0:10 and i will go over some of the
0:13 what that means on march 6 i issued an
0:15 emergency proclamation declaring a civil
0:17 emergency in the city due to the
0:19 covenant
0:21 on march 24th the governor issued
0:23 proclamation 28-28 relating to the covet
0:26 19 emergency
0:28 and open public meetings yesterday the
0:31 legislature
0:32 extended the proclamation until
0:34 termination of the state
0:35 emergency or until it is repealed by the
0:38 governor
0:39 or legislature due to these
0:41 proclamations tonight's meeting will be
0:43 held
0:43 entirely remotely the meeting will be
0:46 recorded
0:46 streamed live and available for later
0:49 viewing on the city's youtube channel

5:38 email on tonight's agenda topic
5:40 thank you madam mayor we received
5:43 several comments
5:45 by email on several items that are on
5:47 our agenda this evening
5:50 and i am summarizing these comments
5:52 while we're having virtual meetings
5:54 the first item that uh we received
5:57 one email from uh one email on was
6:00 regarding ab-8077 grants for water
6:03 system upgrades from our cora foundation
6:06 and the person who
6:10 wrote to us commenting on this objected
6:11 to this item being on the consent
6:13 calendar and provided comments and
6:14 questions on this item
6:16 additionally we received multiple emails
6:19 with comments on ab-8087 property
6:22 acquisition for sammamish plateau access
6:24 road
6:24 spar water system project
6:27 we received emailed comments on this
6:29 item from three individuals
6:31 the questions and concerns from two of
6:32 the individuals were in multiple
6:34 emails and many of those are reflected
6:36 in the memo that's in our packet
6:38 with answers from staff and comments
6:42 from staff and then a third person
6:45 wrote to us on this item provided
6:47 comments on the topic and asked about
6:49 how this project fits into our syst
6:51 our city's broader water system plans
6:54 and that concludes email comments that
6:57 we received on tonight's agenda topics
6:59 thank you council president hunt i'm
7:01 very much appreciated that the public
7:03 sends some of these questions ahead of
7:04 time so that we may be able to bring
7:06 some additional information on your
7:07 meeting night the next item of business

7:21 a couple quick reminders um the next
7:24 meeting of the cascade water alliance
7:26 board of directors is
7:27 wednesday uh january 27th at 3 30 pm
7:31 uh still no agenda on that one
7:34 and then the next meeting of the king
7:36 county affordable housing committee of
7:37 the growth management planning council
7:40 is friday january 29th at 11 am
7:43 and we're going to be discussing
7:44 amendments to the housing chapter of the
7:46 county-wide planning policies like i've
7:49 mentioned a few times before other than
7:52 that no report from me

8:01 i attended the healthier here governing
8:03 board on january 7th
8:05 and following a brief business meeting
8:08 the speaker was dr ben danielson who
8:10 recently made
8:11 headlines by resigning his position as
8:13 director
8:14 of the brown children's center at
8:16 seattle children's hospital
8:18 dr danielson who is black spoke on the
8:20 many ways that systemic racism warps the
8:23 delivery of health care
8:24 program funding decisions and the
8:26 inclusion of people of color in
8:28 organizational decisions
8:30 his presentation engendered a great deal
8:32 of discussion
8:33 especially as it followed the january
8:36 6th events at the capitol
8:38 in washington dc um
8:41 [Music]
8:42 in addition uh eastside human services
8:44 forum meeting will be held this thursday
8:46 january 21st and the january meeting of
8:49 the east side transportation partnership
8:52 was cancelled
8:53 thank you that concludes my report thank

8:58 um i am looking i want to make sure that
9:00 council member walsh is with us
9:02 and there she is i had to read my notes

9:09 last week uh the mayor council member d
9:12 michelle and i
9:13 attended the east king chambers
9:15 legislative
9:16 kickoff um as a way to
9:20 hear what was going on kind of with the
9:22 state legislature we heard from
9:24 i believe the secretary of state and um
9:28 some of our legislators were there
9:30 talking about the budget
9:32 as well as there were different kind of
9:36 side panels on economic revitalization
9:39 transportation affordable housing which
9:41 each of us
9:42 attended um and so that was an event
9:45 and then i also attended the
9:48 um city of visquad chamber of commerce
9:51 meeting
9:52 on friday got a chance to hear from
9:55 them about some of the issues that are
9:57 facing businesses
9:59 as we continue through this covid crisis
10:02 and just i don't want to say the
10:05 desperation but
10:06 the intense need um from our business
10:09 community
10:10 and how they appreciate the continued
10:12 communication but
10:13 gosh they really hope everybody's still
10:16 thinking about them and understands the
10:17 hurt that they're
10:18 in um and so i promised to bring that
10:21 on um and keep them top of mind for
10:25 everyone and so those were the meetings
10:27 i attended and that concludes my report

10:35 participated
10:36 in interviewing applicants for the
10:38 lodging tax advisory
10:40 committee for 2021 and
10:44 we had a lot of applicants um this time
10:46 around which was really exciting
10:48 and the recommendations go to the mayor
10:51 who then makes recommendations to the
10:52 city council
10:53 and um i thought it was going to be on
10:54 the um consent calendar tonight but
10:57 apparently it will be at our next
10:58 regular meeting

11:09 uh the futuretown regional council
11:12 growth management policy board met on
11:14 thursday january 7th
11:16 unfortunately i was not able to attend i
11:18 had a
11:19 urgent situation developed at my
11:22 day job but i will be there next month
11:26 sound cities association held a joint
11:29 pick
11:30 uh committee orientation meeting on
11:32 wednesday january 13th
11:34 and i would say fun was had by all uh
11:37 that concludes my report

11:47 county growth management planning
11:48 council
11:49 will be meeting on january 27th at four
11:52 o'clock in a virtual format
11:53 the purpose of the meeting will be a
11:55 work session to review the
11:56 to review the draft changes to the
11:59 county planning policies
12:01 the east side fire and rescue board of
12:03 directors met
12:04 on january 14th at four o'clock at
12:07 headquarters and
12:08 i did not have time to prepare the notes
12:11 from that so i will
12:12 send those to you via email after this
12:14 movie and i apologize for not having the
12:16 report for you
12:17 much appreciate thank you deputy council
12:19 president ray and council president hunt
12:23 thank you madam mayor this is council
12:24 president hunt the
12:26 wyra8 salmon recovery council will meet
12:28 this thursday at january 21st
12:31 at 2 p.m um wire 8 stands for
12:34 water resource inventory area and it's
12:36 the technical name for our watershed
12:38 the agenda has been posted online and i
12:40 wanted to let you know about one item
12:42 that
12:42 is of particular relevance to the
12:45 issaquah city council which is
12:47 we will have a presentation on the final
12:49 draft plan
12:50 from a ecology-led watershed restoration
12:53 and enhancement committee
12:55 and this is a plan that has to do with
12:58 helping to address withdrawals from
13:00 permanent exempt wells and restoring and
13:01 enhancing stream flows
13:03 and this is relevant to us because we
13:05 will be taking action
13:06 to approve this plan before it goes back
13:09 to ecology at our next regular meeting
13:11 so i will be seeing this presentation
13:14 from the perspective of the whole
13:16 watershed on thursday and if council has
13:18 any questions for me or
13:19 things that you would like me to ask
13:22 please do let me know
13:23 and that concludes my report thank you

13:27 next item on the agenda is the mayor's
13:29 report i have a couple things to share
13:32 there was an executive session held
13:34 earlier this evening
13:36 like to provide a vaccine update as of
13:39 january 18th
13:40 2020 all older adults in washington
13:42 state over the age of 65
13:45 are eligible to receive the covet 19
13:47 vaccine
13:48 people 50 and older who live in
13:50 multi-generational households are also
13:53 eligible if they meet certain conditions
13:56 due to a limited supply of vaccine not
13:58 everyone will be able to access the
14:00 vaccine right away
14:02 however access will improve as the
14:04 supply chain widens
14:05 and providers in king county begin to
14:08 receive more doses
14:10 earlier today we had the second meeting
14:11 of our issaquah vaccine community
14:13 partnership
14:15 which includes representatives from
14:16 swedish issaquah
14:18 isqual school district eastside fire and
14:20 rescue
14:21 costco the city of sammamish and our
14:24 city employees
14:26 to coordinate on future distribution in
14:28 issaquah
14:29 i'm thankful we have such a diverse and
14:31 committed team ready to serve this
14:32 community
14:33 more details will be shared with our
14:35 local community as additional supplies
14:37 become available but you can also look
14:40 information at iscwawa.gov
14:44 vaccine as we start 2021 one of my goals
14:49 is to strengthen relationships and
14:51 communication with our local faith-based
14:54 organizations in issaquah today was
14:57 a memorial uh nationally for covid19
15:00 victims
15:02 and as i start to bring us all together
15:04 i invited all churches in issaquah to
15:06 ring their bells today whether physical
15:09 or over sound systems at 2 30 pm
15:12 to remember and honor the lives lost
15:15 to covet 19. the national league of
15:18 cities
15:18 facilitated the participation of cities
15:21 and towns throughout the country for
15:22 this memorial
15:24 at the same time in washington dc a
15:27 ceremony was held
15:28 featuring historic lighting around the
15:30 lincoln memorial reflecting pool
15:34 the last item i have for you tonight is
15:36 on building codes and fire code updates
15:39 two of the items on tonight's consent
15:41 agenda calendar are ab-7902
15:44 2008 building code adoption and ab-8089
15:48 the 2018 fire code adoption
15:51 these agenda bills adopt the building
15:53 code adopted by the washington state
15:55 building code council
15:57 as well as some local changes the
15:59 building called update
16:00 code update typically occurs every three
16:03 years but it was delayed this year
16:05 due to coveted 19. at their january
16:08 meeting the state building code council
16:10 again extended the deadline for the
16:12 statewide updates to july
16:14 1st 2020 however the governor has
16:17 repealed this change
16:18 and has reinstated the february first
16:21 effective date
16:22 this means that if approved by the city
16:24 council tonight
16:25 the building code and fire code updates
16:27 will be in effect
16:28 on february 1st staff will provide
16:31 notification of the updates on the
16:33 city's website and through various trade
16:35 and user groups
16:36 and additional details on the updates
16:38 are provided in tonight's
16:40 agenda package that concludes the
16:43 mayor's report moving on to the consent
16:46 calendar
16:47 it was distributed to council in advance
16:50 and if authorized the items on the
16:51 consent calendar will be considered
16:53 together
16:54 and approved by one motion have the
16:57 payables and payroll been reviewed

18:32 this item was postponed from the january
18:34 4th council meeting to allow the
18:36 administration to address the council
18:38 and the community's questions
18:40 and i'd like to invite public works
18:42 director bob york
18:43 to present on this item welcome bob oh
18:46 good evening mayor
18:48 paulie and council members this is bob
18:50 york public works director
18:52 and tonight thank you for the
18:54 opportunity to provide a brief
18:56 presentation regarding ab
19:00 8087 which concerns the acquisition of
19:03 property from the washington state
19:05 department of
19:06 transportation washdot for the sammamish
19:09 plateau
19:10 access road spar water system project
19:16 next slide please tisha
19:21 um spark project is uh
19:24 would be a two-phase project if approved
19:27 phase one would
19:29 involve uh providing a redundant water
19:31 potable water supply to feed his
19:33 issaquah iowans this is important for
19:36 resiliency because at the current time
19:38 we only have
19:41 a pump station on a pi and parallel
19:43 pipelines going up the hill from the
19:45 shop to the up to the highlands and if
19:47 that were to fail
19:49 for any reason the highlands and swedish
19:52 hospital wouldn't have a
19:54 water supply so the new facilities that
19:57 are being designed would
19:59 and they're being designed with
20:00 resilient features by the way
20:02 um provide uh a second water feed to the
20:06 highlands
20:07 and all those residents and critical
20:09 facilities
20:10 phase two in the future would be a
20:12 reservoir for
20:14 additional files fire flow storage for
20:16 central issaquah based on the
20:18 expected growth focused in the downtown
20:21 area of central square
20:23 so by way of background this project has
20:26 been
20:27 in the planning stage and evaluation
20:30 stage for at least nine years
20:32 but while before i came to the city and
20:35 by sheldon my predecessor and i
20:38 um initially washdot was
20:43 hesitant about considering uh
20:47 property sales of this what they call
20:49 surplus
20:50 property to the city but multiple
20:53 attempts
20:54 over the years finally showed them the
20:57 the critical importance of this water
21:00 infrastructure project
21:03 to the city in terms of its importance
21:05 for
21:06 fire flow and uh a second feed to the
21:09 highlands so
21:11 um as you'll see on the next slide which
21:13 is uh which i'll
21:14 get to in a second the location near
21:17 interstate 90 a pill from the
21:22 trail and and the freeway was the only
21:27 realistically feasible location for
21:30 such a such a project
21:34 so it would it did require the land
21:35 purchase
21:37 which is one of many many agreements
21:39 that we've had to
21:40 work through with washdot and this is
21:42 one of the
21:44 last ones before
21:47 uh they would provide through the fhwa
21:51 the federal highway administration a
21:52 break and access to allow the
21:54 nf facility in a and a facility
21:57 franchise for the utilities that would
21:59 exist on the trail so we're
22:01 we're getting awful close to uh meeting
22:04 all the washed uh
22:05 agreements and requirements uh but
22:08 notwithstanding all the agreements with
22:10 washta we also have an obligation and
22:13 intend to achieve full compliance with
22:15 all the city codes
22:16 including critical areas so next slide
22:19 please nation
22:22 so you can see the location we're
22:24 talking about it's a a bunch of
22:26 contiguous parcels
22:28 and some tracks that are
22:32 in the area between uh
22:35 along the trail the
22:38 one feed to the highlands is in the
22:40 upper left-hand corner you can see
22:41 almost a line from the shop
22:43 the public works operations shop
22:46 straight up to the highlands that's
22:47 where our
22:48 single feed is or our dual pipe feed and
22:52 by going around along i-90 and up the
22:56 spar access road or highlands drive you
22:58 can see that that represents a much more
23:00 geographic geographically diverse
23:03 way to get water up to the highlands so
23:06 there would be pipelines along this
23:09 preston trail
23:10 there would be a booster pump station
23:12 and a reservoir
23:13 in the uh and a small portion of the
23:17 properties that are shown in blue
23:19 then the the pressurized water would
23:21 continue
23:22 up the preston trail and up the
23:23 highlands drive and connect to our
23:25 existing water system around discovery
23:27 drive
23:29 now the importance of the the secondary
23:32 importance of
23:33 of why to acquire this property is the
23:35 reservoir has to be at a specific
23:37 elevation
23:38 to make it work for the valley
23:42 operating zone which is held the water
23:45 level in the reservoir will be nominally
23:47 around
23:47 elevation 297 so you have to pick a
23:50 place
23:51 or a the city would have to take a place
23:53 on the
23:54 which with the topographic features such
23:56 that we achieved that
23:59 precise elevation and this property
24:02 represented a an opportunity to to
24:05 achieve that
24:06 objective as well next slide tisha
24:13 so this is a brief overview of the
24:16 required
24:17 washdown approvals it started with
24:22 a demonstration of need we've done this
24:24 several times including
24:26 multiple washdot departments that
24:29 subsequently became involved in this and
24:31 asked why
24:32 why we need why do we need to do this
24:33 well we had to supply that explanation
24:36 you can see in some of the documents
24:37 that are
24:38 exhibits to the agenda bill tonight
24:42 uh the short summary of our statement by
24:45 the
24:46 giving the reason why we
24:50 our desire to acquire this land and do
24:52 this project
24:57 a second thing we need to work to
25:01 work through with wash that and with the
25:03 mounts sound green right
25:05 trust is the preservation of the view
25:08 shed on the mountainside
25:09 the hillside so when i first
25:13 arrived in 2016 we met with boston
25:16 and mounds of sound green right trust
25:19 including john hawkesboro the executive
25:21 director to
25:22 achieve this objective we
25:26 did a lot of things to make this happen
25:28 including preserving key trees
25:30 color selection location of the
25:33 facilities so that
25:35 for all practical purposes the view the
25:37 view would
25:38 the the mounds of sound greenway trust
25:40 desire to maintain
25:42 the view shed would be preserved
25:46 next thing we had to do because the fhwa
25:49 federal agency was involved is a achieve
25:52 nepa compliance for all this
25:54 for all the other things to happen and
25:58 the nepa compliance document is is
26:00 included in your
26:02 as an exhibit tonight in your agenda
26:03 bill packet uh
26:05 bob did you state with that acronym for
26:08 me national environmental policy act
26:13 thank you the federal uh version of cipa
26:16 if you want to call it that way but as
26:18 i'll explain in a minute it's much more
26:20 in many ways it's much more complicated
26:22 so uh but it's
26:24 it was a daunting project process to
26:27 meet all their requirements
26:30 then the break-in access is imminent as
26:32 i mentioned
26:35 a minute ago and it's based in large
26:37 part on the approval tonight of the
26:39 land purchase otherwise there's no need
26:41 for breaking access
26:43 um something we just achieved a month or
26:45 two ago as you call is a trail lease
26:47 that
26:48 was negotiated with washdot and also in
26:51 collaboration with the king county parks
26:54 department because they maintain the uh
26:57 the trail and would continue to maintain
26:59 the trail
27:01 uh throughout
27:04 after our construction is complete
27:08 so we worked through that with watchdog
27:10 then as you'll see in your packet
27:11 tonight and that has another exhibit we
27:13 had an independent
27:14 independent independent appraisal for
27:16 the land purchase to
27:18 determine the fair market value and i'll
27:20 go into that
27:22 some of the details of that in a minute
27:26 finally the request tonight for the

27:40 we achieved this nepa approval working
27:43 with our consultants and with washdot
27:45 in late 2018 nepa
27:49 you can browse through the nepa document
27:53 but includes
27:55 uh it was considered a categorical
27:57 exclusion which meant
27:59 we satisfied all the nepa requirements
28:02 those
28:02 requirements included things such as
28:05 water quality store water
28:08 concerns environmental justice critical
28:11 and sensitive areas
28:13 cultural resources biological
28:15 assessments essential fish habitat
28:18 evaluation
28:19 endangered species act compliance and
28:22 in that case we our consultants and
28:25 washdat
28:26 delivered a letter of no effect to our
28:29 in that regard
28:30 so this was worked through mostly as a
28:34 prerequisite for every other activity
28:35 that would
28:36 occur after that next slide
28:40 tisha please
28:43 um so the beginning of our assessment of
28:47 this property
28:48 showed streams and uh wetlands present
28:51 on the
28:52 various properties i don't show the
28:53 property lines themselves here
28:55 due to lack of timing and preparation
28:58 but
28:59 you can see there's two complexes of
29:01 streams and wetlands one's to the east
29:03 one's to the west and we've got narrow
29:07 channel in between and
29:08 rising up to the uh to the um
29:12 the uh open area is our is
29:16 our ability is where we have to
29:19 deliver all these or build all these
29:21 required facilities so you'll see that
29:23 better on the next slide please tisha
29:28 so this is a slide that shows
29:32 our ingredient shows our
29:36 area of impact for for the required
29:39 water system facilities
29:41 and some of the other features are shown
29:44 less visibly
29:45 our design was altered and
29:49 changed to avoid drugs that impacts the
29:51 streams wetlands
29:53 protect key trees and
29:56 and that is a good pers
30:00 percentage of the reason why the value
30:02 of land is
30:03 what you might call fairly reasonable
30:05 for over 10 acres of land
30:09 the constraints that are the basically
30:11 the
30:12 land that where we can do any projects
30:15 represents around 12
30:16 of the total purchase of the land
30:19 so here's the appraisal cover sheet next
30:21 page to show that's fine
30:23 um about the same time as we did this
30:26 nepa document we
30:29 did a appraisal funded by the city
30:32 independently
30:33 in the paper appraisal and that
30:36 appraiser took in the
30:37 into account all the value the the
30:41 the types of parcels we were buying the
30:44 constraints placed on those parcels
30:46 and the value came up to a
30:49 249 000 which is equal to the
30:53 purchase price washed out as requesting
30:55 in the uh
30:56 in the uh property documents that are
31:00 included tonight's
31:01 agenda bill next slide please tisha
31:06 again the many of the reasons why this
31:08 property is uh
31:11 uh is
31:14 fairly inexpensive compared to the
31:15 acreage is
31:17 the nepa restrictions the
31:20 as well as the future city restrictions
31:23 the access if you need to get a vehicle
31:26 there you have to use the trail and
31:28 that's
31:29 where stipulated they only use the trail
31:31 one or two days a week unless there's an
31:33 emergency
31:36 and you can walk up there as we'll get
31:39 to in a minute but
31:41 it's really only available
31:44 through the bisque precedent trail so
31:46 that constrains the property and
31:48 or the purchase price and finally that
31:52 view shed protection
31:53 again we're very narrowly constrained on
31:57 what we can do
31:58 and where we can do it next slide
32:05 so a few details on the property
32:06 transition transaction that
32:09 we're requesting tonight
32:13 one wash dot this is surplus wall
32:15 property to wash that
32:17 washdot only uses a quick clean deed for
32:21 for that kind of transaction um
32:25 however in response to questions
32:28 and our own concerns we did
32:32 we did obtain a tunnel report which is
32:34 included as an exhibit in tonight's
32:36 agenda bill packet
32:38 and the city is also
32:43 a plan is subject to your approval to
32:46 obtain title insurance and we have a
32:48 binder already received
32:50 to provide that insurance based on the
32:52 the title
32:53 report the title reports available but
32:58 by inspection and including input from
33:01 our city attorney we didn't see any
33:03 significant
33:06 issues in the title report that would uh
33:09 make us overly concerned about acquiring
33:11 this
33:12 property next slide please station
33:20 the um historically this property's
33:24 had a wide variety of uses dating back
33:26 to washdot
33:28 gravel operations and and uh but most
33:31 recently
33:33 it's been used as a has a use
33:36 and i think according to the latest
33:39 folks that have been up there
33:40 there still are homeless encampments
33:43 present
33:44 at least one president president on that
33:46 property on those properties
33:50 so questions came about what's going to
33:52 happen um
33:53 if we acquired the property and the city
33:56 takes ownership unlike the present
33:58 situation where washout owns the
34:00 property
34:01 uh the city's policy is that camps would
34:04 not be allowed
34:05 on the property once acquired and
34:07 there's a process that's
34:09 spelled out in your agenda packet in
34:11 some of the
34:14 material that i prepared that spells out
34:17 the details of that
34:18 the city basically would provide a
34:21 notice
34:21 to evacuate and offer access to research
34:24 sources and services
34:26 as part of this process
34:29 once once the site is free of
34:32 of encampments
34:35 um the city and specifically were
34:38 proposing that the water utility as a
34:41 as a as part of the
34:45 need to acquire this property based on
34:46 the water utility would
34:48 provide site cleanup efforts for the
34:50 infectious materials and
34:52 trash that must exist up there
34:56 and then but the interesting or neat
34:59 thing about
35:00 the property in my opinion is we need
35:02 just 12
35:03 of the or the water utility just needs
35:05 12 of the
35:08 available acreage to do our water
35:11 utility work and the rest of the
35:14 property is free for
35:16 open space and also
35:20 potentially trails that the parks
35:23 department has
35:24 indicated there's long been a desire to
35:28 link the highlands to the iskwa
35:31 preston trail maybe using this
35:34 opportunity
35:35 so along with the
35:39 acquisition of property comes from some
35:41 possible
35:43 side benefits other than that which is
35:45 used for the utility
35:48 next slide please tissue
35:52 uh so as i mentioned before there are
35:54 critical areas
35:56 those include streams wetlands steep
35:58 slopes landslides
35:59 um whole a lot of a lot of things to be
36:03 concerned about we're working through
36:04 that process with our
36:07 colleagues public works colleagues in
36:09 this community planning and development
36:10 group
36:12 there's ongoing discussions right now
36:15 about the findings and
36:18 all this has been prepared by our
36:20 consultants and being reviewed by the
36:24 consultants peer review consultants
36:26 retained
36:28 by community planning and developments
36:31 team so uh it looks like we can work
36:35 navigate through all the issues and
36:37 comply with our
36:39 uh visqual city code some things like
36:42 tree removal retention just like washed
36:44 out
36:44 we have concerns and if we remove trees
36:48 we have to mitigate for that we're
36:49 planning on doing that
36:51 storm water requirements we're planning
36:53 on the latest plan is to use
36:56 you know the brains up there uh it
36:58 naturally disperses into the environment
37:00 and with our experts and
37:04 and including wetlands biologists
37:07 that's the plan to deal with the small
37:10 amount of additional runoff that will
37:11 occur as a result of our projects
37:14 uh zoning uh zoning this
37:17 uh this land is the land that we're
37:20 gonna use for the
37:22 water utility projects is zone community
37:24 facilities
37:26 facilities zoning cff
37:32 adjacent parcels
37:35 are also are zones something different
37:38 which is
37:39 community facilities open space but per
37:42 our imc the proposed facilities are
37:45 permissible when
37:46 within the cff zone provided a level two
37:50 administrative site development permit
37:52 is reviewed and approved
37:56 the public works department and its
37:57 consultants have submitted a permit
37:59 package that we believe addresses the
38:00 approval criteria outlined in the imc
38:02 and
38:04 again this is under review by the
38:07 community planning development team sipa
38:10 a sipa checklist has been prepared uh
38:13 cdp staff's review is still underway but
38:16 the latest assessment is that
38:20 a proposed mitigation declaration of
38:23 non-significance is likely
38:26 and of course the preliminary mdns will
38:31 subject to public review okay bob you
38:33 were doing really well but now i've got
38:35 four things for you to fill out for the
38:37 community
38:39 i hope i know the answer so go ahead
38:41 okay let's start with cpd
38:43 oh community planning and development
38:45 thank you
38:47 um you did talk about a site development
38:50 permit
38:51 uh fifa oh state environment
38:54 and state environmental policy act right
38:57 uh and there is a couple others i'm not
38:59 sure if any other council members caught
39:01 it but just for those who are watching
39:03 who are not as engineering nerdy as you
39:05 and i
39:05 are i want to make sure they get their
39:07 acronyms so
39:09 thank you yeah and the last thing i say
39:12 which is not on the
39:13 presentation tonight but we've had
39:14 discussions in the last week and uh
39:17 this what could be the uh one of the
39:18 first or second
39:20 projects that would be eligible or where
39:23 we would
39:24 propose to hold a neighborhood meeting
39:25 if that if that
39:27 policy is indeed enacted so
39:30 uh there'll be another opportunity for
39:32 the public to
39:34 see what's going on if a neighborhood
39:36 meeting is
39:37 held so final slide tisha
39:41 just jump in again i think the acronym
39:43 one of the council members is pointing
39:45 out is mdns
39:47 oh mitigate that comes out of that state
39:50 environmental protection act
39:51 process yes mdns is
39:56 mitigated i better get this right
40:00 because i got it wrong too
40:03 a mitigated determination of
40:08 non-significance
40:10 which is a determination yeah that's a
40:13 determination that
40:15 we have to we can comply with cipa
40:18 requirements
40:19 as long as we perform certain activities
40:22 associated with our project
40:24 thank you yeah and by achieving by
40:28 determining by doing those things
40:30 the consequences of the environment
40:32 would be considered non-significant
40:36 yeah so in conclusion it's time for
40:39 questions but
40:41 staff staff strongly believes that the
40:42 uh water utility really needs this
40:45 project
40:45 and we need the land to do this project
40:47 is it because it provides resiliency for
40:49 our
40:50 escala highlands community including
40:53 swedish hospital
40:56 and also the future reservoir provides
40:58 the
40:59 necessary infrastructure for continuing
41:02 our
41:03 focus on growth in the esquire
41:07 central esque area so staff would
41:10 recommend that you improve this
41:11 land purchase but now i'm open for
41:14 questions

41:46 years and it's also on the approved 2021

41:58 be the purpose of the meeting because we
41:59 would have already purchased the land so
42:00 what would we be asking the community
42:03 um to provide input on
42:06 um may i probably phone a friend on this

42:14 it's to let the community understand
42:18 we have we bought the land but we
42:20 haven't done the project yet so it would
42:23 help the community understand everything
42:24 we're doing to try to minimize impacts
42:27 on critical areas and achieve all our
42:30 code requirements

43:56 um yes we have been in communications
43:59 with
43:59 our team and with director york's team
44:03 over the last couple of weeks and as the

44:07 outreach person um
44:10 has been hired by they support food and
44:12 clothing bank
44:13 we started communications and
44:15 coordinations on starting to engage with
44:19 folks in that area
44:22 as of in currently starting now in the
44:25 next few days
44:26 um and um so our hope
44:29 was that the outreach specialist will
44:33 engage with folks and
44:35 provide resources and help them connect
44:37 with services
44:38 on our end we are trying to leverage
44:42 resources that we already provide to the
44:44 cities human services grants and
44:46 connecting
44:47 individuals with services whether that's
44:49 treatment or shelter services
44:52 or other services that they might need
44:54 and then in the second phase we are also
44:57 evaluating the services that we have
44:58 available as we learn more
45:01 from what the needs are to ensure that
45:04 we have the services available or if not
45:06 to come back to council and request
45:08 increased capacity for those services

48:04 there is an identified cost of a hundred
48:06 thousand dollars for
48:09 clean up and mitigation on the site
48:11 that's in the
48:12 memo and in the financial impacts part
48:15 of our agenda bill it doesn't identify
48:17 that cost but since it's identified
48:18 elsewhere just for transparency
48:20 i think that should be considered in the
48:22 impact especially
48:23 since it's relative to the purchase
48:27 price of the property i think that
48:29 that expense is substantial or relevant
48:32 and i also just wanted to say thank you

48:39 for the other
48:41 city staff that provided answers to the
