In June 2016, Council adopted Ordinance No. 2768, adopting the 2015 Washington State Building Code. Pursuant to RCW 19.27.031, these codes must be adopted as minimum standards and for enforcement purposes. Since adoption, certain discrepancies have been discovered in IMC 16.04 related to the State Building Code adoption. Intended amendments were to align smoke-control and high-rise provisions with the City of Bellevue since during an emergency or fire event, Bellevue Fire would support the City of Issaquah. Considering the alliance Eastside Fire & Rescue has with the eGov jurisdictions and our desire for consistency, it would be most effective from a fire- and life-safety standpoint that the City of Issaquah mimic the code provisions outlined in the City of Bellevue building code amendments. Staff report:
Based on the work of the Advisory Group and the subsequent staff work, Administration recommends that the City partner with a new operator for the Senior Center through a Management Agreement. For decades, the Senior Center has been operated in Issaquah by a non-profit entity. The City has historically not been the direct operator. Although the Parks and Recreation Department has done a quality job in this interim period and could transition to long-term operation, it is not Administration's preference to add this to the list of services that the City directly provides. There are agencies within the area positioned and experienced to manage the Senior Center, delivering the mix of social services and programs that our seniors need at that facility. It is recommended that this partnership be done through a Management Agreement, as opposed to a Lease Agreement as was previously done.

0:25 regular City Council meeting to order
0:28 this evening a special council meeting
0:30 was held to hear presentations by
0:32 applicants to fill the current council
0:34 vacancy we started at 5:00 and we just
0:37 completed that meeting due to this an
0:41 earlier meeting our regular meeting is
0:43 starting an hour later than usual this
0:45 evening on the agenda the transportation
0:48 benefit district bill has been moved to
0:51 the first order of business to allow the
0:52 public hearing to be conducted before
0:54 the hour is too late
0:55 public comments on other topics can be
0:58 made after the public hearing and
1:00 deliberation on agenda bill 72 5-0
1:03 because of the lateness and number of
1:06 those in attendance I will be limiting
1:08 cop limiting all public comments this
1:11 evening to 3 minutes during audience
1:13 comments we recognize that we have a
1:17 really large crowd tonight and it seems
1:19 like many of you have come to talk about
1:21 a single issue a single topic what I
1:24 would ask when we get to audience
1:26 comments is that if there are those that
1:28 want to present on behalf of the group
1:31 to come up and also after that if you
1:35 have additional new information that
1:37 supports your reason the groups reason
1:39 for coming tonight
1:40 please also come up to the microphone
1:42 and add that additional information for
1:45 us while you are in the audience this
1:47 evening and hearing different audience
1:50 comments if you hear at the end of a
1:52 speaker if you are compelled to show
1:55 your support for the the message that
1:58 they're presenting the information
1:59 they're presenting it's very helpful for
2:01 council for you to raise your hand at
2:03 the end of the speakers so that they can
2:05 get an idea of how many people came for
2:08 that particular topic so if you could
2:09 help us out with that tonight that would
2:11 be great I'd like to ask so I'd like I'd
2:14 ask those who'd like to join the council
2:16 myself in the Pledge of Allegiance -

2:38 first item on the agenda this evening is
2:41 a b725 zero transportation benefit
2:45 district at the December 18th council
2:48 meeting council directed the scheduling
2:50 of the public hearing and the
2:51 preparation of an ordinance to establish
2:53 the TBD before I open the public hearing
2:55 I'd like to invite attorney
2:58 I've got Palace here is that correct
3:01 I was Austin ethic from our bond council
3:05 to provide a presentation go good
3:10 evening members of the City Council my
3:12 name is Alice Austin I'm with straddling
3:14 I've been the city's bond council for
3:16 about 15 years give or take a few
3:20 I was asked here tonight to come back
3:22 and sort of revisit I was with you back
3:25 in July and gave a kind of a more
3:28 general presentation about
3:29 transportation benefit districts I
3:31 understand that many of you have been
3:33 studying this quite in-depth since then
3:36 and have had a number back-and-forth
3:39 with staff and with the city attorney
3:41 about this topic so I will give you kind
3:44 of the overview and review and provide
3:48 some context for what the transportation
3:49 benefit district is and what it can do
3:52 and then I'll answer any questions that
3:55 you have
4:01 yeah all right so the formation of a
4:04 transportation benefit district allows
4:07 this it allows the city to form a quasi
4:10 Municipal Corporation that is a separate
4:12 independent taxing district which has
4:15 certain specific authorities and it is
4:18 funded specifically or it is created
4:20 specifically to provide additional
4:22 funding for transportation improvements
4:24 within its boundaries the transportation
4:27 improvements that can be funded must be
4:29 in the city transportation plan they can
4:31 include state highways and local and
4:34 regional streets as well
4:37 and it may include the operation
4:39 preservation and maintenance of these
4:41 facilities and that's the basic kind of
4:43 legal overview I did mention that it is
4:46 a separate independent quasi Municipal
4:51 Corporation however the City Council's
4:54 acts as the board of directors of that
4:57 entity the formation steps which we are
5:03 in the midst of tonight involve
5:05 providing notice to the public which was
5:07 published in December having a public
5:10 hearing which is teed up for this
5:12 evening at the public hearing hearing
5:16 all of the feedback that is available
5:19 from folks who do want to participate
5:21 following that if the City Council finds
5:24 it to be in the public interest you may
5:26 adopt the ordinance that's before you
5:28 which establishes the boundaries which
5:30 in this case would be coterminous with
5:32 those of the city and so you're not
5:34 proposing anything that's larger or
5:37 small or it would simply be the city and
5:40 specifying the transportation
5:42 improvements to be funded in this case
5:47 in the notice and the ordinance are
5:49 consistent on this again the boundaries
5:51 would be coterminous coterminous with
5:53 the boundaries of the city governance
5:55 would be the members of the City Council
5:57 sitting as the board the improvements to
6:00 be funded there's a missing bullet point
6:02 here which is that it's the
6:04 transportation improvement plan that the
6:07 city has previously approved but
6:09 including what's up there preservation
6:11 maintenance and operations which is sort
6:14 of a specific highlight in there and
6:17 then funding sources in the ordinance
6:21 that allows the vehicle license fee it
6:23 also allows for the other taxes fees and
6:27 tolls that are permitted by statute
6:29 which could be imposed at a later date
6:32 the vehicle license fee is the only one
6:34 by statute that allowed that the board
6:36 is allowed to simply go ahead and impose
6:38 should it choose to do so once it's
6:40 constituted that's a maximum of twenty
6:43 dollars and then after two years you do
6:46 have the opportunity to increase that
6:50 under the state law in terms of other
6:53 funding sources the sales tax is
6:55 available it requires a simple majority
6:59 public vote or approval and then there
7:04 are other possibilities of city road
7:06 tolls again requiring majority voter
7:08 approval or property taxes which would
7:10 require a supermajority voter approval
7:14 in terms of voter approval you would
7:17 have to come back to the voters with a
7:19 proposition that would describe the
7:21 transportation improvements specifically
7:23 to be funded by those resources and they
7:28 describe what those taxes fees or tolls
7:31 would be and then finally I don't know
7:37 how much this has been discussed in your
7:39 deliberations but recently the
7:41 legislature authorized cities to simply
7:43 assume the operations of their
7:46 transportation benefit districts once
7:48 they have been formed and we've seen
7:50 since this statute was enacted many
7:52 cities doing that taking over for those
7:55 transportation benefit districts so that
7:56 you avoid having that duplicative sort
8:00 of level of governance and so you kind
8:03 of do away with the district inform and
8:06 take on the powers within the city and
8:09 so that requires a separate ordinance
8:12 that would be that would happen
8:13 somewhere down the road but that is also
8:15 available to the city should you choose
8:17 to go down that road that's the very
8:20 brief summary but I'm happy to answer
8:22 questions folks have or provide any
8:24 other context that's necessary Thank You

8:32 presentation your third bullet says
8:35 improvements funded you just did mention
8:36 something about this right it does in
8:40 quote it says preservation maintenance
8:41 and operations and in the proposed code
8:45 language that is repeated a number of
8:47 times preserve maintain and operate it's
8:51 when unite when I look closely at that
8:53 proposed language it's in 1207 Oh 40 and
8:58 1207 Oh three
9:00 he never says it never really says
9:02 construct built it always talks about
9:05 preserve maintained operates right the
9:08 if you look at the notice and also
9:10 throughout the ordinance it also does
9:13 talk about the projects that are
9:16 included in the transportation
9:17 improvement plan which also include many
9:20 construction project just by the nature
9:22 of those projects being ones that might
9:24 be creating something new that that is
9:28 even though we use these words only in
9:30 our in the code that would by
9:33 implication that's allowed
9:34 I believe the reference there is to the
9:37 entire transportation improvement plan
9:39 okay the second question I had was
9:42 simply does you know it does talk about
9:45 streets city streets and can that does
9:50 that extend to non motorized corridors
9:53 as well is it just motorized streets and
9:57 does it go as far as the other related
9:59 improvements such as sidewalk and other
10:03 improvements so the transportation
10:05 benefit district itself really can
10:10 include really can include those kinds
10:14 of improvements that are within your
10:15 transportation improvement plan it's not
10:17 research into motorized types of
10:19 Transportation okay because the ordinate
10:22 of the proposed code does say city
10:24 streets so I think if we would maybe
10:26 want to clean something up if we want to
10:28 consider that and if that's possible but
10:30 I think the TIR RTI P does include both
10:34 motorized and non-motorized components
10:35 so city street seems to be a little bit
10:38 in conflict with that potentially thank
10:39 you you can't some everyone just thing
10:41 that's Myra Goodman
10:42 I'll up to Paul hello to Paul's question
10:45 and I'm not sure I heard something
10:48 correctly but well that's good a little
10:51 broader in a little different way so
10:53 this is there refers several references
10:56 to our CW's up there so was our code or
11:00 we since we're following the statutes
11:03 mhm
11:04 would it be expected is our code
11:06 expected to track those statutes or
11:08 there would be anything different so
11:10 whatever the statutes allow
11:12 our code would allow we're not doing
11:14 anything different or do we have we
11:15 changed a little bit well the statute is
11:17 drafted more broadly and and I'll turn
11:20 to the city attorney as well if he has
11:22 any thoughts on this question but the
11:25 statute is drafted broadly to permit
11:27 transportation benefits districts to you
11:29 know fund any number of kinds of
11:33 transportation improvements and sort of
11:34 adopts by reference regional plans and
11:37 so any transportation improvement that
11:39 is within a regional plan approved by
11:42 the city is technically eligible under
11:46 the statute now if your code has
11:48 something narrower or whenever your code
11:50 references so what's in this would
11:52 control as long as it's within that
11:55 broader context Jim I think what I'm
11:59 getting at is Paul reference Street so
12:01 Wood Street if you're building a street
12:03 could you also include building
12:05 sidewalks but then that conceals yeah
12:07 our trails and I would think that if
12:10 you're building a one of these projects
12:12 that Street would encompass what we
12:15 typically call as a complete Street but
12:17 oh the actual proposed ordinance states
12:21 that the board has all of the powers
12:24 which are granted by the statute so it
12:27 broadly gives the board those powers it
12:29 provides that the funds generated by
12:31 that transportation benefit district
12:33 shall be used for transportation
12:35 improvements that meet the requirements
12:37 of the statute so yes I believe they
12:39 would have the transportation with
12:41 benefit district would have the
12:42 authority to include sidewalks and other
12:45 improvements assuming that those are
12:47 authorized by the statute which they are
12:49 they'd have to be in the city's plan and
12:52 transportation plan but yes thanks any
12:55 other questions
12:56 what's my beret so just just a
12:59 clarification so we can establish the
13:03 transportation benefit district and not
13:06 impose any new vehicle taxes that at the
13:10 time of creation that's correct that's a
13:12 decision that would be made it's a
13:14 two-step process formation first and
13:16 then coming back once you constitute
13:19 yourselves as the governing board of
13:21 this new entity then you get to make
13:23 that decision later
13:24 about what if any taxes fees charges are
13:28 told you may want to impose any more
13:33 questions at this time I'll open the
13:37 public hearing the public hearing for
13:40 the transportation benefit agenda bill
13:42 the comments were accepting now are two
13:44 just to that particular bill digits and
13:48 comments are important part of our
13:49 process and when I'd like to make sure
13:52 everybody who wants to comment on this
13:54 agenda bill knows to come up to the
13:56 lectern state your name and address if
14:01 we put the public comment instructions
14:04 up on the overhead for those who haven't
14:06 participated before and do we have a
14:10 sign-up list sorry
14:12 opening the hearing at 8:14 and has
14:15 anyone signed up to speak this evening

14:25 Northeast up in the highlands I'm really
14:27 pleased to see that we're looking at
14:29 DVDs this is an option
14:31 I think I said hey we're not ready for
14:34 that I was thinking the decision related
14:37 to the car tabs I think it's fine to
14:40 create the transportation benefit
14:42 district we're gonna have to have a
14:43 robust community conversation about
14:46 funding I think looking at the
14:51 information in some of the packet that
14:54 you guys had received I noticed that
14:56 there was a lot of references to the CIP
14:59 there's several options on there that
15:02 are related to parks I would assume
15:04 that's not included but we were talking
15:07 about the transportation plan and the
15:10 CIP was listed in there so I was a
15:13 little bit confused on that and then
15:16 beyond that there was something I have
15:21 to get to page 36 of course it's not
15:27 going to show up in there I think it's
15:32 just really important to think about the
15:34 larger scope of this
15:37 we're looking at the $20 car tabs that's
15:39 only going to give us an estimated
15:43 450,000 compared to the sales tax and so
15:47 it's really it's a small portion
15:49 it's a portion that we need in order to
15:50 four to spend on our transportation
15:54 stuff but I don't want to put make the
16:00 suggestion that that's going to make all
16:02 of the issues go away so thank you

16:22 name is Vicki hunt I live at 95 Highwood
16:24 Drive south west on squawk Mountain and
16:28 I'm also a member of the Planning Policy
16:29 Commission but speaking as an individual
16:31 I was really glad to hear the
16:34 clarifications regarding that the
16:37 transportation benefit districts could
16:39 cover non-motorized walkways and roads
16:43 because I think as we become more dense
16:46 as a city we want to make sure that
16:48 people are able to get around using
16:50 transportation other than single
16:53 occupancy cars and there's a lot in our
16:57 visions for the city that will involve
16:59 Boehner or a pedestrian walkways tree
17:02 tree-lined streets and I think that that
17:04 is a great clarification to make that
17:07 this can also be used for non-motorized
17:09 improvements thank you Thank You Vicki

17:24 regarding a transportation district I
17:27 just say that I'd hope that this city if
17:29 it is established I'd hope that the city
17:31 would work collaboratively with
17:35 surrounding jurisdictions I believe
17:38 Puget Sound regional councils designate
17:41 it as a quite a city center or some I
17:43 don't have the exact language but a
17:44 recent regional transportation hub
17:47 you're a large gateway to i-90
17:50 so with potential for just recognizing
17:53 that your transportation decisions have
17:54 regional effects and potentials for
17:57 tolling your city streets and like
18:00 previous decisions with your truck
18:02 routes have have significant effects on
18:05 neighboring jurisdictions so I would
18:07 hope that that is a part of the actions
18:10 and consideration considerations and all
18:12 of the the establishment and actions
18:15 that they might take Thank You marina

18:51 was gonna make a motion I would move to
18:56 adopt ordinance number 2 8 to 3 mending
19:01 the Issaquah municipal code to enact a
19:03 new chapter 12 0.70 Issaquah
19:06 transportation benefit district
19:07 establishing a transportation benefit
19:09 district specifying the boundaries for
19:11 the transportation benefit district and
19:12 specifying the maintenance and
19:14 preservation of existing transportation
19:15 improvements second it's been moved and
19:19 seconded to adopt ordinance number 2 8 2
19:21 3 amending the MU knispel code to act
19:24 enact a new chapter 12 point 7 o is

19:33 council discussion on this it comes more
19:36 months so I would actually like to
19:39 consider I would like to move an
19:41 amendment so let me explain to you this
19:43 amendment so as we have talked about I
19:46 had have some concerns around whether
19:51 we're getting into specific remedies
19:55 before we've had a holistic conversation
19:58 about the entire package so I would like
20:01 to propose the foie
20:02 amendment so I would like to add in
20:05 addition direct the city administration
20:08 and the council ad hoc long term Finance
20:11 Committee to propose a comprehensive
20:13 funding strategy for transportation
20:16 capital projects for the for the full
20:18 City Council's consideration by June
20:21 2018 is there a second second chicken
20:28 scratch here so amendment has been
20:31 proposed it's moved and seconded to add
20:34 the language in addition direct the city
20:38 administration in the council ad hoc
20:40 long term financial committee to propose
20:43 a comprehensive funding strategy or
20:48 transportation transportation capital
20:51 projects for the full City Council's
20:53 City Council consideration by June 2018
20:58 is there any discussion
21:01 council president Mertz so this if if
21:06 this amendment is approved I would be
21:08 able to support the bill as written this
21:11 is a conversation that I've had with the
21:13 administration about how to on how to
21:16 address my fundamental concern which is
21:18 around us getting to this the broad what
21:22 the broad package would look like an in
21:24 timely fashion
21:25 I'd be more comfortable enabling this
21:27 mechanisms I recognize that tonight
21:29 we're not deciding on any particular
21:32 funding dollar amount or anything but I
21:35 want to have I want to make sure that we
21:36 have a date certain to a conversation
21:39 about the the broader funding strategy
21:41 this would enable that to do so so I'm
21:43 hoping you will support this amendment
21:46 council member Goodman so my question is
21:50 about what what this amendment in the
21:54 direction would do how is this different
21:56 from what the administration's plan is
21:58 already does do we have any maybe that's
22:03 a question for Emily and then and and I
22:06 think what if the work if the if the
22:10 workload that we
22:12 have can accommodate that we as in terms
22:14 of the administration city staff so I
22:19 want comprehensive packages as well but
22:22 since we're not doing any packaging or
22:25 funding tonight I don't think there is
22:27 any proposal to do so I just want to
22:28 know what the ramification of the memo
22:30 would be sure I think you're correct and
22:34 assuming that we were going to have this
22:36 conversation at the ad hoc committee
22:38 along with examining all of our
22:41 long-term financial sustainability
22:43 issues I think in part the motion gives
22:47 a deadline for us to have that
22:49 conversation and then return with some
22:52 recommendations to the council okay so
22:55 it's it places a deadline on the
22:58 intention that was already there yes
23:00 does it change the timeline dramatically
23:02 no that's my red booties so I I would be
23:08 in support of the amendment when we were
23:11 have been talking about the
23:13 transportation benefit district really I
23:16 to go back to what I've talked about
23:19 before I think that this is putting
23:21 another tool in our tool belt for lack
23:26 of a better way to describe that and a
23:28 lot of conversation needs to be had
23:30 around what what we would do going
23:32 forward but I think that putting a
23:35 timeline on this and having that
23:37 strategy come forward together along
23:40 with that conversation makes really good
23:42 sense thank you
23:43 anybody else wanting to comment on this
23:45 councilmember we understand question
23:46 about the amendment timing how do you
23:49 see that inter playing with potential
23:54 tasks or activities for the TVD we were
23:59 you know should we form this then we
24:03 would we could we could identify one to
24:06 three specific projects and say let's
24:09 let's go forward with a plan on how to
24:12 fund those there may be their unfunded
24:14 portion right now in our capital
24:17 improvement plan how do you see this
24:20 this date certain for this more
24:22 comprehensive
24:24 question-how it may are you intending it
24:27 to affect the actual course of action
24:30 and the options and the timing of the
24:33 options for the DVD yes it is motion
24:38 maker so one make sure is for making out
24:40 for administration well yeah I mean my
24:46 my fundamental concern is that as I've
24:50 stated before we have the most
24:51 regressive tax structure west of the
24:54 Rocky Mountains we have more regressive
24:56 tax structure than Idaho and sales taxes
25:00 aren't as bad as head taxes or tabs but
25:03 they're there at that end of the
25:05 spectrum and so I'm hoping that we will
25:07 develop a comprehensive funding strategy
25:09 that has both progressive and less
25:12 progressive elements to it rather than
25:14 relying just on the expedient but ultra
25:16 progressive form of sales tax so I'm

25:43 then in this this motion and so my
25:47 question is so if the administration
25:49 doesn't deliver the comprehensive
25:51 funding material by the end of June does
25:55 that unravel this adoption of this
25:57 amendment or of this ordinance the ideas
26:06 I just don't like them together great so
26:09 I'm gonna call a friend likely a lawyer
26:12 friend to address this one it's Jim if
26:18 they are made as the same motion then
26:20 yeah motion is amended then you're
26:23 voting on both issues at once and if you
26:26 disagree with one then that would be a
26:30 problem for voting on both of them in
26:32 the same way you could separate them
26:34 into two motions if you wish to do that
26:37 the two are related but not necessarily
26:41 dependent upon one another at least
26:43 perhaps from mr. Marta's standpoint they

29:36 agreed on this last time we were the

29:41 you're trying to do it's not quite
29:42 getting there for me first of all we
29:45 talked about regressive taxes and a
29:46 total agreement with with that part of
29:48 it but I do think also that we're just
29:52 not there yet I don't think there's been
29:54 public involvement before we go to
29:57 setting up a taxing district and that's
29:59 my big hang-up is we're setting up a
30:01 taxing district before you've done that
30:03 so a little bit of the cart before the
30:04 horse I think there needs to be a lot
30:06 more of public involvement before we
30:08 take this step and the timing of
30:11 something still says we've taken this
30:12 step and that says we're still going to
30:14 do that but it doesn't get to anywhere
30:16 I'm saying the public really wants us to
30:17 set up this transportation district so I
30:20 I understand what you're trying to do
30:22 but but it doesn't quite get me there
30:24 because I'm we're back to progressive
30:26 taxes and not enough debate discussion
30:28 before we start have the authority to
30:31 impose taxes because once you set up
30:33 that district the authority is there to
30:35 impose taxes and do that so I can't get
30:37 there yet any other councilmen
30:39 councilmember Goodman I have a question
30:43 about a question before was does it
30:48 doesn't speed up anything does it does
30:50 it delay any plans the administration
30:52 had if we were to establish the TBD to
30:54 come forward with earlier projects or
30:58 was the plan to hopefully get a tool in
31:01 place so that we could use it in the
31:03 future if there was a decision by the
31:05 council sort of a different question
31:09 sure that we have not yet discussed
31:12 timing on bringing forward you've acted
31:15 on the capital improvement plan for the
31:17 year so that's our short-term focus is
31:22 implementing those projects that long
31:24 term discussion about how to fund the
31:28 overall transportation plan is one
31:30 that's been ongoing
31:31 I think we'd love to try to bring
31:33 recommendations to you as quickly as
31:35 possible we have some projects in in
31:39 short-term that still lack some funding
31:42 or partially funded projects in our CIP
31:45 so that would be the next area focus for
31:48 us would be to fill provide some
31:51 opportunities to fund those near-term
31:53 projects okay so it doesn't change
31:57 anything and so respectful of told us
32:02 concern I at this point I would support
32:05 the amendment
32:07 that's my beret I think it
32:11 councilmember President Marx's idea our
32:15 motion to direct the city staff is is
32:18 solid I think it is good business
32:20 practice I think is something we should
32:22 have before making just decisions about
32:24 revenue so I am fully supportive of this
32:27 motion councilmember a anymore
32:29 councilmember comments discussion if
32:33 there is no further discussion all those
32:35 in favor of the motion to direct city
32:37 administration and the council's ad hoc
32:39 long-term financial committee to propose
32:41 a comprehensive funding strategy for
32:43 transportation capital projects for the
32:46 full City Council's consideration by
32:48 June 2018 please signify by saying aye

33:38 know we've had you three at least
33:41 meetings on this and I've said several
33:43 times that I support this because it is

33:49 city there's no funding that would take
33:54 place now that those are for future
33:56 decisions but I fully support providing
33:59 flexibility for our transportation
34:02 projects or which we do need funding and
34:06 we may choose to use this tool later on
34:08 but that's a decision to be made in the

34:18 with establishing this special-purpose
34:22 district does add to the options that we
34:25 can consider and potentially propose in
34:29 that June time frame without it we would

36:03 my name is Bruce temple and I live at
36:07 102 Burr Ridge Way Northwest within the
36:11 talus development
36:12 I'm a resident Lovisa PO my comments are
36:15 primarily about health which is
36:17 understandable given that I'm a retired
36:19 physician and who's passionate about our
36:22 Issaquah Alps in which I regularly hike
36:24 there's a substantial amount of ongoing
36:28 parcel development here and I have no
36:30 doubt that the council spends
36:31 considerable time evaluating as it must
36:33 the many associated engineering aspects
36:37 for roadways retaining walls house sites
36:39 and related services my concern relates
36:43 to the health aspects of any associated
36:45 loss of green spaces and forests and I'm
36:48 not alone in this the regional open
36:51 space strategy for the central Puget
36:53 Sound region states we cannot afford to
36:56 underestimate the importance of open
36:58 space in supporting human health and
37:00 goes on to say that would despite 40
37:03 years of evidence the benefits of health
37:06 are often not part of the planning
37:08 efforts I ask Ken konigsmark about this
37:11 and the substantial and growing
37:13 literature on the health benefits that
37:15 open green spaces and forests provide he
37:19 responded that in addition there are
37:21 also other studies that show the
37:23 enormous value of ecosystem services
37:25 provided by forests and open spaces such
37:28 as clean and accessible drinking water
37:30 flood control and air quality etc to
37:33 which I would add landslide avoidance
37:36 and mitigation of stormwater runoff
37:38 which is so necessary for our iconic
37:41 salmon after having replaced the open
37:44 spaces with homes and streets these
37:47 ecosystem services functions have to be
37:50 replaced with human measures such as
37:52 water filtration dikes and other
37:54 engineered means the costs of these are
37:57 immensely greater and require ongoing
38:00 operations and maintenance expenditures
38:02 that never end
38:03 I provided a sampling of studies for
38:06 your reference that describes the
38:08 substantial benefits of health of open
38:11 spaces and wood land forests
38:13 one of these from the Department of
38:15 Environmental Conservation of New York
38:17 State lists eight benefits of forests
38:19 with the relevant references from the
38:22 scientific literature ranging from the
38:24 boosting of the immune system to
38:25 lowering blood pressure reducing stress
38:27 etc I would commend the council's
38:31 perusal of this representative sample
38:33 from the science literature and hope
38:35 that you will be encountered to always
38:37 incorporate the potential health
38:39 benefits of green spaces and woodland
38:41 forests into your future evaluation of
38:44 proposed developments I thank you thank
38:47 you mr. Hampel forty to fifty people in
38:51 the audience have raised their hand to
38:53 show support for the speaker's comments
38:54 if you have written copies of your
38:57 comments please drop them off with the
39:00 clerk at the end of your turn at the
39:01 podium and the next speaker ed hansen
39:07 counsel I'm ed Hansen I reside at Timber
39:11 Ridge 110 Ridgeway and Issaquah I'm
39:16 president of the resident Council there
39:19 of about 425 residents and most recently
39:24 you might expect what might be occurring
39:27 there with people who have acknowledged
39:30 the fact that the moratorium has gone
39:34 away and that settled the agreements of
39:37 surrounding Timber Ridge are no longer
39:41 in existence so there's some degree of
39:43 concern and I might say anxiety about
39:46 what happens now and I think my comment
39:49 so basically oriented toward maybe what
39:52 what happens now and and maybe hope that
39:55 maybe you think about some of these
39:56 things that I mentioned the population
39:59 they are as very versatile and as a wide
40:04 range of professional backgrounds that
40:08 we have there and people there have
40:10 lived all over the country and in
40:12 various places so they have a pretty
40:14 broad spectrum of what what's happened
40:17 and some of the discussions I've had and
40:19 had
40:20 do with their experience with city
40:22 councils and cities and towns that they
40:25 lived in and I'll just share with you a
40:27 little bit of what what some of the
40:29 feedback I got on that these experiences
40:34 basically had basically to regard to
40:37 land entitlements zoning building
40:41 heights floor area ratios and road
40:44 access
40:46 they've been remarkably similar I think
40:49 and the people I've talked to residents
40:51 come in an appeal for fair balance and
40:55 considering proposals to develop land
40:57 parcels which are seen as open space
41:00 green belts unbuildable locations due to
41:06 terrain contours the presence of family
41:10 trails through wooded areas and I would
41:15 think roads that are already crowded as
41:18 well so people who've come here to live
41:20 from all over the country see this and
41:22 over and over and these cases as well as
41:26 what they see here they've found out
41:29 that a council can be persuaded that a
41:34 good chain saw a bulldozer and
41:38 outstanding retaining wall contractor
41:42 can make almost any parcel of land
41:44 buildable and for that reason it becomes
41:48 very as we know very attractive to a
41:52 developer likewise the addition of a
41:54 stop light what would be another way
41:56 well I remember your former mayor Fred
42:00 the butler who came to Denver Ridge
42:05 several times and he would listen to
42:07 some of our concerns and he would always
42:09 not his head in agreement and and would
42:12 give a very favorable approach but he
42:15 always said and I thought this was very
42:17 important and I was glad I'm persuaded
42:20 to agree but I have to tell you he would
42:23 say that when I take these issues back
42:25 to the City Council
42:27 they often changed my mind
42:30 and I think that just wrap it up mr.
42:32 Hanson sir again if you could wrap it up
42:34 with a concluding statement I'm finished
42:37 at the present time anyway I think
42:39 that's sort of the foundation of our
42:41 concerns and we really understand your
42:44 challenge during this year and we're
42:47 grateful very thankful for your service
42:49 thank you

43:33 Sheriff will be buried and his funeral

44:43 veteran at the Holman National Cemetery
44:45 that has no family one remaining family
44:49 member is dying of cancer in a hospital
44:52 and will not be able to attend
44:54 so our VFW post will be there to bury

45:48 12:20 awkward place northwest Issaquah
45:52 well I'm here tonight for the same
45:55 reason of everyone is here I believe
45:59 he's a guar is a unique historical
46:02 culture and natural heritage located in
46:07 the he's a co helps cougar Munter park
46:11 service in part why the life habit while
46:15 offering ample opportunities for
46:19 recreation we needed to preserve and
46:22 stay behind other more dense soil
46:27 vegetated area of the park away from the
46:31 side and the sons of a nearby urban area
46:36 regularly see a the cooker cooker monden
46:42 along with a wider life such as black
46:46 bear bobcats and many birds and other
46:51 species
46:53 we needed to save the importance of the
46:56 culture and be more responsible to the
47:01 natural heritage located in the hyssop
47:04 ahab's I am a proud resident of hosaka I
47:09 came from the bigger huts and I find the
47:13 little hearts I I invite all of you to
47:19 to save Kruger mountains we need we need
47:26 a fresh air we needed to restore the
47:30 land the way the way it is for long for
47:35 a long time so please save a coger
47:37 mountains thank you miss conforte a
47:41 large raise of hands everybody that's
47:44 here raised their hands miss wall I'm
47:50 Janet wall and I live in the over Dale
47:52 Park neighborhood at 2-2 seven-four-zero
47:54 South East 56th Street after having read
47:58 the geotech report by Reilly I feel that
48:02 the proposed development of the Bergsma
48:04 property would be a grave mistake I have
48:07 learned a lot about landslides and
48:09 retaining walls since moving to Issaquah
48:11 23 years ago at the end of my driveway
48:14 there is a 40 foot retaining wall put in
48:17 by the Sammamish Water District to help
48:20 protect the water tower that was not the
48:23 original wall an earlier wall had
48:26 collapsed because there was inadequate
48:27 drainage from behind the wall and it
48:30 caused a major landslide which went half
48:32 way down the hillside fortunately there
48:35 weren't any homes directly below when
48:37 that happened years later a housing
48:40 development did come in below the water
48:42 tower
48:42 but the drainage they put in was not
48:45 adequate residents complained that their
48:47 marshy lawns so dish they complained
48:50 about their marshy lawns so additional
48:52 drainage was put in which deposited
48:54 stormwater on the steep slope itself I
48:58 investigated and found out that the
49:00 additional drainage was put in without a
49:02 permit yet I couldn't get anyone from
49:05 the city to be concerned about it
49:07 until the near collapse of a retaining
49:09 wall further down the hillside the
49:13 residents of Park Hill apartments were
49:15 given 15 minutes in the middle of the
49:17 night to evacuate their apartment
49:21 building because the be the retaining
49:24 wall above was giving signs of
49:26 collapsing the wall had to be replaced
49:30 and was giving sigh the wall had to be
49:32 replaced in the drainage from the
49:35 development above was tight lined at
49:38 their expense the geotech report for the
49:43 Bert's Mott property indicated that
49:45 there are layers of sand and gravel
49:47 above impervious impervious soil
49:50 probably clay creating perched
49:53 groundwater in places when that occurs
49:56 on a hillside it can be a recipe for
49:58 disaster
50:00 especially when trees are removed and
50:02 the ground disturbed clearing the Heat
50:04 trees which soak up water and stabilize
50:07 the hillside with their roots
50:09 exasperates
50:10 the issue we've all heard recently what
50:13 happened in the Santa Barbara area when
50:15 the tree canopy was destroyed by fire
50:18 and lives were lost when the hillsides
50:21 turned to mud and destroyed the homes
50:23 below it was a clear example of how
50:26 important trees can be in stabilizing a
50:28 hillside I don't believe it's a quiet
50:31 present has the staff expertise to
50:33 properly evaluate and inspect
50:35 construction activities on steep slopes
50:37 to prevent landslides from happening on
50:40 this site look what happened recently at
50:43 Allis the geotech report had numerous
50:47 cautions about construction activities
50:49 one of the things that mentioned that
50:51 advised proof rolling and you Janet if I
50:56 could get you to conclude that would be
50:58 great okay so I I really feel that we
51:02 should learn something about the history
51:03 of landslides that we've had in the area
51:06 see whether there is other methods of
51:09 preserving this land using possibly the
51:15 tdq transfer of development rights or
51:20 other methods
51:21 raising funds to compensate the owners

51:40 the Sammamish Point community thank you
51:44 for taking the consideration of our
51:45 neighborhood to not develop the bergna
51:48 Hill so much Issaquah for me as a fairly
51:54 recent resident is tied to the the
51:58 visual beauty of the hills around and
52:00 the hidden development tucked here and
52:04 tuck there that starts stripping away
52:07 the hillside so close to the visual
52:11 corridor that you've taken so much time
52:14 to preserve I think this is just you
52:19 know the first straw to ruining is a
52:23 quarte to what it could be and continue
52:25 to be and thank you for considering that
52:29 keep the keep the trees thank you thank
52:33 you very much all hands up
52:36 I appreciate the speakers who have come
52:38 so far we've heard about health concerns
52:41 drainage concerns and protection of
52:43 trees is Tina our to show there are
52:46 others on the list there are next we

53:25 development eight nine zero lingering
53:27 pine lane northwest and speaking as a
53:30 residence I heard earlier during
53:35 petitions for applying for the council
53:37 position how awesome your
53:39 responsibilities are because the
53:40 decisions you make affect the community
53:42 not this year but 20 30 40 maybe even 50
53:45 years from now and what I found is that
53:49 there's a outspoken community here
53:51 willing to work to preserve some of this
53:53 and some of the most recent ideas were
53:56 like participating in land conservation
53:58 advisory groups where King County is
54:01 working with cities to preserve over
54:03 sixty thousand acres of high
54:06 conservation value lands including farm
54:08 lands nature's trails the Bergsma
54:11 property is arguably considered some of
54:14 that high-value land the King County
54:17 effort also includes potential funding
54:20 sources which may allow for an equitable
54:24 distribution the only negative is of
54:28 course it requires action from the
54:30 council and it won't happen
54:31 automatically and unlike a developer
54:33 they don't come calling on a regular
54:34 basis to do something the negatives of
54:37 building the 57 homes have been talked
54:41 about a number of times but just quickly
54:42 you know it's misaligned with the plan
54:45 vision of everything from the growth
54:47 management act Mountains to sound
54:49 greenways the King County lands
54:51 conservation initiatives you know just
54:53 the whole large clearing large sections
54:55 of visible growth and arguably it's not
54:58 even in line with the a comprehensive
55:00 plan for reducing sprawls and protecting
55:02 the environment or creating pedestrian
55:04 friendly communities again arguably it's
55:07 not even within its supposed own design
55:09 standards in the green edge of acquiring
55:12 it's already been talked about at least
55:14 once the risky development 50 percent of
55:17 the land is high-risk slide potential we
55:19 have very adjacent land immediately
55:21 adjacent that has slid before and within
55:24 eyesight of that Heslin there's been a
55:28 home damage on land very similar to that
55:31 additionally the amount of development
55:34 here is just unbelievable in some ways
55:36 you're talking about eighty eight
55:37 hundred truckloads you know ten minutes
55:40 twelve hours a day is a hundred twenty
55:42 days just think about how much the land
55:44 is getting displaced and the argument
55:46 that there may not be any slides is
55:48 almost laughable critical areas are
55:50 being affected it's a twenty seven acres
55:52 of wetland stream slopes two of three
55:55 streams are being crossed two of six
55:57 wetlands are being filled in all that's
55:59 been talked about as of yesterday the
56:02 variances are not listed on the State
56:04 Environmental Protection Act site
56:05 obviously it decreased the safety of
56:08 continually interrupting any potential
56:10 trails or pads or anything with more
56:12 cars and development and and not really
56:16 aligned with the sequester survey again
56:18 of loving of the environment and
56:21 complaining about traffic so that's what
56:23 the fifty seven homes buys you the
56:26 alternative is a little action on the
56:28 council side thank you thank you very

57:13 should be given emergency acquisition
57:15 funding status the city has many funding
57:22 requirements and priorities we
57:24 understand that and we respect that but
57:28 looking ahead five twenty fifty years
57:31 from now how many of those funding items
57:34 will seem as important as the loss of
57:37 our forested hillsides and the prominent
57:39 scar that's going to be left on Cougar
57:42 Mountain and the Gateway to the Issaquah
57:46 elves we ask you to consider the Bergsma
57:51 windward plat as an emergency
57:53 acquisition is it late in the
57:56 development process yes is it going to
57:59 be costly yes but maybe this is the
58:02 price we have to pay for having no teeth
58:04 in our vision and here's the higher
58:08 price that we'll pay a much higher price
58:11 in addition to the permanent loss of the
58:13 current view shed there will also be a
58:15 complete clear-cutting of 22 acres of
58:18 tree canopy in a critical area a 12%
58:21 access road that gains 350 feet in
58:24 elevation through the property over a
58:26 thousand feet of retaining wall is up to
58:28 20 feet in height and for water
58:29 retention vaults 14 acres of site
58:32 grading through 40% slopes the removal
58:35 of 88,000 cubic yards of the mountain
58:38 2:06 wetlands filled in and stream
58:40 buffers reduced a major removal of
58:42 existing forests along Newport Way homes
58:45 perched right on the edge of previously
58:46 heavily wooded slopes the addition of a
58:49 hundred cars and 543 daily vehicular
58:52 trips along newport a slight to this
58:55 neighborhood already deluged with the
58:57 coming five hundred and seventy two
58:58 units of new housing with over a
59:00 thousand additional cars and over 3500
59:03 added daily vehicular trips this would
59:06 also be the loss of a truly rare
59:08 opportunity to connect mass transit to
59:10 an urban trail that had
59:11 cougar Mountain leave your cars in the
59:13 highlands or anywhere in the region and
59:15 take a bus to the trailhead we are all
59:19 stewards of the land and environment in
59:21 Issaquah but the City Council and staff
59:24 are the leaders of the stewardship
59:27 please consider the Bergsma windward
59:29 plat and emergency as well as a great
59:32 opportunity for the city put together
59:35 the staff citizens elected officials
59:38 regional groups form a reader group seek
59:41 out partnerships partnerships explore
59:44 all the pieces of the financial puzzle
59:46 together quickly so that this
59:48 opportunity is not lost thank you thank

1:00:10 to the Bergsma windward development as
1:00:12 Bergsma and I've spent the last year
1:00:14 trying to figure out how the Bergsma
1:00:17 property application for development was
1:00:20 even approved it has been an interesting
1:00:22 yet frustrating journey in my research I
1:00:26 became acquainted with the comprehensive
1:00:28 and central Issaquah plans the city put
1:00:31 a huge amount of time and resources into
1:00:35 creating these plans which established
1:00:37 the city's future vision and policy
1:00:39 direction but how does the Bergsma
1:00:43 proposal line up with these plans it is
1:00:46 my belief they do not this development
1:00:50 is in direct opposition to concentrating
1:00:52 density on the valley floor which is one
1:00:56 of the primary issues stated in the
1:00:57 comprehensive plan so how did this
1:01:00 happen during a recent meeting I had
1:01:03 with city staff concerning his property
1:01:05 I asked a city planner
1:01:08 how will they insure cougar Mountains
1:01:11 tree canopy and tree retention will be
1:01:14 in compliance with the comprehensive
1:01:17 plan and I was told by this staff person
1:01:20 he explained that they are bound by the
1:01:23 zoning laws
1:01:24 in land-use codes associated with the
1:01:28 property the zoning laws bind them the
1:01:32 comprehensive plan is only a guide so
1:01:37 going forward what is the city doing to
1:01:40 protect our forested hillsides
1:01:42 developers will never build to meet a
1:01:44 vision they build to meet meet required
1:01:47 codes and standards and they build to
1:01:49 maximize their profit when will City
1:01:52 Council update our land use codes to
1:01:55 meet our vision until then it is up to
1:01:58 you to protect our forests to do sides
1:02:00 and preserve our Issaquah gateway and
1:02:02 view shed thank you Thank You Susan

1:02:13 good evening and I'm also speaking about
1:02:17 the Bergsma windward property and we've
1:02:21 heard about many of the problems with
1:02:24 the Bergsma property and some of the
1:02:26 frustrations and limitations in trying
1:02:28 to work with the city and its codes I
1:02:32 would like to talk about some solutions
1:02:35 my belief is the best use of the 45
1:02:38 acres is for public open space because
1:02:41 the Bergsma property is special this is
1:02:45 one of the last parcels of forested
1:02:48 cougar mountain hillside in Issaquah
1:02:51 acquiring the property would be
1:02:53 consistent with the vision of the
1:02:55 Comprehensive Plan by the city taking
1:02:58 the lead to protect this land we will
1:03:01 keep the northeast corner of Cougar
1:03:03 Mountain forested and open to the public
1:03:06 this parcel is just steps away from the
1:03:09 Issaquah Transit Center and accessible
1:03:12 to many residents the Bergsma property
1:03:16 connects to existing city and county
1:03:18 open space and by acquiring the property
1:03:22 and providing the link to the existing
1:03:25 open space it allows for safer
1:03:27 activities to those utilizing our trails
1:03:31 so in addition
1:03:35 so the solution is in purchasing the
1:03:39 property and I am bringing forth a few
1:03:42 funding options in addition to applying
1:03:46 for numerous grants that are available
1:03:48 through King County the city has
1:03:50 excellent credit and could consider
1:03:52 selling bonds or using bank credits
1:03:54 acquiring Bergsma could be excuse me
1:03:59 acquiring Bergsma should provide the
1:04:01 city with TDRs that could help fund the
1:04:04 acquisition but when the city gives out
1:04:07 free up zones the TDRs lose their value
1:04:11 it is our understanding that the city
1:04:14 excuse me that King County is interested
1:04:17 in partnering with the city please step
1:04:20 up show initiative creativity and a
1:04:24 willingness to work with others Issaquah
1:04:28 is not an isolated island members of
1:04:31 Issaquah and surrounding cities such as
1:04:34 Seattle Bellevue Sammamish Snoqualmie
1:04:37 Ridge have expressed support let's
1:04:41 accept their help it feels like the
1:04:45 residents of Issaquah are not being
1:04:47 heard and there is not a serious effort
1:04:49 by the city to acquire and protect this
1:04:52 area as open space we want to know are
1:04:56 you doing anything and if so what thank

1:05:40 a resident of Cougar Mountain and so I'm
1:05:42 speaking as a resident my first time do
1:05:46 not have polished notes my 9 year old
1:05:48 actually asked me to come tonight he
1:05:50 looks around almost every day and asks
1:05:52 why are they tearing down more trees why
1:05:55 are we not stopping all the destruction
1:05:58 of our forests and of our mountain and
1:06:01 so I'm really here on his behalf
1:06:04 supporting him completely to ask you to
1:06:07 consider the future generations that
1:06:10 will be in Issaquah and our communities
1:06:11 and to please do everything within your
1:06:13 power to maintain as many green spaces

1:06:36 development and construction along
1:06:38 Newport Way which is west of State Road
1:06:41 900 current construction projects are
1:06:44 underway and others are in the pipeline
1:06:46 we don't know yet the impact it will
1:06:49 have on the traffic and the neighboring
1:06:50 community therefore please put a hold on
1:06:53 any new projects that are in the area
1:06:55 including the Bergsma when we're
1:06:57 property thank you Joe

1:07:11 Newport Way Northwest is a main
1:07:14 east-west thoroughfare into Issaquah and
1:07:19 out of this aqua that is not the i-90
1:07:22 freeway but parallel is a freeway should
1:07:27 there ever be a slide
1:07:32 on Cougar Mountain that comes down
1:07:36 across Newports way that would be a
1:07:41 major impact on the city not just for
1:07:45 the residents we have to figure out how
1:07:47 to get out of the Newport Way area but
1:07:52 to our past through traffic and then
1:07:59 we'd end up being listened to watched on
1:08:03 world television and news and that
1:08:07 wouldn't be good for us so I don't
1:08:09 begrudge the birds my family and the
1:08:11 Windward Development Corporation they
1:08:15 took their risk they were betting on to
1:08:18 come but I'd sure like to see the city
1:08:21 in the county step up the pace to
1:08:24 acquire the property for the use of the
1:08:27 public thank you thank you Joe all hands

1:08:46 hello my name is Teresa Marx I live at
1:08:48 to 500 third Avenue Northeast I'm
1:08:51 actually an aqua city resident but I'm
1:08:54 speaking on behalf of the Eastside
1:08:56 Audubon Society you may not know that we
1:08:59 connected we conducted a survey in the
1:09:02 area around the Harvey Manning Park from
1:09:04 November of 2015 to September of 2016 we
1:09:09 followed 1.5 miles of trail and we were
1:09:12 asked at that time to conduct the survey
1:09:14 because of development that was
1:09:15 happening on the nearby parcels of land
1:09:17 during this survey we had experienced
1:09:20 team members that noted all birds seen
1:09:22 or heard as they walked along those
1:09:24 trails they did a total of 10 walks over
1:09:28 the eleventh month period over this
1:09:31 period of time they found 43 species of
1:09:33 birds 15 of which were year-round
1:09:36 residents 14 were migrants and 14 either
1:09:40 visited or flew over the site while they
1:09:42 were there a total of 22 species were
1:09:45 seen in the area on just one day in May
1:09:48 during the breeding season breeding
1:09:51 birds were confirmed by presence of
1:09:53 breeding pairs male singing on territory
1:09:56 adults feeding young active nest and
1:09:59 nesting behavior breeding birds
1:10:01 consisted of both resident and migratory
1:10:03 species nesting birds used the entire
1:10:06 forest area from the ground to the
1:10:08 understory to the canopy 13 species were
1:10:12 thought to be breeding in the area and
1:10:14 these included the hairy woodpecker the
1:10:16 Pacific slope fly catcher the backed
1:10:18 capped chickadee the Pacific wren the
1:10:20 chestnut backed chickadee the brown
1:10:22 creeper the brown crowned kinglet the
1:10:25 American Robin the back floated grey
1:10:27 Warbler Wilson's Warbler dark-eyed junco
1:10:29 z-- and spotted toe he's my grits found
1:10:33 at the site who may have used the area
1:10:34 as a stopover include the olive sighted
1:10:37 flycatcher
1:10:37 the Western wood peewee the violet green
1:10:40 swallow the warbling very very oh the
1:10:42 orange crowned Warbler and the Western
1:10:44 Tanager black-headed grosbeak and the
1:10:46 purple finch
1:10:47 most of these were seen in the spring
1:10:50 because migration patterns in the fall
1:10:52 require a little bit different route for
1:10:54 them in order to find foraging they also
1:10:56 noted that a
1:10:58 King County regulated wildlife species
1:11:00 the bald eagle was seen flying near the
1:11:02 park in both April and July due to the
1:11:05 difficulty in seeing and hearing birds
1:11:07 in the forest the team that did this
1:11:09 survey considered the results of this
1:11:11 survey to be an undercount of the
1:11:13 numbers of birds in the area the flora
1:11:16 in the area consisted of big leaf maple
1:11:18 western red cedar Western hemlock and
1:11:21 dumb list Douglas fir with native shrubs
1:11:23 planted near the landscaping of the park
1:11:27 these surveys were all reported online
1:11:30 to eBird and online database and we did
1:11:33 this survey to hope that this
1:11:34 information can assist in future
1:11:36 land-use decisions including what will
1:11:39 happen to the Bergsma property as an
1:11:41 organization whose mission is to protect
1:11:43 preserve and enhance natural ecosystems
1:11:45 on our communities for the benefits of
1:11:47 birds other wildlife and people
1:11:48 we support open space green space and
1:11:51 limited development in natural areas
1:11:54 thank you very much Teresa all hands

1:12:04 ten years now so first of all thanks to
1:12:07 the 13 people put their had a name and
1:12:09 consideration for this new council in
1:12:11 addition that though there's all kinds
1:12:13 of opportunities to volunteer for the
1:12:14 city and I just done City Council
1:12:16 Commission's boards committees coming to
1:12:20 and speaking your mind before the City
1:12:22 Council to say you know what you think
1:12:23 so this is more of a plug for everybody
1:12:25 in the audience please get involved with
1:12:26 your city
1:12:28 second topic on January 10th I had the
1:12:30 opportunity to attend a presentation at
1:12:33 the Issaquah Senior Center on group
1:12:36 called hero house which is a
1:12:38 organization that does community meeting
1:12:42 places and there's one here in Kirkland
1:12:45 factorio in Bellevue and one in Seattle
1:12:48 but a sudden international organization
1:12:49 where people with diagnosed mental
1:12:51 illnesses can come and work on daily
1:12:53 maintenance activities not just have
1:12:57 meals but plan the meals make the meals
1:12:59 hospitality I think was a great chance
1:13:01 for the city to have an opportunity
1:13:03 where people could come and meet and
1:13:04 learn about this opportunities I want to
1:13:06 say thanks to zoo quest Senior Center
1:13:08 and for the
1:13:09 for making that opportunity available
1:13:11 lastly on saving Cougar Mountain I
1:13:15 support the idea but I think if there
1:13:16 ever a poster child that says there's a
1:13:18 piece of property that we don't want to
1:13:19 develop it would be Bergsma property so
1:13:22 I think we need a firm look at city code
1:13:24 enforcement and changes that say and
1:13:26 prevent this from happening not just
1:13:28 having to use the city funds which are
1:13:31 limited for the broader scope I support
1:13:34 the preservation I just think we need to
1:13:35 be thinking 5 10 30 years down the road
1:13:38 and making that happen thank you thank

1:13:51 those who came tonight and spoke about
1:13:53 Save Cougar Mountain we have heard about
1:13:55 health concerns drainage preservation of
1:13:57 trees working with land conservation
1:13:59 groups cooperatively that Bergsma
1:14:03 proposal is not in line with the
1:14:05 Comprehensive Plan vision and goals it
1:14:06 has impacts to critical areas a request
1:14:09 for emergency city funding the desire to
1:14:12 protect forested hillsides open space
1:14:15 designation being the best and highest
1:14:17 use for this property the enjoyment of
1:14:19 future generations the concern of
1:14:21 development pacts on existing
1:14:23 neighborhoods the concern of slides on
1:14:25 existing neighborhoods and safety and
1:14:27 road closures and the effects on
1:14:28 wildlife if there is anyone else who has
1:14:30 not signed up and would like to add to
1:14:32 this list of items that you've presented
1:14:34 to Council tonight I see two hands I'm
1:14:38 actually gonna start with Linda and then
1:14:41 I'll get to marina I'm Melinda Shepherd
1:14:50 at 1 4 9 8 5 to 56 Avenue southeast
1:14:55 Issaquah I'm in miramont so I'm not a
1:14:58 resident of Issaquah but I identify
1:15:03 myself with Issaquah and I spend a lot
1:15:07 of my time in Issaquah both hiking and
1:15:10 shopping so supporting business in
1:15:11 Issaquah the riley geotech report has
1:15:15 numerous cautions about construction
1:15:17 activities after removing trees it
1:15:19 advised proof rolling and calm
1:15:22 acting the soil only during specific
1:15:24 soil moisture periods when the soil had
1:15:28 a specific plus or minus 2% moisture
1:15:30 content
1:15:31 I doubt that the city staff would be
1:15:34 able to ensure these conditions were
1:15:35 always met under our changeable weather
1:15:37 I'd like to point out that I've lived in
1:15:41 Miramon for the past thirty years and
1:15:44 the past several years three to five
1:15:47 years our weather patterns have changed
1:15:50 dramatically and we've been had we used
1:15:52 to have mist constantly all through the
1:15:55 winter and we had the rainy season and
1:15:59 then there's August now we have day
1:16:03 losses and we have much more flooding
1:16:05 than we used to so assumptions that we
1:16:08 made before about weather patterns are
1:16:11 not valid in these times do the city
1:16:18 staff know how many tests borings are
1:16:20 needed and where on this property to
1:16:22 locate perched water tables and other
1:16:25 locations of concern an original SEPA
1:16:29 determination for this property
1:16:30 recommended mount maintaining the
1:16:33 forested character of the hillsides
1:16:35 protecting and preserving the existing
1:16:38 tree canopy it is recommended the use of
1:16:42 off-site transfer of development rights
1:16:45 as a means to achieve that end we should
1:16:49 look into ways of protecting the
1:16:52 hillside to reject proposed development
1:16:54 is too risky oppose the impact of
1:16:58 endless eighty eight hundred truckloads
1:17:01 of dirt that would have to be carried
1:17:04 off adding to our traffic and congestion
1:17:06 x' you may have seen the signs along the
1:17:09 valley road that say Issaquah keep your
1:17:11 dirt so it's not making friends in the
1:17:14 community we must finally learn
1:17:18 something from the history of landslides
1:17:20 in the area the fall of the water
1:17:23 district retaining wall in and the other
1:17:28 the other cases that janet wall
1:17:31 mentioned in her talk let's not
1:17:34 underestimate the power of water
1:17:36 the difficulty in evaluating soil
1:17:38 structure and where soil conditions
1:17:41 warrant some hillsides are better left
1:17:43 forested and undisturbed thank you give
1:17:47 in to all hands and many many signs

1:18:01 nine thousand new cell theast i'm
1:18:02 representing dozens of residents along
1:18:05 may Valley Road with Issaquah addresses
1:18:08 technically south of the city limits
1:18:11 concerned specifically about trucking
1:18:14 effects from the potential bergman
1:18:17 development in addition to adding
1:18:18 support to all the other previous
1:18:20 speakers the decisions by this council
1:18:25 to ban trucks from Issaquah city streets
1:18:28 last November has had a devastating
1:18:30 effect on May Valley Road we are not in
1:18:33 your jurisdiction and County site state
1:18:36 law firm making it difficult for us to
1:18:38 restrict traffic on our Road but the
1:18:41 proposed Bergsma development has eighty
1:18:44 eight thousand cubic yards of dirt to be
1:18:46 removed we would like to ask that a
1:18:50 condition be placed on the permit for
1:18:52 the permit I guess when it's presented
1:18:55 to the Hearing Examiner that specifies
1:18:58 that may Valley Road is not a haul route
1:19:00 for the development should it go through
1:19:03 grey get from when word committed
1:19:07 verbally on October 30th that he was
1:19:10 plant or they were planning on using
1:19:11 i-90 for some dump site east but that
1:19:16 obviously is meaningless if not in
1:19:18 writing or not specified in conditions
1:19:21 so asking that a SEPA condition Council
1:19:26 resolution condition to the permit be
1:19:28 placed that me Valley Road is not on the
1:19:30 Hal route that the whole route uses SR
1:19:32 900 to interstate 90 the interstates and
1:19:35 highways are used as efficiently as
1:19:38 possible for removal and bringing in all
1:19:41 material to the site the and
1:19:48 the I don't understand how SEPA I don't
1:19:51 super resolutions can claim that
1:19:54 eighty-eight thousand cubic yards of
1:19:57 dirt can all be mitigated or that
1:19:59 trucking has no environmental impact but
1:20:01 somehow they do someone could explain
1:20:03 that to me later but second point being
1:20:08 that your current truck ordinance closes
1:20:12 most of your city streets to local truck
1:20:15 traffic but I would just consider that a
1:20:18 local construction project in your city
1:20:20 limits is local traffic and I would like
1:20:23 the city to take responsibility for
1:20:25 developments that you approve that if
1:20:28 you are collecting the money and
1:20:31 approving developments that technically
1:20:34 all of your roads are on the table for
1:20:36 any haul routes needed for those
1:20:38 developments and consider that in your
1:20:39 decisions and in summary I presented the
1:20:43 safety concerns along may Valley Road to
1:20:46 the increased truck traffic thousands of
1:20:48 gateway trucks that we saw over the past
1:20:50 year than me would middle school bus was
1:20:53 literally inches away from being
1:20:55 rear-ended by a fully loaded tandem dump
1:20:57 truck on May 5th and on July 11th the
1:20:59 semi truck rolled over on the road I'm
1:21:02 just a few hundred feet from the Liberty
1:21:05 High School bus stop and not on my belly
1:21:08 Road but I'm sure we're all aware
1:21:09 December 28th the truck rolled over on
1:21:13 State Road 900 and that was a driver
1:21:15 admittedly was supposed to see on the
1:21:18 interstate and took SR 900 as a shortcut
1:21:22 and was driving too fast and the road
1:21:23 was closed for I believe almost eight
1:21:25 hours so thank you for the consideration
1:21:29 lots of hands lots of signs is there
1:21:32 anyone else who would like to provide
1:21:34 some comments or additional information

1:21:57 you mayor councilmembers I think you
1:22:00 have a rare opportunity ahead of you
1:22:02 right now and that's to make a
1:22:03 difference what it's going to requires
1:22:04 you to step up and make a difference
1:22:06 right now you have a vision for Issaquah
1:22:10 and a zoning code that the don't align
1:22:13 they don't intersect and that's why
1:22:15 these projects keep coming up right now
1:22:18 your your vision is really written on
1:22:21 paper and it's not really your culture
1:22:23 in order to have a culture it's got to
1:22:26 be a belief it's got to be followed by
1:22:28 behavior then that produces an effect
1:22:30 that becomes your culture and that gets
1:22:32 the results we're looking for it's a
1:22:34 quad developed the way it's written on
1:22:36 paper so I I passed by a landslide
1:22:40 anywhere from two to six times a day
1:22:43 that has a nickname to it it's called
1:22:45 shower curtain Hill because it's covered
1:22:47 in a shower curtain so if you want to
1:22:50 know how long a landslide takes to
1:22:52 resolve that happened I was in the
1:22:54 council meeting when that was with that
1:22:56 when that was approved and the City
1:22:58 Council said that this is something
1:22:59 that's going to be a sound decision
1:23:02 it's got sound engineering twenty six
1:23:04 months later it's still covered by
1:23:06 shower curtain
1:23:07 I urge anybody to go up to that hill and
1:23:10 see what it takes to stabilize a hill
1:23:12 the engineering is unbelievable so
1:23:15 please look at this partner with King
1:23:18 County and make this an acquisition

1:24:57 after the Hearing Examiner made his
1:24:59 decision and the property owner will
1:25:06 still fight you but you have a chance to
1:25:09 rethink the city's position that's a
1:25:14 beautiful piece of property it has woods
1:25:16 on it that are holding back water which
1:25:19 when they're removed will run down into
1:25:22 the residential areas across the road
1:25:29 some of what they've just said about

1:26:55 before this and it's very difficult
1:26:56 sometimes to deal with the noise and
1:27:00 confusion that the city can bring and I
1:27:01 think that it's very important for
1:27:03 people to have a space like cougar
1:27:05 Mountain to remain wild and for there to
1:27:09 be a place for people to go for a sense
1:27:11 of health and well-being like was talked
1:27:13 about earlier so I'd like you to
1:27:16 consider that thank you thank you very
1:27:19 lots of hands up in the air anyone else

1:27:35 do I would like to thank all of the
1:27:38 people who came tonight I tracked about
1:27:40 six different items that were discussed
1:27:42 but by far and away the save Cougar
1:27:45 Mountain group of speakers had almost 20
1:27:48 people providing comments to council
1:27:50 today I appreciate that you covered a
1:27:53 long and extensive list of issues and
1:27:55 concerns and thank you for bringing that
1:27:57 to the council this evening thanks to
1:28:00 everybody who came in we are going to
1:28:02 move on to their regular busy
1:28:04 portion of our meetings so if you're not
1:28:06 staying for that exciting and riveting
1:28:08 part I would ask if you could hold your
1:28:10 conversations until you get outside so
1:28:13 that we can continue with the business
1:28:14 meeting thank you very much the next
1:28:17 item on the agenda this evening is
1:28:19 committee and regional reports and we'll
1:28:21 start with councilmember Rea nothing to
1:28:24 report this evening Thank You
1:28:25 councilmember Ramos
1:28:26 thank you I'll try to make this quick on
1:28:30 the 10th of January we had my emergency
1:28:34 management advisory council meeting and
1:28:36 we're setting up next week or next month
1:28:38 I say on the 14th of February
1:28:40 Valentine's Day to have a full-day
1:28:42 workshop for the council to work on
1:28:46 resiliency and preparedness and that
1:28:48 coordination across the county last
1:28:52 Friday the 12th I was a did Eastside
1:28:54 transportation I think the other council
1:28:57 members are having hard time sold off
1:28:59 take a couple minute break and let
1:29:01 everybody so we'll just recess for a
1:29:04 couple minutes so everybody's gone
1:30:37 we're back in session and council member
1:30:40 Ramos if you want to begin over with
1:30:42 your regional and community reports that
1:30:44 would be great
1:30:44 thank you just quickly again the
1:30:46 emergency management advisory committee
1:30:48 is working on setting up a retreat next
1:30:50 month be a full day on February 14th
1:30:54 trying to coordinating in across the
1:30:56 county to better yet set things up for
1:30:57 our preparedness and resiliency so we're
1:30:59 gonna really get together spend the day
1:31:01 versus you know an hour and a half
1:31:02 meeting a month that was last Wednesday
1:31:06 was a regular meeting set up for next
1:31:07 month on last Friday was at Eastside
1:31:09 Transportation Partnership we had
1:31:11 updates on the 405 they had some
1:31:14 interesting data on how those carpool
1:31:17 lanes are working the double carpool
1:31:19 lanes and all that through mouthful and
1:31:20 so forth and interestingly enough they
1:31:22 seem to be improving that the flow that
1:31:26 they had predicted and so it's getting
1:31:27 better than it was and there's been some
1:31:29 changes of course it was helped out too
1:31:31 as well as the other item there was PSR
1:31:34 C funding coming up this next year in
1:31:35 some of the criteria so if they're
1:31:36 looking at their tomorrow I will be at
1:31:40 the regional transit committee meeting
1:31:41 continued work on development of work
1:31:43 and that'll make King County Council
1:31:44 tomorrow at 3 o'clock and that concludes
1:31:47 my report
1:31:48 Thank You councilmember we're
1:31:49 interesting thank you my first report is
1:31:51 about the lodging tax Advisory Committee
1:31:53 there is an open house or a public
1:31:56 engagement opportunity to discuss
1:31:58 tomorrow at the at 7:00 p.m. at the
1:32:02 train depot to talk about the possible
1:32:05 formation of a destination marketing
1:32:08 organization funded by the LTAC funds
1:32:11 the the committee has is making that
1:32:15 recommendation this is an opportunity to
1:32:18 hear more for members of the public or
1:32:22 anybody who's interested businesses or
1:32:24 residents to learn more about the
1:32:26 proposal and to provide feedback and
1:32:30 comments members of the LTAC will be
1:32:32 there will be a short presentation to do
1:32:35 kind of an introduction
1:32:38 and cue a question-and-answer
1:32:39 opportunity and the committee will be
1:32:44 collecting the comment and the feedback
1:32:46 making adjustments to the plan meeting
1:32:49 again to make adjustments to the plan
1:32:51 and then forwarding that a revised plan
1:32:54 in lieu of those changes back to
1:32:56 services and safety for consideration in
1:32:59 in the February meeting so that's
1:33:01 tomorrow that meeting is at 7 p.m. at
1:33:04 the train depot
1:33:04 that's LTAC and then back on January 4th
1:33:09 there was a meeting of the growth
1:33:13 management policy board and new major
1:33:21 issues or items on the agenda some of
1:33:25 you may be aware of something that PSR C
1:33:27 calls vision 2040 and that is a guiding
1:33:31 document about growth and transportation
1:33:34 evolution here in the Puget four-county
1:33:36 Puget Sound region that's so homage King
1:33:41 Pierce in Kitsap counties we're kicking
1:33:44 off a two plus year process to update
1:33:47 that vision we're calling it it's going
1:33:49 to be called vision 2050 and I've
1:33:53 formally kind of kicked off back in the
1:33:55 meeting on the 4th and the very first
1:33:57 item to complete is to actually define
1:34:00 the scope of the of the work to redefine
1:34:03 the vision so there will be am a draft
1:34:06 by february 1st will open up a 45-day
1:34:09 comment period and there will be members
1:34:13 of PSR C will be traveling around the
1:34:15 region and a number of public engagement
1:34:17 opportunities I don't have the schedule
1:34:19 or locations for that now but they will
1:34:23 be publishing that so that is actually
1:34:25 just to set the scope for this two-year
1:34:27 exercise and then the other major item
1:34:30 for discussion we continue conversations
1:34:32 about the regional centers framework
1:34:34 update and there are a number of
1:34:37 probably half a dozen outstanding issues
1:34:40 that the GMTV has not come together on
1:34:43 yet and our SCA caucus did did come
1:34:48 together on three that were actually
1:34:51 brought up during the regular meeting
1:34:53 and one of them had to do with some area
1:34:54 planning we here in Issaquah do have a
1:34:58 sub area plan that covers our regional
1:35:01 growth center but not all do and so for
1:35:04 us there isn't as much of a deal here
1:35:07 but all other existing regional centers
1:35:10 the discussion point is whether or not
1:35:13 they must complete a sub area plan by
1:35:15 2020 and so that has not been voted on
1:35:18 but that is something that we and the
1:35:20 SCA caucus supports and it's consistent
1:35:23 with what we've already done the other
1:35:25 thing has to do if is the potential of
1:35:29 completing a market study if by the year
1:35:32 2025 there are certain kind of
1:35:35 performance metrics for growth centers
1:35:37 both manufacturing and industrial
1:35:39 centers and for regional growth centers
1:35:41 that if yours or any one of them don't
1:35:45 meet these performance metrics we're
1:35:48 debating whether or not to require a
1:35:50 market study that can actually
1:35:51 demonstrate that the growth targets
1:35:53 whether that being jobs
1:35:54 or whether it be in population and/or
1:35:56 jobs is actually viable given the market
1:36:01 so that is a very contentious issue for
1:36:04 GMP B and what exactly is a market study
1:36:07 I can they're hoping to finish this up
1:36:09 in the may meet excuse me in the
1:36:11 February meeting the next meeting but I
1:36:14 have my doubts about that and then the
1:36:15 last issue we discussed with the mix of
1:36:17 uses currently there is no prescription
1:36:20 or even target mix of jobs to housing
1:36:22 ratio and there's a incredible
1:36:27 misbalance
1:36:29 in a number of them especially Seattle
1:36:31 where they're the jobs there are so
1:36:35 outweigh the housing that's there
1:36:36 they'll never even get to a 2080 mix for
1:36:40 Issaquah within our regional center we
1:36:43 have according to PSR C in our regional
1:36:45 center where the we're the one that has
1:36:47 zero residents in our regional center
1:36:49 and we're 100% jobs so I think the
1:36:53 direction that this is going to go is
1:36:55 it'll be kind of a target mix of 2080
1:36:59 population to jobs and
1:37:03 but it will probably not be an enforce
1:37:05 it'll just be used as a planning tool
1:37:06 not anything part of the performance
1:37:08 measures so those are the major issues
1:37:11 there that we discussed at that last
1:37:13 meeting and our next one is on February
1:37:16 this coming February first I don't have
1:37:18 I have not seen the full agenda for that
1:37:20 thank you that's more of a Goodman I
1:37:23 thank you madam mayor the council an
1:37:27 inch or committee typically meets the
1:37:29 first Thursday of the month and as I am
1:37:33 maybe probably likely the chair for the
1:37:36 2018 and in short committee I'm helping

1:37:42 looking at the second Thursday of the
1:37:43 month and because there is a conflict
1:37:45 with one of the potential members and so
1:37:47 all I don't have it confirmed watch the
1:37:49 calendar landed chores next meeting will
1:37:51 likely be February 8th thank you thank

1:38:00 Eastside Human Services forum board
1:38:02 meeting will be Thursday January 18th in

1:38:14 count is happening On January 26 2018
1:38:18 from 2 a.m. to 6 a.m. and they are
1:38:21 looking for volunteers who can get more
1:38:23 information on the King County website

1:38:29 you madam mayor the council services and
1:38:33 Safety Committee met on Tuesday January
1:38:36 9th we looked at agenda bill 75 22 the
1:38:40 creating visit Issaquah organization as
1:38:42 councilmember winter Stein mentioned
1:38:44 there's going to be community outreach
1:38:46 tomorrow night then it's coming back to
1:38:48 services in February and then with an
1:38:51 intention to come back to full Council
1:38:53 on February 19th
1:38:54 agenda bill 72 95 was a conversation
1:38:58 about amendments to IMC 1604
1:39:00 construction codes a spellbinding
1:39:02 conversation necessitated by some state
1:39:06 requirements and the long and the short
1:39:08 is it's on tonight's consent agenda but
1:39:12 there is nothing remotely controversial
1:39:14 about it and then
1:39:16 was a walk-on regarding and influenced
1:39:18 the choice grant application and
1:39:20 basically the long and the short of it
1:39:22 was that the committee after some
1:39:24 discussion recommended to come back to
1:39:26 the February 5th regular business so we
1:39:28 didn't take a formal recommendation in
1:39:30 committee but levy but believe it can be
1:39:32 addressed
1:39:33 generally in in regular business on the
1:39:35 fifth and then Sound city's association
1:39:38 public issues committee met on Wednesday
1:39:40 January 10th at Renton city hall there
1:39:44 were no substantive action items
1:39:46 discussed my report next item on our
1:39:50 agenda this evening is the mayor's
1:39:52 report a special meeting was held
1:39:54 earlier this evening at 5 o'clock p.m.
1:39:57 to interview possible candidates for
1:39:59 vacant council position three and some
1:40:02 of them are still here an executive
1:40:04 session was held afterwards to discuss
1:40:07 appointments there will be an executive
1:40:10 session held this evening to discuss
1:40:12 acquisition of real estate and pending
1:40:14 and potential litigation per RCW forty
1:40:17 two point three zero point one one zero
1:40:19 bracket one bracket B and forty two
1:40:22 point three zero point one one Oh
1:40:24 bracket one bracket I these items are
1:40:26 expected to take approximately 45
1:40:28 minutes action is anticipated to follow

1:40:53 committee meeting sorry it was not able

1:40:58 Alliance resource committee meeting they
1:41:00 did hold an executive session their next
1:41:02 meeting is February 8th at 2 p.m. at
1:41:05 cascades office in Bellevue and no
1:41:07 agenda has been set yet the next board
1:41:09 meeting for cascade water Alliance is
1:41:11 the annual meeting on February 7th at
1:41:14 3:30 p.m. in Bellevue they have not set
1:41:17 the agenda yet on January 11th I
1:41:19 attended the Puget Sound Regional
1:41:21 Council transportation policy board as a
1:41:23 sound city's association alter alternate
1:41:26 there were a couple of items on their
1:41:29 event
1:41:29 justise aqua the board recommended the
1:41:33 approval of the Transportation
1:41:34 Alternatives program to the Executive
1:41:36 Board if this is approved by the
1:41:39 Executive Board Issaquah would receive
1:41:41 1.5 million dollars for engineering and
1:41:43 design of the bike facilities and
1:41:45 sidewalk on the south side of Newport
1:41:47 and the multi-purpose trail on the north
1:41:49 side of Newport for that section from
1:41:51 State Route 900 to southeast 54th Street
1:41:54 the next meeting of the transportation
1:41:57 policy board is February 8th at 9:30
1:41:59 a.m. the major topics for that day will
1:42:02 be the review of the regional
1:42:04 transportation plan and the summary of
1:42:06 public comments as well as discussing as
1:42:10 similar as councilmember winter Stein
1:42:12 said the vision 250 there'll be a
1:42:14 briefing on the scope a January 11th
1:42:17 they attended the greater is Sequoia
1:42:18 Chamber of Commerce luncheon and
1:42:20 provided some comments on the State of

1:42:26 the fire chief provided a briefing on

1:45:21 like to invite our Parks and Recreation
1:45:23 Director Jeff Watling to provide a brief
1:45:25 presentation all right I will emphasize
1:45:27 brief good evening Jeff Watling Parks
1:45:30 and Recreation Director yeah this is an
1:45:33 item that was before
1:45:34 services and safety in December as I
1:45:36 stated at that meeting when I introduced
1:45:38 this this agenda bill and the proposed
1:45:41 action tonight does not reflect a final
1:45:47 decision on long-term operation of the
1:45:49 the senior center but rather it allows
1:45:52 us to get some direction as staff to
1:45:56 pursue seeking a long-term operating
1:45:59 partner as you know interim operation of
1:46:04 the facility began January of last year
1:46:07 since that time it has been the
1:46:09 intention as we move this facility
1:46:13 forward into its desired future that
1:46:17 interim operation allows us this time to
1:46:20 discuss explore determine policy on what
1:46:24 we want long term operation to look like
1:46:26 in March of last year we began work with
1:46:30 an advisory group at the senior center a
1:46:32 tremendous amount of work it was done by
1:46:34 that group over five months time their
1:46:38 advisory report is in your packet I've
1:46:40 had the chance to go over that a number
1:46:42 of times at services and safety the
1:46:46 group did a fantastic job of researching
1:46:49 exploring evaluating discussing various
1:46:53 long-term operating models and which one
1:46:55 we felt make them up made the most sense
1:46:57 as a community for the Issaquah senior
1:47:00 center in that time and discussion I
1:47:03 think it also a very important element
1:47:05 was created and that was the creation of
1:47:08 six guiding principles that this group
1:47:11 felt strongly and staff felt strongly
1:47:13 really became the anchors became the
1:47:15 tenants for what we want successful
1:47:18 operation of that Senior Center to be
1:47:20 the group was unanimous in consensus on
1:47:23 those guiding principles where they
1:47:26 weren't and and where I think we'll
1:47:28 always understand there's going to be
1:47:30 differences of opinion as is what
1:47:34 operating model made the most sense
1:47:36 whether it be direct City operation or
1:47:40 seeking operating partner what was
1:47:43 understood by that group
1:47:45 and what the report really points out
1:47:46 though is either those models that group
1:47:50 felt very strongly would be very very
1:47:52 successful in the senior center as long
1:47:55 as those guiding principles were met I
1:47:57 emphasize those guiding principles
1:47:59 because as we move forward into this
1:48:02 request and into this action in terms of
1:48:05 seeking an operating partner those
1:48:06 guiding principles really become anchors
1:48:09 for what request for qualifications and
1:48:12 a request for proposal would look like
1:48:14 they become really anchors for how we
1:48:18 measure what a successful partner might
1:48:20 look like so following that work of the
1:48:24 advisory group staff in administration
1:48:27 and the Parks Department and that
1:48:29 explore discussed recommended action
1:48:33 moving forward that action that's here
1:48:35 tonight now like I stated before is
1:48:38 pursuing seeking an operating partner
1:48:42 what that would mean is putting out a
1:48:46 request for qualifications request for
1:48:49 proposal really a sort of a hybrid of
1:48:51 both and that we will seek to find any
1:48:54 interested partners that would like to
1:48:56 come alongside and operate with us going
1:48:59 through that work this this first
1:49:03 quarter and second quarter will allow us
1:49:06 to determine ideally in the timeline by
1:49:08 June or July if we have a successful
1:49:12 operating partner and we would certainly
1:49:15 update you at that time and then go into
1:49:19 negotiations it's the recommendation as
1:49:21 you see in the staff report that we
1:49:23 would be pursuing should we find it a
1:49:25 successful operating partner to cement
1:49:29 this through a management agreement as
1:49:31 opposed to a lease agreement which was
1:49:33 the the prior template we feel a
1:49:36 management agreement really gives us the
1:49:39 tools and the ability to understand as
1:49:41 owners of that public building we want
1:49:44 to partner with a successful operator
1:49:46 and moving this forward should we as we
1:49:50 go through this process not find an
1:49:53 operating partner that we
1:49:55 I'm more interested in alternatives we
1:49:58 see with certainly at that time
1:50:00 exploring other alternatives one of
1:50:03 those being City operation but we felt
1:50:06 it was imperative in this recommendation
1:50:08 given the history that this facility has
1:50:11 been operated by a non-profit partner
1:50:13 given the professional agencies that we
1:50:17 see in this area that operate senior
1:50:19 centers that pursuit of this seemed to
1:50:22 be a first priority before considering
1:50:26 adding this to our spectrum of services
1:50:29 that we provide directly one last item
1:50:32 before I open it up for questions
1:50:35 something we discussed it services and
1:50:37 safety should we approve this tonight
1:50:39 and proceed with this action we would
1:50:43 very much want to stay in communication
1:50:45 with our customers as we've enjoyed
1:50:47 establishing some strong relationships
1:50:50 with our senior customers every Monday
1:50:52 morning we have coffee talks this would
1:50:54 be certainly an opportunity to present
1:50:56 what this path forward what this pursuit
1:50:59 ournament of an operating partner would
1:51:00 look like we would also plan on in
1:51:03 probably early February hosting a QA
1:51:06 session either right after lunch but
1:51:08 something that would be a little bit
1:51:10 bigger and would certainly make sure
1:51:12 you're aware of that and if you're
1:51:13 interested in attending to come to that
1:51:15 as well
1:51:16 so with that any questions thank you

1:51:25 move to direct the administration to
1:51:27 initiate a request for qualifications

1:52:47 new operator and to follow up on that do
1:52:49 you anticipate that you would have any
1:52:51 cost savings associated with
1:52:53 transitioning from a city operated model
1:52:56 to a partner operated model still to be
1:53:00 determined given that we are not in a
1:53:02 full city operation right now council
1:53:04 member array we're really in a and
1:53:06 council members have also heard me say
1:53:08 this sort of a two-cylinder low budget
1:53:11 interim operation I hard to say but I
1:53:15 wouldn't anticipate it being a
1:53:17 significant savings or a significant
1:53:19 increase either way right thank you
1:53:21 additional questions that's a member we
1:53:25 understand thank you that's member
1:53:27 Goodman previous nonprofit did some of
1:53:32 their own fundraising do you are you
1:53:35 going to be seeking any type of
1:53:36 qualification to our past history with
1:53:38 for doing development in this hour
1:53:41 absolutely those fun developments yep
1:53:44 and seeking partnerships both financial
1:53:46 and programmatic
1:53:47 would be a requirement thank you thank

1:53:55 $25,000 typically that city
1:53:58 administration manages its own process
1:54:02 this is the 25,000 to have an outside
1:54:07 organization manage this process or
1:54:10 what's tell me how this would be spent

1:54:14 I didn't mention in the staff report
1:54:15 this would be consultant services to
1:54:18 assist us so this wouldn't be an outside
1:54:20 group solely managing it we would still
1:54:23 be managing it this would certainly be
1:54:24 under my task but just given our work
1:54:29 plan and given everything on our plate
1:54:31 and given the timeline we want to
1:54:33 accomplish this work this would be a
1:54:35 consultant that could help us with
1:54:37 framing the RFQ someone with experience
1:54:39 in non-profit senior services we find
1:54:44 that very important okay thank you
1:54:48 yeah other questions any discussion
1:54:54 that's member Goodman well I support the
1:54:58 taking this step which is the next step
1:55:01 which will have us making decisions
1:55:09 based on when we find out and I'm I'm
1:55:12 excited to be at this point and looking
1:55:15 forward to the results of this process

1:55:20 too like this direction that we're going
1:55:22 and I particularly like the idea of
1:55:25 bringing in some outside expertise to
1:55:27 help frame this because I don't think we
1:55:29 get a lot of shots at this Apple if you
1:55:32 will or bites of this Apple and I just
1:55:34 want to make sure that we do take
1:55:35 advantage of this situation and that we
1:55:37 are thorough and that when we put
1:55:39 together our procurement or our
1:55:40 qualifications and proposal that we are
1:55:42 considering all of the things that are
1:55:45 possible in a partner Batista's yes so I
1:55:52 I just I know all of the hard work that
1:55:56 has gone into putting all of this
1:55:58 together both from staff and the senior
1:56:01 center advisory group and just a lot of
1:56:04 time and effort put into the guiding
1:56:07 principles that would guide any kind of
1:56:10 an agreement that would go forward so I
1:56:12 just think it's exciting that we're at
1:56:14 this point
1:56:15 and I would be in support of this Thank
1:56:19 You councilmember Ramos yes I thank you
1:56:23 and Parks Department for all the work
1:56:25 that's been done all the seniors that
1:56:26 have gathered up and advisory work it's
1:56:29 great I'm really happy to get to this
1:56:30 point also so I want to move right ahead
1:56:33 along with this I do have one concern I
1:56:35 just want to mention and it's not
1:56:36 anything on you at all it's on the
1:56:39 budgeting process that I had some
1:56:41 concerns with previously and here were
1:56:43 January 16th and we're asking for
1:56:45 amendments to our budget and I find that
1:56:47 strange that 16 days into our our budget
1:56:51 we're asking to make amendments so I
1:56:53 just like a little reflection on our
1:56:55 budgeting process we spent three months
1:56:56 working really hard on that
1:56:57 and two weeks into it we need to ask for
1:57:00 amendments so that's that's a concern
1:57:01 for me on how that that went but I am
1:57:03 totally supportive of this process and
1:57:05 the money you need is as you said to do
1:57:08 it right is very important and so go
1:57:11 forth and do it right council president
1:57:15 Mertz I just wanted to make a comment
1:57:18 for council member Ramos because it's
1:57:20 probably something that most of the
1:57:22 council is not aware of by the
1:57:24 scheduling of how we approved the
1:57:25 process the actual formation of the 2018
1:57:28 work plan for the year begins after the
1:57:31 approval of the budget and because it
1:57:33 happened late in December this year I
1:57:35 believe what's going on is that there
1:57:37 are some items that still need to
1:57:39 proceed and so as the work plan gets
1:57:41 prioritized about which work in which
1:57:43 section and we review which staff levels
1:57:45 we have that is why it seems like it's
1:57:47 coming out of nowhere rather quickly but
1:57:50 that was why the request is coming now
1:57:53 kind of a workload balancing thing but
1:57:55 thank you for bringing that up that's
1:57:57 what President Mertz I just want to say
1:57:59 that I'm really excited that the citizen
1:58:02 group had unanimous agreement on the
1:58:05 principles on the six principles and I'm
1:58:07 confident that it's going to help guide
1:58:08 our review of proposals that come in and
1:58:13 help us make a really smart decision
1:58:15 that the community is going to wind up
1:58:18 having a lot of support for you know
1:58:20 it's possible that we won't get
1:58:21 unanimity of support when that when that
1:58:24 time comes but we'll certainly have
1:58:26 we'll certainly have been guided by
1:58:28 principle

1:59:23 got a little bit of stuff here to
1:59:25 describe to those of you who weren't on
1:59:27 infrastructure right to give you the
1:59:29 background because we took quite a while
1:59:30 to discuss through this this so
1:59:33 basically this franchise tax aren't for
1:59:37 Verizon question I was just wondering if
1:59:41 we have a presentation no this is it
1:59:44 actually we do have a presentation as
1:59:46 well have our public works engineering
1:59:52 director for a presentation but he's
1:59:58 present as Manny chair rama proceeds
2:00:01 okay so again it infrastructure we took
2:00:06 a couple meetings to get through this
2:00:08 and and so just give you a little bit of
2:00:11 the background as we got through it if
2:00:13 you remember a while back there was some
2:00:15 attempted legislation at the state level
2:00:17 to try to remove local control over
2:00:20 franchise agreements on small cells so
2:00:22 that's a piece of history that happened
2:00:24 didn't get passed and so now
2:00:26 individually these franchise agreement
2:00:28 requests are going to be coming to us
2:00:29 this is the first one with Verizon and
2:00:33 so we had some concern with that the
2:00:35 original request was for citywide
2:00:37 franchise tax agreement and
2:00:40 the infrastructure community was very
2:00:44 concerned with the broad scope of it and
2:00:47 not well enough defined controls so we
2:00:52 actually went back a second time we
2:00:55 looked at this very closely and the the
2:00:57 proposal now before you is specifically
2:01:00 for one area is a call fall city wrote
2:01:03 and one site on Pine Lake Road it's for
2:01:05 seven sites along there it's
2:01:08 specifically for those seven sites only
2:01:10 it is there are photo simulations for
2:01:14 all those seven sites of what it will
2:01:15 look like because we don't have code
2:01:18 written that defines all this yet so we
2:01:20 went with photo simulations to describe
2:01:23 what we wanted and it includes things
2:01:26 such as like no ground equipment being
2:01:27 there and so forth so it's very specific
2:01:30 for that area it's kind of our pilot if
2:01:34 you will now the plan in the future is
2:01:37 that they'll be working with Sheldon and
2:01:39 Keith on getting code written so that we
2:01:42 will have code in place so when we do
2:01:44 these that that will be there and it can
2:01:46 be well defined it won't have to have
2:01:47 all these photo simulations and things
2:01:49 of that nature so we'll simplify that a
2:01:50 little bit and we expect there will be
2:01:55 more requests of these coming from other
2:01:57 companies as well as additional requests
2:01:58 possibly from this company because they
2:02:01 want more areas of the city to have put
2:02:04 put these small cell sites up on so
2:02:07 there's probably more coming we don't
2:02:09 know what but the way things aren't we
2:02:11 these are so also time limited when
2:02:14 someone does a request the city really
2:02:15 has about 120 days to react to those
2:02:19 were already past that a little bit
2:02:20 because it stayed in committee for a
2:02:21 while so we're actually just past that a
2:02:23 little bit and so anyway hopefully these
2:02:26 will come a little bit better with a
2:02:27 little more definition as they go and
2:02:31 actually we can expect more and also
2:02:34 just another background piece I've also
2:02:35 heard there's further attempts at the
2:02:37 state level to get some laws passed
2:02:40 again to limit local control on these
2:02:44 things so we don't know where that will
2:02:46 be in the future - I just want to
2:02:47 mention that another thing mentioned
2:02:49 that the community was concerned about
2:02:50 was net neutrality
2:02:53 there wasn't anything done about that
2:02:54 and Paul if you went to a farm done if
2:02:56 you want to add more of that you can but
2:02:58 request that if they're doing these
2:03:00 things then you try to was a concern to
2:03:02 us and many folks but there's nothing
2:03:04 right this level that we thought we
2:03:05 could do with that and so sum it up you
2:03:10 look at this it's for seven sites very
2:03:12 controlled very limited and very
2:03:14 specific and with photo simulations of
2:03:16 what it will look like those are in your
2:03:18 package I hope you saw them so if you
2:03:19 have any questions ask me or Sheldon's
2:03:22 or two and if I was gonna add anything
2:03:23 to that I may have missed there was a
2:03:25 lot talked about in those two meetings
2:03:26 you want to add go right ahead

2:03:39 had the opportunity to give the

2:03:47 learn we we had representative from
2:03:50 Ogden Murphy Wallace there who was
2:03:52 assisting us with this plan and did
2:03:55 answer the question about whether or not
2:03:58 we could in our own local control in
2:04:02 call for enforcement of net neutrality
2:04:04 as through this agreement and we were
2:04:08 told that no the way that the FCC issued
2:04:11 their ruling local not even states have
2:04:14 control and then we do know that we were
2:04:17 advised that a number of Western states
2:04:21 Washington State and as well perhaps are
2:04:25 considering court action to challenge
2:04:28 that FCC ruling so we were advised to
2:04:31 just follow what that process rather
2:04:34 than go out on our own so that's what we
2:04:36 did we did not ask for any inclusion
2:04:38 into the contract thank you

2:07:49 proposed agenda and it's subject to
2:07:51 change over the next few weeks I also
2:07:53 wanted to provide a quick update on the
2:07:55 moratorium work items since we don't
2:07:57 necessarily touch on those these council
2:08:00 meeting but I know there are many
2:08:01 members of the public and many
2:08:02 businesses that are tracking that one of
2:08:05 the work items which was reviewing the
2:08:08 central istrico plan district visions
2:08:10 the next touch in public for this will
2:08:13 be at the Planning Policy commission
2:08:15 slash task force meeting
2:08:18 they met last Thursday to discuss the
2:08:22 updated visions and their next meeting
2:08:24 is scheduled for January 25th at 7 p.m.
2:08:27 and council chambers second work item
2:08:30 that is still outstanding for the
2:08:31 moratorium is inclusionary zoning this
2:08:34 is covered in agenda bills 7 505 which
2:08:36 was on the consent calendar this evening
2:08:38 is that correct issue and it is looking
2:08:41 to refer it to the February landed Shore
2:08:43 committee meeting the agenda bill looks
2:08:45 to set the next steps for this
