0:51 ↗ the first order of business to allow the

0:52 ↗ public hearing to be conducted before

0:54 ↗ the hour is too late

0:55 ↗ public comments on other topics can be

0:58 ↗ made after the public hearing and

1:00 ↗ deliberation on agenda bill 72 5-0

1:03 ↗ because of the lateness and number of

1:06 ↗ those in attendance I will be limiting

1:35 ↗ have additional new information that

1:37 ↗ supports your reason the groups reason

1:39 ↗ for coming tonight

2:45 ↗ district at the December 18th council

2:48 ↗ meeting council directed the scheduling

2:50 ↗ of the public hearing and the

2:51 ↗ preparation of an ordinance to establish

2:53 ↗ the TBD before I open the public hearing

2:55 ↗ I'd like to invite attorney

3:01 ↗ I was Austin ethic from our bond council

3:05 ↗ to provide a presentation go good

3:10 ↗ evening members of the City Council my

3:12 ↗ name is Alice Austin I'm with straddling

3:14 ↗ I've been the city's bond council for

3:16 ↗ about 15 years give or take a few

3:20 ↗ I was asked here tonight to come back

3:22 ↗ and sort of revisit I was with you back

3:25 ↗ in July and gave a kind of a more

3:28 ↗ general presentation about

3:29 ↗ transportation benefit districts I

3:31 ↗ understand that many of you have been

3:33 ↗ studying this quite in-depth since then

3:36 ↗ and have had a number back-and-forth

3:39 ↗ with staff and with the city attorney

3:41 ↗ about this topic so I will give you kind

3:44 ↗ of the overview and review and provide

3:48 ↗ some context for what the transportation

3:49 ↗ benefit district is and what it can do

3:52 ↗ and then I'll answer any questions that

3:55 ↗ you have

4:01 ↗ yeah all right so the formation of a

4:04 ↗ transportation benefit district allows

4:07 ↗ this it allows the city to form a quasi

4:10 ↗ Municipal Corporation that is a separate

4:12 ↗ independent taxing district which has

4:15 ↗ certain specific authorities and it is

4:18 ↗ funded specifically or it is created

4:20 ↗ specifically to provide additional

4:22 ↗ funding for transportation improvements

4:24 ↗ within its boundaries the transportation

4:27 ↗ improvements that can be funded must be

4:29 ↗ in the city transportation plan they can

4:31 ↗ include state highways and local and

4:34 ↗ regional streets as well

4:37 ↗ and it may include the operation

4:39 ↗ preservation and maintenance of these

4:41 ↗ facilities and that's the basic kind of

4:43 ↗ legal overview I did mention that it is

4:46 ↗ a separate independent quasi Municipal

4:51 ↗ Corporation however the City Council's

4:54 ↗ acts as the board of directors of that

4:57 ↗ entity the formation steps which we are

5:03 ↗ in the midst of tonight involve

5:05 ↗ providing notice to the public which was

5:07 ↗ published in December having a public

5:10 ↗ hearing which is teed up for this

5:12 ↗ evening at the public hearing hearing

5:16 ↗ all of the feedback that is available

5:19 ↗ from folks who do want to participate

5:21 ↗ following that if the City Council finds

5:24 ↗ it to be in the public interest you may

5:26 ↗ adopt the ordinance that's before you

5:28 ↗ which establishes the boundaries which

5:30 ↗ in this case would be coterminous with

5:32 ↗ those of the city and so you're not

5:34 ↗ proposing anything that's larger or

5:37 ↗ small or it would simply be the city and

5:40 ↗ specifying the transportation

5:42 ↗ improvements to be funded in this case

5:47 ↗ in the notice and the ordinance are

5:49 ↗ consistent on this again the boundaries

5:51 ↗ would be coterminous coterminous with

5:53 ↗ the boundaries of the city governance

5:55 ↗ would be the members of the City Council

5:57 ↗ sitting as the board the improvements to

6:00 ↗ be funded there's a missing bullet point

6:02 ↗ here which is that it's the

6:04 ↗ transportation improvement plan that the

6:07 ↗ city has previously approved but

6:09 ↗ including what's up there preservation

6:11 ↗ maintenance and operations which is sort

6:14 ↗ of a specific highlight in there and

6:17 ↗ then funding sources in the ordinance

6:21 ↗ that allows the vehicle license fee it

6:23 ↗ also allows for the other taxes fees and

6:27 ↗ tolls that are permitted by statute

6:29 ↗ which could be imposed at a later date

6:32 ↗ the vehicle license fee is the only one

6:34 ↗ by statute that allowed that the board

6:36 ↗ is allowed to simply go ahead and impose

6:38 ↗ should it choose to do so once it's

6:40 ↗ constituted that's a maximum of twenty

6:43 ↗ dollars and then after two years you do

6:46 ↗ have the opportunity to increase that

6:50 ↗ under the state law in terms of other

6:53 ↗ funding sources the sales tax is

6:55 ↗ available it requires a simple majority

6:59 ↗ public vote or approval and then there

7:04 ↗ are other possibilities of city road

7:06 ↗ tolls again requiring majority voter

7:08 ↗ approval or property taxes which would

7:10 ↗ require a supermajority voter approval

7:14 ↗ in terms of voter approval you would

7:17 ↗ have to come back to the voters with a

7:19 ↗ proposition that would describe the

7:21 ↗ transportation improvements specifically

7:23 ↗ to be funded by those resources and they

7:28 ↗ describe what those taxes fees or tolls

7:31 ↗ would be and then finally I don't know

7:37 ↗ how much this has been discussed in your

7:39 ↗ deliberations but recently the

7:41 ↗ legislature authorized cities to simply

7:43 ↗ assume the operations of their

7:46 ↗ transportation benefit districts once

7:48 ↗ they have been formed and we've seen

7:50 ↗ since this statute was enacted many

7:52 ↗ cities doing that taking over for those

7:55 ↗ transportation benefit districts so that

7:56 ↗ you avoid having that duplicative sort

8:00 ↗ of level of governance and so you kind

8:03 ↗ of do away with the district inform and

8:06 ↗ take on the powers within the city and

8:09 ↗ so that requires a separate ordinance

8:12 ↗ that would be that would happen

8:13 ↗ somewhere down the road but that is also

8:15 ↗ available to the city should you choose

8:17 ↗ to go down that road that's the very

8:20 ↗ brief summary but I'm happy to answer

8:22 ↗ questions folks have or provide any

8:24 ↗ other context that's necessary Thank You

8:45 ↗ language that is repeated a number of

8:47 ↗ times preserve maintain and operate it's

8:51 ↗ when unite when I look closely at that

8:53 ↗ proposed language it's in 1207 Oh 40 and

8:58 ↗ 1207 Oh three

9:02 ↗ construct built it always talks about

9:05 ↗ preserve maintained operates right the

9:08 ↗ if you look at the notice and also

9:10 ↗ throughout the ordinance it also does

9:13 ↗ talk about the projects that are

9:17 ↗ improvement plan which also include many

9:20 ↗ construction project just by the nature

9:22 ↗ of those projects being ones that might

9:24 ↗ be creating something new that that is

9:28 ↗ even though we use these words only in

9:30 ↗ our in the code that would by

9:33 ↗ implication that's allowed

9:34 ↗ I believe the reference there is to the

9:37 ↗ entire transportation improvement plan

9:39 ↗ okay the second question I had was

9:42 ↗ simply does you know it does talk about

9:45 ↗ streets city streets and can that does

9:50 ↗ that extend to non motorized corridors

9:53 ↗ as well is it just motorized streets and

9:57 ↗ does it go as far as the other related

9:59 ↗ improvements such as sidewalk and other

10:03 ↗ improvements so the transportation

10:05 ↗ benefit district itself really can

10:10 ↗ include really can include those kinds

10:14 ↗ of improvements that are within your

10:15 ↗ transportation improvement plan it's not

10:17 ↗ research into motorized types of

10:19 ↗ Transportation okay because the ordinate

10:22 ↗ of the proposed code does say city

10:24 ↗ streets so I think if we would maybe

10:26 ↗ want to clean something up if we want to

10:28 ↗ consider that and if that's possible but

10:30 ↗ I think the TIR RTI P does include both

10:34 ↗ motorized and non-motorized components

10:35 ↗ so city street seems to be a little bit

10:38 ↗ in conflict with that potentially thank

11:22 ↗ any thoughts on this question but the

11:25 ↗ statute is drafted broadly to permit

11:27 ↗ transportation benefits districts to you

11:29 ↗ know fund any number of kinds of

11:33 ↗ transportation improvements and sort of

11:34 ↗ adopts by reference regional plans and

11:37 ↗ so any transportation improvement that

11:39 ↗ is within a regional plan approved by

11:42 ↗ the city is technically eligible under

11:46 ↗ the statute now if your code has

11:48 ↗ something narrower or whenever your code

11:50 ↗ references so what's in this would

11:52 ↗ control as long as it's within that

11:55 ↗ broader context Jim I think what I'm

11:59 ↗ getting at is Paul reference Street so

12:01 ↗ Wood Street if you're building a street

12:03 ↗ could you also include building

12:05 ↗ sidewalks but then that conceals yeah

12:07 ↗ our trails and I would think that if

12:10 ↗ you're building a one of these projects

12:12 ↗ that Street would encompass what we

12:15 ↗ typically call as a complete Street but

12:17 ↗ oh the actual proposed ordinance states

12:21 ↗ that the board has all of the powers

12:24 ↗ which are granted by the statute so it

12:27 ↗ broadly gives the board those powers it

12:29 ↗ provides that the funds generated by

12:31 ↗ that transportation benefit district

12:33 ↗ shall be used for transportation

12:35 ↗ improvements that meet the requirements

12:37 ↗ of the statute so yes I believe they

12:39 ↗ would have the transportation with

12:41 ↗ benefit district would have the

12:42 ↗ authority to include sidewalks and other

12:45 ↗ improvements assuming that those are

12:47 ↗ authorized by the statute which they are

12:49 ↗ they'd have to be in the city's plan and

12:52 ↗ transportation plan but yes thanks any

12:55 ↗ other questions

12:56 ↗ what's my beret so just just a

12:59 ↗ clarification so we can establish the

13:03 ↗ transportation benefit district and not

13:06 ↗ impose any new vehicle taxes that at the

13:10 ↗ time of creation that's correct that's a

13:12 ↗ decision that would be made it's a

13:14 ↗ two-step process formation first and

13:16 ↗ then coming back once you constitute

13:19 ↗ yourselves as the governing board of

13:21 ↗ this new entity then you get to make

13:23 ↗ that decision later

13:24 ↗ about what if any taxes fees charges are

13:28 ↗ told you may want to impose any more

13:33 ↗ questions at this time I'll open the

13:37 ↗ public hearing the public hearing for

13:40 ↗ the transportation benefit agenda bill

13:42 ↗ the comments were accepting now are two

13:44 ↗ just to that particular bill digits and

13:48 ↗ comments are important part of our

13:49 ↗ process and when I'd like to make sure

13:52 ↗ everybody who wants to comment on this

13:54 ↗ agenda bill knows to come up to the

13:56 ↗ lectern state your name and address if

14:01 ↗ we put the public comment instructions

14:04 ↗ up on the overhead for those who haven't

14:06 ↗ participated before and do we have a

14:10 ↗ sign-up list sorry

14:12 ↗ opening the hearing at 8:14 and has

14:15 ↗ anyone signed up to speak this evening

14:37 ↗ to the car tabs I think it's fine to

14:40 ↗ create the transportation benefit

14:42 ↗ district we're gonna have to have a

14:43 ↗ robust community conversation about

14:46 ↗ funding I think looking at the

14:51 ↗ information in some of the packet that

14:54 ↗ you guys had received I noticed that

14:56 ↗ there was a lot of references to the CIP

14:59 ↗ there's several options on there that

15:02 ↗ are related to parks I would assume

15:04 ↗ that's not included but we were talking

15:07 ↗ about the transportation plan and the

15:10 ↗ CIP was listed in there so I was a

15:13 ↗ little bit confused on that and then

15:16 ↗ beyond that there was something I have

15:21 ↗ to get to page 36 of course it's not

15:27 ↗ going to show up in there I think it's

15:32 ↗ just really important to think about the

15:34 ↗ larger scope of this

15:37 ↗ we're looking at the $20 car tabs that's

15:39 ↗ only going to give us an estimated

15:43 ↗ 450,000 compared to the sales tax and so

15:47 ↗ it's really it's a small portion

15:49 ↗ it's a portion that we need in order to

15:50 ↗ four to spend on our transportation

15:54 ↗ stuff but I don't want to put make the

16:00 ↗ suggestion that that's going to make all

16:02 ↗ of the issues go away so thank you

16:39 ↗ cover non-motorized walkways and roads

16:43 ↗ because I think as we become more dense

16:46 ↗ as a city we want to make sure that

16:48 ↗ people are able to get around using

16:50 ↗ transportation other than single

16:53 ↗ occupancy cars and there's a lot in our

16:57 ↗ visions for the city that will involve

16:59 ↗ Boehner or a pedestrian walkways tree

17:02 ↗ tree-lined streets and I think that that

17:04 ↗ is a great clarification to make that

17:07 ↗ this can also be used for non-motorized

17:50 ↗ so with potential for just recognizing

17:53 ↗ that your transportation decisions have

17:54 ↗ regional effects and potentials for

17:57 ↗ tolling your city streets and like

18:00 ↗ previous decisions with your truck

18:02 ↗ routes have have significant effects on

18:05 ↗ neighboring jurisdictions so I would

18:07 ↗ hope that that is a part of the actions

18:12 ↗ of the the establishment and actions

19:58 ↗ about the entire package so I would like

20:01 ↗ to propose the foie

20:02 ↗ amendment so I would like to add in

20:05 ↗ addition direct the city administration

20:08 ↗ and the council ad hoc long term Finance

20:11 ↗ Committee to propose a comprehensive

20:13 ↗ funding strategy for transportation

20:16 ↗ capital projects for the for the full

20:18 ↗ City Council's consideration by June

20:21 ↗ 2018 is there a second second chicken

20:28 ↗ scratch here so amendment has been

20:31 ↗ proposed it's moved and seconded to add

20:34 ↗ the language in addition direct the city

20:38 ↗ administration in the council ad hoc

20:40 ↗ long term financial committee to propose

20:43 ↗ a comprehensive funding strategy or

20:48 ↗ transportation transportation capital

20:51 ↗ projects for the full City Council's

20:53 ↗ City Council consideration by June 2018

20:58 ↗ is there any discussion

21:01 ↗ council president Mertz so this if if

21:06 ↗ this amendment is approved I would be

21:08 ↗ able to support the bill as written this

21:11 ↗ is a conversation that I've had with the

21:13 ↗ administration about how to on how to

21:16 ↗ address my fundamental concern which is

21:18 ↗ around us getting to this the broad what

21:22 ↗ the broad package would look like an in

21:24 ↗ timely fashion

21:25 ↗ I'd be more comfortable enabling this

21:27 ↗ mechanisms I recognize that tonight

21:29 ↗ we're not deciding on any particular

21:32 ↗ funding dollar amount or anything but I

21:35 ↗ want to have I want to make sure that we

21:36 ↗ have a date certain to a conversation

21:39 ↗ about the the broader funding strategy

21:41 ↗ this would enable that to do so so I'm

21:43 ↗ hoping you will support this amendment

21:46 ↗ council member Goodman so my question is

21:50 ↗ about what what this amendment in the

21:54 ↗ direction would do how is this different

21:56 ↗ from what the administration's plan is

21:58 ↗ already does do we have any maybe that's

22:03 ↗ a question for Emily and then and and I

22:06 ↗ think what if the work if the if the

22:10 ↗ workload that we

22:12 ↗ have can accommodate that we as in terms

22:14 ↗ of the administration city staff so I

22:19 ↗ want comprehensive packages as well but

22:22 ↗ since we're not doing any packaging or

22:25 ↗ funding tonight I don't think there is

22:27 ↗ any proposal to do so I just want to

22:28 ↗ know what the ramification of the memo

22:30 ↗ would be sure I think you're correct and

22:34 ↗ assuming that we were going to have this

22:36 ↗ conversation at the ad hoc committee

22:38 ↗ along with examining all of our

22:41 ↗ long-term financial sustainability

22:43 ↗ issues I think in part the motion gives

22:47 ↗ a deadline for us to have that

22:49 ↗ conversation and then return with some

22:52 ↗ recommendations to the council okay so

22:55 ↗ it's it places a deadline on the

22:58 ↗ intention that was already there yes

23:00 ↗ does it change the timeline dramatically

23:02 ↗ no that's my red booties so I I would be

23:08 ↗ in support of the amendment when we were

23:11 ↗ have been talking about the

23:13 ↗ transportation benefit district really I

23:16 ↗ to go back to what I've talked about

23:19 ↗ before I think that this is putting

23:21 ↗ another tool in our tool belt for lack

23:26 ↗ of a better way to describe that and a

23:28 ↗ lot of conversation needs to be had

23:30 ↗ around what what we would do going

23:32 ↗ forward but I think that putting a

23:35 ↗ timeline on this and having that

23:37 ↗ strategy come forward together along

23:40 ↗ with that conversation makes really good

23:42 ↗ sense thank you

31:48 ↗ us would be to fill provide some

31:51 ↗ opportunities to fund those near-term

36:17 ↗ understandable given that I'm a retired

36:19 ↗ physician and who's passionate about our

36:22 ↗ Issaquah Alps in which I regularly hike

36:24 ↗ there's a substantial amount of ongoing

36:28 ↗ parcel development here and I have no

36:30 ↗ doubt that the council spends

36:31 ↗ considerable time evaluating as it must

36:33 ↗ the many associated engineering aspects

36:37 ↗ for roadways retaining walls house sites

36:39 ↗ and related services my concern relates

36:43 ↗ to the health aspects of any associated

36:45 ↗ loss of green spaces and forests and I'm

36:48 ↗ not alone in this the regional open

36:51 ↗ space strategy for the central Puget

36:53 ↗ Sound region states we cannot afford to

36:56 ↗ underestimate the importance of open

36:58 ↗ space in supporting human health and

37:00 ↗ goes on to say that would despite 40

37:03 ↗ years of evidence the benefits of health

37:06 ↗ are often not part of the planning

37:08 ↗ efforts I ask Ken konigsmark about this

37:11 ↗ and the substantial and growing

37:13 ↗ literature on the health benefits that

37:15 ↗ open green spaces and forests provide he

37:19 ↗ responded that in addition there are

37:21 ↗ also other studies that show the

37:23 ↗ enormous value of ecosystem services

37:25 ↗ provided by forests and open spaces such

37:28 ↗ as clean and accessible drinking water

37:30 ↗ flood control and air quality etc to

37:33 ↗ which I would add landslide avoidance

37:36 ↗ and mitigation of stormwater runoff

37:38 ↗ which is so necessary for our iconic

37:41 ↗ salmon after having replaced the open

37:44 ↗ spaces with homes and streets these

37:47 ↗ ecosystem services functions have to be

37:50 ↗ replaced with human measures such as

37:52 ↗ water filtration dikes and other

37:54 ↗ engineered means the costs of these are

37:57 ↗ immensely greater and require ongoing

38:00 ↗ operations and maintenance expenditures

38:02 ↗ that never end

38:03 ↗ I provided a sampling of studies for

38:06 ↗ your reference that describes the

38:08 ↗ substantial benefits of health of open

38:11 ↗ spaces and wood land forests

38:13 ↗ one of these from the Department of

38:15 ↗ Environmental Conservation of New York

38:17 ↗ State lists eight benefits of forests

38:19 ↗ with the relevant references from the

38:22 ↗ scientific literature ranging from the

38:24 ↗ boosting of the immune system to

38:25 ↗ lowering blood pressure reducing stress

38:27 ↗ etc I would commend the council's

38:31 ↗ perusal of this representative sample

38:33 ↗ from the science literature and hope

38:35 ↗ that you will be encountered to always

38:37 ↗ incorporate the potential health

38:39 ↗ benefits of green spaces and woodland

38:41 ↗ forests into your future evaluation of

38:44 ↗ proposed developments I thank you thank

38:47 ↗ you mr. Hampel forty to fifty people in

39:37 ↗ surrounding Timber Ridge are no longer

39:41 ↗ in existence so there's some degree of

39:43 ↗ concern and I might say anxiety about

39:46 ↗ what happens now and I think my comment

39:49 ↗ so basically oriented toward maybe what

39:52 ↗ what happens now and and maybe hope that

39:55 ↗ maybe you think about some of these

39:56 ↗ things that I mentioned the population

39:59 ↗ they are as very versatile and as a wide

40:04 ↗ range of professional backgrounds that

40:08 ↗ we have there and people there have

40:10 ↗ lived all over the country and in

40:12 ↗ various places so they have a pretty

40:14 ↗ broad spectrum of what what's happened

40:17 ↗ and some of the discussions I've had and

40:19 ↗ had

40:20 ↗ do with their experience with city

40:22 ↗ councils and cities and towns that they

40:25 ↗ lived in and I'll just share with you a

40:27 ↗ little bit of what what some of the

40:29 ↗ feedback I got on that these experiences

40:34 ↗ basically had basically to regard to

40:37 ↗ land entitlements zoning building

40:41 ↗ heights floor area ratios and road

40:44 ↗ access

40:46 ↗ they've been remarkably similar I think

40:49 ↗ and the people I've talked to residents

40:51 ↗ come in an appeal for fair balance and

40:55 ↗ considering proposals to develop land

40:57 ↗ parcels which are seen as open space

41:00 ↗ green belts unbuildable locations due to

41:06 ↗ terrain contours the presence of family

41:10 ↗ trails through wooded areas and I would

41:15 ↗ think roads that are already crowded as

41:18 ↗ well so people who've come here to live

41:20 ↗ from all over the country see this and

41:22 ↗ over and over and these cases as well as

41:26 ↗ what they see here they've found out

41:29 ↗ that a council can be persuaded that a

41:34 ↗ good chain saw a bulldozer and

41:38 ↗ outstanding retaining wall contractor

41:42 ↗ can make almost any parcel of land

41:44 ↗ buildable and for that reason it becomes

41:48 ↗ very as we know very attractive to a

41:52 ↗ developer likewise the addition of a

41:54 ↗ stop light what would be another way

41:56 ↗ well I remember your former mayor Fred

42:00 ↗ the butler who came to Denver Ridge

42:05 ↗ several times and he would listen to

42:07 ↗ some of our concerns and he would always

42:09 ↗ not his head in agreement and and would

42:12 ↗ give a very favorable approach but he

42:15 ↗ always said and I thought this was very

42:17 ↗ important and I was glad I'm persuaded

42:20 ↗ to agree but I have to tell you he would

42:23 ↗ say that when I take these issues back

42:25 ↗ to the City Council

42:27 ↗ they often changed my mind

42:30 ↗ and I think that just wrap it up mr.

42:32 ↗ Hanson sir again if you could wrap it up

42:34 ↗ with a concluding statement I'm finished

48:04 ↗ property would be a grave mistake I have

48:07 ↗ learned a lot about landslides and

48:09 ↗ retaining walls since moving to Issaquah

48:11 ↗ 23 years ago at the end of my driveway

48:14 ↗ there is a 40 foot retaining wall put in

48:17 ↗ by the Sammamish Water District to help

48:20 ↗ protect the water tower that was not the

48:23 ↗ original wall an earlier wall had

48:26 ↗ collapsed because there was inadequate

48:27 ↗ drainage from behind the wall and it

48:30 ↗ caused a major landslide which went half

48:32 ↗ way down the hillside fortunately there

48:35 ↗ weren't any homes directly below when

48:37 ↗ that happened years later a housing

48:40 ↗ development did come in below the water

48:42 ↗ tower

48:42 ↗ but the drainage they put in was not

48:45 ↗ adequate residents complained that their

48:47 ↗ marshy lawns so dish they complained

49:56 ↗ on a hillside it can be a recipe for

50:28 ↗ hillside I don't believe it's a quiet

50:33 ↗ properly evaluate and inspect

50:40 ↗ this site look what happened recently at

50:43 ↗ Allis the geotech report had numerous

54:01 ↗ working with cities to preserve over

54:03 ↗ sixty thousand acres of high

54:06 ↗ conservation value lands including farm

54:08 ↗ lands nature's trails the Bergsma

54:11 ↗ property is arguably considered some of

54:14 ↗ that high-value land the King County

54:17 ↗ effort also includes potential funding

54:20 ↗ sources which may allow for an equitable

54:24 ↗ distribution the only negative is of

54:28 ↗ course it requires action from the

54:30 ↗ council and it won't happen

54:31 ↗ automatically and unlike a developer

54:33 ↗ they don't come calling on a regular

54:34 ↗ basis to do something the negatives of

54:37 ↗ building the 57 homes have been talked

54:41 ↗ about a number of times but just quickly

54:42 ↗ you know it's misaligned with the plan

54:45 ↗ vision of everything from the growth

54:47 ↗ management act Mountains to sound

54:49 ↗ greenways the King County lands

54:51 ↗ conservation initiatives you know just

54:53 ↗ the whole large clearing large sections

54:55 ↗ of visible growth and arguably it's not

54:58 ↗ even in line with the a comprehensive

55:00 ↗ plan for reducing sprawls and protecting

55:02 ↗ the environment or creating pedestrian

55:34 ↗ here is just unbelievable in some ways

55:40 ↗ twelve hours a day is a hundred twenty

55:42 ↗ days just think about how much the land

55:44 ↗ is getting displaced and the argument

55:50 ↗ being affected it's a twenty seven acres

1:00:26 ↗ became acquainted with the comprehensive

1:00:28 ↗ and central Issaquah plans the city put

1:00:31 ↗ a huge amount of time and resources into

1:00:35 ↗ creating these plans which established

1:00:37 ↗ the city's future vision and policy

1:00:39 ↗ direction but how does the Bergsma

1:00:43 ↗ proposal line up with these plans it is

1:00:46 ↗ my belief they do not this development

1:00:50 ↗ is in direct opposition to concentrating

1:00:52 ↗ density on the valley floor which is one

1:00:56 ↗ of the primary issues stated in the

1:00:57 ↗ comprehensive plan so how did this

1:01:00 ↗ happen during a recent meeting I had

1:01:03 ↗ with city staff concerning his property

1:01:05 ↗ I asked a city planner

1:01:08 ↗ how will they insure cougar Mountains

1:01:11 ↗ tree canopy and tree retention will be

1:01:14 ↗ in compliance with the comprehensive

1:01:17 ↗ plan and I was told by this staff person

1:01:20 ↗ he explained that they are bound by the

1:01:23 ↗ zoning laws

1:01:24 ↗ in land-use codes associated with the

1:01:28 ↗ property the zoning laws bind them the

1:01:32 ↗ comprehensive plan is only a guide so

1:01:37 ↗ going forward what is the city doing to

1:01:40 ↗ protect our forested hillsides

1:01:42 ↗ developers will never build to meet a

1:01:44 ↗ vision they build to meet meet required

1:01:47 ↗ codes and standards and they build to

1:01:49 ↗ maximize their profit when will City

1:01:52 ↗ Council update our land use codes to

1:01:55 ↗ meet our vision until then it is up to

1:01:58 ↗ you to protect our forests to do sides

1:02:00 ↗ and preserve our Issaquah gateway and

1:02:21 ↗ heard about many of the problems with

1:02:24 ↗ the Bergsma property and some of the

1:02:32 ↗ would like to talk about some solutions

1:02:35 ↗ my belief is the best use of the 45

1:02:38 ↗ acres is for public open space because

1:02:41 ↗ the Bergsma property is special this is

1:02:45 ↗ one of the last parcels of forested

1:02:48 ↗ cougar mountain hillside in Issaquah

1:02:51 ↗ acquiring the property would be

1:02:53 ↗ consistent with the vision of the

1:02:55 ↗ Comprehensive Plan by the city taking

1:02:58 ↗ the lead to protect this land we will

1:03:01 ↗ keep the northeast corner of Cougar

1:03:03 ↗ Mountain forested and open to the public

1:03:06 ↗ this parcel is just steps away from the

1:03:09 ↗ Issaquah Transit Center and accessible

1:03:12 ↗ to many residents the Bergsma property

1:03:16 ↗ connects to existing city and county

1:03:18 ↗ open space and by acquiring the property

1:03:22 ↗ and providing the link to the existing

1:03:25 ↗ open space it allows for safer

1:03:27 ↗ activities to those utilizing our trails

1:03:31 ↗ so in addition

1:03:35 ↗ so the solution is in purchasing the

1:03:39 ↗ property and I am bringing forth a few

1:03:42 ↗ funding options in addition to applying

1:03:46 ↗ for numerous grants that are available

1:03:48 ↗ through King County the city has

1:03:50 ↗ excellent credit and could consider

1:03:52 ↗ selling bonds or using bank credits

1:03:54 ↗ acquiring Bergsma could be excuse me

1:03:59 ↗ acquiring Bergsma should provide the

1:04:01 ↗ city with TDRs that could help fund the

1:04:04 ↗ acquisition but when the city gives out

1:04:07 ↗ free up zones the TDRs lose their value

1:04:11 ↗ it is our understanding that the city

1:04:14 ↗ excuse me that King County is interested

1:04:17 ↗ in partnering with the city please step

1:04:20 ↗ up show initiative creativity and a

1:04:24 ↗ willingness to work with others Issaquah

1:04:28 ↗ is not an isolated island members of

1:04:31 ↗ Issaquah and surrounding cities such as

1:08:56 ↗ Audubon Society you may not know that we

1:08:59 ↗ connected we conducted a survey in the

1:09:02 ↗ area around the Harvey Manning Park from

1:09:04 ↗ November of 2015 to September of 2016 we

1:09:09 ↗ followed 1.5 miles of trail and we were

1:09:12 ↗ asked at that time to conduct the survey

1:09:14 ↗ because of development that was

1:09:15 ↗ happening on the nearby parcels of land

1:09:17 ↗ during this survey we had experienced

1:09:20 ↗ team members that noted all birds seen

1:09:22 ↗ or heard as they walked along those

1:09:24 ↗ trails they did a total of 10 walks over

1:09:28 ↗ the eleventh month period over this

1:09:31 ↗ period of time they found 43 species of

1:09:33 ↗ birds 15 of which were year-round

1:09:36 ↗ residents 14 were migrants and 14 either

1:09:40 ↗ visited or flew over the site while they

1:09:42 ↗ were there a total of 22 species were

1:09:45 ↗ seen in the area on just one day in May

1:09:48 ↗ during the breeding season breeding

1:09:51 ↗ birds were confirmed by presence of

1:09:53 ↗ breeding pairs male singing on territory

1:09:56 ↗ adults feeding young active nest and

1:09:59 ↗ nesting behavior breeding birds

1:10:01 ↗ consisted of both resident and migratory

1:10:03 ↗ species nesting birds used the entire

1:10:06 ↗ forest area from the ground to the

1:10:08 ↗ understory to the canopy 13 species were

1:10:12 ↗ thought to be breeding in the area and

1:10:14 ↗ these included the hairy woodpecker the

1:10:16 ↗ Pacific slope fly catcher the backed

1:10:18 ↗ capped chickadee the Pacific wren the

1:10:20 ↗ chestnut backed chickadee the brown

1:10:22 ↗ creeper the brown crowned kinglet the

1:10:25 ↗ American Robin the back floated grey

1:10:27 ↗ Warbler Wilson's Warbler dark-eyed junco

1:10:29 ↗ z-- and spotted toe he's my grits found

1:10:33 ↗ at the site who may have used the area

1:10:34 ↗ as a stopover include the olive sighted

1:10:37 ↗ flycatcher

1:10:37 ↗ the Western wood peewee the violet green

1:10:40 ↗ swallow the warbling very very oh the

1:10:42 ↗ orange crowned Warbler and the Western

1:10:44 ↗ Tanager black-headed grosbeak and the

1:10:46 ↗ purple finch

1:10:47 ↗ most of these were seen in the spring

1:10:50 ↗ because migration patterns in the fall

1:10:52 ↗ require a little bit different route for

1:10:54 ↗ them in order to find foraging they also

1:10:56 ↗ noted that a

1:10:58 ↗ King County regulated wildlife species

1:11:00 ↗ the bald eagle was seen flying near the

1:11:02 ↗ park in both April and July due to the

1:11:05 ↗ difficulty in seeing and hearing birds

1:11:07 ↗ in the forest the team that did this

1:11:09 ↗ survey considered the results of this

1:11:11 ↗ survey to be an undercount of the

1:11:13 ↗ numbers of birds in the area the flora

1:11:16 ↗ in the area consisted of big leaf maple

1:11:18 ↗ western red cedar Western hemlock and

1:11:21 ↗ dumb list Douglas fir with native shrubs

1:11:23 ↗ planted near the landscaping of the park

1:11:27 ↗ these surveys were all reported online

1:11:30 ↗ to eBird and online database and we did

1:11:33 ↗ this survey to hope that this

1:11:34 ↗ information can assist in future

1:11:36 ↗ land-use decisions including what will

1:11:39 ↗ happen to the Bergsma property as an

1:11:41 ↗ organization whose mission is to protect

1:11:43 ↗ preserve and enhance natural ecosystems

1:11:47 ↗ birds other wildlife and people

1:12:57 ↗ meals but plan the meals make the meals

1:13:03 ↗ where people could come and meet and

1:13:04 ↗ learn about this opportunities I want to

1:13:06 ↗ say thanks to zoo quest Senior Center

1:14:15 ↗ designation being the best and highest

1:14:17 ↗ use for this property the enjoyment of

1:14:19 ↗ future generations the concern of

1:14:21 ↗ development pacts on existing

1:14:23 ↗ neighborhoods the concern of slides on

1:14:25 ↗ existing neighborhoods and safety and

1:14:27 ↗ road closures and the effects on

1:14:28 ↗ wildlife if there is anyone else who has

1:15:15 ↗ numerous cautions about construction

1:15:17 ↗ activities after removing trees it

1:15:19 ↗ advised proof rolling and calm

1:15:22 ↗ acting the soil only during specific

1:15:24 ↗ soil moisture periods when the soil had

1:15:28 ↗ a specific plus or minus 2% moisture

1:15:30 ↗ content

1:15:31 ↗ I doubt that the city staff would be

1:15:34 ↗ able to ensure these conditions were

1:15:35 ↗ always met under our changeable weather

1:15:37 ↗ I'd like to point out that I've lived in

1:15:41 ↗ Miramon for the past thirty years and

1:15:44 ↗ the past several years three to five

1:15:47 ↗ years our weather patterns have changed

1:15:50 ↗ dramatically and we've been had we used

1:15:52 ↗ to have mist constantly all through the

1:15:55 ↗ winter and we had the rainy season and

1:15:59 ↗ then there's August now we have day

1:16:03 ↗ losses and we have much more flooding

1:16:05 ↗ than we used to so assumptions that we

1:16:08 ↗ made before about weather patterns are

1:16:11 ↗ not valid in these times do the city

1:16:18 ↗ staff know how many tests borings are

1:16:20 ↗ needed and where on this property to

1:16:22 ↗ locate perched water tables and other

1:16:25 ↗ locations of concern an original SEPA

1:16:29 ↗ determination for this property

1:16:30 ↗ recommended mount maintaining the

1:16:33 ↗ forested character of the hillsides

1:16:35 ↗ protecting and preserving the existing

1:16:38 ↗ tree canopy it is recommended the use of

1:16:42 ↗ off-site transfer of development rights

1:16:49 ↗ look into ways of protecting the

1:16:52 ↗ hillside to reject proposed development

1:16:54 ↗ is too risky oppose the impact of

1:16:58 ↗ endless eighty eight hundred truckloads

1:17:04 ↗ off adding to our traffic and congestion

1:17:06 ↗ x' you may have seen the signs along the

1:17:09 ↗ valley road that say Issaquah keep your

1:17:11 ↗ dirt so it's not making friends in the

1:17:14 ↗ community we must finally learn

1:17:18 ↗ something from the history of landslides

1:17:20 ↗ in the area the fall of the water

1:17:23 ↗ district retaining wall in and the other

1:17:28 ↗ the other cases that janet wall

1:17:31 ↗ mentioned in her talk let's not

1:17:36 ↗ the difficulty in evaluating soil

1:17:38 ↗ structure and where soil conditions

1:18:33 ↗ your jurisdiction and County site state

1:18:36 ↗ law firm making it difficult for us to

1:18:38 ↗ restrict traffic on our Road but the

1:18:41 ↗ proposed Bergsma development has eighty

1:18:44 ↗ eight thousand cubic yards of dirt to be

1:18:46 ↗ removed we would like to ask that a

1:18:50 ↗ condition be placed on the permit for

1:18:52 ↗ the permit I guess when it's presented

1:18:55 ↗ to the Hearing Examiner that specifies

1:18:58 ↗ that may Valley Road is not a haul route

1:19:00 ↗ for the development should it go through

1:19:03 ↗ grey get from when word committed

1:19:07 ↗ verbally on October 30th that he was

1:19:10 ↗ plant or they were planning on using

1:19:11 ↗ i-90 for some dump site east but that

1:19:16 ↗ obviously is meaningless if not in

1:19:18 ↗ writing or not specified in conditions

1:19:21 ↗ so asking that a SEPA condition Council

1:19:26 ↗ resolution condition to the permit be

1:19:28 ↗ placed that me Valley Road is not on the

1:19:30 ↗ Hal route that the whole route uses SR

1:19:35 ↗ highways are used as efficiently as

1:19:38 ↗ possible for removal and bringing in all

1:19:41 ↗ material to the site the and

1:19:48 ↗ the I don't understand how SEPA I don't

1:19:51 ↗ super resolutions can claim that

1:19:54 ↗ eighty-eight thousand cubic yards of

1:19:57 ↗ dirt can all be mitigated or that

1:19:59 ↗ trucking has no environmental impact but

1:20:12 ↗ most of your city streets to local truck

1:20:15 ↗ traffic but I would just consider that a

1:20:23 ↗ the city to take responsibility for

1:20:25 ↗ developments that you approve that if

1:20:28 ↗ you are collecting the money and

1:20:31 ↗ approving developments that technically

1:20:34 ↗ all of your roads are on the table for

1:20:36 ↗ any haul routes needed for those

1:20:38 ↗ developments and consider that in your

1:20:39 ↗ decisions and in summary I presented the

1:20:43 ↗ safety concerns along may Valley Road to

1:20:46 ↗ the increased truck traffic thousands of

1:20:48 ↗ gateway trucks that we saw over the past

1:20:50 ↗ year than me would middle school bus was

1:20:53 ↗ literally inches away from being

1:20:55 ↗ rear-ended by a fully loaded tandem dump

1:20:57 ↗ truck on May 5th and on July 11th the

1:20:59 ↗ semi truck rolled over on the road I'm

1:21:02 ↗ just a few hundred feet from the Liberty

1:21:05 ↗ High School bus stop and not on my belly

1:21:08 ↗ Road but I'm sure we're all aware

1:21:09 ↗ December 28th the truck rolled over on

1:21:13 ↗ State Road 900 and that was a driver

1:21:15 ↗ admittedly was supposed to see on the

1:21:18 ↗ interstate and took SR 900 as a shortcut

1:21:22 ↗ and was driving too fast and the road

1:21:23 ↗ was closed for I believe almost eight

1:21:25 ↗ hours so thank you for the consideration

1:22:34 ↗ quad developed the way it's written on

1:22:36 ↗ paper so I I passed by a landslide

1:22:40 ↗ anywhere from two to six times a day

1:22:43 ↗ that has a nickname to it it's called

1:22:45 ↗ shower curtain Hill because it's covered

1:22:47 ↗ in a shower curtain so if you want to

1:22:50 ↗ know how long a landslide takes to

1:22:52 ↗ resolve that happened I was in the

1:22:54 ↗ council meeting when that was with that

1:22:56 ↗ when that was approved and the City

1:22:58 ↗ Council said that this is something

1:22:59 ↗ that's going to be a sound decision

1:23:06 ↗ shower curtain

1:23:07 ↗ I urge anybody to go up to that hill and

1:23:10 ↗ see what it takes to stabilize a hill

1:24:37 ↗ currently a whole lot of buildings that

1:24:42 ↗ were designed to provide affordable

1:24:44 ↗ housing that aren't being used but could

1:24:48 ↗ be used if the city had the willingness

1:24:52 ↗ to save them we are now back where we

1:24:57 ↗ were

1:24:57 ↗ after the Hearing Examiner made his

1:24:59 ↗ decision and the property owner will

1:25:06 ↗ still fight you but you have a chance to

1:25:09 ↗ rethink the city's position that's a

1:25:19 ↗ when they're removed will run down into

1:34:54 ↗ planning we here in Issaquah do have a

1:34:58 ↗ sub area plan that covers our regional

1:35:04 ↗ us there isn't as much of a deal here

1:35:10 ↗ the discussion point is whether or not

1:35:13 ↗ they must complete a sub area plan by

1:35:15 ↗ 2020 and so that has not been voted on

1:35:18 ↗ but that is something that we and the

1:35:20 ↗ SCA caucus supports and it's consistent

1:35:23 ↗ with what we've already done the other

1:35:25 ↗ thing has to do if is the potential of

1:35:29 ↗ completing a market study if by the year

1:36:55 ↗ it'll be kind of a target mix of 2080

1:37:03 ↗ but it will probably not be an enforce

1:45:38 ↗ this this agenda bill and the proposed

1:45:41 ↗ action tonight does not reflect a final

1:45:47 ↗ decision on long-term operation of the

1:45:49 ↗ the senior center but rather it allows

1:45:52 ↗ us to get some direction as staff to

1:45:56 ↗ pursue seeking a long-term operating

1:45:59 ↗ partner as you know interim operation of

1:46:04 ↗ the facility began January of last year

1:46:07 ↗ since that time it has been the

1:46:09 ↗ intention as we move this facility

1:46:13 ↗ forward into its desired future that

1:46:17 ↗ interim operation allows us this time to

1:46:20 ↗ discuss explore determine policy on what

1:46:24 ↗ we want long term operation to look like

1:46:26 ↗ in March of last year we began work with

1:46:30 ↗ an advisory group at the senior center a

1:46:32 ↗ tremendous amount of work it was done by

1:46:34 ↗ that group over five months time their

1:46:38 ↗ advisory report is in your packet I've

1:46:40 ↗ had the chance to go over that a number

1:46:42 ↗ of times at services and safety the

1:46:46 ↗ group did a fantastic job of researching

1:46:49 ↗ exploring evaluating discussing various

1:46:53 ↗ long-term operating models and which one

1:46:55 ↗ we felt make them up made the most sense

1:46:57 ↗ as a community for the Issaquah senior

1:47:00 ↗ center in that time and discussion I

1:47:03 ↗ think it also a very important element

1:47:05 ↗ was created and that was the creation of

1:47:08 ↗ six guiding principles that this group

1:47:11 ↗ felt strongly and staff felt strongly

1:47:13 ↗ really became the anchors became the

1:47:15 ↗ tenants for what we want successful

1:47:18 ↗ operation of that Senior Center to be

1:47:20 ↗ the group was unanimous in consensus on

1:47:23 ↗ those guiding principles where they

1:47:26 ↗ weren't and and where I think we'll

1:47:28 ↗ always understand there's going to be

1:47:30 ↗ differences of opinion as is what

1:47:34 ↗ operating model made the most sense

1:47:36 ↗ whether it be direct City operation or

1:47:40 ↗ seeking operating partner what was

1:47:43 ↗ understood by that group

1:47:45 ↗ and what the report really points out

1:47:46 ↗ though is either those models that group

1:47:50 ↗ felt very strongly would be very very

1:47:52 ↗ successful in the senior center as long

1:47:55 ↗ as those guiding principles were met I

1:47:57 ↗ emphasize those guiding principles

1:47:59 ↗ because as we move forward into this

1:48:02 ↗ request and into this action in terms of

1:48:05 ↗ seeking an operating partner those

1:48:06 ↗ guiding principles really become anchors

1:48:09 ↗ for what request for qualifications and

1:48:12 ↗ a request for proposal would look like

1:48:14 ↗ they become really anchors for how we

1:48:18 ↗ measure what a successful partner might

1:48:20 ↗ look like so following that work of the

1:48:24 ↗ advisory group staff in administration

1:48:27 ↗ and the Parks Department and that

1:48:29 ↗ explore discussed recommended action

1:48:33 ↗ moving forward that action that's here

1:48:35 ↗ tonight now like I stated before is

1:48:38 ↗ pursuing seeking an operating partner

1:48:42 ↗ what that would mean is putting out a

1:48:46 ↗ request for qualifications request for

1:48:49 ↗ proposal really a sort of a hybrid of

1:48:51 ↗ both and that we will seek to find any

1:48:54 ↗ interested partners that would like to

1:48:56 ↗ come alongside and operate with us going

1:48:59 ↗ through that work this this first

1:49:03 ↗ quarter and second quarter will allow us

1:49:06 ↗ to determine ideally in the timeline by

1:49:08 ↗ June or July if we have a successful

1:49:12 ↗ operating partner and we would certainly

1:49:15 ↗ update you at that time and then go into

1:49:19 ↗ negotiations it's the recommendation as

1:49:21 ↗ you see in the staff report that we

1:49:23 ↗ would be pursuing should we find it a

1:49:25 ↗ successful operating partner to cement

1:49:29 ↗ this through a management agreement as

1:49:31 ↗ opposed to a lease agreement which was

1:49:33 ↗ the the prior template we feel a

1:49:36 ↗ management agreement really gives us the

1:49:39 ↗ tools and the ability to understand as

1:49:41 ↗ owners of that public building we want

1:49:44 ↗ to partner with a successful operator

1:49:46 ↗ and moving this forward should we as we

1:49:50 ↗ go through this process not find an

1:49:53 ↗ operating partner that we

1:49:55 ↗ I'm more interested in alternatives we

1:49:58 ↗ see with certainly at that time

1:50:00 ↗ exploring other alternatives one of

1:50:03 ↗ those being City operation but we felt

1:50:06 ↗ it was imperative in this recommendation

1:50:08 ↗ given the history that this facility has

1:50:11 ↗ been operated by a non-profit partner

1:50:13 ↗ given the professional agencies that we

1:50:17 ↗ see in this area that operate senior

1:50:19 ↗ centers that pursuit of this seemed to

1:50:22 ↗ be a first priority before considering

1:50:26 ↗ adding this to our spectrum of services

1:50:29 ↗ that we provide directly one last item

1:50:32 ↗ before I open it up for questions

1:50:35 ↗ something we discussed it services and

1:50:37 ↗ safety should we approve this tonight

1:50:39 ↗ and proceed with this action we would

1:50:43 ↗ very much want to stay in communication

1:50:45 ↗ with our customers as we've enjoyed

1:50:47 ↗ establishing some strong relationships

1:50:50 ↗ with our senior customers every Monday

1:50:54 ↗ be certainly an opportunity to present

1:51:08 ↗ something that would be a little bit

1:51:10 ↗ bigger and would certainly make sure

1:51:12 ↗ you're aware of that and if you're

1:51:13 ↗ interested in attending to come to that

1:56:45 ↗ amendments to our budget and I find that

1:56:47 ↗ strange that 16 days into our our budget

1:56:51 ↗ we're asking to make amendments so I

1:56:53 ↗ just like a little reflection on our

1:56:55 ↗ budgeting process we spent three months

1:56:56 ↗ working really hard on that

1:56:57 ↗ and two weeks into it we need to ask for

1:57:00 ↗ amendments so that's that's a concern

1:57:01 ↗ for me on how that that went but I am

1:57:03 ↗ totally supportive of this process and

1:57:05 ↗ the money you need is as you said to do

1:57:28 ↗ work plan for the year begins after the

1:57:31 ↗ approval of the budget and because it

1:57:33 ↗ happened late in December this year I

1:57:35 ↗ believe what's going on is that there

1:57:37 ↗ are some items that still need to

1:57:39 ↗ proceed and so as the work plan gets

1:57:41 ↗ prioritized about which work in which

1:57:43 ↗ section and we review which staff levels

1:57:45 ↗ we have that is why it seems like it's

1:57:47 ↗ coming out of nowhere rather quickly but

1:57:50 ↗ that was why the request is coming now

1:57:53 ↗ kind of a workload balancing thing but

1:57:55 ↗ thank you for bringing that up that's

1:57:57 ↗ what President Mertz I just want to say

1:57:59 ↗ that I'm really excited that the citizen

1:59:52 ↗ director for a presentation but he's

1:59:58 ↗ present as Manny chair rama proceeds

2:00:28 ↗ requests are going to be coming to us

2:00:29 ↗ this is the first one with Verizon and

2:00:33 ↗ so we had some concern with that the

2:00:35 ↗ original request was for citywide

2:00:37 ↗ franchise tax agreement and

2:00:40 ↗ the infrastructure community was very

2:00:44 ↗ concerned with the broad scope of it and

2:00:47 ↗ not well enough defined controls so we

2:00:52 ↗ actually went back a second time we

2:00:55 ↗ looked at this very closely and the the

2:00:57 ↗ proposal now before you is specifically

2:01:00 ↗ for one area is a call fall city wrote

2:01:03 ↗ and one site on Pine Lake Road it's for

2:01:05 ↗ seven sites along there it's

2:01:08 ↗ specifically for those seven sites only

2:01:10 ↗ it is there are photo simulations for

2:01:14 ↗ all those seven sites of what it will

2:01:15 ↗ look like because we don't have code

2:01:18 ↗ written that defines all this yet so we

2:01:20 ↗ went with photo simulations to describe

2:01:23 ↗ what we wanted and it includes things

2:01:26 ↗ such as like no ground equipment being

2:01:27 ↗ there and so forth so it's very specific

2:01:30 ↗ for that area it's kind of our pilot if

2:01:34 ↗ you will now the plan in the future is

2:01:37 ↗ that they'll be working with Sheldon and

2:01:39 ↗ Keith on getting code written so that we

2:01:46 ↗ be well defined it won't have to have

2:02:15 ↗ has about 120 days to react to those

2:02:19 ↗ were already past that a little bit

2:02:23 ↗ little bit and so anyway hopefully these

2:02:26 ↗ will come a little bit better with a

2:02:27 ↗ little more definition as they go and

2:02:35 ↗ heard there's further attempts at the

2:02:37 ↗ state level to get some laws passed
