Staff report:
On June 7, 2022, the Metropolitan King County Council passed Ordinance 19447 (Exhibit B), setting sewer rates for 2023. In accordance with long term agreements for sewage disposal, King County (as successor to METRO) provides wastewater treatment and disposal service to cities and special utility districts, including Issaquah. The fees for such service are set and approved by King County, as reviewed and recommended by the Metropolitan Wastewater Pollution Abatement Advisory Committee (MWPAAC). The King County fees were last increased for 2022.

Eastside Fire & Rescue (EF&R) has identified that, in order to respond in the desired amount of time to the cities of Issaquah and Sammamish, there is the need for a fire station in North Issaquah. Their preferred location in North Issaquah is specifically along the East Lake Sammamish corridor. In accordance with EF&R's Standards of Coverage Policy, this fire station would replace the existing Station 71 in Olde Town. This information was initially presented to the City Council in ID 0517 at the September 3, 2019 City Council meeting.

Staff report:
The Board of Judicial Administration prioritized funding for court interpreters in their strategic initiative in 2017-2019. The legislature appropriated $4.8 million for interpreter reimbursement to counties over the last two biennium budgets, 2018- 2023. The purpose of the Interpreter Reimbursement Program is to improve language access in the courts. It provides an opportunity for courts to receive reimbursement for interpreters and language access related expenses and helps to ensure that people who are limited in English proficiency, or deaf, or hard of hearing, can access and meaningfully participate in the judicial process in accordance with RCW Chapters 2.42 and 2.43.

1:21 Proclamation and uh I would like to call

1:34 thank you for joining us
1:41 so the Saturday after Thanksgiving every
1:43 year is recognized as small business
1:45 Saturday and whereas the City of
1:48 Issaquah celebrates our local small
1:49 businesses and the contributions they
1:52 make to our economy and community and
1:54 whereas according to the United States
1:56 small business administration there are
1:58 32.5 million small businesses in the
2:00 United States and these small businesses
2:03 are responsible for 62 percent of the
2:05 net new jobs created since 1995. and
2:09 whereas most consumers understand the
2:11 importance of supporting the small
2:12 businesses in their community on small
2:15 business Saturday and report that the
2:17 day encourages them to want to shop
2:19 small all year long and whereas
2:21 merchants and vendors that do business
2:22 in the City of Issaquah bolster our
2:25 community's vibrancy and support
2:26 economic vitality and whereas Vision
2:29 Partners the collaboration of economic
2:31 development organizations supports the
2:34 success of small businesses throughout
2:35 the year now therefore I Mary Lou Paulie
2:38 mayor of the City of Issaquah do
2:40 recognize November 26 2022 to be small
2:43 business Saturday in the City of
2:45 Issaquah and invite the community to

3:53 whereas the Issaquah Deca Club prepares
3:55 emerging leaders and entrepreneurs in
3:57 marketing Finance hospitality and
3:59 management in its high school and
4:02 whereas the Issaquah Deca Club provides
4:04 opportunities to learn and practice
4:06 important life skills such as problem
4:08 solving communication collaboration
4:10 teamwork and creativity and whereas the
4:13 DECA Community is built and supported on
4:15 the local state local state and National
4:18 levels where students can meet peers and
4:20 create connections with people all over
4:22 the country and whereas the Issaquah
4:24 Deca Club hosts fundraisers and
4:26 community events to support local
4:27 Issaquah organizations and whereas the
4:30 club promotes ethical leadership whose
4:33 definition is the set of standards for
4:35 right and wrong conduct in business and

5:29 helped coordinate and communicate this
5:31 event for us tonight
5:33 um Deca has opened up many doors for all
5:35 of us we've all had opportunities to
5:37 help our community meet new people and
5:40 explore future careers that we might
5:42 want to take upon ourselves in the
5:44 future ethical leadership is not only a
5:46 critical aspect of business but also in
5:49 our daily lives this is why we have made
5:51 it our goal to spread our message to the
5:52 rest of our community
5:54 we have each had our own Journey as a
5:56 part of this club and carry everything
5:57 we learn here with us into the future so

10:43 good evening and happy early
10:45 Thanksgiving to everybody and all of you
10:47 as well I'm here to address the rezone
10:51 request of Our Savior Lutheran church
10:53 and I'm speaking on behalf of the church
10:55 which is located at 745 Front Street
10:57 South in Issaquah
10:59 our church is happy to be here including
11:01 several in the audience from our church
11:05 along with the recommendations from City
11:07 Planning staff the administration and
11:09 the Planning Development and environment
11:11 committee that suggests approving the
11:15 rezone for our property the church's
11:17 priority and focus is on creating a
11:20 beneficial social impact project
11:23 that will be good for the community the
11:25 city those in need and our church a
11:29 win-win for everybody we hope there may
11:32 still be a possibility with the food
11:33 bank who needs to do some financial
11:36 studies to determine the feasibility of
11:39 raising the funds needed and we hope
11:42 that we'll prove positive and they may
11:45 come back to us but even without that we
11:48 wish to find other social impact
11:51 Partners who would combine forces with
11:53 us to do something creative and good on
11:56 what is a very strategic parcel in the
11:58 center of the city
12:00 to help us Define the optimal outcome we
12:04 welcome the council the city and any
12:07 assistance that could be provided in
12:09 identifying and developing Partnerships
12:11 and funding sources for such a project
12:14 so your connections and ideas are
12:17 welcomed at any time
12:19 we also have the expert advice of our
12:22 consultants for Meriweather advisors one
12:25 of whom will speak tonight
12:26 who has a long track record of creating
12:31 amazing win-win projects for churches
12:34 and non-profits around the Puget Sound
12:36 area who have used their land and
12:39 properties to do something very
12:40 beneficial
12:43 as indicated by the administration's
12:46 recommendation for approval this rezone
12:48 is Justified for several reasons first
12:51 and most importantly it meets all the
12:53 city criteria in the Issaquah code for
12:55 justifying a rezone as was confirmed by
12:58 the City attorney and the planning staff
13:02 number two given the multi-family zoning
13:04 and uses that surround this parcel on
13:06 all sides except for Ingy Johnson Park
13:09 including mfh zoning on our second
13:12 Church owned parcel
13:15 this parcel too should very logically be
13:18 zoned multi-family high density
13:20 I think we would all agree that the
13:22 worst future outcome that nobody would
13:25 want to see on this parcel would be for
13:27 it to ever be developed into
13:29 single-family multi-million dollar homes
13:32 as an island of single-family homes
13:35 surrounded by multi-family
13:39 number three mfh zoning enables greater
13:42 opportunity and flexibility for us and
13:45 our partners to create a dynamic social
13:48 impact project that can be maximized at
13:51 this strategic location in the center of
13:52 the city
13:54 and number four why is future planning
13:56 requires that the city not only meet its
13:59 growth targets but also other key social
14:03 needs within the City Human Services
14:05 needs is outlined in the Human Services
14:07 strategic plan
14:09 a livable vibrant compassionate and
14:13 successful community that needs these
14:15 kinds of services that we hope to be
14:17 able to provide on our parcel
14:19 a rezoned combined with a creative with
14:22 creative Partnerships can help us
14:24 achieve these goals
14:26 so as you're planning staff and
14:28 administration recommend we too are
14:30 convinced that this rezone request meets
14:33 all the criteria along with many logical
14:36 and compelling reasons to support this
14:39 your vote to approve this rezone will
14:41 inspire opportunities to partner with
14:44 you and others to create a project
14:47 beneficial to the city the community and
14:50 those needing assistance please vote Yes
14:52 on the rezone tonight thank you

15:18 uh it's a pleasure to meet you all uh
15:20 City Council Members I'm a resident here
15:22 in ichigois
15:24 I have a point of a question more or
15:28 less and I realize this is not a
15:29 question answer setting but I I feel
15:33 about me I'll just State my piece uh we
15:36 were given this uh flyer I'm going to
15:39 say on Friday of this last week I didn't
15:42 get a big chance to delve too deeply
15:45 into it however it does pose
15:48 a bit of a hassle when it comes to the
15:51 neighborhood located on
15:54 uh Juniper and Juniper and Holly
15:57 is the
16:01 the Turkey Trot tends to block in the
16:03 entirety of that neighborhood allowing
16:06 absolutely no one to leave unless it's
16:08 at the behest of the turkey Trotters I
16:11 guess you could say
16:13 uh my question was since city council
16:16 was the ones to approve of this
16:19 and
16:20 city council also has the ability to
16:23 put in stipulations upon whether or not
16:25 they changed the route
16:27 would city council be willing to do so I
16:30 do believe it Bears a an undue burden on
16:33 everyone in that neighborhood since that
16:35 neighborhood in itself is entirely
16:37 enclosed
16:38 by the Turkey Trot route
16:40 there is no no way for the residents to
16:43 leave for example uh people still have
16:46 to go to work that morning it's
16:47 Thanksgiving morning people still have
16:49 to get groceries last minute if people
16:51 are having family members come into
16:54 their home they cannot go through that
16:56 route if they are leaving to go visit
16:58 family members they cannot leave their
17:00 home on that route
17:01 and it is to my understanding after
17:03 speaking with uh the people who are
17:07 hosting the Turkey Trot it is at their
17:09 behest at whether or not people are
17:12 allowed to travel through in and out of
17:14 that location so
17:16 then it Bears the question does this not
17:19 impact our constitutionality on whether
17:22 or not we are able to access our private
17:23 homes
17:24 for example myself I work overnights I'm
17:27 not allowed to come home immediately
17:29 after work I then have to wait for the
17:31 behest of
17:33 the Turkey Trot to allow me to come home
17:36 uh if there are if there's an emergency
17:40 there's a lot of elderly residents in
17:43 that neighborhood
17:44 cannot go say to park somewhere all the
17:49 way down on the other end of
17:51 Front Street or on the other end of
17:56 what is this little one here uh Gilman
17:59 unless we're going to park at a business
18:01 in which case could we not get ticketed
18:03 for parking at that business overnight
18:05 that's
18:08 I feel an egregious overstep now I'm not
18:12 going to say that there shouldn't be a
18:14 Turkey Trot I feel like a Turkey Trot is
18:16 a great thing but I do feel like the
18:18 oversight of blocking in specifically
18:21 only one only one neighborhood
18:25 uh it's a bit much
18:28 having the route moved is something that
18:30 can still be done between now and
18:32 Thanksgiving day and I do pose this
18:34 question to
18:36 are to city council and whether or not
18:39 they will
18:40 they will do something about this

18:46 um actually the administration mayor's
18:48 Administration approved the permit so I
18:51 would like to make sure that if you and
18:53 Tisha are able our city clerk are able
18:55 to talk in the chat that you provide
18:56 information so that we can follow up

19:22 hello uh thanks for the opportunity to
19:25 to comment uh I'm uh here to address the
19:30 uh Our Savior Lutheran Church uh rezone
19:33 efforts and uh I'd like to report that
19:36 we had a semi-annual meeting yesterday
19:39 and presented ideas that we had for the
19:43 for the ongoing efforts to have our
19:46 property rezoned into uh have it become
19:51 a center of of support for the Greater
19:55 Community and I am asking if you will
19:59 yes approve the rezone everyone in the
20:02 congregation when we
20:07 gave our plans for moving forward after
20:09 not having a an arrangement with the
20:13 food bank is enthusiastic about still
20:16 continuing our efforts and still
20:18 becoming a a center for support
20:21 for the community so
20:25 that's it thank you thank you Gary
20:28 the clerk the next speaker is Mary Lynch
20:36 my name is Mary Lynch and I reside at
20:38 2690 Northwest Oakcrest Drive
20:41 I'm here tonight for two things first I
20:43 want to say um I would have loved to
20:45 have attended on with WebEx and Comcast
20:47 because of comicast uh
20:51 in my neighborhood it really does not
20:53 facilitate WebEx and it's broad
20:56 bandwidth that's required for WebEx and
20:58 there's been any number of meetings I've
20:59 not been able to log on to because of
21:01 the Comcast in my neighborhood so I'd
21:03 ask you to maybe consider a until
21:05 Comcast improves their service that you
21:09 look at other options I have no trouble
21:11 with
21:12 Zoom with FaceTime which I don't like
21:15 that that much or with Microsoft teams
21:18 but WebEx consistently has not worked
21:20 and a couple times on really important
21:22 meetings that I want to attend with
21:24 planning in the rezone
21:26 that being said I also sent you a letter
21:28 I would ask that you read completely
21:29 through my letter that I sent you today
21:31 on my concerns with the lack of
21:34 long-range planning and integration that
21:36 the city is doing
21:37 some of this rebuttal that I've gotten
21:39 already isn't really reading in a
21:42 approaching what I'm asking for with
21:45 Riva and when we learned about that
21:47 project we are assured that we would
21:48 have not sidewalks but a walking path on
21:51 the south side to the trailhead that
21:53 didn't happen because of the rework that
21:56 has had to be twice by anti-aircraft
21:58 Creek so thank you you did give us a
22:00 bridge I think it's more than what we
22:02 need down there but we have almost a
22:04 motorized bridge over anti-aircraft
22:07 Creek going in right now for the third
22:10 and fourth time a number of those power
22:12 polls have been relocated unfortunately
22:14 right now they're currently pouring in
22:16 all the concrete for that bridge and the
22:20 concrete approaches to that right over
22:23 where if the city had been long range
22:25 planning in front of Oak Crest and then
22:28 further down could have had the power
22:30 lines underground if you look at that
22:32 long term and say you want this to
22:34 happen so every time you approach a
22:36 power pole the that you have a plan in
22:39 coordination with King County with Puget
22:42 Sound Energy to underground the service
22:45 so you know the project that's on the
22:47 board tonight yes I applaud but it's a
22:50 very small portion of what's causing us
22:52 problems along that road and we have to
22:55 suffer along there the consequences of
22:57 up to 12 to 24 hours road closures due
23:01 to trees falling over power lines
23:02 luckily the last one we weren't most of
23:05 us weren't without power for that 12 to
23:07 24 hours but we didn't have access into
23:10 the City and now with these new projects
23:13 that we have going on
23:15 what has been happening over the last
23:17 five years were also then with these new
23:19 projects aren't going to have access
23:20 into City or not reliable access into
23:23 the City and that's caused us a big
23:25 problem so to be more proactive in
23:27 planning ahead minimizing you know the
23:31 project done in a piecemeal approach and
23:34 looking more proactively and long range
23:36 I think some of these could have been
23:38 number one avoided the pedestrian bridge
23:41 could have been avoided we might not
23:42 have had a raised crosswalk but we would
23:44 have had a crosswalk at Riva which we
23:46 asked for
23:48 because if you also look at the amount
23:50 of roadway that has been torn up by
23:52 these two new projects they're raised
23:54 that's tax dollars it's going down the
23:56 drain it's roadways that's less than a
23:59 couple years old is being torn up again
24:01 once the power lines if we ever do get
24:05 them underground there's more project or
24:07 more roadway that'll maybe only be five
24:10 ten years old that we're digging up
24:11 again and those are our tax dollars at
24:13 work so I'm asking to the city to be
24:15 more proactive with all the Departments
24:18 looking together more proactive in
24:20 defining where your utilities need to go
24:23 in the future how they need to function
24:25 and plan for that set aside some
24:27 reserves so when you have a project
24:29 let's not relocate a telephone pole six
24:33 times and still have it in the area that
24:35 trees are going to fall down on it
24:37 that's crazy
24:38 because who pays for it those of us that
24:41 live in that neighborhood at the very
24:42 end I also was talking about emergency
24:44 access
24:46 and my concern with all this projects
24:48 have been happening along there
24:50 that
24:51 East Side Fire and rescue's time is
24:54 taking longer and longer and on Friday
24:56 when I was walking along there like I
24:57 say had I not waved and the car at front
25:00 not seeing me and I maybe had the window
25:03 rolled down it would have taken that
25:05 fire truck a long time to get through
25:08 that bottleneck to get to wherever it
25:10 was going and so we need to minimize the
25:13 amount of road closures on our major
25:16 ulteriors not only for the convenience
25:18 of the neighborhood and the amount of
25:20 time we have to pay but for the safety
25:22 of our neighborhood Eastside fire and
25:25 rescue uses Newport wave to access all
25:27 the Western area and if they have to go
25:29 out and about on s900 or on I-90 that's
25:34 bad so please work together plan ahead
25:37 and set aside some funds thank you thank

25:55 members for the opportunity to be here
25:58 tonight and for the chance to offer my
26:02 support of the Our Savior Lutheran
26:05 Church proposed ordinance my name is
26:08 Doug Barrett I've lived in Issaquah for
26:10 over 25 years actually as a neighbor of
26:14 Zach halls and his family and raised
26:16 three kids in the South Cove
26:17 neighborhood so I'm a proud Issaquah
26:20 resident to be sure but I also am very
26:22 proud to be working on behalf of our
26:24 Savior Lutheran Church
26:26 uh as Ken mentioned I'm with uh
26:29 Meriwether advisors we're a commercial
26:31 real estate brokerage and advisory firm
26:35 that in Seattle but works throughout
26:37 Central Puget Sound region
26:39 we specialize in working with
26:41 non-profits and churches
26:44 to help them understand how they might
26:47 use their real estate in different ways
26:49 to better
26:51 fund their mission and fund their
26:53 Community programs and
26:55 it's an unusual Niche to be sure but
26:58 it's so rewarding for us because we feel
27:01 like we're making a great impact to our
27:03 communities with the work that we're
27:04 doing because the reality is faith-based
27:08 communities and many non-profits are
27:10 under intense pressure right now
27:12 in the case of churches unfortunately
27:15 they're losing congregation members and
27:19 they're facing Rising costs and it's a
27:22 very difficult environment for these
27:24 faith-based communities to be in so we
27:27 like working with faith-based
27:29 communities and churches to help them
27:31 reimagine what could be done with their
27:33 real estate to help set them up for
27:36 decades more of relevance in our
27:38 community and that's
27:39 the role that I feel that we're playing
27:41 with Our Savior Lutheran Church we've
27:44 worked on behalf of St James Cathedral
27:47 and Trinity Episcopal church and
27:49 University Temple United Methodist
27:52 Church University Christian Church
27:54 Seattle University St Mark's Cathedral
27:57 the Plymouth Congregational Church in
27:59 downtown Seattle
28:01 uh and and Immaculate Conception Parish
28:04 St Mary's many many others and I'd like
28:07 to talk just very briefly about a few of
28:11 these projects for the fry Art Museum
28:14 we help them sell some excess land that
28:17 they had that has provided now
28:20 multi-family rental units but the fry
28:23 Art Museum took some of their proceeds
28:25 and funded their arts program at the fry
28:28 Art Museum and took other parts of their
28:30 proceeds to buy units in the new
28:32 development for their artists and
28:34 residents this enables artists to live
28:37 in in in nearby in the in the fry Art
28:40 Museum community and that's a very
28:42 unusual circumstance and some has been
28:44 very important to the Fryar Museum we
28:47 represented St James Cathedral in a
28:49 ground lease transaction that's
28:50 providing regular income to St James
28:53 Cathedral and the land is being used for
28:57 affordable senior housing rental units
28:59 something that is very hard to come by
29:01 and Seattle we represented University
29:05 Christian Church which sold a part of
29:07 their land for over a hundred units of
29:10 affordable housing
29:11 and they sold a portion of other parts
29:15 of their land to fund their own
29:16 endowment which they used to donate to
29:19 Community programs in and around their
29:23 their Church community we represented
29:27 University Temple United Methodist
29:29 Church to be able to construct a new
29:31 Sanctuary because their Sanctuary was
29:33 not seismically sound enough and fund
29:36 their endowment which will enable them
29:38 Propel their mission for another hundred
29:40 years
29:41 in Seattle we see the same potential
29:45 here with Our Savior Lutheran Church to
29:47 us can say said create a true win-win
29:51 except I would say win-win-win we think
29:54 with the council's support of this
29:56 ordinance
29:58 Our Savior Lutheran Church can benefit
30:02 so can the non-profit or other use that
30:05 they could invite onto their campus
30:07 and so can the Issaquah community so
30:10 there really is a potential for a true
30:12 win-win-win but we would ask for the
30:14 council's support of the ordinance to
30:16 enable that to happen thank you very

30:43 hi there my name is Josh Friedman and
30:45 I'm here as the attorney for Our Savior
30:48 Lutheran Church I think the church
30:50 Community has spoken more persuasively
30:53 than I certainly ever could about the
30:56 rezone and redesignation proposal that
30:59 they've prepared and submitted and which
31:02 you have before you for decision tonight
31:05 um so I just want to kind of uh tie up
31:09 our our record with a bow by thanking
31:12 the city's staff team and the church's
31:15 uh Community for all the detailed
31:18 attention that they've devoted to this
31:20 somewhat complex process over the course
31:22 of this year
31:24 um through that process I think the
31:26 church has thoroughly thought through
31:28 and answered all questions that have
31:30 been raised about this proposal
31:33 so in the
31:35 um and I
31:37 recently uh you saw Doug speak about how
31:40 these proposals really can and have in
31:43 communities throughout the region
31:45 enabled faith-based communities to
31:47 continue to serve their own missions to
31:50 provide their uh property to also other
31:55 community entities and community
31:57 services and uh
32:00 better integrate and serve Community
32:02 needs that we all see before us so in
32:06 the spirit of the upcoming Thanksgiving
32:08 holiday I'm hoping the council will
32:11 support this effort to provide greater
32:13 capacity for public serving and
32:15 Community Building work on this site
32:18 we'll be here and would be happy to
32:20 answer any questions you may have in the
32:23 course of the meeting thank you thank

32:49 all right awesome I decided to actually
32:51 do this meeting from home tonight so I'm
32:53 not going to turn on my camera because
32:54 you'll see the uh the crazy amount of
32:56 laundry I'm trying to get done at the
32:58 same time so I apologize
33:00 um I really appreciate your time this
33:02 evening
33:04 I represent the Wildwood proposal our
33:06 firm represents the Wildwood proposal
33:09 for a reason which has been recommended
33:11 to be denied which I think is a really
33:14 unfortunate situation
33:16 the sole reason for the recommendation
33:19 of denial when you go through the
33:21 information that's in the packet as
33:23 revised is around General conformance uh
33:28 with the uh with the zoning and
33:31 I you know it's been brought up that
33:34 there's issues with critical areas and
33:37 other uh you know restrictions on this
33:39 site which is exactly the reason uh why
33:43 we believe the rezone is necessary in
33:46 order to be able to provide a good level
33:48 of Housing and some housing
33:50 opportunities that are needed throughout
33:52 the region and I won't get into a lot of
33:55 the facts and the figures that we put
33:57 into several of our letters here
34:00 recently to talk about the housing needs
34:02 that we have in the region but even the
34:06 lieutenant governor's office and uh in
34:10 cooperation with the legislature has
34:12 pointed out that it is one of our top
34:15 issues affecting Economic Development
34:17 and really just the fabric of our
34:19 communities is we need to address
34:21 housing uh that being said this General
34:24 conformance matter I'd direct you to
34:28 page 53 of the packet that's specific to
34:31 this agenda item
34:33 and if you look at the two zones the
34:36 existing Zone the proposed Zone setbacks
34:39 are the same impervious surface limits
34:42 are the same
34:43 both have no minimum lot width and the
34:47 only real difference is the building
34:48 height and the density allowance
34:51 the significant difference though in
34:54 development terms is that under the
34:57 existing zoning you're limited to no
34:59 more than four attached units
35:01 and so even with the ability to use your
35:04 clustering ordinance you can't work
35:07 around the constraints on the site to
35:09 make a very economically viable project
35:11 that can be an opportunity to provide
35:15 housing options that are not at the
35:18 highest end of people's budgets
35:22 and with the proposed zoning it gives
35:24 the opportunity to look at some
35:27 different housing styles that would be
35:30 allowed to be able to create some
35:32 density on this site and work around the
35:35 constraints that are present at the end
35:37 of the day whether it develops under the
35:39 current zone or the future Zone
35:42 the development footprint is going to be
35:44 the same
35:45 the protection of critical areas is
35:48 going to be the same zoning does not
35:50 affect the critical areas that are
35:53 identified or how they're rated or what
35:54 buffers get applied or what standards we
35:58 look at for making sure that we
36:01 mitigate any impacts that could happen
36:04 to buffers
36:05 and so I really think it's a lost
36:07 opportunity here to have the city
36:10 reading deny this rezone especially when
36:14 you know we're facing such a housing
36:15 crisis that is only getting worse
36:19 um even with the market conditions being
36:21 the way they are it's certainly not
36:24 helping buyers uh it's not helping
36:26 renters uh get into the marketplace and
36:29 find Opportunities to have housing
36:31 that's affordable
36:33 and housing that's supportive
36:35 and I would hope that the city council
36:38 would reconsider the recommendations to
36:41 deny this rezone and move it forward
36:44 um it is an opportunity and I say it
36:48 very often in the communities that I
36:51 work in on proposals like this once
36:54 you've allowed something to develop it's
36:56 very difficult for many years to go back
36:59 and change that decision
37:01 and when you allow something to develop
37:03 at a very low density and not take
37:06 advantage of creating the opportunities
37:08 that we need we lose out on we could
37:14 have created the the housing we needed
37:16 but we didn't
37:18 um and I I it's just unfortunate so I've
37:22 seen it throughout my career working in
37:24 housing as an advocate
37:26 you know I've had people on my staff
37:28 where it's tough to employ people that I
37:33 have working on housing projects when
37:34 they can't even often afford the housing
37:37 that they're helping to support create
37:40 and I'm hoping that at some point
37:43 throughout this region in this situation
37:45 and others that we won't pass up
37:48 opportunities to do wise rezones that
37:51 are not inconsistent with their
37:53 surroundings and allow for the efficient
37:55 use of our land Supply because honestly
37:58 speaking Urban growth boundaries are not
38:01 going to be bad at any time in the near
38:03 future we have the land support excuse
38:06 me this is the clerk you've reached the
38:07 end of the five-minute comment period

38:20 comments tonight we heard about
38:23 many speakers tonight speaking on the
38:25 Civic Council might be considering this
38:27 evening we had someone call in and talk
38:30 about route planning for the Turkey Trot
38:34 um we heard from residents about the
38:37 need for more coordinated long-range
38:39 planning and some issues with cable
38:42 providers
38:44 and I think that's about it so thank you
38:47 all for taking the time to address the
38:49 council this evening we really
38:50 appreciate it and as a reminder if you
38:53 have written comments you can submit
38:54 them at any time to the city council at
38:56 issaquah.gov at council president Walsh
38:59 who is joining us virtually I just
39:01 wanted to give her an opportunity to
39:03 share any email comments that the
39:05 council may have received on any of
39:07 tonight's agenda topics

39:13 highlight and I'm sure the council has
39:14 received you know all of these but
39:17 throughout the feedback process the
39:19 council has received dozens of emails
39:22 regarding the various comprehensive plan
39:25 reason requests
39:27 um that are on tonight's agenda and we
39:29 have read all of them and appreciated
39:30 hearing from some of them tonight I
39:33 won't summarize how many there were in
39:35 each area but they all shared great
39:39 stories about
39:40 um what each of these properties mean to
39:43 them thank you thank you council
39:45 president next item of business on this
39:48 evening's agenda is committee and
39:49 Regional reports and I'll start with
39:51 council member Joe
39:52 thank you madam mayor the mobility and
39:55 infrastructure meeting which was
39:56 scheduled for December 13th is canceled
40:00 the Cascade water Alliance board met on
40:03 the 16th of November and there were no
40:06 significant impact significant decisions
40:09 impacting Issaquah that were made during
40:11 that meeting that concludes my report
40:13 thank you thank you council member
40:15 councilmember D Michelle
40:16 thank you mayor Paulie on November the
40:19 16th I attended the regional transit
40:22 committee and uh during that meeting the
40:24 RTC unanimously approved the Metro
40:27 Transit 2022 system evaluation which now
40:31 moves to the King County Council for
40:33 approval the December RTC meeting has
40:36 been canceled
40:38 and then on November the 18th I zoomed
40:41 into the Eastside Transportation
40:42 partnership meeting from Kansas City
40:44 where I was attending the national
40:47 league of cities convention and that was
40:50 once again demonstrating the value of
40:52 remote connections
40:54 ETP members received a presentation from
40:57 Metro regarding its new strategic plan
40:59 dashboard and its Rider dashboard I have
41:03 sent those links to both dashboards to
41:06 the council and would gladly share those
41:09 links with anyone who else who is
41:11 interested
41:12 following the Metro presentation ETB
41:15 members reviewed and approved a draft
41:18 ETP legislative priorities document that
41:22 also has been distributed to council
41:23 members for review and comments I'd just
41:26 like to ask my uh
41:29 fellow council members to please note
41:31 that the document was completely
41:34 Rewritten in light of the move ahead
41:37 Washington legislation that passed in
41:39 2022
41:41 also the ETP members work to produce
41:43 some more General platform for future
41:45 requests since the consensus of the
41:48 group is that the legislature having
41:50 passed such a historic piece of
41:53 legislation will not be as focused on
41:56 Transportation this year so we're
41:58 preparing with the current the draft to
42:03 create a sort of framework for future
42:05 advocacy
42:09 um there is a general sense of the a
42:11 body that we should focus on the timing
42:13 and sequencing of projects already
42:16 approved in the move ahead Washington
42:17 package very similar to the statement
42:20 that was in our own uh legislative
42:23 agenda
42:24 so uh I would ask you to review and
42:27 prepare comments and I will accept
42:29 council's comments on the let ETP
42:32 legislative priorities at the December
42:34 5th meeting under good of the order and
42:36 then the next ETP meeting is December
42:39 the 9th so we'll do a final approval at
42:43 the December 9th meeting and that
42:45 concludes my report thank you thank you
42:47 council member councilmember hunt thank
42:49 you madam mayor the salmon Recovery
42:51 Council of wire 8 met on November 17th
42:55 and wire 8 is the technical name for our
42:57 watershed
42:58 the major agenda items included approval
43:01 of funding recommendations for the small
43:03 grant program of wyra 8 and a
43:06 presentation about the upcoming 2023
43:08 wyra 8 Grant rounds and then approval of
43:11 the 2023 Cooperative watershed
43:13 management grant program funding
43:15 guidance and this year we were
43:17 considering among other criteria
43:19 diversity equity and inclusion
43:21 criteria so that was great to hear how
43:24 grants were looked at through that lens
43:27 uh we also had a informational
43:30 presentation about Watershed the
43:33 Watershed salmon returns and the
43:35 monitoring that's ongoing and an update
43:37 on King County's recently completed
43:39 restoration project at the little bit
43:41 site on Bear Creek there's an upcoming
43:43 meeting of the salmon Recovery Council
43:45 January 19th and 2023 so that was our
43:48 last meeting of 2022. that concludes my
43:50 report thank you council member
43:52 councilmember Wray thank you mayor
43:54 Paulie very briefly tonight the King
43:56 County growth management planning
43:58 council is scheduled to meet on November
44:00 30th and the agenda has not been set
44:03 thank you councilmember march thank you
44:06 madam mayor the Puget Sound Regional
44:08 Council growth management policy board
44:11 met on Thursday November 3rd from 10
44:15 till noon no action occurred at that
44:18 meeting sound cities Association public
44:20 issues committee met virtually online
44:23 November 9th from 7 till 9 pm and we did
44:27 take up for potential feature action
44:29 that a 2023 SCA legislative priorities
44:33 draft which I forwarded to all of you
44:35 and will be asking for feedback at
44:37 tonight's uh good of the order in in
44:41 preparation for my uh commenting at the
44:44 next pick meeting presenting feedback
44:46 from our Council the council services
44:49 safety and Parks committee met on
44:51 Tuesday November 15th at 6 30 pm here in
44:54 Chambers we had two items on the agenda
44:56 ID 1298 Tod project Tibbetts Valley Park
45:01 cell tower lease this was a presentation
45:03 on a potential relocation of a cell
45:06 tower that is on the property that would
45:08 be potentially re done for the Tod
45:12 project and we voted 3-0 to continue to
45:15 negotiate with vertical bridge on the
45:17 lease for telecommunications Tower to
45:19 support the todoc project and then the
45:22 second bill was related ID 1297 King
45:26 County Housing Authority interlocal
45:28 agreement this would be an agreement
45:30 that basically as part of this effort
45:35 would basically enshrine that the use of
45:38 that property would be by King County
45:41 Housing Authority it set certain terms
45:44 around the fraction that would be market
45:46 rate housing and the fraction that would
45:48 be subsidized housing as well as certain
45:51 other terms and we voted three to O to
45:54 advance the Ila for full Council
45:56 consideration which I believe will be
45:58 occurring at the next city council
46:00 meeting this concludes my report

46:13 meeting of the King County affordable
46:15 housing committee will be Friday
46:16 December 2nd the agenda is not yet

46:24 King County county-wide Planning
46:27 policies to present those to the other
46:30 board for approval that concludes my
46:32 report
46:33 thank you council president uh next item
46:35 on the agenda this evening is the
46:37 mayor's report
46:38 there will be no executive session there
46:42 is no executive session scheduled for
46:43 this evening
46:45 as part of tonight's consent calendar
46:47 city council has anticipate to vote on
46:49 ab8490 this is an authorization for the
46:53 mayor to enter and execute an
46:54 interagency agreement with Washington
46:56 State Parks and Recreation Commission
46:59 this interlocal agreement allows the
47:01 city to continue to explore the
47:03 conversion of State Park land and the
47:05 sighting of a fire station near the boat
47:07 launch at Lake Sammamish State Park this
47:10 agreement would permit the city to
47:12 reimburse state parks for exploratory
47:14 work into the feasibility of the
47:15 sighting including appraisals and a
47:18 cultural resource review
47:20 this interlocal does not commit the city
47:22 to exchanging any city land for the
47:24 state park property the city council
47:26 will have the ability to make that
47:27 decision at a future date if the current
47:29 work indicates that the exchange is
47:31 feasible
47:32 earlier tonight we had a fabulous
47:34 perception for our Human Services
47:36 Commission for the council to be able to
47:38 meet greet and thank them for the
47:40 incredible work that they completed
47:42 earlier this year on the Human Services
47:44 Grant recommendations the city council
47:47 adopted the recommendations made by the
47:49 commission as part of the city's
47:50 biannual Budget on November 7th
47:53 and in tonight's Council agenda there is
47:55 the Human Services quarterly report this
47:59 informational update includes a summary
48:00 of the activities conducted by the Human
48:02 Services Division from July 1st to
48:04 September 30th 2022. in particular I
48:08 encourage council members to review the
48:09 incredible work that our Human Services
48:11 Commission performed to provide Human
48:13 Services Grant recommendations and thank
48:16 you again for the commission to the
48:18 Commissioners for their outstanding work
48:20 there are a few upcoming events that I
48:22 thought I would give you notice of
48:23 coffee with the mayor which we were
48:25 doing before covid is back I will be
48:29 able available for Community Dialogue on
48:31 November 22nd from 3 30 to 5 at 55.

51:11 zoning map amendments the ask before
51:13 Council this evening is to adopt the
51:15 ordinances and I'd like to invite it

51:51 I am now we got you can see it yep we
51:55 can see the presentation and we can hear
51:56 you
51:57 okay I am Kristen Leeson a senior
52:00 planner with the community planning and
52:01 development department and I'm here
52:03 tonight to talk about the proposed 2022
52:05 comprehensive plan and zoning map
52:07 amendments
52:10 if I can get this slide to change
52:13 here we go
52:14 so tonight's purpose is to take action
52:17 on the proposed amendments
52:19 but taking a step back a little
52:21 background you may recall that in
52:23 February of this year city council
52:25 approved a docket of proposed conference
52:27 a plan designing a map amendments which
52:29 this year only included three proposed
52:32 results or requested reasons and a
52:35 reminder that the docket is required by
52:37 the state so that we look at all of the
52:39 proposed amendments holistically rather
52:41 than piecemeal
52:43 we will get into details of these
52:45 proposed amendments in a few minutes
52:47 so some of the things that we consider
52:50 when we're doing reasons is that first
52:52 they meet the criteria I'll get into
52:54 that as well second is that we look at
52:56 all uses particularly highest best uses
52:58 on the property because sometimes
53:00 someone will come in and say we want to
53:03 do this on this site and maybe they
53:06 submit a permit but it doesn't always
53:07 happen and then if it doesn't happen and
53:09 the property has been rezoned something
53:10 else could happen there so you have to
53:12 look at everything and the last one is
53:14 development standards comparison what's
53:16 allowed on the site now as far as height
53:18 impervious
53:19 setbacks far
53:21 as opposed to what could possibly
53:23 potentially go on that site
53:26 so the criteria are located in our land
53:29 use code Title 18 it's a 1804 procedures
53:33 632 reasons
53:35 um and there are 10 of them so from a
53:38 complete application to is there a
53:40 community benefit provided here
53:42 zoning conformance can you develop under
53:44 the proposed zoning the two that are
53:47 highlighted in Orange we will be talking
53:49 about tonight a little bit more but the
53:51 growth controls
53:53 this was written
53:55 um several years ago but it's intended
53:58 you know if if the request is going to
54:00 improve increase housing and density on
54:02 a site and we have not met growth
54:06 control or the GMA the growth management
54:08 act mandated housing targets then it
54:12 could be that meets the Criterion could
54:14 be approved the other one has changed
54:15 circumstances or Regional development
54:17 this is number four and something on or
54:20 adjacent to the site has changed and
54:23 this needs to change in accordance with
54:25 those changes or maybe the zoning
54:27 District
54:29 is it's appropriate for a reason that a
54:32 reasonable development on that site if
54:34 with the new resume
54:36 there's no detriment to adjacent
54:37 property material detriment it's
54:39 consistent with or can be consistent
54:40 with the comprehensive plan it would be
54:42 consistent with any development would be
54:44 consistent with city regulations any
54:46 public services
54:47 utilities are on site or could be
54:50 provided on the site and environmental
54:52 impacts can be mitigated and for some
54:53 reason they can't be mitigated then
54:55 those impacts are considered acceptable
54:58 those are the criteria that we look at
55:01 the first one I'm going to talk about is
55:03 the Newport area and so just sort of
55:04 ignore what I just said
55:07 um this is a this is a unique situation
55:09 so this parcel is 0.41 Acres
55:13 it is currently zoned the land use
55:15 designation is community facilities the
55:17 proposed designation is a multi-family
55:20 residential the existing zoning is
55:23 community facilities Recreation and the
55:25 proposed zoning is Village Residential
55:28 this is actually being proposed by the
55:30 city as a correction to an oversight
55:32 that was made in 2021 so in the years
55:37 ago as part of the Anthology development
55:38 Anthology was required to give the city
55:40 land to be used as a Park and trail on
55:43 the site so what you see here in the
55:45 blue was given to the city
55:47 unbeknownst to us a lot line adjustment
55:50 happened in 2019 and taking this parcel
55:53 with the orange dotted line
55:55 out of this parcel 107 and putting it
55:58 into this parcel 109 you can sort of see
56:00 it outlined here
56:02 um which means that Technically when
56:04 this was rezoned last year
56:07 it wasn't actually this little parcel
56:09 was it actually rezoned but it was
56:11 because of the map anyway it's a
56:13 correction that needs to be made you can
56:15 see on this map from the aerial view
56:17 that's where it's located here's the
56:19 entrance to anthology
56:21 here's the trail
56:23 and then here you can see this actually
56:26 contains the utility box for Anthology
56:28 it also serves as the stormwater Vault
56:31 for Anthology and it's the entrance to
56:34 the area so this it won't be changing
56:37 it would remain as you know when it's
56:39 Village Residential these same uses will
56:42 remain
56:43 so the recommendations the
56:45 administration the planning policy
56:47 commission and the Planning Development
56:48 and environment committee all recommend
56:50 approval of this rezone and
56:52 redesignation
56:55 next I'm going to move on to Wildwood
56:59 Wildwood is a Four Acre Site located on
57:02 Wildwood Boulevard Southwest
57:04 it's in just south of sunset way and
57:07 Newport it is
57:10 um four acres
57:11 its current designation is low density
57:13 residential the requested designation is
57:16 multi-family residential
57:18 the existing zoning single-family small
57:20 lot for requested zoning is multi-family
57:22 medium you could see on here but to the
57:25 West are single family small lot and a
57:28 single family Suburban to the South is
57:30 multi-family medium open space is to the
57:34 right and more single family small lot
57:37 it's located on the East up north
57:40 and when you look at the aerial map you
57:42 can see there are no structures
57:43 currently on the site it is heavily
57:45 treed
57:46 and when you look at the oh and uh there
57:49 are single-family houses that's what's
57:51 developed primarily around here
57:54 and when you look from the street level
57:56 there is it's I'll read There is a path
57:59 that runs adjacent to that multi-purpose
58:01 trail that runs adjacent to the site
58:03 it's not on the site
58:06 additional uses that need to be
58:08 considered would be
58:10 Triplex vorplex although we have denied
58:13 multi-family housing Assisted Living
58:15 library right now elementary schools and
58:18 middle schools are allowed on the site
58:19 but this would allow high schools and
58:21 colleges personal grooming and a small 4
58:23 000 foot grocery store
58:26 standards this actually doubles the
58:28 density it would take it from 7.2 to six
58:30 dwelling units per acre to 14.5220 units
58:33 per acre it also reduces the minimum lot
58:36 size from 6 000 square feet to 2500
58:38 square feet these setbacks and
58:40 impervious surface are about the same
58:42 the base Building height would go from
58:45 30 feet to 40 feet and with the
58:47 potential of going to 50 feet under
58:49 multi-family medium
58:52 there are several environmental
58:53 constraints
58:55 so everything you see in green right
58:57 here is a steep slope the brown is the
59:00 steep slope buffer which is 50 feet in
59:03 addition to that there's another 15 foot
59:05 setback that would be required
59:07 on the right we have
59:09 uh the water constraints so you have the
59:12 dam access Creek which is a class three
59:14 has a 50 foot setback or a 50-foot
59:16 buffer excuse me and
59:19 again with a 15 foot setback and then
59:21 Issaquah Creek
59:23 is a Class one and has a hundred foot
59:25 buffer with a 15 foot setback and I
59:28 should note that this is shown from the
59:31 center line and not from the high water
59:33 mark and the high water mark would push
59:34 it out a little bit the Planning
59:37 Development and environmental commission
59:38 asked environment commission asked if we
59:41 could please show it from the high water
59:42 mark because it does change what it
59:44 looks like and we were told no it
59:47 requires a consultant
59:48 and it changes regularly so that's why
59:51 it's usually marked at the time of
59:53 development rather than
59:55 as a as a place in time now
59:58 it's a market time now
1:00:01 um our Shoreline master program also
1:00:04 designates this part of Issaquah Creek
1:00:06 as the Issaquah Creek Urban Conservancy
1:00:08 area which puts on this a 200 foot
1:00:11 buffer from the from the high water mark
1:00:13 of the creek which disallows or does not
1:00:16 allow
1:00:17 multi-family within 200 feet of the
1:00:19 creek
1:00:20 so if you look at this layer when you
1:00:22 overlay the steep slopes with the urban
1:00:25 Conservancy with the creek buffers what
1:00:28 you see in green is the remaining
1:00:29 developable site approximately
1:00:35 so the wild would recommend
1:00:36 recommendations the administration does
1:00:38 not approve this because it would not
1:00:39 meet criteria for which means it
1:00:41 wouldn't be appropriate for reasonable
1:00:43 reasonable development under the
1:00:45 requested zoning
1:00:47 planning policy commission also does not
1:00:49 approve and they base it on criteria
1:00:51 number four as well but they also cited
1:00:53 criteria number three which talks about
1:00:55 the growth targets and whether the
1:00:58 stating that we have already met our
1:01:00 growth targets
1:01:01 the Planning Development and environment
1:01:03 committee has the same recommendation as
1:01:05 the administration that we do not
1:01:06 approve this or that you do not approve
1:01:09 this again citing criteria number four
1:01:11 and reasonable development
1:01:16 lastly is Our Savior Lutheran Church
1:01:19 this is about three and a half acres
1:01:21 located on Front Street South
1:01:24 it is that's existing land use
1:01:26 designation is low density residential
1:01:30 and they're requesting multi-family
1:01:31 residential the zoning is currently
1:01:33 single family small lot and they are
1:01:35 requesting multi-family High
1:01:37 and looking here you can see that to the
1:01:40 east of the property and to the south of
1:01:42 the property it is on multi-family high
1:01:44 this parcel right here Missouri
1:01:45 multi-family high is actually owned by
1:01:47 the church this is developed whoops I
1:01:49 apologize
1:01:51 this is developed as Condominiums and
1:01:54 apartments this site down here is a
1:01:56 nursing home
1:01:57 or here you have multi-family medium
1:01:59 these are Condominiums and then an open
1:02:02 space directly to the north
1:02:07 looking at the area you have the church
1:02:08 this is the other parcel that's owned by
1:02:10 the church and it has parking there's a
1:02:12 church there's also a single family
1:02:13 house back here
1:02:16 it is from the street view
1:02:20 it's similar to the other one additional
1:02:22 uses that would need to be considered
1:02:24 are much denser multi-family Assisted
1:02:27 Living Museum or Art Gallery again a
1:02:30 high school and garage Library
1:02:32 distribution warehouse and shipping a
1:02:35 grocery store and office both about 4
1:02:37 000 square feet personal grooming
1:02:40 and then development standards this more
1:02:43 than triples the amount of allowable
1:02:44 density on the site from 7.26 acres to
1:02:47 29 I'm sorry from 7.26 dwelling units
1:02:50 per acre to 29 dwelling units per acre
1:02:52 it also has no minimum lot size whereas
1:02:54 single family small lot is 6 000 square
1:02:56 feet again the setbacks and the
1:02:59 impervious impervious surfaces are about
1:03:00 the same as they would be existing
1:03:03 the base Building height would go from
1:03:05 30 feet to 40 feet with the potential to
1:03:07 go to 65 feet in order to go up and
1:03:10 increase the height there are conditions
1:03:12 that must be met one of those includes
1:03:14 increasing the pervious Surface by 10
1:03:16 percent which would decrease the
1:03:18 impervious surface that also would
1:03:20 require step X of 25 once you hit the
1:03:23 third floor of a building and there are
1:03:25 other things that are listed
1:03:30 environmentally uh the Issaquah Creek
1:03:34 um adjacent to the property so I'm going
1:03:36 to start over here on the right runs
1:03:38 adjacent to the property
1:03:40 um it's it's about creating this class
1:03:42 one and it has a 100 foot buffer plus a
1:03:45 15 foot setback and this is from the
1:03:46 center from the center line there are
1:03:49 minimal steep slopes on this property
1:03:51 that have a 50-foot buffer right here
1:03:53 this also
1:03:56 is designated as is the clock Creek
1:03:58 Urban consistency Urban Conservancy
1:04:01 under our Shoreline master program it
1:04:03 has a 200 foot buffer within the 200
1:04:05 feet you cannot put multi-family within
1:04:07 100 feet which would be this one over
1:04:09 here but about right there you cannot
1:04:11 put commercial
1:04:12 those are not allowed uses there
1:04:16 so the administration's recommendation
1:04:18 is to approve the rezone the planning
1:04:21 policy
1:04:22 recommends denying the reason
1:04:25 they do recommend however that the
1:04:28 applicant engage in discussions with
1:04:29 Council about a development agreement
1:04:31 their basis for not approving this is
1:04:33 our is criteria number three growth
1:04:36 controls stating that they believe that
1:04:37 we have met our growth tarp growth
1:04:39 targets and the Planning Development and
1:04:42 environment committee recommends
1:04:43 approval
1:04:45 should these amendments be approved they
1:04:48 would become effective December 21st
1:04:52 our recommendations so there are three
1:04:54 different recommendations there are
1:04:55 three different ordinances you may
1:04:57 combine these if you'd like and take a
1:04:59 vote on two at the same time or three at
1:05:00 the same time
1:05:02 um but the three recommendations one is
1:05:04 to adopt an ordinance amending
1:05:06 comprehensive plan land use designation
1:05:08 math and sending map for the Newport
1:05:11 the second is to adopt an ordinance
1:05:13 amending the comprehensive plan land use
1:05:14 designation map and zoning map for Our
1:05:16 Savior Lutheran Church and the last is
1:05:18 to adopt an ordinance denying the
1:05:20 changes to the comprehensive plan and
1:05:22 land use designation land use
1:05:24 designation map and zoning map for
1:05:25 Wildwood
1:05:27 and that is the end of my presentation
1:05:31 thank you Kristen um I'm just going to
1:05:33 check in with Rachel if you needed to
1:05:36 address the Council on the ordinances at
1:05:43 thank you madam mayor for the record
1:05:45 Rachel Turpin City attorney I just
1:05:47 wanted to let you all know I believe
1:05:49 you've been advised in advance of this
1:05:51 meeting that there were some minor
1:05:53 changes made to the ordinance uh the
1:05:57 proposed ordinance recommending denial
1:06:00 of the Wildwood Amendment
1:06:03 earlier today the packet was replaced or
1:06:07 the or the version of the packet was
1:06:09 replaced these were minor revisions that
1:06:12 were made to better reflect the
1:06:14 discussion that occurred at the Planning
1:06:17 Development and environment committee a
1:06:20 couple weeks ago that's it thank you
1:06:22 thank you Rachel and now I'll turn it
1:06:24 over to committee chair hunt if you'd
1:06:26 like to provide a planning development
1:06:27 environment committee recommendation for
1:06:28 this item
1:06:30 yes thank you
1:06:31 um so the recommendation was covered in
1:06:34 the presentation thank you Kristen for
1:06:37 um the Planning Development and
1:06:38 environment committee met on November
1:06:39 1st to discuss this item and
1:06:43 we agreed with the staff recommendation
1:06:46 at that time on all three of the items
1:06:49 uh the first one was the is the Newport
1:06:53 area rezone which is the request by the
1:06:55 city and we had very little discussion
1:06:58 on this topic we felt it was a
1:07:00 technicality and there was no reason not
1:07:03 to approve it as such
1:07:06 um and then on the second two items we
1:07:08 had more discussion we agreed with the
1:07:12 staff on the Wildwood
1:07:16 on the staff's recommendation regarding
1:07:18 the Wildwood rezone and redesignation we
1:07:21 did not think that this met criteria
1:07:23 four which is the one about that the
1:07:25 rezone is warranted because of change
1:07:27 circumstances and the need for
1:07:28 additional property in the proposed land
1:07:30 use District or because the proposed
1:07:31 zoning district is appropriate for
1:07:33 reasonable development of the property
1:07:35 we didn't believe that Circumstances had
1:07:38 had changed
1:07:40 and we also had a discussion about the
1:07:43 environmental constraints and the
1:07:45 extensive
1:07:50 um areas around or on this property that
1:07:53 would not be developable because of
1:07:55 environmental
1:07:58 constraints including also Shoreline
1:08:00 master program a number of other issues
1:08:04 um so on that one we agreed with the
1:08:07 staff's recommendation to deny the
1:08:09 recommendation
1:08:11 we also had a discussion on this one as
1:08:14 well as on the Our Savior Lutheran
1:08:17 Church
1:08:18 request about that neither of these
1:08:21 requests for rezone were in central
1:08:24 Issaquah but they were adding density so
1:08:27 they weren't in our Urban growth planned
1:08:30 area for the most growth we did have a
1:08:32 discussion about that in our comp plan
1:08:34 it it states that that's preferred that
1:08:37 is what we are preferring but also it's
1:08:41 still a legislative decision and still
1:08:43 up to our individual judgment on a
1:08:45 case-by-case basis and I'll look to the
1:08:47 attorney if I've misstated anything but
1:08:49 um it's up to us basically to determine
1:08:52 each one and to factor in that it isn't
1:08:55 in within our regional growth Center or
1:08:57 it isn't within Central Issaquah but we
1:09:00 still have to take each
1:09:02 each reason request into consideration
1:09:04 on its own Merit
1:09:06 and then with Our Savior Lutheran Church
1:09:09 we believe that that one did meet the
1:09:10 criteria necessary for the rezone
1:09:14 we had a discussion about two of the
1:09:18 criteria in particular so the criteria
1:09:21 three was the criteria that the planning
1:09:24 policy commission recommended
1:09:27 um was the one that they recommended
1:09:29 against the rezone because they felt
1:09:32 that it didn't meet that criteria
1:09:35 unfortunately we they Unfortunately they
1:09:39 did not have
1:09:40 um the legally defensible interpretation
1:09:43 of that criteria and it's very
1:09:45 complicated criteria it refers to a
1:09:48 growth Target they interpreted that as a
1:09:50 as a previous growth Target and then
1:09:53 when the committee asked our legal
1:09:56 counsel about which growth Target we
1:09:57 should be looking at we were told that
1:10:00 the more legally defensible growth
1:10:02 Target to be considering was the 2044
1:10:04 housing Target which we have not which
1:10:06 we have accepted as a city but we have
1:10:08 not yet met
1:10:10 and today we're using an older growth
1:10:13 Target and they also in their discussion
1:10:15 were considering capacity for housing
1:10:19 just that we could meet our growth
1:10:22 Target uh without this zoning change
1:10:25 which is also
1:10:29 not the um
1:10:31 legally defensible way to interpret the
1:10:33 criteria so unfortunately they didn't
1:10:36 have that guidance we did I think that's
1:10:40 a key factor in why we ultimately went
1:10:42 with a different recommendation than the
1:10:44 planning policy Commission
1:10:48 we also had a discussion about their
1:10:49 recommendation which was to go into a
1:10:53 in a conversations
1:10:56 um about a development agreement and
1:10:58 that requires both parties to be willing
1:11:01 and in this case both parties both the
1:11:03 city and the and the applicant both
1:11:05 preferred to they both recommended and
1:11:08 preferred to have the rezone rather than
1:11:11 go this extra step with the current
1:11:13 zoning so we didn't think that that
1:11:16 we didn't um
1:11:18 think that that would be the way to go
1:11:21 [Music]
1:11:23 and then basically we agreed that it met
1:11:26 all of the other criteria and that when
1:11:29 we were using the 2044 housing targets
1:11:31 the city had not yet met those so that
1:11:34 criteria was was not something
1:11:37 um that that was violated in this case
1:11:48 yeah and so I think um I think
1:11:50 ultimately we came to the same
1:11:51 conclusions as the staff and I did just
1:11:53 want to thank the planning policy
1:11:56 commission I watched their meeting and I
1:11:57 thought I think that served as a really
1:11:58 good basis for our conversation it teed
1:12:00 up a lot of really good questions for
1:12:02 our Planning Development environment
1:12:03 committee
1:12:05 um and a lot of those questions are
1:12:06 answered in our packet and I think
1:12:08 um so I think they were they their
1:12:10 discussion was really important for
1:12:12 getting us to this recommendation in the
1:12:15 future I think it would be really
1:12:17 important that especially when there are
1:12:19 complicated
1:12:20 criteria that require interpretation
1:12:23 that they have the same basis of
1:12:25 understanding and that same legal
1:12:26 counsel that we have so then we're
1:12:28 operating on the same playing field
1:12:31 um and so that concludes our discussion
1:12:33 and if you have any questions for me
1:12:35 about any of them please let me know

1:12:53 were a couple slides that you showed
1:12:54 both for the Our Savior Lutheran Church
1:12:57 in the Wildwood
1:12:58 requests around additional uses and you
1:13:01 have the different boxes of additional
1:13:02 uses that we should consider I was
1:13:04 hoping you could walk me through how
1:13:07 exactly we should use that slide as
1:13:10 we're considering these requests
1:13:14 and let me know if you need further
1:13:16 clarification on that
1:13:19 would you would you like me to pull
1:13:20 those slides back up if it's helpful for
1:13:22 the rest of the council sure why not
1:13:44 oh there we go
1:13:47 so I'll you wanted to see both correct
1:13:51 yeah I guess just more generally how
1:13:53 should we use them as we're thinking
1:13:55 about this concept tonight as we're
1:13:57 thinking about the requests
1:14:04 um I hope I didn't but I'm going to
1:14:05 start with that with one parcel
1:14:08 um what you see when you look at these
1:14:14 everything that is in this green and
1:14:17 brown right here cannot be developed oh
1:14:18 I'm really sorry
1:14:20 um the there were a couple slides let's
1:14:23 see how far away that one is
1:14:25 um that have all the different boxes of
1:14:27 additional uses like Triplex Assisted
1:14:29 Living yeah those how should we be using
1:14:31 this information in our decision making
1:14:36 um when you look at these you look at it
1:14:38 and you will not me when you when we
1:14:40 look at these uh we look at them and we
1:14:42 think okay so a Triplex and a fourplex
1:14:44 can go on this site
1:14:45 and there are this many environment
1:14:48 environmental constraints and it's
1:14:49 located adjacent to these uses would
1:14:51 these can would these be compatible uses
1:14:53 are these reasonable uses on the site
1:14:55 so that's that's what we're looking at
1:14:59 does that help
1:15:03 these are uses that would be allowed if
1:15:07 we adopted the rezone and redesignation
1:15:09 that are not currently allowed with the
1:15:11 current zoning so they could put a high
1:15:13 school there in theory if we put the
1:15:16 result but not currently not if we deny
1:15:19 the result
1:15:20 so right now in elementary school and
1:15:21 middle school can go there
1:15:23 that's one impact but this would allow
1:15:25 high school and potentially a college on
1:15:27 there which is a different impact so yes
1:15:34 so is this the same
1:15:39 way that we're thinking about the
1:15:41 considering highest and best use when it
1:15:43 comes to reasonable development then is
1:15:45 is that in the same space because I
1:15:46 guess for for
1:15:54 you knew we could as we move through
1:15:56 these I'm hoping that committee chair
1:15:57 wants to move them one by one because I
1:15:59 have a couple of council members who
1:16:00 need to make comments but you could
1:16:03 probe with your other council members as
1:16:05 well how they are using that different
1:16:07 information in their decision making
1:16:08 because I think I think
1:16:11 that will come out in your conversation
1:16:13 okay each one well that answered my

1:19:00 a few comments I did watch the planning

1:19:04 discussion and
1:19:06 I was very happy that I had done so
1:19:09 there are things that can't be captured
1:19:11 by the official minutes
1:19:13 it was a really good healthy discussion
1:19:16 that they had
1:19:17 and during the discussion although they
1:19:21 focused on criteria number three
1:19:24 um there were also many expressions of
1:19:29 what can I say very many expressions of
1:19:33 hope for the project itself
1:19:36 um and uh one of the Commissioners
1:19:39 commissioner Lewis stated if I were a
1:19:42 council member I would vote differently
1:19:45 than I'm voting as a commissioner
1:19:47 and so it was a very nuanced discussion
1:19:50 and as councilweber hunt said they did
1:19:54 not they were not privy to legal counsel
1:19:57 as we have been and thank you so much
1:20:00 for the clarification
1:20:02 so that was a one experience and then I
1:20:05 also wanted to commend the pde committee
1:20:08 for the excellent discussion they had
1:20:09 and the clarification that they had
1:20:13 to respond to your question about the
1:20:16 different uses at the policy Planning
1:20:20 Commission they did they were very clear
1:20:22 with the Commissioners that if they
1:20:23 approved
1:20:24 this ordinance that those are all the
1:20:27 possible uses and so you have to keep
1:20:31 that in the back of your mind that it
1:20:32 could someday be used and I think that's
1:20:35 full transparency that we understand
1:20:37 that yes someday it could be but we we
1:20:41 have some owners that are there right
1:20:43 now who have plans for what they'd like
1:20:44 to do
1:20:46 and I think those are reasonable plans
1:20:49 and also
1:20:51 as was stated earlier plans that could
1:20:54 be very beneficial to our community
1:20:57 um I also wanted to say that the
1:21:00 statements that were made about churches
1:21:02 uh being very logical places right now
1:21:05 because of the circumstances and the
1:21:08 declining congregations
1:21:10 for uh and people willing and wanting to
1:21:13 be consistent with their mission of
1:21:17 helping people who are low income or in
1:21:20 need of housing or other assistance
1:21:23 so our savior meets all of those
1:21:26 criteria as well so yes I will be
1:21:29 supporting this I think I'm very hopeful
1:21:32 that this will turn into a really
1:21:35 important asset to our community thank
1:21:40 other discussion
1:21:46 and council president I just want to
1:21:48 check in with you yep go ahead council

1:21:55 council member D Michelle having
1:21:56 participated in the PD
1:21:59 um committee meeting and conversation
1:22:02 there and having watched the PPC there's
1:22:05 obviously a lot of thought around this

1:22:08 interest and Community concern over this
1:22:12 um I believe this is a parcel that meets
1:22:16 the criteria
1:22:18 that have been designated for this and
1:22:21 thus is an excellent opportunity for a
1:22:24 rezone that has Community benefits as
1:22:28 well so I will be supporting this
1:22:30 amendment

1:22:36 sure Deputy council president uh just
1:22:38 real quickly I'm also going to be
1:22:39 supporting
1:22:40 um the motion tonight I'm thrilled and
1:22:43 loved to see all this positive energy

1:25:16 and while I appreciate that as a concept
1:25:20 I believe this property meets all of the
1:25:24 same criteria that the Our Savior
1:25:27 Lutheran Church property does and while
1:25:31 there is a bunch of this property that
1:25:36 has environmental constraints that the
1:25:39 property owner will have to work around
1:25:42 I do not see a difference between
1:25:46 whether that small bit of land is used
1:25:49 for a multi-family or single family in
1:25:52 this instance and so I will actually be
1:25:56 voting nay to indicate support of this
1:26:02 being an amendment to the comprehensive
1:26:04 plant thank you

1:26:17 I still in my reading of the current
1:26:20 criteria still believe that it does
1:26:22 violate criteria four

1:26:27 rezone is warranted because of change

1:26:31 um I I do think it's important that we
1:26:34 not allow for multi-family uh buildings
1:26:39 when they aren't on a suitable parcel
1:26:44 um and and yes council president spoke
1:26:46 to this but we did have this discussion
1:26:48 about you know a hypothetical situation
1:26:50 where you're allowing a very large
1:26:52 building on a very small encumbered
1:26:55 parcel and and um
1:26:57 and we specifically have a criteria that
1:26:59 we we assess against that
1:27:02 um so I I still don't think it meets
1:27:04 criteria for
1:27:06 um and this is a very in a parcel with a
1:27:11 lot of environmental constraints on it
1:27:15 um so yeah I still think it doesn't meet
1:27:18 criteria four so I'll still be voting
1:27:19 for this and I still will be I also have
1:27:22 a pretty high bar for staff
1:27:24 recommendations on something this
1:27:26 complicated they're planning
1:27:29 um you know planning professionals
1:27:30 they've no they know the zoning in and
1:27:33 out and they are the ones who made this
1:27:35 recommendation based on
1:27:37 um the uses uh you know thinking through
1:27:40 all the hypotheticals about all the
1:27:42 possible uses under the current zoning
1:27:44 and the and the requested zoning and I
1:27:48 have a pretty high bar for for um
1:27:51 disagreeing with that so I will be
1:27:54 voting yes
1:27:57 sorry I did have one one additional
1:27:59 thing which is the criteria are very
1:28:01 complicated and they are part of Title
1:28:03 18 so they're going to be redone in the
1:28:05 next version of title 18. so I think
1:28:07 that's one other thing is if if the
1:28:08 criteria are complicated for other
1:28:10 council members and you know through
1:28:12 this conversation through the planning
1:28:13 policy conversation all of that
1:28:16 um that that can all be hopefully
1:28:18 helpful for this next iteration of the
1:28:20 criteria that are used in the title 18
1:28:23 update because it is complicated but
1:28:26 again I still think it doesn't meet
1:28:27 criteria four

1:29:40 regular council meeting I uh sent out a
1:29:45 tattoo or send out an email to the rest
1:29:47 of you that is the draft legislative
1:29:50 priorities for the sound cities
1:29:52 Association
1:29:53 my expectation is that the pick will
1:29:56 take action at this upcoming meeting to
1:29:59 either recommend adoption of that to the
1:30:01 board or not so I was going to ask if
1:30:04 any of you had any feedback for me to
1:30:07 share as I you know to synthesize to to
1:30:12 in well to get a sense of the body uh
1:30:15 when I when I participated in the next
1:30:17 pick meeting
1:30:20 thank you councilmember Joe and oh sorry
1:30:23 uh councilmember hunt for comments
1:30:27 thank you for sharing these with uh
1:30:30 Council I think they're
1:30:32 um very aligned with our City's uh goals
1:30:36 as well
1:30:37 um generally one thing that stood out to
1:30:39 me is in the discussion about the
1:30:41 multimodal transportation support for
1:30:44 cities which is a big issue for Issaquah
1:30:46 it talks about support for move ahead
1:30:49 Washington
1:30:50 um one of the main driving factors
1:30:52 behind move at Washington that I didn't
1:30:54 see I didn't see mentioned was
1:30:57 sustainability and Emissions reduction
1:31:00 so I think that could be added in it
1:31:02 actually does have a sense about
1:31:03 supporting
1:31:05 um I think economic vitality and um and
1:31:08 vitality because those will come about
1:31:10 from more multimodal transportation and
1:31:13 Transit but it doesn't speak to
1:31:14 emissions reduction which is one of the
1:31:16 driving reasons why Hoover had
1:31:18 Washington is so important
1:31:20 thank you council president
1:31:24 thank you um I was also going to say I
1:31:27 read over it I think
1:31:29 um everything that is on there I agree
1:31:31 with the only thing that I think we did
1:31:34 a very good job identifying as a council
1:31:37 is um washed up maintenance of roadways
1:31:41 and I wonder whether that would be
1:31:43 something that might also
1:31:45 um be something that other cities might
1:31:49 want to help
1:31:51 double down on that idea and include in
1:31:54 the um pick an SCA commentary there

1:32:06 councilmember Mart's under the promote
1:32:08 Public Safety item
1:32:12 we had talked about
1:32:14 vehicular Pursuits
1:32:16 and it says clarify circumstances which
1:32:19 vehicular Pursuits are permissible could
1:32:21 you go a little bit in depth on that are
1:32:23 we saying that the state is going to set
1:32:25 a standard and then says we'll have to
1:32:28 adhere to that standard or will we still
1:32:30 have flexibility to choose our own
1:32:34 policy within our own department and
1:32:38 uh I don't think that they went so far
1:32:42 as to have an opinion on that particular
1:32:45 issue I think the general promote public
1:32:48 safety items were crafted specifically
1:32:51 around clarification as opposed to
1:32:53 moving the bar in any direction which
1:32:56 would have which would have been I think
1:32:59 somewhat controversial and I think the
1:33:01 Hope Was That by focusing on
1:33:03 clarification the word clarify is used
1:33:05 in all of these uh items
1:33:09 um well not the Blake decision one but
1:33:11 generally uh these were crafted to try
1:33:14 to have the minimal amount of uh
1:33:17 contention but rather provide officers
1:33:20 with clarification which is one of the
1:33:22 things that we've heard so much from
1:33:23 them but I don't think we got into the
1:33:25 level of whether the legislation would
1:33:28 be such that municipalities would not be
1:33:30 able to supersede it but I can certainly
1:33:32 you know I'm going to take this feedback
1:33:34 I think what I'm going to do is contact
1:33:36 SCA staff and see how it Compares with
1:33:39 other things they're hearing and seeing
1:33:40 if there's opportunity to make revisions
1:33:42 and I could certainly it I think I'm
1:33:45 hearing you saying that you would hope
1:33:47 that it would not preclude Municipal uh
1:33:50 municipalities having their own
1:33:52 standards in this regard and then if we
1:33:54 had language clarifying that he would
1:33:55 appreciate that that's exactly correct
1:33:57 you're reading my mind thank you
1:34:00 hence my dude Michelle
1:34:03 I just want to plus one uh councilmember
1:34:06 Walsh's comments and also note that the
1:34:09 Eastside Transportation partnership when
1:34:10 we had our discussion on Friday uh felt
1:34:13 very strongly also about providing more
1:34:16 funding for washdot maintenance so I
1:34:19 think it's certainly a position that we
1:34:21 should be
1:34:22 doubling down on so yeah I just wanted
1:34:24 to to agree with council member Walsh
1:34:29 uh Deputy council president
1:34:32 the other thing I might add thinking
1:34:34 about move ahead Washington is this
1:34:35 great Transportation package of a lot of
1:34:37 great projects including ones that are
1:34:39 important to us right here in Issaquah
1:34:41 but there's not really any timeline for
1:34:43 when that funding will be dispersed or
1:34:44 projects will start I wonder if SCA
1:34:46 might consider
1:34:49 urging the legislature to begin those
1:34:53 discussions around timing on projects
1:34:55 thinking of Highway 18 unless East King
1:34:57 County cities in particular and like
1:34:59 when that's going to get started so I
1:35:01 wonder if that might be worth putting it
1:35:05 any other comments for councilman Mertz
1:35:09 hey Annie okay can I just say thank you
1:35:11 so much this was really thoughtful
1:35:12 feedback like I said I will um present
1:35:15 it to uh SCA staff and if given the
1:35:18 Opera if if it winds up getting in in

1:35:59 a hopefully a brief report but there is
1:36:01 so much to say about my attendance at
1:36:03 the National League of cities convention
1:36:05 I want to start off by thanking the
1:36:07 council for supporting uh the the
1:36:10 attendance and thanks also to Juliana de
1:36:13 Cruz for her support in planning my
1:36:15 travel itinerary which turned out to be
1:36:17 really one of the smoothest trips I've
1:36:20 ever ever taken
1:36:22 still and then at the very top before I
1:36:24 report on what happened I'd like to say
1:36:26 that I recommend that the city next year
1:36:29 sent two or three council members it was
1:36:31 really a valuable worthwhile experience
1:36:34 I think it would be great to have two
1:36:37 people there so that the many excellent
1:36:40 And Timely sessions could be covered by
1:36:43 two people it was really difficult to
1:36:45 choose between all of the good sessions
1:36:47 that were being offered so and also be
1:36:50 kind of useful to have more than one
1:36:52 person there to debrief at the end of
1:36:55 each day so and it doesn't necessarily
1:36:57 need to be me that goes next time but I
1:36:59 think it would be great to to over time
1:37:02 make sure that the whole Council gets
1:37:04 this opportunity
1:37:05 so I'll be as brief as I can because it
1:37:07 was a terrific three days I attended two
1:37:11 sessions on affordable housing and rent
1:37:13 protections that were really wonderful
1:37:16 and I'm going to be following up there
1:37:18 was a presentation from Marilyn Harris
1:37:20 the director of the Louisville Metro
1:37:22 Department of Housing and director of
1:37:25 develop Louisville who was just a
1:37:28 dynamic speaker and had so many ideas
1:37:30 about what we could do for renter
1:37:32 protections that we've talked about at
1:37:36 this Council and they have an actually
1:37:39 affordable housing commission and they
1:37:42 developed a healthy renters policy that
1:37:46 the their Council adopted
1:37:48 they also have a affordable housing
1:37:52 trust fund which she created through
1:37:55 very creative financing which I probably
1:37:58 not applicable to hear to us here in
1:38:01 Issaquah but I thought it was she must
1:38:03 have been a very brave staff person to
1:38:05 create created and then the other thing
1:38:07 that they've done is what she called an
1:38:10 affordable housing overlay project
1:38:13 which she said was a great help in
1:38:16 reducing the number of NIMBY encounters
1:38:19 that they had so she gave us her email
1:38:23 I've requested her PowerPoints which I
1:38:26 will share with everybody when they
1:38:27 arrive and I'm going to reach out to her
1:38:30 to see if I can get more information
1:38:31 about all of those other things that
1:38:33 they're doing they have a terrific
1:38:34 website that I've been exploring so
1:38:37 other worthwhile sessions were one on
1:38:40 rebuilding trusted government with a
1:38:42 really excellent panel discussion
1:38:44 I attended the federal legislation
1:38:47 that's coming up for the 20 2023
1:38:50 excellent session and then a session on
1:38:54 how cities are supporting Mental Health
1:38:56 Services for both their residents and
1:38:58 for city employees who are under a lot
1:39:00 of pressure just for the divisions and
1:39:03 things that are going on in our
1:39:05 communities
1:39:06 on the networking front I attended two
1:39:08 Gatherings of women in municipal
1:39:10 government the association of Washington
1:39:13 City's reception which was great fun
1:39:15 Democrats and municipal office breakfast
1:39:18 which was great fun and then four
1:39:20 General Sessions and got to talk from to
1:39:22 people all over the United States
1:39:25 compared different forms of governance
1:39:27 and what they were doing with
1:39:29 conversations mostly centered on
1:39:31 affordable housing seems to be the top
1:39:34 issue everywhere
1:39:35 and then finally it was wonderful to be
1:39:39 there when Victoria Woodard who's the
1:39:41 mayor of Tacoma was installed as the new
1:39:44 president of the National League of
1:39:46 cities we are well representative
1:39:50 represented by mayor Woodard who gave an
1:39:53 absolutely inspirational speech after
1:39:56 she was installed it was absolutely
1:39:58 wonderful I also got a chance to see the
1:40:01 mayor of Kansas City who is Clinton
1:40:02 Lucas he's the youngest mayor in Kansas
1:40:05 City history he gave a barn burner of a
1:40:08 speech as well write that name down that
1:40:11 is going to be somebody who's going to
1:40:13 be known outside of Kansas City for sure
1:40:16 and so anyway wonderful experience thank
1:40:18 you so much for supporting me and I hope
1:40:21 to bring a lot of the ideas that I
1:40:23 gathered back to the council as
1:40:26 appropriate so thank you very much thank

1:41:04 Tibbetts Creek Manor and we will be
1:41:05 meeting with issaquah's legislative
1:41:08 delegation to discuss the city's
1:41:10 legislative priorities so the next item
1:41:12 of business this evening would be an
1:41:14 executive session but we're not having
1:41:16 so there being no further business we
