0:50 our first order of business is audience

0:58 citizens comments are an important part
1:00 of the public process
1:02 we take them seriously and Factor them
1:04 into the decisions that we make
1:06 anyone from the public who wishes to
1:09 comment will have the opportunity to do
1:11 so when recognize please come to the
1:14 lectern speak into the microphone state
1:17 your name address and relationship to
1:19 the city
1:20 please limit your comments to five
1:22 minutes if you have written comments
1:24 please submit those to the city clerk
1:27 personal attacks obscene language
1:29 derogatory remarks and disruptive
1:31 behavior will not be permitted
1:34 the speaker is out of order the mayor
1:36 will direct the speaker to return to his
1:38 or her seat if the speaker does not
1:40 comply I will ask him or her to leave

1:45 comments written in verbal or an
1:47 important aspect of the public process
1:49 process the study takes those seriously
1:53 and we thank members of the public for

2:28 hello my name is Joanne Doherty and I'm
2:31 a resident of Issaquah I live up in the
2:34 Issaquah Highlands area I live in West
2:37 Highland Park near Swedish Hospital
2:39 I purchased a home there two years ago
2:41 in West Highland Park and it's a nice
2:44 view lot on the rim my home is the only
2:47 home that does not have a deck I asked
2:51 my Builder why they wouldn't add a deck
2:53 and they said well they forgot to put it
2:55 on the permit and they told me they were
2:57 not going to add it anytime soon they
2:59 were just going to build the home as is
3:01 and that I could put it in aftermarket
3:04 so I thought fine a little bit of a
3:06 hassle but I'll do it so I started my
3:09 quest this year in April to find out
3:12 what the process is to get a permit
3:14 approved to add the stack
3:16 well I went to the City of Issaquah
3:18 planning department and I found out that
3:21 I have a building set back in my very
3:23 small 14-foot yard they told me that I
3:27 could only place deck footings at four
3:29 feet from the building structure
3:31 I could not cantilever the deck because
3:34 it would cast a shadow on the critical
3:36 slope or critical area they told me it's
3:39 a nature issue Environmental
3:42 um I was pretty surprised because my
3:45 backyard is just simply a set of
3:48 Rhododendron bushes and a fence there's
3:50 really no environmental hazards that I'm
3:53 aware of or that I would damage anything
3:55 so after being told by numerous folks
3:59 there that there's really nothing they
4:00 could do to help me I hired an attorney
4:03 someone familiar with this type so these
4:05 types of issues and he basically told me
4:08 that
4:09 know that there shouldn't be any
4:11 restriction like that that would prevent
4:13 you from cantilevering that the setback
4:15 may have some issues with it however I
4:18 found out according to the attorney that
4:21 the City of Issaquah allowed a huge
4:23 retaining structure in the setback
4:25 already because the Builder asked for
4:28 that privilege they moved it on the plan
4:31 I have documents that I can leave with
4:32 you I've already filed these with the
4:34 clerk by the way
4:35 also there's an asphalt Trail going
4:37 through the critical area which should
4:39 not be allowed because it's a critical
4:41 area it should be gravel should be no
4:43 concrete so I have found that the
4:46 City of Issaquah inspector to approve
4:49 this without
4:50 really any evidence of why they did and
4:53 I got an email from the planning
4:55 department that they have no idea why it
4:57 was approved or why all this was allowed
4:59 but they allowed it and this is a major
5:02 intrusion to me it's my driveway that
5:04 sits here for the house so all I want to
5:07 do is put deck footings in about eight
5:10 feet from my home eight to ten feet
5:12 within this little backyard
5:15 well I went through this process of
5:17 trying to get the correct information
5:18 for months the attorney said I'm very
5:21 expensive you should you know see a
5:24 consultant who can help and speak to the
5:26 city in code terms and help figure out
5:28 what's going wrong well I did that and
5:31 they spent several weeks months working
5:34 with the planning department and being
5:36 told many different stories and avenues
5:39 of what they could do they were told
5:41 that we could file an administrative
5:43 modification and we could go to the
5:45 Issaquah Highlands Community
5:47 organization first and gain their
5:49 approval we did all this you know about
5:52 seventy five hundred dollars later
5:55 we take this to the planning department
5:57 and they tell me no I cannot move the
6:00 deck posts any further than indicated
6:02 but then we found out that they
6:05 originally had quoted me a code for a
6:08 wetland I don't have a wetland in my
6:10 backyard I have three Rhododendron
6:12 bushes and a fence
6:13 so they were incorrect on numerous
6:16 occasions and I found out I can place
6:19 one footing at seven and a half feet but
6:21 the other one has to be at five feet and
6:23 all I'm asking for them to do is to
6:25 kindly use common sense and look at the
6:29 situation there is no danger to me
6:31 there's no safety issue which they went
6:33 from telling me that I was casting a
6:35 shadow on a wetland that didn't exist
6:38 to now I'm in danger I'm in severe
6:41 danger of getting hurt in my backyard by
6:44 putting a deck post next to my fence
6:46 which I don't think is true I have
6:48 examples of other Decks that the city
6:51 seems to approve that are very scary and
6:53 I wouldn't want to be barbecuing on
6:55 those myself because the footings are on
6:57 steep inclines such as this I know you
7:01 can't see these but I'll leave them if
7:03 you are interested
7:05 thank you that's pretty much my story
7:08 and I'm kind of at my wits end with it
7:11 because I can't
7:12 I don't want the city to protect me I
7:15 don't need protection in in this
7:17 situation there is no danger and I feel
7:21 that the builders and the city inspector
7:24 have different standards or rules for
7:27 themselves that a citizen doesn't have
7:30 that's my story and I'm sticking to it
7:36 bring that uh let us take another look
7:40 at that okay make sure
7:44 we understand the information that you
7:47 have presented and okay see see what we
7:52 can do to address your
7:54 they have a full copy of all these
7:56 things so this is just a sample of the
7:59 pictures and you guys know where I am so
8:01 if you want to get in touch and advise
8:03 me before I go too crazy how I might
8:07 resolve it

8:28 and Regional reports beginning with
8:31 council member Milligan thank you Mr
8:33 Mayor I have no report tonight
8:36 council member Paulie thanks
8:39 um I have two things to or three I guess
8:42 uh first is the as Chamber of Commerce
8:44 liaison in 2014 the last board meeting
8:48 of the chamber was on December 18th and
8:51 there was a few items that I wanted to
8:52 just quickly share with that but also to
8:55 let the council know that Nina Milligan
8:57 councilmember Milligan will be
8:58 fulfilling that role through 2015.
9:04 at the chamber meeting they talked about
9:07 some of their plans for next year which
9:08 will focus on a membership drive and an
9:10 Outreach they have a new some a new
9:13 leadership it's chair Alan Finkelstein
9:15 and vice chair David blyvice
9:17 their board meeting times are switching
9:19 from to Friday at 7 30 in the morning on
9:22 the fourth Friday of the month and some
9:24 of their highlights from 2014 were a
9:27 focus on tourism a very successful
9:29 salmon Days festival with a lot of new
9:31 ideas
9:33 a lot of involvement from the board
9:35 and their other Focus for 2014 was
9:38 looking at the electrical
9:41 electrical supply issues and a
9:43 transportation Focus
9:46 um the next thing I want to talk about
9:47 was Landon Shore the landed Shore
9:49 committee for 2015 has three new members
9:53 I'll be the chair council member
9:55 Milligan and council member Barber are
9:59 the other two members of the committee
10:01 there will be no meeting in January and
10:04 the next scheduled meeting in February
10:06 the date will be announced at our next
10:08 council meeting
10:09 also I got appointed as an alternate for
10:13 SCA for 2015 to the growth management
10:15 policy board they will also not be
10:18 having a meeting in January and I'll
10:20 announce their February meeting at our
10:21 next council meeting
10:24 thank you council member Martz
10:27 Mr Mayor and I will be taking over
10:29 services and safety from council member
10:31 Barber and I'm very excited about it she
10:34 is going to be staying on with services
10:36 and safety and council member Cher is
10:38 joining us we are also canceling our
10:42 January meeting and moving our meetings
10:45 to the second Thursday at 5 30 each
10:47 month which means that our next meeting
10:50 is going to be Thursday February 12th in
10:52 the eagle room and the time again will
10:54 be 5 30. and I will add in terms of
10:58 appointments for the year I continue on
11:00 on the sca public issues uh committee
11:04 and in addition I'm now on the regional
11:07 law and social justice so
11:11 thank you council member Sheriff thank
11:13 you mayor and good evening to members of
11:14 the viewing public the council
11:15 infrastructure committee will meet
11:17 tomorrow evening that will be at 5 30
11:19 p.m in the Pickering room of City Hall
11:21 Northwest off 12th Avenue and on the
11:24 agenda we have one single large item
11:27 which is a continuation of our
11:29 transportation concurrency discussion
11:33 a welcoming our council president and
11:35 Deputy president as members of that
11:37 Committee in 2015.
11:39 Additionally the Eastside Transportation
11:42 partnership will be meeting this Friday
11:44 at 7 30 in the morning at the Bellevue
11:47 school district office which is off
11:50 Northeast 1st Street near downtown
11:51 Bellevue and on the agenda we have a
11:55 2015 legislative discussion with
11:58 with these government relations manager
12:00 to talk about the upcoming legislative
12:02 session as well as the governor's 2015
12:05 biennial budget proposal and King
12:07 County's legislative priorities we're
12:10 going to do some in-house business uh
12:12 review our legislative agenda and
12:14 statement
12:15 we have a planning committee report
12:19 officer selection and other reports
12:22 scheduled for that meeting which is due
12:24 to a last about an hour and a half so if
12:27 you're one of the new alternate members
12:30 of ETP
12:31 um hope to see you there on Friday

12:44 this year on the Eastside fire and
12:46 rescue board and there is a meeting this

13:31 so we have one item on the agenda it is
13:33 going to be the continuation of our
13:35 discussion about concurrency and our
13:37 current plan is to take plan on the
13:40 concurrency bill
13:41 after two weeks from tonight that's the
13:43 current plan but as council member chair
13:45 already mentioned it will be part of the
13:48 agenda for infrastructure tomorrow and
13:50 then the work session on
13:52 from tonight
13:55 where's my report thank you for the
13:57 mayor's report there will not be an
13:59 executive session meeting this evening
14:02 uh we had our Washington State audit
14:05 exit conference on December the 17th I'm
14:07 happy to report that we are financially
14:10 healthy and there were no material
14:12 weaknesses or in internal controls or
14:16 for non-compliance
14:19 I attended the sound cities Association
14:22 uh North and Snoqualmie Valley Caucus
14:26 meeting on December the 18th mayor Dave
14:29 Baker from Kenmore and mayor Amy Whalen
14:33 from Kirkland were elected by the caucus
14:36 to the sound cities Association board
14:39 those present identified Transportation
14:43 package streamlined sales tax and
14:46 lifting the one percent property LED as
14:49 the top three issues for 2015 during a
14:53 general discussion of those attending
14:55 that meeting
14:57 at the South Transit board meeting on
14:59 December the 19th a board updated the
15:02 regional long range plan setting the
15:05 stage to begin working this year
15:08 in shaping a sound transit 3 ballot
15:11 measure that will identify the specific
15:14 projects that would be included in a st3
15:20 ballot measure
15:22 finally we had a special counsel meeting
15:25 this morning to discuss issaquah's
15:27 legislative agenda with Senator mullet
15:31 and representatives Rodney Clayburn
15:34 Cleburn and send from the 5th and 41st
15:39 districts
15:41 we talked about headlines we would like
15:44 to see at the conclusion of the next
15:48 legislative session and just about
15:51 everyone present picked
15:55 Transportation package passing the
15:58 legislature as the headline that they
16:01 would like to see
16:02 uh with that that concludes my report
16:05 moving now to the consent calendar there
16:09 are a number of items on the consent
16:10 calendar this evening the first is the
16:14 accounts payable in payroll uh dated
16:17 January uh fifth the minutes of our city
16:21 council regular meeting of December the
16:25 15th 2014 agenda Bill 6891 amending IMC
16:33 3.78.010 inmate Health and Welfare
16:36 account booking fee agenda Bill 6938
16:41 King County Waste reduction and
16:43 recycling Grant agenda Bill
16:47 6939 hazardous local hazardous waste
16:51 management program Grant and finally
16:53 agenda Bill
16:56 6904 The Walk and Roll Issaquah action

17:04 as any council member desire to pull any
17:07 of these down to regular business
17:12 council member share thank you mayor um
17:14 I didn't necessarily want to pull it
17:16 down to regular business but I would ask
17:18 that agenda bill
17:20 6891 which is the booking fee be
17:24 referred back to the February Services
17:26 committee meeting for recommendation at
17:28 that time okay well we'll pull that down
17:30 to regular business and have a
17:34 discussion uh on on that uh any other
17:38 bills that council members desire to
17:40 pull down
17:43 have the accounts payable and payroll
17:47 been reviewed yes they have and uh what
17:51 is your uh pleasure

19:02 you're succeeding that council member
19:03 Cher had a addition that he would like
19:06 to put into this and
19:10 um would you prefer to present this or
19:12 should I read this for you for Josh
19:14 I'd be happy to just mention the basis
19:17 for for having it come back to committee
19:19 is to take a look at the discretion of
19:22 the court in either being able to waive
19:24 or reduce the fee now there may be and
19:27 I've been told
19:29 um from a couple different sources a
19:31 couple different state laws that may be
19:34 applicable here one in RCW title III and
19:39 another in title 10
19:42 that may be applicable and so I'm not
19:45 100 sure as we sit here regarding that
19:49 and actually as I was referred to those
19:52 rcws then another question came to mind
19:54 which is making sure that that cost is
19:58 wholly recoverable by the city and
20:00 whether we needed any sort of special
20:01 language in there that
20:03 emphasizes that it's a reimbursement of
20:06 a cost incurred by the city in the
20:08 prosecution of the case which would then
20:10 exempt us from having to pay the state
20:12 some portion of that fee uh again that
20:15 may be covered by existing state law but
20:17 as I sit here I don't know the answer so
20:19 I'm hoping that a couple of these issues
20:20 can be addressed through a committee
20:22 level discussion which frankly shouldn't
20:24 take very long so it sounds like uh
20:29 is there a motion to refer this back to
20:32 services and Safety Committee at their
20:36 next meeting
20:39 we can I can make that motion if that's
20:41 what the committee would like I'd like
20:43 to make a motion at this moment to refer
20:45 agenda Bill

20:50 committee meeting for their February

22:23 you about issues and questions that they
22:25 may have about dealings
22:27 so I am excited at that announcement and
22:30 uh you can assure all all of our our
22:33 residents up in the highlands and
22:35 throughout the city that I'm looking
22:36 forward to that uh that meeting also so
