In 2019, the City Council approved the professional services agreement with Otak, Inc. in the amount of $463,865 to complete the Storm and Surface Water Master Plan (Plan). The Plan is a Citywide plan to develop a prioritized list of stormwater infrastructure and habitat restoration improvements and programs to be implemented within a 20-year time frame to address impacts that have resulted in impaired surface water quality, aquatic and riparian habitat degradation, increased flooding and aging infrastructure. The goal is to complete the Plan and have it adopted by the end of 2022.

Staff report:
Under state law, courts can issue several types of civil protection orders to restrain individuals from engaging in harmful or threatening behavior. Civil protection orders are available for persons subjected to domestic violence, sexual assault, stalking, harassment, and vulnerable adult abuse. A court may grant broad relief to the protected party, such as restraining a person from having contact with or threatening them, excluding a person from certain locations or from coming within a specified distance of certain locations, or prohibiting a person from possessing a weapon when they have been deemed an extreme risk of harm to themselves or others. The penalty for knowingly violating a protection order is generally a gross misdemeanor, though there are exceptions—for example, it is a felony when an individual commits an assault in the process of violating a domestic violence…

1:14 sister cities commission
1:16 the chair of the sister cities
1:18 commission to the lectern to introduce
1:20 this item welcome stephanie

1:36 members my name is stephanie angula and
1:39 it's been my pleasure serving the sister
1:41 cities commission for the past four
1:42 years
1:44 as you may know issaquah has two sister
1:46 cities sundal norway and chefchaouen
1:48 morocco
1:49 as a commission we work to grow and
1:51 maintain a bond with these two sister
1:53 cities while also supporting our own
1:56 community and the spirit of global
1:57 knowledge goodwill and understanding
2:00 in spring of this year our commission
2:02 learned about a national competition
2:04 held annually for youth of sister cities
2:07 international member cities called the
2:10 young artist and author showcase
2:12 the commission decided to participate
2:14 and was excited by the theme of 2022
2:18 generation rescue sustainable water for
2:20 all
2:21 a relatable theme for issaquah
2:25 with the competition and theme in mind
2:27 this past march our commission held an
2:29 open call for issaquah youth ages 13 to
2:32 18 to submit original works and the
2:35 categories of visual art digital art
2:38 photography
2:40 written composition poetry and original
2:42 music
2:43 the goal was twofold
2:46 to engage issaquah's youth and celebrate
2:48 talent at the local level
2:50 as well as promote the top qualifiers to
2:52 the national competition
2:55 on that note please allow me to
2:56 introduce maya mendiola maya can you
2:59 come forward
3:01 have you be here
3:05 maya is a student of liberty high school
3:07 upon hearing about the youth showcase
3:09 from her teacher and allowing her mind
3:11 to interpret the theme sustainable water
3:13 for all
3:14 maya a digital artist got to work
3:17 creating this beautiful piece you see
3:19 here on the screen
3:20 she has titled her work celestial
3:22 aquatic
3:27 not only is this art stunning and
3:29 impactful from this view i hope you all
3:32 are lucky enough to study in a way that
3:34 allows you to notice all the thoughtful
3:36 details maya included
3:39 thanks to her interest and talent maya
3:41 gave our commission an opportunity to
3:43 review her art and with the help of the
3:45 arts commission
3:46 we easily determined it was not only our
3:48 pleasure to recognize and celebrate her
3:51 locally but we were excited to promote
3:53 maya and celestial aquatic to the
3:56 national competition
3:58 okay maya please accept these flowers

5:46 so tonight i hope you uh help me to wish
5:49 bob congratulate bob york on his
5:51 retirement and wish him a great
5:52 retirement public works director bob
5:55 york is retiring after 20 years of
5:57 public service his last day is september
6:00 1st
6:01 bob served issaquah as our utilities
6:02 engineering manager for four years and
6:05 in the last two years as our first ever
6:07 public works director after merging
6:09 operations and engineering departments
6:12 prior to issaquah he was the senior
6:14 engineer of the port of seattle
6:15 responsible for over one billion of
6:17 utility assets he also worked for ch2m
6:20 hill for 24 years designing and advising
6:23 on over 150 projects for his clients
6:26 bob is an excellent engineer with a
6:28 reputation for for thriftiness
6:31 a sly wit and is someone who truly cares
6:34 about his team
6:35 among his many contributions in issaquah
6:37 most notable are his accomplishments in
6:39 pfas making issaquah the leader in the
6:42 state in testing monitoring and
6:44 filtration of pfas to ensure our water
6:46 supply is better than the state and
6:48 federal standards bob also negotiated a
6:50 deal with cascade water which allows our
6:52 city to keep water in abundant supply
6:55 and keep rates low for years to come
6:58 bob is a highly trusted expert in his
6:59 field and has helped issaquah build
7:01 great relationships with state and local
7:03 partners thank you bob for all you have
7:05 done for the city and best wishes in
7:07 your retirement and it looks like you
7:09 might have a few words to share
7:12 if you insist
7:16 well thank you mayor paulie and council
7:18 members it's been a real honor to serve
7:21 the city for
7:22 six plus years
7:24 uh i had a comfortable job at the port
7:26 of seattle
7:27 heading toward retirement and then one
7:29 evening i almost randomly applied to the
7:31 city of issaquah to see if i could write
7:33 another different chapter in my diverse
7:36 career
7:37 well within a day or two sheldon called
7:39 sheldon lynn the previous public works
7:42 engineering director and
7:43 despite initial hesitation like what am
7:46 i doing i work at an airport what's an
7:48 airport in the city have in common is
7:51 this a step too far
7:53 but partly because i live in the greater
7:55 isqui area and have an affinity i've
7:57 always felt an affinity to the city i
7:59 decided to write that new chapter
8:02 and accept that offer then the
8:04 opportunity for the public works
8:06 director
8:08 arose and initially i was hesitant
8:11 only casually interested but
8:13 there was a grassroots effort on behalf
8:15 of all my
8:17 teammates both in pwo and pwe
8:21 they gave me the encouragement to submit
8:23 my application
8:26 to offer the city
8:27 an internal candidate at the last minute
8:30 so my great teammates kept on
8:32 encouraging me throughout that process
8:34 and lo and behold here i stand today
8:38 so another chapter was written
8:40 now almost two two years has passed and
8:42 i want to give all the credit
8:45 to that incredible public works team
8:59 and also
9:00 all the many other city employees
9:03 as well as our elected officials
9:05 teammates from other cities and agencies
9:08 and many from the general public
9:11 those names are too numerous to recite
9:14 but you all know who you are
9:17 so thanks i'm so blessed to still be in
9:20 good health and enjoy what's next
9:23 i plan on staying in touch with my great
9:25 team and many of you
9:27 i will never forget this chapter in my
9:29 life thank you

10:56 welcome him and we congratulate him as
10:58 well and we're excited to have them as
11:00 an addition for all their knowledge and
11:02 experience that they're going to bring
11:03 to our city
11:04 new to washington but yet
11:07 having a blended experience to bring to
11:10 our community
11:11 through their years of experience
11:13 elsewhere so

11:21 know as bill and he's been with our
11:23 department for many years and he's going
11:25 to be as recently promoted to sergeant

17:13 id1173 which is the national night out
17:16 proclamation
17:17 and i'm going to present this to
17:20 chief schwann
17:23 whereas national night out is a
17:25 community building campaign that
17:27 promotes police community partnerships
17:29 annually on the first tuesday of august
17:32 and whereas the 38th annual national
17:34 night out provides a unique opportunity
17:36 for the city of visquad to join forces
17:38 with thousands of other communities
17:40 across the country in promoting
17:41 cooperative police community drug and
17:44 crime prevention efforts and whereas the
17:47 city of issaquah and the issaquah police
17:49 department play a vital role in crime
17:51 drug and violence prevention efforts in
17:53 issaquah and are supporting national
17:55 night out 2022 locally and whereas it is
17:59 essential that all residents of the city
18:01 of issaquah be aware of the importance
18:03 of crime prevention programs and the
18:05 impact that their participation can have
18:07 on reducing crime drugs and violence in
18:10 issaquah and whereas police community
18:12 partnerships neighborhood safety
18:14 awareness and cooperation are important
18:16 themes of the national night out program
18:19 now therefore i mary lou paulie mayor of
18:21 the city of vizqua do hereby proclaim
18:23 august 2nd 2022 to be national night out
18:26 in the city of issaquah and urge all
18:28 citizens to join in the community
18:30 festivities raising awareness for this
18:32 important cause

18:42 this proclamation is huge and we
18:44 appreciate it greatly
18:46 and the collaboration between our police
18:48 department and the community is a major
18:51 and the main the main reason we're here
18:53 and so these efforts are greatly
18:55 appreciated by all the communities that
18:57 participate
18:58 and we have several this year coming
19:00 back after two years of covet and that
19:02 being
19:03 on hold so we are excited to be able to
19:06 bring that back
19:07 we are
19:08 also hosting it at the
19:10 city hall
19:12 on the back side and we welcome all the
19:13 communities to come join us as well we
19:15 have several people that will be joining
19:17 other agencies that are collaborating
19:18 that we partner with to include king
19:20 county for air support marine support
19:23 the bomb disposal unit all of those as
19:25 well so it's a big collaboration not
19:27 just for the community but for other
19:29 agencies and as you mentioned we share
19:32 that with all the different communities
19:33 across the nation and so this is the
19:35 night that we try and come together and
19:37 we have other vendors as well that
19:38 really focus on the safety and
19:40 opportunities between the police
19:42 department and our community so thank
19:43 you again for this proclamation

27:55 evening is committee and regional
27:56 reports and we will start with council
27:58 member joe
28:00 thank you madam mayor on july july 19th
28:05 city administrator bokowitz and i met
28:07 with the chamber board
28:10 my role as chamber liaison to let them
28:13 know what was going on with the city i
28:15 conveyed to them the new legislation
28:17 that was
28:18 that we put in place to retain
28:22 the clean building standard
28:25 action to get those buildings up to
28:28 code on the 29th we had our ltch meeting
28:34 lodging tax advisory committee meeting
28:36 we did
28:38 some budget discussion at that time so
28:39 we can prepare for
28:42 the
28:43 september discussions that will be
28:44 coming up and we we received a report
28:46 from
28:47 visit issaquah
28:48 and uh their quarterly report was given
28:50 to us
28:52 that concludes my report thank you

28:56 councilmember d michelle uh thank you
28:58 mayor paulie um on behalf of um customer
29:02 marts who's absent tonight i'm reporting
29:04 on the safety security and parks
29:06 committee meeting that was held on july
29:08 the 19th
29:10 am i being heard all right okay sounds
29:13 like it okay thanks
29:14 um so uh chairman's council member ray
29:18 and myself discussed three different
29:19 items the first one was id 0724
29:23 facilities assessment and surplus
29:25 property policy
29:27 the committee favors the
29:28 administration's suggested approach and
29:30 would like to see it move forward we
29:32 recommended that the measure be placed
29:34 on the consent agenda for approval by
29:36 the full council
29:38 the second item was id 1126 cultural
29:41 calendar
29:42 uh introduced by equity board members um
29:45 kelly bunn and megan reichley it's
29:47 wonderful to see them there the safety
29:49 services and parks committee is
29:51 supportive of the calendar that was
29:53 presented we acknowledge that the
29:55 calendar will evolve and change over
29:57 time committee thanked the equity board
29:59 and staff for their time and effort on
30:00 the calendar and recommended moving it
30:02 to the full council on the consent
30:04 agenda
30:06 and then the last item which was the
30:07 major discussion was id1162
30:11 landlord and tenant protections of the
30:13 three recommendations offered by arch
30:16 a regional coalition for housing the
30:19 committee favored adoption of the first
30:21 recommendation a 120 day notification
30:24 requirement for rent increases above 3
30:27 percent on the other two recommendations
30:30 offered by arch the committee felt that
30:32 caps on late fees and moving costs don't
30:34 have an impact on increasing rental
30:36 rates and might even trigger additional
30:39 rent increases by landlords the
30:41 committee recommended preparing an
30:43 ordinance for consideration by full
30:44 council requiring landlords to give a
30:47 hundred and 120 days notice for rent
30:50 increases above 3 percent
30:52 and that the ordinance be placed on a
30:54 regular agenda for deliberation by the
30:56 full council
30:57 committee also directed staff to
30:59 continue to monitor regional and state
31:02 uh i have a different word here i'm
31:05 sorry to monitor regional
31:07 and state actions uh with regard to the
31:10 arch uh suggestions
31:12 and then uh finally uh all of my
31:14 regional committee meetings where i
31:16 serve have been cancelled so i have
31:18 nothing else to report thank you
31:20 thank you councilmember d michelle
31:21 councilmember hunt thank you madam mayor
31:24 i have two reports this evening they
31:26 both have to do with salmon recovery and
31:28 then i have
31:29 one upcoming meeting
31:31 the kokanee ila which stands for
31:33 inter-local agreement management
31:35 committee
31:36 met on july 20th and at this meeting we
31:38 approved the 2023 kokane ila work plan
31:41 the budget and the cost share and
31:43 basically this will allow us to continue
31:45 the good work of this group they provide
31:47 very important services for conservation
31:49 of kokanee which is a very endangered

31:58 that shortly after the meeting we heard
32:00 that perry falcone will be taking a new
32:02 position as king county's water and land
32:05 resources division as manager of the
32:07 watershed and ecosystem assessment team
32:09 so this is very exciting and it will
32:11 mean that over the next couple of months
32:13 we will have
32:14 there will be work on a transition plan
32:16 and they will begin the process to hire
32:18 a new kokanee recovery manager um so
32:21 very excited for
32:22 perry for that new opportunity
32:24 and that concludes that report the uh
32:27 wyra8 salmon recovery meeting occurred
32:30 on july 21st wyra8 is the technical name
32:32 for our watershed here
32:34 and at this meeting we approved
32:38 the project subcommittee's
32:39 recommendation for allocation of
32:41 additional funding for salmon recovery
32:43 projects throughout the watershed this
32:45 was about 512
32:48 thousand dollars worth of state grants
32:50 that were additionally allocated to go
32:52 towards salmon recovery so that was that
32:53 was excellent continues the excellent
32:55 work of that group
32:57 the next meeting of the wire 8 salmon
32:59 recovery meeting will be september 15th
33:01 at 2 to 4 15 pm
33:03 and then i have one upcoming meeting we
33:06 will have a meeting of the planning
33:07 development and environment committee on
33:09 august 4th this is one of the
33:11 subcommittees of this council that works
33:13 on planning development and environment
33:15 issues
33:16 and august 4th is a thursday which is
33:19 not the usual day for this meeting but
33:20 that will be this coming thursday
33:22 we have um
33:25 the two items one is id 1156 title 18
33:28 zoning and development standards title
33:30 18 is our land use code and there are
33:33 several items within this affordable
33:35 housing transfer of development rights
33:37 or tdrs landmarks and archaeological
33:40 resources and parking
33:42 and then the second item will be title
33:44 18 land use code future updates list
33:46 this is a list of items that council has
33:49 determined will be addressed following
33:52 our code update
33:53 and
33:55 in this discussion we have a couple
33:57 items that are proposed by the
33:58 administration for us to
34:00 consider as a committee and these
34:02 include are there any items that council
34:04 that the committee would like to add to
34:06 that list and does the list contain all
34:09 the information for the council to sort
34:11 the list for the purposes of determining
34:13 which items to fund in the 2023-2024
34:16 budget and i did want to raise this for
34:18 councils consideration if there are
34:21 thoughts on that because this item will
34:23 be coming back to the full council
34:25 shortly and because it has to do with
34:26 this white board which was identified as
34:28 one of the priorities at our last
34:30 retreat
34:32 i wanted to give council members an
34:33 opportunity if you have questions that
34:35 our committee should consider i'll raise
34:37 this again at good of the order and then
34:39 um we will take that input into our
34:41 meeting for this thursday uh so with

34:51 planning council met on july 27th there
34:54 were three items on the agenda one was a
34:57 presentation on the updated city of
34:58 samamish housing unit and employment
35:01 2019-2044 growth targets
35:04 there was also a briefing on the
35:06 affordable housing committee's
35:09 affordability framework accountability
35:11 framework and the allocation of
35:13 county-wide affordable housing needs and
35:16 finally there was an updated schedule
35:17 for the urban growth area expansion
35:19 policy the four
35:21 four to one program review and that
35:23 concludes my report this evening thank
35:25 you council member deputy council
35:26 president hall thank you no report this
35:29 evening
35:31 that was fast okay the next item is the
35:33 mayor's report there will be an
35:35 executive session this evening to
35:37 discuss pending and potential litigation
35:39 per rcw
35:42 42.30.110 n1 paren i
35:45 this item is expected to take a total of
35:47 30 minutes and no action is anticipated
35:50 in open session
35:52 due to the state of infl inflation and
35:54 supply chain the actual cost of projects
35:56 for parks and public works are costing
35:58 significantly more than the estimates
36:00 from one year ago historically city
36:02 staff has successfully secured quotes
36:05 that are accurate or conservative in
36:06 their estimates however due to the
36:08 massive fluctuations in the economy
36:10 projects that were bid a year ago are
36:12 costing much more than anticipated and
36:14 in some cases over 50 percent as labor
36:17 remains in high demand
36:18 still the administration projects that
36:20 the city has sufficient reserves to
36:22 cover these significant costs
36:25 boarding commission member meeting
36:26 participation the city has begun
36:28 transitioning the city's advisory boards
36:30 to in-person meetings in july with the
36:32 second phase in september as part of
36:35 this transition i asked the board
36:36 commission members to attend meetings in
36:38 person the public and staff were given
36:40 the option to attend in-person or
36:42 virtually
36:43 based on feedback from the volunteer
36:45 board members i'm asking staff to draft
36:47 a policy giving the boards and
36:48 commissions the option to allow limited
36:51 virtual attendance of board members the
36:54 emphasis will remain on attending
36:55 meetings in person and a quorum of the
36:58 boards will be required to be in person
37:00 however the option to attend virtually
37:02 will be available for certain situations
37:05 the city will continue monitoring covet
37:07 19 public health protocols and may make
37:10 further adjustments to meeting
37:11 attendance requirements
37:13 and there is an ongoing recruitment
37:15 right now for the planning policy
37:16 commission
37:17 the city is currently accepting
37:19 applications for volunteer positions on
37:21 the planning policy commission the
37:23 commission serves as a policy advisory
37:25 body and provides guidance and direction
37:27 for issues future growth through
37:29 continued review and improvement to the
37:31 city's comprehensive plan
37:33 the city-wide land use policies and
37:35 related planning documents we're looking
37:37 to fill several vacant unexpired terms
37:40 interested individuals should have an
37:41 interest in environmental affairs
37:43 planning land use residential or
37:46 commercial development as evidenced by
37:48 training experience or actions
37:51 city residency is required or ownership
37:53 of a business located within city limits

42:42 operations engineer and i am here to
42:45 present about the agenda bill that was
42:47 included in the packet for newborn
42:49 newport way pedestrian bridge and race
42:52 intersection project
43:10 to give a little brief overview of this
43:14 project before presenting the uh the
43:17 improvements that will be done with the
43:18 project
43:19 king county is constructing a new
43:22 parking lot and amenities at cougar
43:25 mountain trailhead
43:27 located approximately here and
43:31 but
43:32 pedestrian access across anti-aircraft
43:35 creek is currently limited to the
43:37 northwest of the trailhead so
43:40 intersection improvements will be
43:42 necessary to complete pedestrian
43:44 connections to the trailhead
43:49 the picture showing in the in the right
43:53 tub shows how there is no safe way to
43:56 walk past the anti-aircraft creek from
43:59 the existing gravel path
44:01 so pedestrians have been
44:04 seen stepping
44:06 up outside of the gravel path into the
44:09 bike lane to navigate their way to the
44:11 trail head and
44:13 also they have been seen crossing at
44:15 multiple locations from
44:18 the other side of newport way
44:22 in summary of the project we'll be
44:25 constructing
44:27 improvements for pedestrian to construct
44:30 a pedestrian breach over anti-aircraft
44:32 creek
44:34 approximately here
44:36 and also
44:38 to rebuild the pedestrian the gravel
44:41 pedestrian path that exists from the
44:43 creek to the
44:45 trailhead
44:47 additionally a
44:48 race intersection will be constructed
44:52 for
44:54 right in front of the
44:56 trail trailhead driveway that is
44:58 proposed from king county
45:00 and
45:02 a pedestrian crossing will be
45:04 constructed to the north west part of
45:07 the intersection
45:09 with rectangular rapid flashing beacons
45:20 okay
45:23 the city had allocated five hundred
45:26 thousand dollars for for this project in
45:28 the 2020 adopted budget based on
45:31 estimates that were done in previous
45:33 year
45:34 the design services and construction
45:37 costs that were included in that 2020
45:40 budget were underestimated
45:43 design contract came at 178

45:51 and the construction estimate while when
45:53 we completed the design was estimated in
45:56 two in 882

46:05 in addition to
46:07 this
46:08 increase in the design and the
46:10 construction cost
46:12 no funds were allocated for construction

46:24 amounts that are estimated based on a

46:37 estimated project cost
46:40 would really be around 1.3 million
46:44 instead of the 500
46:47 000 that were budgeted for
46:50 back in 2020

46:58 construction of the project last week

47:23 around 1.44 million dollars
47:26 and this i know this seems like
47:30 a huge difference in project
47:33 cost part of it is
47:36 is caused due to
47:38 to inflation
47:40 but we also recognize
47:43 that
47:44 when we
47:45 budgeted for this project
47:47 in 2022

47:51 coming back and forth
47:54 we underestimated the project costs

48:16 this table shows how we are
48:19 proposing to fund this project now
48:22 knowing that the
48:23 project cost is

48:26 1.4 million dollars
48:30 how we are proposing to pro to fund this
48:32 project using the already allocated

48:38 and i would like to clarify that this
48:40 number is slightly smaller than the 500
48:44 000 included in the adopted 2020 budget
48:47 after
48:48 learning that the agreed contribution
48:51 from king county
48:53 was 92 000 instead of the 100 000
48:57 dollars that were budgeted for
49:01 in addition to that
49:04 are proposing to amend the 2022 budget
49:06 to include
49:10 460 dollars of underspent fronts from
49:14 strategic small capital
49:16 projects
49:17 and additional 300 000 from the school
49:21 safety fund
49:23 and 343

50:38 start construction in spring next year
50:42 with delaying the project we don't know
50:45 exactly what could happen with the
50:47 project costs
50:49 market is unpredictable costs may
50:51 increase or decrease
50:53 however the trend that we have seen
50:56 is increasing the cost
50:59 also
51:00 if we
51:01 delay the project we need to consider
51:04 the agreement with king county for the
51:06 right of way which
51:09 stands what
51:10 that need for for pedestrian connection
51:13 before the
51:15 the king county trailhead project is
51:17 completed
51:23 so our recommendation would be
51:26 approve the proposed motion of awarding
51:29 the construction project construction
51:31 contract for the newport way pedestrian
51:34 bridge race intersection project
51:36 in the amount of the of
51:38 995
51:42 9955 including sales tax to active
51:45 construction inc
51:47 and direct the chief financial officer
51:49 to allocate an additional

52:58 jumped up very much but construction
53:00 management since we didn't didn't budget
53:02 for that in 2020 is that common to not
53:04 budget for construction management early
53:06 on and then to kind of get a better
53:07 sense of
53:08 what that's going to cost later on or
53:11 did we just forget
53:13 we typically do
53:15 budget for construction management
53:17 especially if the project is a
53:21 considerable amount of size of the
53:24 project for for smaller projects and
53:27 that could be the reason
53:29 why for the difference in project costs
53:32 for smaller projects we
53:34 don't generally do that because it is
53:37 assumed that we could
53:38 do the construction management in-house
53:40 ourselves okay that makes sense
53:44 um and then when we're talking about um
53:47 some of the
53:49 budget coming from school zone safety
53:51 fund and general fund are we talking
53:53 about fund balance from those funds or
53:55 is this underspent in certain areas
53:58 i'm seeing the city administrator
54:00 nodding his hit for fund balance
54:03 yes deputy council president members of
54:04 the council good evening uh yes we're
54:06 looking at fund balance for both school
54:08 safety fund and the general fund and
54:10 with the motion would be allocating uh
54:12 from 22 and then asking the
54:15 administration to include it in next
54:16 year's budget for the balance okay

54:23 could we um pull up the slide again and
54:25 go back to the map i just kind of want
54:26 to get a better sense of where this
54:28 raised crosswalk is so there you said
54:31 there's also going to be a um
54:34 yeah the flashing beacons um so there's
54:37 already one of those right at the
54:40 northwest oak crest drive at that
54:42 intersection so then there'll be another
54:44 one up
54:45 a little farther up where the trailhead
54:47 is and i thought right at the trailhead
54:49 there was kind of a median
54:51 kind of a large medium so is that going
54:53 to go through the median or is it just
54:54 kind of north or south no when when the
54:57 intersection the race intersection is
54:59 built the median will not be right at
55:02 the
55:03 very middle of the intersection there
55:05 will be portions of the median still but
55:08 it would be open the crossing would
55:10 occur right at the
55:13 intersection at the point where it's
55:15 already raised
55:17 isabelle can you address whether or not
55:19 there will be two rapid flashing
55:21 a crosswalk and a rapid flashing beacon
55:23 or just the rapid flashing beacon at the
55:25 proposed location

55:29 the wrap the the existing

55:37 placed for the race intersection that
55:40 would be for direct access to the trail

56:09 of the cost of the project and so i'm
56:11 wondering why that contribution remains
56:14 the same even though the cost of the
56:16 project has um
56:19 more than let's see more than doubled
56:21 yeah so um
56:23 and just generally
56:26 do we have a policy about
56:28 our contributions to the art fund fund
56:30 from our um from our construction
56:33 projects

56:55 on the increase in budget but likely
56:57 would need to make an adjustment for the

57:20 it was my understanding that issaquah
57:22 has an admissions tax that stuns our

59:56 we see in our construction projects

1:00:04 gone up um has been thoroughly explained
1:00:06 so i appreciate that i think we have
1:00:08 um items that we still need a little bit
1:00:10 more information on so whether the arts
1:00:12 fund contribution needs to be altered
1:00:14 since this is coming from um general
1:00:17 fund fund balance i think it would be
1:00:19 good also to get a better sense of what
1:00:21 this means if we're taking this from
1:00:23 fund balance how much is left in fund
1:00:25 balance as we head into
1:00:26 budget development it's good to have
1:00:28 that metric i don't necessarily need to
1:00:30 have it tonight though but if we could
1:00:32 have that sooner rather than later that
1:00:33 would be good although actually i think
1:00:35 we are getting an updated forecast on
1:00:37 those kinds of things next week so
1:00:40 yes deputy council president it's on
1:00:42 your committee of the whole agenda next
1:00:43 monday perfect thank you for that for
1:00:45 clarification uh and for those reasons
1:00:47 i'll be voting in favor of the project

1:00:54 and at the risk of seeing the obvious
1:00:57 while we do usually have or often have
1:01:00 um awarding contracts on consent this
1:01:04 this one has had a substantial increase
1:01:06 and so i think for me this is is just a
1:01:12 something that we should take into
1:01:14 consideration going forward that this
1:01:15 may continue to happen because as was
1:01:18 mentioned also in the mayor's report
1:01:19 earlier there have been these
1:01:22 increases due to inflation and the cost
1:01:23 of construction so we're sort of seeing
1:01:26 for the first time in a big way with
1:01:28 this project and should be mindful i
1:01:29 think of this going forward for other
1:01:32 projects i also think it's important not
1:01:34 to delay for that reason and because
1:01:36 this is a pedestrian safety project and
1:01:38 is um
1:01:39 has been in the works and is expected by
1:01:40 the community and it's a commitment to
1:01:42 the community so i will be supporting it
1:01:43 but i think the the headline for me here
1:01:45 is that we should be mindful that this
1:01:47 will likely or could possibly happen for
1:01:50 other projects as well with these

1:03:24 violations and the request before
1:03:26 council this evening is to adopt the
1:03:27 ordinance and i'd like to invite the
1:03:29 attorney rachel bender turpin to make a
1:03:31 presentation hi rachel
1:03:32 hi thank you
1:03:34 good evening council mayor staff
1:03:36 tisha are you able to share it for me
1:03:38 that would be great thank you
1:03:53 this ordinance is going to be pretty
1:03:54 straightforward
1:03:56 it simply enacts
1:03:58 legislation that was actually passed by
1:04:00 the state in
1:04:03 2021 but it didn't become effective
1:04:06 until july 1st of this year
1:04:08 regarding
1:04:10 protection order violations the
1:04:12 criminalization of protection order
1:04:14 violations
1:04:26 it seeks to amend chapter 9.30 of the
1:04:29 issaquah municipal code which is where
1:04:33 the city has previously
1:04:35 included the
1:04:37 criminal the
1:04:38 city's adoption of state laws that
1:04:41 criminalize violation of protection
1:04:43 orders of various types next slide
1:04:46 please
1:04:50 so a little bit about protection orders
1:04:52 state law authorizes courts to enter
1:04:55 protection orders
1:04:56 to restrain individuals from engaging in
1:04:59 all sorts of different
1:05:00 types of harmful behavior
1:05:03 there are anti-harassment orders there
1:05:06 domestic violence protection orders
1:05:08 there are sexual assault protection
1:05:10 orders vulnerable adult abuse protection
1:05:12 orders there's protection orders that
1:05:14 that restrain people from many many
1:05:16 different types of
1:05:19 harassing or threatening
1:05:21 dangerous whatever conduct
1:05:26 these these statutes are these orders
1:05:29 can grant a very broad
1:05:32 variety of relief
1:05:34 it can range from no hostile contact
1:05:37 with someone to you not you're not able
1:05:39 to come within 500 feet of their school
1:05:42 daycare
1:05:44 uh work
1:05:45 house etc
1:05:48 judges uh enter them after after
1:05:52 hearings listening to the evidence on on
1:05:55 why the order is being sought there's
1:05:56 they're actually civil orders they're
1:05:58 sought these are not the orders that are
1:06:00 issued by our judge in
1:06:02 criminal court those
1:06:04 often uh defendants in criminal court
1:06:06 will also be ordered to stay away from
1:06:08 people or to not engage in certain
1:06:10 behaviors as conditions of their release
1:06:13 or as conditions of their sentence these
1:06:16 are different these are civil orders
1:06:17 that people can petition the courts for
1:06:21 and that are granted
1:06:23 the the civil superior courts however
1:06:26 violation of such orders then
1:06:29 can result in criminal law uh criminal
1:06:32 proceedings against a person most mostly
1:06:35 in the form of gross misdemeanors there
1:06:37 are a few exceptions for instance
1:06:39 if you if you assault someone in the
1:06:42 process of
1:06:43 committing a protection or domestic
1:06:45 violence protection order violation
1:06:47 then that would be a felony or if you've
1:06:49 had multiple uh convictions two or more
1:06:51 convictions for
1:06:53 dv protection order that would be a
1:06:54 felony but for the
1:06:56 most part they're gross misdemeanors
1:06:57 which means that uh that
1:07:00 courts of limited jurisdiction have
1:07:02 jurisdiction over them uh is
1:07:04 communicable court being one however
1:07:07 now you can go to the next slide
1:07:09 because they are state statutes they
1:07:12 have to be adopted by reference in the
1:07:15 equal municipal code
1:07:17 previous to this bill that was uh
1:07:20 enacted in 2021 they were scattered
1:07:24 throughout the rcw so the domestic
1:07:26 violence ones were in the domestic
1:07:28 violence statutes
1:07:29 and then the the extreme risk protection
1:07:32 order which is a temporary order that
1:07:35 protects people from um that that will
1:07:38 allow the the courts to order that
1:07:39 someone's firearms be removed for a
1:07:41 temporary period if they've been
1:07:43 demonstrated that they're a risk of harm
1:07:46 to themselves or others
1:07:48 those were in the firearm statutes and
1:07:50 the harassment ones were in the they
1:07:52 were in the criminal
1:07:55 code so they were just kind of all
1:07:56 throughout different areas this bill
1:07:58 essentially did a lot of things that it
1:08:00 also changed the jurisdiction for a few
1:08:03 of these but the thing that's relevant
1:08:05 to us is that it re-codified them all in
1:08:08 a single chapter of the rcw
1:08:11 which is actually handy because now uh i
1:08:13 think people will some many cities had
1:08:16 not had inadvertently not adopted all of
1:08:18 these and i think it's because they
1:08:19 didn't know they existed so now they are
1:08:22 all part of one chapter it's easier for
1:08:24 the courts to administer that way it's
1:08:26 easier for everyone to see what the
1:08:28 rules are and
1:08:30 everything's just in one place however
1:08:33 you can go to the next slide
1:08:35 that means that all of our references in
1:08:38 the isoquant municipal code are now
1:08:39 outdated we did have some language in
1:08:42 the code that i think protects us that
1:08:44 says that
1:08:46 we adopted at least the domestic
1:08:47 violence protection order law with
1:08:50 any subsequent amendments there too
1:08:53 however
1:08:54 it's only a matter of time before that
1:08:56 gets challenged uh by someone who has
1:08:59 been charged with that so it really
1:09:01 would be better to
1:09:03 clean it up and
1:09:05 have it match what state law currently
1:09:08 uh has these statutes codified as
1:09:12 with a little bit better
1:09:14 language
1:09:15 making those adoptions that's a revised
1:09:17 version of the ordinance that you would
1:09:19 have seen mailed out by clerk
1:09:21 geyser this evening or this afternoon
1:09:24 that will
1:09:25 hopefully prevent this from becoming an
1:09:27 issue in the future by adopting any
1:09:30 types of re-codifications to these
1:09:32 statutes in the future
1:09:37 why is this an emergency well there
1:09:39 really is uh demonstrated evidence there
1:09:42 have been studies that show that
1:09:43 protection orders while they they aren't
1:09:45 a physical barrier people can can
1:09:47 violate them clearly but they uh
1:09:51 they actually do
1:09:53 have been shown to reduce harm and
1:09:55 reduce violence
1:09:56 and they really are only meaningful if
1:09:58 they're enforced so it's important that
1:10:01 people know that they will be uh
1:10:03 arrested and prosecuted if they violate
1:10:06 these otherwise
1:10:07 you don't really have much of a
1:10:10 incentive to do so
1:10:13 and because of that i think just the
1:10:15 nature of these i wouldn't normally
1:10:17 bring
1:10:19 i wouldn't normally bring
1:10:21 many criminal law ordinances to the
1:10:24 council as an emergency because i do
1:10:26 think you know that's something that you
1:10:28 can consider but this one considering
1:10:30 that the council had adopted most of
1:10:32 these before and
1:10:34 that there really is a risk of harm to
1:10:36 individuals if they're not
1:10:38 uh and if these laws aren't enforced i
1:10:40 would highly recommend you know this is
1:10:42 a little different than property crimes
1:10:43 these are this is people's lives at
1:10:45 stake i would highly recommend adoption

1:11:03 kind of the effect statement of the
1:11:04 revised version is essentially if the
1:11:06 rcw is changed in the future will be
1:11:08 automatically correct

1:11:15 go ahead victoria that's kind of a tough
1:11:17 night councilman
1:11:19 absolutely um so my question is the one
1:11:21 that i emailed but i thought it'd be
1:11:22 good to have it um in our meeting so
1:11:24 this seems like an important um based on
1:11:26 your your presentation that seems very
1:11:28 important and the law that prompted
1:11:29 these changes was passed in 2021 uh and
1:11:32 it already went into effect on july 1st
1:11:34 of this year and so i'm wondering um why
1:11:37 it was being why it's being brought
1:11:39 to council now as an emergency um given
1:11:42 that we had we
1:11:44 that this law was on the books since 20
1:11:46 or it was going to be on the books since
1:11:47 2021 and then also um what could be done
1:11:50 to avoid similar occurrences being
1:11:53 caught like this and having to pass as
1:11:55 an emergency ordinance in the future for
1:11:56 for anything similar
1:11:58 that's a good question and
1:12:00 um i can say that it you know it should
1:12:02 have been dealt with much sooner than
1:12:04 this this is uh
1:12:06 this is not how i would like to see
1:12:08 things operate i think that historically
1:12:10 there has not been quite as much
1:12:12 communication between
1:12:13 the administration and the court which
1:12:17 which is honestly not not atypical uh
1:12:19 they're
1:12:20 the whole separate branches of
1:12:22 government thing tends to silo those uh
1:12:25 those bodies pretty pretty effectively
1:12:28 however
1:12:29 i i think i'm kind of an advantage
1:12:31 coming in here because i i used to be a
1:12:34 municipal prosecutor and in fact have
1:12:36 have worked in is aqua municipal court
1:12:39 i think that stuff's a little bit more
1:12:41 on my radar and um
1:12:44 you know that and so and i actually have
1:12:46 been working really closely with the
1:12:47 with the court and i think that's sort
1:12:49 of the the
1:12:50 um feeling of the administration is that
1:12:53 this needs to be resolved and that we'd
1:12:55 like to see a closer working
1:12:57 relationship with the court on all
1:12:59 things including you know issues like
1:13:01 this so
1:13:02 i think that we shouldn't see that in
1:13:04 the future just because i think these
1:13:06 issues will come to our attention a lot
1:13:08 sooner just by that collaboration
1:13:10 and i'll also just say that um
1:13:13 the extent that folks keep up on
1:13:17 legislative updates and changes varies
1:13:20 and i think that often
1:13:23 folks sort of ignore the criminal law
1:13:26 changes a little bit to the to their
1:13:28 detriment or they they focus more on
1:13:30 some of the more
1:13:31 you know
1:13:32 they focus on really what they know i
1:13:34 think and i think since a lot of people
1:13:36 haven't done criminal law or worked in
1:13:37 criminal you know that's kind of a
1:13:39 different area you just kind of expect
1:13:41 that you're you know prosecutors going
1:13:43 to deal with all of that and of course
1:13:45 they don't know they don't
1:13:47 prosecutors don't generally follow much
1:13:50 as the legislative changes as much as
1:13:53 the civil city attorneys do for instance
1:13:56 so they get these issues when they come
1:13:58 as evidentiary challenges which is how
1:14:01 this came up for the prosecutors here so
1:14:03 then they did alert us but
1:14:05 i um i just really like following uh the
1:14:09 legislative session and
1:14:12 there are a lot of really good summaries
1:14:14 of basically every bill that affects
1:14:17 municipalities and i just i can't speak
1:14:19 to why
1:14:21 it didn't get noted in 2021 because i
1:14:22 wasn't here but i can assure you that
1:14:24 going forward i actually read all the
1:14:26 bills that affect uh the cities and so
1:14:29 including the ones that affect
1:14:32 you know criminal matters because those
1:14:35 are i get it and i find it interesting
1:14:38 uh i hope that by doing those things
1:14:41 that this will not happen again
1:14:44 any additional questions

1:16:26 we don't have a way to enforce it in our
1:16:28 courts because there isn't a penalty for

1:16:36 seems a little trivial at times that
1:16:38 we're just moving paper around but this
1:16:39 has real impacts on the lives of our
1:16:41 citizens so i hope that everyone would

1:20:10 commission grants
1:20:12 and i did want to note that
1:20:15 in that
1:20:17 ordinance
1:20:18 there was this statement the
1:20:19 administration encourages the city
1:20:21 council to revisit the policy of
1:20:24 subsidizing non-issaquah residents
1:20:26 through arts commission grants and parks
1:20:28 and community services department
1:20:30 programs
1:20:34 would really encourage us to do that
1:20:38 i just wanted to state that
1:20:41 i support that

1:20:44 re-looking at our policy um i know that
1:20:47 we can be somewhat nuanced about that
1:20:49 that sports programs are different than
1:20:51 handing out arts grants to
1:20:54 different organizations that really are
1:20:57 not part of the issaquah community
1:21:00 this is not a criticism of the arts
1:21:02 commission because they're following
1:21:04 long-standing policy but i think it is
1:21:06 time for us to review that because we
1:21:08 have other
1:21:09 [Music]
1:21:10 government organizations now that could
1:21:12 possibly take on that role while we can
1:21:14 focus on spending our tax dollars here
1:21:16 with our citizens so
1:21:18 at any rate i wanted to lend my support
1:21:20 to that statement and um hope that we'll
1:21:23 have that come back in front of us at a
1:21:25 future agenda

1:21:30 particularly important when you think
1:21:32 that the city of samamish likely did not
1:21:34 exist at the time that policy was
1:21:36 adopted

1:21:43 you know a new local services department
1:21:46 and that also has happened since you
1:21:48 know this was probably considered so
1:21:50 those are great points um council member

1:22:17 what kind of feedback were you looking

1:22:45 be good to make sure that our council
1:22:47 committee discussion does touch on
1:22:49 questions that are important to the
1:22:50 council if the council did have
1:22:52 additional questions for us to consider

1:26:23 around town i thought that was great
1:26:24 please keep this in the loop as we're
1:26:27 just continuing to connect with you on a
1:26:29 weekly or bi-weekly basis whether or not
1:26:31 you think that's something you want to
1:26:32 do more frequently during the year and
1:26:34 not just over the summer if that's
1:26:35 something that you'd like to create
1:26:36 opportunities for council members to be
1:26:38 out in the community more often that's
1:26:39 something we can take up as an action so
1:26:41 just keep us in the loop on that
1:26:43 with regard to the next community
1:26:45 listening session it looks like
1:26:47 september 15th might not work out after
1:26:49 all so we're going to be searching for a
1:26:51 new date um and keep you in the loop on
1:26:53 that but um we are proposing hosting
1:26:56 that at the talus in the talos community
1:26:58 so details are coming on that i did want
1:27:00 to bring up though based on some
1:27:01 feedback um i just want to take a moment
1:27:05 to talk about what we might be doing
1:27:06 differently so based on feedback that we
1:27:08 got from the community at our first
1:27:09 listening session up in the ischool
1:27:11 highlands it sounds like there's a lot
1:27:13 of value on the q a part of the meeting
1:27:15 and maybe less value on the other parts
1:27:19 based on that i'd like potentially for
1:27:21 us to consider updating the structure so
1:27:23 the evening the first half is focused on
1:27:26 these kind of walk-up tables and i'll
1:27:28 explain that in a second and the second
1:27:30 half is focused on q a so we have a full
1:27:32 hour i think it was two hours the first
1:27:34 one is that right a full hour on q a
1:27:36 which is what the community really
1:27:37 values and a full hour of us essentially
1:27:40 combining the mingling and the
1:27:41 presentation into a table based service
1:27:44 instead so maybe there's a public safety
1:27:45 table with the police chief and council
1:27:47 members can float to that table if they
1:27:49 want there's also a climate table
1:27:51 i was about to say megan with stacy
1:27:52 there's a development table with many
1:27:55 and that way council members can kind of
1:27:56 float between those tables and also
1:27:58 float amongst people who are in the
1:27:59 middle
1:28:00 and we do that kind of to lead up to the
1:28:02 q a part i wanted to just quickly bring
1:28:04 that up to the council members who are
1:28:05 here and see if that's something you
1:28:07 think might
1:28:08 fit the needs of the community better if
1:28:10 you have any thoughts on on that model
1:28:13 anything else i see one thumbs up
