payoff of the berg's my debt
41:37 and the reduction of the proposed
41:38 one-time investment fund from 1.25
41:40 million to 300 000
41:42 and that money would be allocated for
41:44 employees who served during the pandemic
41:46 with the rest of those funds going back
41:47 into the uh to the ending fund balance
41:50 so following those adjustments the total
41:53 undesignated fund balance as a
41:54 percentage of expenditures is now at 19
41:57 for next year

44:50 faced these comments on the
44:52 initial budget that came out so this
44:53 makes a little bit out of date so i
44:55 apologize if that's the case in the
44:57 initial budget though there was a
44:58 proposal to reduce city staffing for the
45:03 be streets management and have that
45:04 outsource
45:08 my concern with that is i guess two-fold
45:11 ones and contacts of city staff had
45:14 count numbers uh that
45:16 we seem to be increasing city staff from
45:18 professional services to
45:22 general steep speedscape but also we
45:24 talked about providing a one-time
45:26 staffing budget for hundreds of dollars
45:28 as a temporary thank you city staff at
45:30 the same time we're outsourcing the city
45:31 to afghanistan
45:33 as well so
45:37 maybe a possibility of the standard if
45:40 some may think that this is just a city
45:41 administration issue
45:43 and not a city policy issue and
45:45 therefore not an issue for city council
45:47 that will determine if the city council
45:49 doesn't weigh in on that decision if
45:51 there's good decisions aid with the

48:03 this has been a smooth budget process

48:07 have been able to incorporate the
48:09 comments including the early comments
48:11 from council into the budget so i
48:13 appreciate that and just wanted to
48:14 express my appreciation
48:16 also
48:17 there is for council there is a budget
48:20 letter this is um the first time that
48:23 council will have uh have that budget
48:25 letter um because it was written
48:28 after the study session and between
48:30 between the study session and this
48:31 meeting
48:33 i reviewed our past
48:36 meeting minutes meeting notes
48:39 and
48:39 also the last conversations that we had
48:43 up when council members
48:45 indicated what they thought should be in
48:46 the letter and then i also looked at our
48:49 last letter and followed up on any items
48:51 that were remaining that were policy
48:53 direction from last year um so i uh
48:58 and then lastly just process wise um
49:01 we also i also reviewed it with
49:04 council deputy president ray
49:07 and worked with autumn as far as
49:08 tracking down the information uh from
49:11 that last budget letter so appreciate
49:13 all of their
49:14 help with it and hopefully it meets
49:17 council's intent and if not i am open to
49:19 hearing
49:21 proposed changes and thanks again for
49:23 all the work from council on the budget
49:25 this year

49:30 let's move to council member walsh

49:37 i similarly wanted to
49:39 give some appreciation to the
49:41 administration on how smooth of a budget
49:43 cycle this has been and particularly um
49:47 some kudos and props to
49:49 the interim finance director and the
49:52 team that just picked things up
49:56 and moved them forward and i'm sure
49:58 there were many long hours weekends
50:01 nights that we didn't get a chance to
50:04 see that i do want to appreciate
50:07 for just making this a smooth
50:10 budget process
50:12 despite all of the changes
50:15 in employment and so just kudos to the
50:17 team there as well so thank you
50:20 very much appreciate council member
50:21 walsh council member d michelle
50:25 so i'm just uh thirteen uh everybody's
50:28 comments and uh just wanna be sure that
50:30 i got my voice in an appreciation
50:33 to the staff and the administration as
50:36 well it's uh i this is my second uh
50:39 budget process and so i think i'm
50:41 getting very spoiled because it was a
50:44 very good process last year and now i'm
50:46 hearing that this is the best
50:48 process that's ever been and so um
50:52 i think it's it's been great i want to
50:54 commend um
50:56 i think that people uh
50:58 listened very very well and i enjoyed
51:01 the discussions we had
51:03 and the the uh changes that were made i
51:06 think reflected the comments from the
51:08 council and i just
51:11 i think that is part of why it has been
51:13 such a very productive
51:15 uh process and such a satisfying process
51:18 so i will be uh happy to support this
51:22 budget in adoption so thanks to
51:24 everybody and again
51:27 uber kudos to the staff for an excellent
51:30 job

52:01 in all my years on council it's also the
52:03 best best but budget process that
52:08 i have been
52:10 attending
52:12 since uh including my nine years on
52:13 council so that's i counted it's either
52:15 19 or 20 years so i would like to uh
52:19 and as
52:20 um as tedious as it is sometimes sitting
52:22 in these meetings um i sat in on nine of
52:25 them in the audience and that is
52:26 incredibly tedious so um this is
52:29 actually more fun than sitting around
52:30 going oh if i could just say something
52:34 so anyway
52:35 it's it's just been great and i want to
52:37 commend the mayor for
52:38 just the
52:40 very
52:42 significant improvements that have been
52:44 made in the budget process in the past
52:45 four years thank you

54:50 because you were willing at the very
54:51 front end to get involved to make your
54:54 desires known and i think quite honestly
54:55 the strategic plan gets a vote of thanks
54:57 because the strategic plan had a very uh
55:00 specific process that this was the first
55:02 year we had an opportunity to follow and
55:04 so thank you to the council for that um
55:07 we've had an interim finance director uh
55:10 you think back to all of the challenges
55:12 that the community has had with budgets
55:16 many of you have said this is the best
55:17 budget you've ever seen
55:19 led by a team with an interim finance
55:22 director in otto monahan autumn is
55:25 an exceptional professional when i knew
55:27 that beth was going to be leaving spoke
55:29 with the mayor and i was only one person
55:31 that i had in mind that could lead this
55:33 process and that was out of monahan she
55:35 has such
55:37 good experience working with all of the
55:39 principals here in the city
55:41 she has seen a lot
55:43 she also has a tremendous tremendous
55:45 judgment and i think was able to step
55:48 into something she's never done before a
55:50 lead an excellent team the finance staff
55:53 is truly an excellent team um and i just
55:56 want to say thank you autumn
55:58 you didn't hesitate oh maybe a little
56:00 hesitation but not much hesitation uh to
56:04 take this on and so i appreciate that
56:05 very much uh lots of folks in the city
56:08 worked on the budget uh but i really
56:10 need to recognize two additional staff
56:12 members dale markey krim who joined us
56:15 at the beginning of the process provided
56:17 lots of support
56:19 with the details
56:21 but there's really one additional person
56:23 that i think we must recognize and
56:25 that's the interim budget manager susie
56:27 monsall
56:28 susie uh
56:30 had the uh the uh pleasure of doing the
56:33 capital improvement program uh turned
56:35 around had beth announced her departure
56:38 and then uh had the uh
56:40 the task of really being the staff lead
56:43 with the operating budget this year so
56:46 my thanks to susie she's a remarkable
56:48 individual she works extraordinarily
56:50 hard
56:52 while i think many many people were
56:53 involved and through autumn's excellent
56:56 leadership
56:57 susie gets a lot of the credit for
56:59 making sure that the documents and the
57:01 completeness of the answers to all of
57:03 your questions came at the time that
57:05 they did so amanda mayor members of the
57:06 council let me again thank autumn dale
57:09 and especially susie monsell for their
57:11 excellent work it's our pleasure to
57:13 provide a budget that is complete and
57:15 transparent so that the community knows
57:18 how their money is being spent how
57:20 that's aligned with strategic plan

57:35 autumn to transition to a brand new

1:03:37 to invite chief of staff tina eggers and
1:03:39 senior governmental affairs consultant

1:03:44 welcome ladies
1:03:48 thank you madam mayor and city council
1:03:50 members tina aker speaking i'm pleased
1:03:52 to be here this evening
1:03:54 jean paul is absent he is traveling and
1:03:57 unable to attend tonight
1:04:00 and uh just confirming that you can see
1:04:02 what's on my screen yes we can perfect
1:04:05 thank you
1:04:06 uh tonight we're gonna just look back
1:04:08 briefly at the direction that you
1:04:09 provided at the october 26 study session
1:04:13 and we ask for your approval of the
1:04:15 legislative agenda excuse me the
1:04:17 legislative agenda that is provided in
1:04:19 your packet
1:04:22 for background your legislative agenda
1:04:24 is made with two parts the first being
1:04:26 the legislative priorities this section
1:04:28 highlights two projects as part of the
1:04:31 transportation funding package
1:04:34 specifically the widening of state route
1:04:36 18 from issaquah hobart the raging river
1:04:39 and an additional interstate 90 under
1:04:42 overcrossing
1:04:45 the second component of the legislative
1:04:47 agenda is the policy manual this
1:04:49 document was revised to remove or update
1:04:52 items that were accomplished in the 2021
1:04:55 legislative session such as streamlined
1:04:58 sales tax mitigation multi-family
1:05:00 property tax exemption
1:05:02 pension contribution tax increment
1:05:05 financing and arts law funding request
1:05:08 in addition statements were added in
1:05:10 response to what's that what was passed
1:05:13 in 2020 one session such as providing
1:05:16 clarification on police reform policies
1:05:19 funding for diversion related activities
1:05:22 and open public meetings act for
1:05:24 flexibility during emergencies
1:05:26 at this point i'll ask our lobbyist
1:05:29 shelly hebler to speak to the next
1:05:31 slides and recap the additional changes
1:05:33 to the policy manual
1:05:36 ellie
1:05:37 thank you good evening mayor and council
1:05:40 i am shelley helder the city's
1:05:41 government affairs consultant and i'm
1:05:43 going to review the changes that have
1:05:45 been made to the policy manual based on
1:05:48 the feedback that was received during
1:05:49 the october 26th study session
1:05:53 so there are three changes uh one
1:05:55 substantive and two
1:05:57 non-substantive changes
1:05:59 for the first change we added a
1:06:02 statement of support for
1:06:04 unanticipated state marijuana revenues
1:06:07 to be dedicated to youth substance abuse
1:06:09 and prevention programs
1:06:12 the two non-substantive changes were
1:06:15 merging to existing statements
1:06:17 for simplification and those changes
1:06:19 were made in the environment section and
1:06:21 in the water section
1:06:24 during the study session council
1:06:27 requested more information on three
1:06:29 topics
1:06:30 which are listed on the screen
1:06:32 i'm going to provide some brief comments
1:06:34 on the first two since they're not
1:06:36 connected to a recommended change in the
1:06:39 policy manual
1:06:40 and then we'll dive a little bit deeper
1:06:41 into the third
1:06:44 on the first topic of zoning and equity
1:06:47 there was a question raised about how
1:06:49 zoning practices are connected to equity
1:06:52 and this is a
1:06:54 complex policy discussion that's
1:06:56 happening at the national
1:06:58 and the state level um about how
1:07:00 historic zoning
1:07:02 and land use decisions have had
1:07:04 inequitable impacts on certain
1:07:06 communities
1:07:08 and there's
1:07:09 somewhat i would argue of a false
1:07:12 narrative being presented and that is
1:07:15 if the state implements certain land use
1:07:17 policies for example requiring accessory
1:07:20 dwelling units on all lots
1:07:23 um that that will result in more adus
1:07:26 being built and
1:07:27 more equity
1:07:29 but there are communities that allow
1:07:31 adus on every lot and adus aren't being
1:07:35 built
1:07:35 in the quantity anticipated and that's
1:07:38 just one example
1:07:40 based on previous legislation that we've
1:07:42 seen introduced
1:07:43 and there's much more to land use
1:07:46 planning than simply changing the
1:07:48 allowable uses for certain zones
1:07:51 um so if equity is the goal then that
1:07:55 needs to be incorporated into the
1:07:57 planning policies
1:07:59 so this is i think a topic that warrants
1:08:02 a thoughtful conversation with the
1:08:05 community and again is not recommended
1:08:07 for any change to the policy manual at
1:08:09 this time
1:08:12 the second question was about school
1:08:14 citing and specifically if there were
1:08:16 any plans for amendments to the growth
1:08:18 management act to accommodate school
1:08:20 sighting
1:08:21 um and i i just want to note that the
1:08:23 gma does not prohibit the sighting of
1:08:26 schools outside the urban growth area
1:08:28 but it does limit the extension of
1:08:31 certain utilities outside the uga
1:08:34 um thereby making it difficult to cite
1:08:36 outside
1:08:38 there was an amendment to address this
1:08:40 issue several years ago
1:08:42 but it was very narrowly crafted to
1:08:45 apply only to pierce county
1:08:47 and i
1:08:48 did some sleuthing and i am not aware of
1:08:52 any plans to bring forward legislation
1:08:55 on school siding in the 2022 legislative
1:08:58 session
1:08:59 and so there is not any recommendation
1:09:01 for any change to the policy manual to
1:09:03 address that topic
1:09:06 um the third area where more information
1:09:09 was requested was climate change and the
1:09:11 growth management act
1:09:13 specifically what the
1:09:14 implications are for the city if house
1:09:18 bill 1099 were to pass into law
1:09:22 um next slide
1:09:24 the house bill 1099 was introduced in
1:09:27 the 2021 session and it advanced nearly
1:09:30 all the way through the process
1:09:32 but ran out of time at the end in the
1:09:34 senate so it will be automatically
1:09:36 reintroduced in the 2022 session
1:09:40 and many legislators have already
1:09:41 indicated a desire to see it get across
1:09:44 the finish line
1:09:46 the bill adds climate change as a goal
1:09:49 of the growth management act and would
1:09:51 require cities to add climate change
1:09:54 resiliency as an element to
1:09:56 comprehensive plans
1:09:58 so issaquah has already done much
1:10:01 of the planning work that would be
1:10:02 required for house bill 1099
1:10:06 and it's reflected in the city's
1:10:08 draft climate action plan
1:10:10 for cities that have not yet done this
1:10:12 planning work the bill would require
1:10:15 them to do so
1:10:16 and there's a common understanding that
1:10:19 um there would be funding provided along
1:10:22 with the bill it's not written into the
1:10:24 bill itself but there's an expectation
1:10:26 that funding would accompany the bill's
1:10:28 passage
1:10:29 because otherwise it would be considered
1:10:31 an unfunded mandate
1:10:34 since issaquah has
1:10:36 essentially fulfilled the planning
1:10:37 requirements of house bill 1099 the
1:10:41 city's support of this bill would uh
1:10:44 communicate an importance for all gma
1:10:47 cities to adopt climate action plans um
1:10:50 or the equivalent as it's being
1:10:52 referenced in the bill
1:10:54 and it would also be an opportunity to
1:10:56 highlight the need for state funding for
1:10:59 implementation of local climate action
1:11:02 plans
1:11:04 as many of you know the climate
1:11:06 commitment act is anticipated to
1:11:08 generate revenue for tackling climate
1:11:11 change and in promoting resilience
1:11:14 but there is no statutory designation
1:11:16 for funding um for implementation of
1:11:20 local climate action plans so that is
1:11:22 something that we could call attention
1:11:26 next slide
1:11:28 the direction that's needed from council
1:11:31 is whether we should include a statement
1:11:33 on climate change and the gma in the
1:11:35 city's policy manual
1:11:37 so a draft statement for the council to
1:11:39 consider is on the screen and it says
1:11:42 issaquah supports updates to the growth
1:11:44 management act that align with the
1:11:46 city's climate action plan as outlined
1:11:48 in house bill 1099 as well as funding to
1:11:51 implement to implement mitigation
1:11:54 actions
1:11:55 and i'm going to
1:11:56 pause here for a council discussion and
1:11:58 then have a few more comments to make
1:12:00 before we um
1:12:03 wrap up the presentation
1:12:06 thank you
1:12:06 shelly uh comments from council members
1:12:09 on the um
1:12:11 draft the inclusion of the draft
1:12:13 statement that shelley's recommended up
1:12:15 on the
1:12:17 on the powerpoint
1:12:20 council president hunt

1:12:25 i raised this um at our city session i
1:12:28 appreciate the information that's been
1:12:30 provided my
1:12:33 am there is an optional amendment so i
1:12:35 think
1:12:36 i'll save my comments i plan on making
1:12:39 the optional amendment at least for
1:12:40 council's discussion um
1:12:43 yeah i think it would probably be more
1:12:45 appropriate to
1:12:46 comment once there's a motion on the
1:12:48 table but i just also wanted to say
1:12:50 thank you for
1:12:51 following up with this information
1:12:54 it's great any other comments
1:13:00 i just have a procedural question for
1:13:03 shelley i'm assuming since the current
1:13:06 manual does not include the statement
1:13:10 that what you have on the screen is a
1:13:12 potential draft motion if one of the
1:13:15 council members would like to do that
1:13:16 because i am not seeing that that is
1:13:18 included in
1:13:19 the motions that are in our packet is
1:13:21 that correct
1:13:22 that is correct yes it's not included so
1:13:25 um we would be looking for council to
1:13:27 make that motion to have it included
1:13:30 if they you so choose

1:13:42 so as i've previously mentioned the
1:13:44 city's policy manual is a reference
1:13:47 document and that's helpful for city
1:13:49 staff and for myself as as your
1:13:51 lobbyists to weigh in in support or
1:13:54 opposition to policies as they're
1:13:56 considered during a legislative session
1:13:59 and although we aim for the document to
1:14:01 be comprehensive it's
1:14:03 likely not exhaustive so i want to just
1:14:05 briefly review what our firm recommends
1:14:08 as best practices for cities to engage
1:14:11 if there's
1:14:13 a bill or a policy that comes up during
1:14:15 the session that's not directly aligned
1:14:17 with a statement that is already in the
1:14:19 policy manual
1:14:21 first i'll just say that consensus is
1:14:24 always the goal
1:14:26 as far as i'm aware the documents before
1:14:28 you this evening reflect the consensus
1:14:30 of counsel and and that is important to
1:14:32 be able to speak with a unified voice
1:14:35 and to be an effective advocate
1:14:37 um if we as a city are divided it's not
1:14:40 likely that we'll get our local
1:14:42 legislators support uh much less
1:14:44 legislators that are outside our region
1:14:48 and then second it's important that any
1:14:50 city position on state policies also
1:14:53 align with city goals and any previously
1:14:56 identified priorities
1:14:59 we wouldn't want to support a proposed
1:15:01 state policy that conflicts with
1:15:03 anything that the city has already
1:15:05 identified as a priority
1:15:07 um that especially something that has
1:15:09 input from the county or from the
1:15:10 community
1:15:12 um so our recommended process for
1:15:14 proposing changes is to first share any
1:15:17 relevant information with your
1:15:19 government affairs consultant and
1:15:20 relevant city staff
1:15:22 and that's because we may have awareness
1:15:24 of local or state politics that would be
1:15:27 important to consider
1:15:29 and then after that information should
1:15:30 be shared with your fellow council
1:15:32 members
1:15:34 and if an additional discussion is
1:15:35 needed which may be the case um we do
1:15:38 encourage that substantive policy
1:15:40 discussions
1:15:41 um occur through work groups or
1:15:43 committees when possible
1:15:45 and then on items where there is not
1:15:47 consensus
1:15:49 our recommendation is to remain silent
1:15:51 or neutral
1:15:53 and allow others to engage in the debate
1:15:57 and that's because it harms the city's
1:15:59 credibility and could detract from
1:16:02 accomplishing other priorities
1:16:05 um in the event there is consensus then
1:16:08 i recommend that it be brought forward
1:16:10 for the city to take a position
1:16:13 um so next slide this evening we are
1:16:16 hoping for approval for the city's
1:16:18 legislative documents
1:16:20 um and this is an important step to take
1:16:22 prior to the december first
1:16:25 date since we've scheduled a virtual
1:16:28 meeting with the city's legislative
1:16:30 delegation on
1:16:31 wednesday december 1st from 8 to 9 a.m
1:16:35 and this is the opportunity for
1:16:38 you all as the city's elected officials
1:16:40 to brief the fifth and the 41st district
1:16:43 legislators
1:16:44 on issaquah's priorities for the coming
1:16:46 session um and then following the
1:16:50 legislative meeting um the next
1:16:52 important date is monday january 10th
1:16:54 and that's when the 2022 legislative
1:16:57 session begins
1:16:59 um and with that um
1:17:02 is the last slide of the presentation
1:17:04 and a recommendation
1:17:06 is for approval of
1:17:08 the city's legislative agenda
1:17:11 thank you shelley um just a clarifying
1:17:13 question here before uh council
1:17:16 i want to give council an opportunity to
1:17:18 ask questions as well
1:17:20 um when you talk about consensus to add
1:17:22 a new item i assume that means seven
1:17:26 thumbs up on putting something in adding
1:17:28 something new that hadn't been in in the
1:17:33 booklet daca before
1:17:34 um the second part to the question was
1:17:38 we always have council members who have
1:17:42 issues that they independently as a
1:17:45 council person but not as a
1:17:46 representative city
1:17:48 do advocacy work down in olympia where
1:17:50 they speak to as a member of the council
1:17:53 and not for the council to a specific
1:17:55 issue this doesn't preclude a council
1:17:57 member from doing that it just means if
1:17:59 it's added to the manual we should have
1:18:02 seven thumbs up is that a correct
1:18:03 interpretation that's correct yes thank
1:18:06 you for that clarification there that is
1:18:08 that is accurate
1:18:11 so uh before
1:18:14 we go to the motion

1:19:37 choose to sometimes advocate for
1:19:39 different items um
1:19:41 that they feel passionately about on
1:19:42 their own behalf and that is our
1:19:45 prerogative so i think it's important to
1:19:46 point that out um i will now make the
1:19:51 optional amendments um
1:19:53 and that is i move to amends the policy
1:19:56 manual by adding the following statement
1:19:58 to the policy manual under the land use
1:20:01 gross management act gma housing section
1:20:04 issaquah supports updates to the growth
1:20:05 management act that align with the
1:20:07 city's climate action plan as outlined
1:20:09 in house bill 1099 as well as funding to
1:20:12 implement mitigation actions
1:20:17 and is there a second
1:20:22 deputy council president right sorry i
1:20:24 missed you
1:20:25 second
1:20:27 uh council president do you want to
1:20:29 speak to the
1:20:30 amendment thank you this is council
1:20:32 president hunt i'll speak briefly i am
1:20:35 in support of this i think it aligns
1:20:36 with our climate action plan which we

1:20:41 consider for adoption next month um and
1:20:44 so i think it aligns well with our goals
1:20:46 and with our
1:20:48 cities
1:20:49 um with our community's enthusiasm for
1:20:53 environmental protection of our natural
1:20:55 spaces and also with our city's climate
1:20:57 action plan and the other reason why i
1:20:58 think it's a good idea is because this
1:21:02 uh bill and in the statement it it talks
1:21:05 about the need for funding so
1:21:08 more funding for this work would help us
1:21:10 achieve our goals

1:21:14 want to speak to it i if i could just
1:21:16 have a quick second i i agree with the
1:21:19 council president this is very much
1:21:21 aligned with
1:21:22 the values and and state of direction of
1:21:25 both this council and the city as a

1:21:28 but what i'm particularly fond of is the
1:21:30 funding to implement the action plans is
1:21:32 not only a benefit to the city of israel
1:21:34 but since we share this environment and
1:21:36 we share climate change with everybody
1:21:38 around us making it easier for other
1:21:40 communities to take the actions that we
1:21:42 already have is
1:21:43 in all of our best interests
1:21:48 uh council member hall
1:21:50 uh thank you councilmember hall here um
1:21:53 just real quickly to say uh with regard
1:21:55 to both this
1:21:57 amendment and the underlying motion just
1:21:59 as it was last year i hope the council
1:22:01 is comfortable with me refusing myself
1:22:02 from this vote just as a reminder
1:22:05 that as an employee of the state
1:22:06 legislature myself i've been advised by
1:22:08 the state legislature
1:22:10 that state legislative ethic guidelines
1:22:13 asked me not to lobby the state
1:22:14 legislature so due to those policies
1:22:16 i'll be recusing myself from voting on
1:22:18 this amendment or the underlying agenda
1:22:20 bill and appreciate you all for
1:22:22 understanding and hopefully one year
1:22:23 i'll be able to join you all

1:22:30 appropriate to have our lobbyists um
1:22:33 provide some feedback pro con about why
1:22:38 what the differences are between the

1:22:48 differences that the council would like
1:22:49 to discuss or consider

1:24:04 always asked myself about
1:24:08 policies around the idea
1:24:11 of what if we didn't have such a
1:24:15 collaborative and consensus-driven

1:24:20 on a different day
1:24:22 i would hate to have a policy
1:24:25 that was supported in the community and
1:24:28 let's say six of the seven council
1:24:30 members
1:24:31 not move forward because there was one
1:24:33 council member that didn't support it so
1:24:37 i i see the value in having a strong
1:24:40 consensus statement coming out of the
1:24:42 council but i wouldn't want to
1:24:44 have that be an absolute requirement in
1:24:47 a situation like this like i said um we
1:24:50 have a we have a very thoughtful council
1:24:53 but you know some councils
1:24:56 will have one or two members that just
1:24:59 really want to zig where everyone else
1:25:01 is lagging and um like i said i i don't
1:25:04 think i think if you got five to two or
1:25:06 six to one in a situation like that you
1:25:09 might want to continue moving ahead even
1:25:11 if you didn't have a claim
1:25:14 with your with your council members

1:25:23 i quite agree i think
1:25:26 as a community um
1:25:29 the values that
1:25:31 we as seven members um

1:25:42 representative government allows for
1:25:46 some disagreement but still
1:25:49 presenting and putting forth um
1:25:52 you know a
1:25:54 not united as in the individual's voting
1:25:57 but a united
1:25:59 sense of this is our community's values
1:26:01 um which is represented in the
1:26:03 legislative agenda so i i don't know
1:26:06 that i um feel
1:26:09 strongly that we should be moving in the
1:26:11 direction of just providing consensus

1:26:33 a definition of consensus as uh

1:26:38 and i just googled it and consensus is a
1:26:41 quote unquote general agreement and
1:26:43 that's the meaning that i've always used
1:26:47 and in addition at king county when i
1:26:49 was with the king county
1:26:52 department of uh transportation we use
1:26:55 the definition of this is what we agree
1:26:57 with or that we can live with
1:27:00 uh in reaching consensus it wasn't
1:27:03 necessarily that we all 100
1:27:06 agreed
1:27:07 uh but that we could live with whatever
1:27:10 uh was the issue in front of us so i
1:27:12 think if we can say that it's a general
1:27:15 agreement but not necessarily a
1:27:18 unanimous agreement then i think that's
1:27:21 definition of consensus that i am able
1:27:24 to live with

1:31:36 ab-8291 title 18 land use code ad hoc
1:31:40 committee
1:31:41 and the recommendation before the
1:31:44 council this evening is to discharge the
1:31:46 ad hoc and i'd like to invite deputy
1:31:48 city administrator andrea snyder to
1:31:50 introduce this item andrea
1:31:53 thank you mayor paulie and good evening
1:31:55 members of city council i'm andrea
1:31:57 snyder the deputy city administrator
1:32:00 and we're really following up from
1:32:02 direction that council provided at the
1:32:04 november first meeting for the
1:32:05 administration to return
1:32:07 with options for how to proceed with the
1:32:09 title 18 ad hoc committee as you may
1:32:12 recall there were a couple of concerns
1:32:14 that were brought up during good of the
1:32:15 order in that city council meeting
1:32:18 one concern is that the
1:32:21 way that the ad hoc committee is
1:32:22 currently structured that it could
1:32:23 result in
1:32:24 three members or a minority of city
1:32:26 council providing direction to the
1:32:28 administration
1:32:30 that it could result in prematurely
1:32:32 narrowing policy options
1:32:34 presented to the planning policy
1:32:36 commission
1:32:37 and there was also concern that there's
1:32:41 lack of transparency to both members of
1:32:44 the public and city council
1:32:47 preferences were also raised that
1:32:48 evening to
1:32:50 regarding a council committee structure
1:32:53 and at this time the administration
1:32:56 recommends further discussion on the
1:32:57 council committee structure
1:32:59 to occur
1:33:00 in january during the city council
1:33:02 retreat
1:33:03 the question for tonight
1:33:05 is how would council like to proceed
1:33:07 with the title 18 ad hoc committee
1:33:11 in the agenda bill provided in your
1:33:12 packet this evening the background
1:33:15 discusses
1:33:16 why the committee was formed in the
1:33:18 first place and what tasks the committee
1:33:20 was assigned to do by council
1:33:23 including a summary of the committee's
1:33:25 accomplishments to date
1:33:28 in summary the administration believes
1:33:30 that the ad hoc committee has
1:33:33 accomplished most of the tasks
1:33:35 that were assigned to them except
1:33:37 providing ongoing policy guidance as we
1:33:39 progress through the title 18
1:33:42 update and we'd also like to thank
1:33:45 the council members that's council
1:33:47 president hunt councilmember goodman and
1:33:49 councilmember walsh
1:33:51 who are on the committee and for all
1:33:52 their time spent over the past two years
1:33:54 in helping this
1:33:55 large land use code update project
1:33:58 progress
1:34:00 in the agenda bill you'll also see a
1:34:03 couple of options to address the
1:34:04 concerns raised by some of the members
1:34:07 of council
1:34:09 the administration recommends as the
1:34:11 mayor indicated disbanding the ad hoc
1:34:13 committee
1:34:15 at this time instead the administration
1:34:17 would provide
1:34:19 monthly updates to council
1:34:21 including uh quarterly presentations
1:34:24 and would bring away um
1:34:26 bring any issues
1:34:28 to city council study sessions that it
1:34:30 would otherwise have brought to the ad
1:34:31 hoc committee
1:34:34 we believe this option best addresses
1:34:35 all the concerns raised on november 1st
1:34:39 there are other options as presented in
1:34:41 the agenda bill that include
1:34:43 having the committee meet very similarly
1:34:45 as it does today
1:34:47 but that they would not be discussing
1:34:49 policy matters
1:34:52 and then
1:34:53 the third option
1:34:55 as depicted in the agenda bill is
1:34:57 [Music]
1:34:58 that we would have the ad hoc committee
1:35:01 meetings continue as they have been but
1:35:04 that we would record those meetings and
1:35:06 make them viewable to the public
1:35:08 so as far as next steps go pending
1:35:10 council direction this evening the
1:35:12 administration may need to return to
1:35:14 council to update a resolution
1:35:16 pertaining to the ad hoc's role
1:35:20 any other direction that council would
1:35:22 provide
1:35:23 and so at this time i ask if there are

1:38:20 that we should rush into discharging

1:38:23 um i would i'm looking forward to having
1:38:25 a broader discussion at our retreat in
1:38:27 january and i think at that point we
1:38:29 could take
1:38:30 this motion if it fits in with the
1:38:32 overall plan that the council puts
1:38:34 together

1:38:44 interest in going back to council

1:40:15 you know agreement here and it meets all
1:40:17 of our needs that um were discussed at
1:40:19 the good of the order you know so
1:40:21 there's the transparency aspect there
1:40:24 the policy discussion aspect um and then
1:40:27 there's this new aspect that's been
1:40:29 introduced the conversation tonight now
1:40:30 of um having a broader discussion about
1:40:34 how we work as a city council and
1:40:35 whether or not we want to just include
1:40:37 that as one element of a broader
1:40:38 conversation so i think this meets all
1:40:41 of our needs especially because there
1:40:42 aren't going to be any uh meetings in
1:40:45 the near future that we're able to meet
1:40:47 kind of check off all three of those
1:40:48 boxes and honor all three of those
1:40:51 aspects so i think
1:40:52 i'll be voting in favor of this tonight

1:40:58 keep my eye on the chat

1:42:39 less than two months i will be a regular
1:42:44 person living in the city and so i would
1:42:46 hope that you would all choose great
1:42:48 transparency over a two year long ad hoc
1:42:51 in the future
1:42:52 so if this is what
1:42:53 um if this is what you you want to do
1:42:56 then i'm fine with it but i just think
1:42:58 it's really odd

1:43:47 how do we want to take
1:43:49 a very important piece of our work plan

1:43:57 you know meets that need and meets the
1:44:00 transparency needs so i look forward to
1:44:02 having that conversation

1:46:31 having a study session and the potential
1:46:33 agenda items include storm and surface
1:46:36 water and wastewater master plans
1:46:38 the metro discussion on east link and
1:46:41 2022 downtown issaquah association
1:46:44 memorandum of understanding
1:46:46 on december 1st the council will be
1:46:47 holding a special council meeting at 8am
1:46:50 it will be our legislative breakfast
1:46:53 and on december 6th regular council
1:46:55 meeting the potential agenda items
1:46:57 include issaquah creek flood studies and
1:46:59 strategy and the climate action plan
1:47:02 i see that council member goodman has a
1:47:06 comment for good of the order
1:47:09 uh thank you councilmember goodman here
1:47:11 it's kind of a question it's it's a
1:47:13 follow-up question to the
1:47:17 comments that nicole miller raised and
1:47:20 then the comments that administrator
1:47:22 bobkowitz made after that
1:47:24 around the mayor's report time and that
1:47:31 information we heard tonight about the
1:47:32 national retailers
1:47:35 and their policies about
1:47:37 shoplifting so what i think is
1:47:39 interesting and um and maybe in your
1:47:42 talks with the national retailers you
1:47:44 found to answer this question but um
1:47:47 that is a seems to be a recent change
1:47:51 and um
1:47:53 four years ago i
1:47:55 was in the middle of like physically in
1:47:58 the middle of a scuffle in the safeway
1:48:00 parking lot of the highlands with
1:48:01 somebody coming out of the store trying
1:48:03 to steal like a 12 pack or
1:48:06 pack of coke and the security person in
1:48:09 the store
1:48:10 um trying to stop that person from
1:48:12 stealing it we were right outside
1:48:14 just as the parking lot
1:48:17 transition from the sort of
1:48:19 where you drive and then you park and um
1:48:22 before i even left the parking lot um uh
1:48:25 two issaquah police officers responded
1:48:28 um so at that point clearly safeway was
1:48:30 still calling issaquah police
1:48:32 and then in the
1:48:36 boy how many
1:48:37 years 1989 you do the math um since i've
1:48:40 been here you couldn't go to target
1:48:44 ever really and be there and not have an
1:48:46 issaquah police um car in the parking
1:48:49 lot because we had been called for
1:48:50 shoplifting so it's interesting to me
1:48:54 that in a very short period of time
1:48:57 the policy has changed from um from
1:49:00 calling on
1:49:02 very small thefts you know like how much
1:49:04 is a 12 pack of coke well it's more
1:49:06 today than it was four years ago but
1:49:08 it's not very much it's certainly not a
1:49:10 felony and um
1:49:13 you know now they're not even calling on
1:49:15 big things and you know i'm
1:49:18 up here in the highlands and every
1:49:20 single time i go to the store
1:49:22 um i see
1:49:23 uh somebody with shopping carts putting
1:49:26 things in the cards exactly what what
1:49:28 nicole miller was talking about i think
1:49:30 i may have been at target the day she
1:49:32 was there because i think i saw that
1:49:33 person with the cart in the alcohol
1:49:35 aisle so
1:49:38 i would just be interested to know
1:49:39 specifically
1:49:41 what what caused that policy to change
1:49:43 nationally nationally
1:49:45 um and why
1:49:47 um i just think that's
1:49:48 um i think that's interesting and i
1:49:51 think you know we had heard something
1:49:52 from the
1:49:54 um well it was from connie about our
1:49:57 losing history when we have a lot of
1:49:58 turnover and um that's this is something
1:50:01 that's i don't want us to lose the
1:50:03 history on that this is not a national
1:50:05 policy that has always been the national
1:50:07 policy has always been or at least the
1:50:08 local policy was we're calling on every
1:50:11 six pack of coke that gets stolen so i
1:50:13 think it's a very important question to
1:50:15 add to to figure out the answer to um
1:50:18 anyway that was just my question and i
1:50:20 wanted to to throw a little bit of
1:50:21 history there because this is all very
1:50:23 new that we just stand back and you
1:50:25 stand in a parking lot and you watch
1:50:26 somebody at marshalls or home goods or
1:50:30 dicks or safeway or target just throwing
1:50:32 stuff in carts and nobody does anything
1:50:33 it's it's
1:50:34 shocking
1:50:36 so anyway thank you councilmember
1:50:37 goodman i think we can provide and go to
1:50:39 the order a little bit of information
1:50:41 tonight because it is an emerging issue
1:50:43 and it does involve changes and so i
1:50:45 will let miss peter bobkowitz um give
1:50:48 you some general information that we've
1:50:50 received over the last eight weeks or so
1:50:54 yeah thank you madam mayor councilmember
1:50:55 goodman
1:50:56 you know the information i'm going to
1:50:58 share is is not specific policy to any
1:51:02 store but really just some comments that
1:51:04 we have heard and talking
1:51:05 with folks and it really comes down to
1:51:08 the issue of safety and liability
1:51:11 many of these national chains as we have
1:51:13 talked to them have have told stories of
1:51:16 when employees have confronted
1:51:19 potential shoplifters of those employed
1:51:23 you know being threatened
1:51:25 verbally and with the weapons
1:51:27 in the store
1:51:28 they've had instances where individuals
1:51:31 have confronted folks and also have been
1:51:34 threatened verbally or with weapons
1:51:36 i think the stores have just decided
1:51:39 that the costs associated with the
1:51:40 safety of their employees and their
1:51:43 customers versus the cost of the items
1:51:45 being the taken
1:51:47 they don't match and i think that's been
1:51:50 the the change is that
1:51:53 there's a certain allowance for that in
1:51:55 order to keep the customers and the
1:51:57 employees safe
1:51:59 certainly what we're seeing like and as
1:52:01 we've talked with representatives of
1:52:03 late uh the the the amount of theft is
1:52:06 certainly beyond uh those those general
1:52:09 criteria and so that is what we've tried
1:52:11 to point out to these uh
1:52:14 businesses quite honestly they're also
1:52:16 also struggling with staffing also
1:52:18 struggling at all levels including
1:52:20 management um and so uh i think things
1:52:23 have changed a little bit recently and
1:52:25 mayor paulie has had discussions with at
1:52:27 least one of those national retailers at
1:52:29 the regional management level
1:52:31 they understand our community concern
1:52:33 for this theft
1:52:35 and we're all working together to try to
1:52:36 stop it
1:52:39 so in short
1:52:42 council member goodman this is new
1:52:45 it is new it is not something that has
1:52:47 been in the background and not been
1:52:49 enforced before cities
1:52:52 these regional retailers are adjusting
1:52:55 to what they consider to be very
1:52:57 difficult times but the impacts on the
1:52:59 community and the number of calls that
1:53:01 we receive about shoplifting and carts
1:53:04 being left at the transit center etc is
1:53:06 significantly on the rise
1:53:09 so i feel like it's in our best interest
1:53:12 right now to get the correct information
1:53:14 out there and to work with the national
1:53:16 realtors and say
1:53:18 not okay here not okay here what are we
1:53:21 all together going to do differently
1:53:23 because this is not okay
1:53:26 well thank you and i appreciate the
1:53:28 additional information and that was my
1:53:29 point this is not
1:53:32 this is new it's and it's
1:53:35 new recently um
1:53:37 and uh so i appreciate you all working
1:53:40 on it and i appreciate nicole miller
1:53:42 coming forward um and acknowledging it
1:53:44 publicly thank you
1:53:47 so do i i guess when uh i'm going to go
1:53:49 to councilmember march next but one
1:53:51 other quick word is if anybody is still
1:53:53 watching us tonight at 8 54

1:53:58 and don't interject yourself into these

1:54:02 if the retailers are deciding is because
1:54:04 it could be potentially harmful to their
1:54:06 employees i'm concerned that it can be

1:54:10 intercedes you just need to call the
1:54:12 police and provide the information that
1:54:14 you have and
1:54:16 not put yourself in any sort of personal
1:54:18 danger
1:54:19 uh councilman remarks
1:54:21 thank you madam mayor just to follow up
1:54:23 on that i would be very interested to
1:54:26 hear from
1:54:27 our interim chief
1:54:29 as to whether there are
1:54:32 opportunities or emerging
1:54:35 thoughts in public safety on how to
1:54:37 address this i totally get that we
1:54:39 shouldn't ask
1:54:41 a sales clerk
1:54:42 who's working at target to
1:54:46 endanger themselves to necessarily get a
1:54:49 12-pack of coke although i applaud
1:54:51 councilmember goodman's willingness to
1:54:53 mix it up uh to help try to keep her
1:54:55 community safe oh maybe she wasn't maybe
1:54:57 maybe she wasn't we've heard that rock
1:55:00 but um
1:55:02 oh i see gotcha um but i do wonder i
1:55:05 mean the police are very good at
1:55:07 managing risk and de-escalating um i you
1:55:10 know i recently saw then get somebody
1:55:13 who was very angry by the time they were
1:55:15 done he was fine with them putting the
1:55:17 cuffs on him and putting him in the back
1:55:19 of the car so i do wonder if if there
1:55:22 are emerging i have to think the police
1:55:24 have seen this elsewhere and there are
1:55:26 ideas on how to address it and i wonder
1:55:28 if we bring the ipd together with some
1:55:31 of these businesses i think what we want
1:55:33 to do is
1:55:34 um you know just get if anybody's
1:55:37 thinking about doing this they they
1:55:38 shouldn't and they particularly
1:55:40 shouldn't do it in issaquah so we'd love
1:55:42 to would love to hear more from the ipd
1:55:44 on this subject on a later date sure
1:55:45 thank you we'll get an update for you i
1:55:48 mean i think some of our recent
1:55:49 successes are because we agree that
1:55:52 um the asset managers
1:55:54 that do protect the
1:55:56 assets of the store can only go so far
1:55:59 but they have to know that we're we're
1:56:01 there with them
1:56:02 and so i think some of the outreach that
1:56:05 um acting interim chief schwann has done
1:56:08 has been amazing so and it's shown some
1:56:10 results which is great but we're not
1:56:13 there yet we're not all the way there

1:56:18 order it's kind of a fast one but i just
1:56:20 want to let you know come january 1st um
1:56:23 king county district 3 we'll have a new
1:56:25 council member
1:56:26 um we have seven mayors within this
1:56:29 district and uh about um back in august
1:56:33 we started to have uh some wednesday
1:56:35 morning meetings to talk about common
1:56:37 administrative issues that we've had
1:56:40 we had a luncheon on december 11th and
1:56:42 that would be duvall redmond carnations
1:56:45 mokwami north bend spamish and issaquah
1:56:48 to talk about what a collective agenda
1:56:51 for our king county council member might
1:56:53 look like
1:56:54 we share many common interests in terms
1:56:56 of transportation projects environmental
1:57:01 preservation and also flooding issaquah
1:57:04 you know got flooding history very
1:57:06 different than our neighbors to the west
1:57:08 and very similar to our neighbors to the
1:57:10 east although maybe not at scale
1:57:12 so we will be coming back
1:57:14 to echoing the order to our various
1:57:16 councils and sharing that draft list and
1:57:19 using that sort of as our our template
1:57:22 or our playbook within the county to
1:57:23 make sure that our new county council
1:57:26 member has a good understanding of the
1:57:27 needs of the seven cities within our
1:57:30 district so
1:57:32 i've gotten information from two cities
1:57:34 so far and putting it together and at
1:57:36 some point we'll come back and talk
1:57:37 about the general strategies and also
1:57:42 some of the individual items that are
1:57:43 showing up for different cities but it's
1:57:45 not something that needs to be formally
1:57:47 adopted it's just sort of a heads up of
1:57:49 this is what we're hoping our council
1:57:51 member can do for us as a district
1:57:55 and i am not seeing any other comments
1:57:58 under good of the order there is no
1:58:00 executive session
1:58:02 this evening
