0:26 Council meeting and I'm calling it to
0:29 order the purpose of tonight's special
0:31 meeting is to provide an update on the
0:33 city's Kovach 19 response and address a
0:36 few items requiring council action and
0:38 discussion before we move on to the
0:41 agenda item I'd like to acknowledge our
0:44 remote meeting format on March 6th
0:47 I issued an emergency proclamation
0:49 declaring a civil emergency in the city
0:52 due to the curve of 19f break due to the
0:55 civil emergency and in consideration for
0:58 the health and safety of our council
0:59 members and staff and the public
1:01 tonight's meeting is being held remotely
1:04 the audio of the meeting will be
1:06 recorded streamed live and available for
1:09 later listening on the city's YouTube
1:11 channel there will be no meeting video
1:14 due to this tonight staff presentations

4:05 lastly before you forget I'd like to
4:07 read reiterate some meeting guys I'm
4:10 please indicate when you wish to speak

4:37 the sound quality for all meeting

4:57 frequently the first item on the agenda
5:00 this evening item a is the Koba 19
5:03 report it is the mayor's report last
5:08 week I issued to emergency proclamations
5:11 one for a temporary moratorium on late
5:13 fees for tenants and the other to
5:16 temporarily suspend the paper bag fee
5:18 more emergency proclamations may be
5:21 forthcoming as the situation evolves and
5:24 I'd like to outline the process state
5:27 law allows the city to declare an
5:28 emergency such as the one I declared on
5:31 March third once an emergency is
5:33 declared I have certain authority under
5:35 state law and the city's comprehensive
5:37 emergent emergency management plan to
5:41 take emergency actions such as the to
5:43 emergency proclamations that were issued
5:45 on March 19 it's recommended that some
5:49 emergency powers such as suspension of
5:51 the paper bag feed also should be
5:53 ratified by the City Council the
5:55 administration is consulting with the
5:57 city attorney to follow the proper
5:59 process for these emergency actions in
6:02 either case City Council will be kept
6:04 apprised of all proclamations and once
6:06 the proclamation is signed and filled it
6:08 will be then sent out to the public
6:10 through our various communication
6:11 channels and posted to our website
6:14 thanks to those of our staff that are
6:18 working on the front line please
6:20 ironing empties and Parks and Public
6:22 Works operations workers they are all
6:25 still out in the community and
6:27 responding to the changing situation
6:29 literally basis and thanks to all of our
6:32 city staff we're working from home or
6:34 taking on new assignments in support of
6:36 emergency you are flexibility to allow
6:40 us to
6:41 save our city team in a moment of crisis
6:43 is so very much appreciated
6:45 and lastly for tonight's meeting I've
6:48 also asked our city administrators to
6:50 give a special report city administrator
6:52 bowsprit babka will now give an update
6:54 on the city's kovat 19 response Mali
6:58 madam mayor members of the council good
7:00 evening I wanted to take a few minutes
7:03 to talk about the things that we are
7:05 doing to address this emergency we have
7:10 been working largely at home those
7:12 employees can work at home are working
7:14 at home and I think that has certainly
7:17 helped we are about 10 days into that
7:20 and I think that we've still been able
7:22 to be very effective in serving the
7:24 public of course there are those roles
7:26 and responsibilities that we're not able
7:28 to do remotely and again as the mayor
7:31 mentioned I would want to commend our
7:32 staff who are the front lines every day
7:35 addressing issues but it's clear that
7:38 business is not as usual that the city
7:42 of Issaquah in order to address the
7:45 issues faced by the Cova 19 crisis has
7:48 changed how we do business and what I
7:51 did last week was ask our staff to
7:54 really give it the work that they're
7:56 doing into a few very specific areas to
8:00 focus on the health and safety of our
8:01 community and madam mayor members of the
8:03 council I'd like spend a few minutes
8:05 talking about those specific areas and
8:08 the work that we've been doing like the
8:10 conclusion of my comments would be happy
8:12 to answer any questions clearly in the
8:15 face of the civil emergencies our public
8:18 safety is the most important thing in
8:20 our first priority is making sure that
8:22 this quality department and the planned
8:24 Fire and Rescue Department have the
8:26 resources that they need we've been
8:29 working very closely together with both
8:31 police and fire we've been looking very
8:33 carefully at resources that our police
8:36 department needs staffing resources
8:38 equipment resources flexibility to do
8:41 their jobs all of those things have been
8:44 put in place clearly as we look to the
8:48 future we want to make sure that this
8:50 Police Department has the resources and
8:52 staff
8:53 that it needs to keep our community safe
8:57 and this has been a major focus of ours
9:00 I'm pleased to say so far we've had no
9:02 issues with the police other than an
9:06 issue that I think all law enforcement
9:08 and fire emergency service agencies are
9:10 facing and that is the ability to have
9:13 proper protective equipment we are able
9:16 to make sure that our police officers
9:18 and firefighters are properly equipped
9:20 but if this is an ongoing process and we
9:23 are going to continue to work very
9:24 closely with our state and county
9:28 partners to make sure that our both of
9:30 our police and fire departments have the
9:32 emergency protective gear that they need
9:34 so we have been focused first and
9:36 foremost on public safety second areas
9:39 communications we want to make sure that
9:41 our residents receive information about
9:43 what we're doing receive information
9:45 about what's happening both at the
9:47 county and state level as I know the
9:49 council is aware the governor has made
9:53 some additional proclamations and orders
9:55 this evening that in 48 hours
9:58 majority of businesses will close except
10:00 those essential services we are sharing
10:03 that information we are sharing the
10:04 information as things change here in
10:06 this COIs we've redone our website we've
10:10 done videos of Katrina there and the
10:13 council president we will continue to do
10:16 those be very well received by the
10:17 community we have created a special
10:20 email address held at a squad of so
10:24 individuals who are looking for specific
10:26 pieces of information can email us at
10:28 that telephone number actually have that
10:31 email address and we continue to answer
10:33 phones masked people D so communications
10:37 has been a key part of our outreach and
10:39 our response and a very pleased to
10:41 report we've been doing a very good job
10:43 of interrogations this year Cubans
10:47 services are one that we get that
10:49 focusing board more on in the city of us
10:52 o'clock certainly given the civil
10:54 emergency requires even more of our
10:56 efforts and we have work to pivot
10:59 additional individuals on our city staff
11:01 to work on human service issues we have
11:04 at least one major issue
11:07 the agenda the seeking which we'll talk
11:08 about a little more but clearly this is
11:10 a long-term issue this is something that
11:13 the Seva squad is going to need to focus
11:15 on as we move forward and the staff and
11:18 I hope to bring to the council in the
11:20 coming weeks additional information and
11:22 additional requests for programs and
11:25 services financial support to not only
11:28 help individuals but here in this club
11:30 but also our nonprofit organizations
11:33 we've been working very closely with
11:35 several of this food bank probably first
11:38 among them and that will continue to
11:41 work very closely with them the mayor
11:43 mentioned had a proclamation regarding
11:46 evictions and layton up these four that
11:49 we are going to continue to make
11:51 information available so if individuals
11:54 are the charge late fees or rent that we
11:59 will provide support to them and we'll
12:00 have information on our website
12:02 regarding that so in the area of Human
12:04 Services that something that we are
12:06 going to continue to focus on next is
12:08 economic development businesses
12:11 throughout our community are being
12:12 severely impacted by the closings by the
12:16 the changes caused by this emergency gen
12:19 David Heiser Economic Development
12:20 Manager has been leading a team of staff
12:23 working every day with our stakeholder
12:26 groups with individual businesses to
12:29 make sure that we're doing what we can
12:31 but quite honestly at this early stage
12:34 there's there's not a lot that we're
12:36 able to do but we're going to continue
12:38 to share information the best because we
12:40 can the city I implemented a plan to
12:44 provide a $25 a day per diem for our
12:47 employees to purchase food and beverages
12:51 here in this block this is something
12:54 that I felt strongly was an important
12:56 economic development tool to continue to
12:59 patronize our restaurants and other
13:02 fruit serving businesses as well quite
13:04 frankly is to provide some additional
13:07 support for our employees and I think
13:09 from a moral standpoint I anecdotally
13:11 have been hearing from both managers and
13:13 employees that this has been well
13:15 received and we've also heard
13:16 anecdotally from our businesses
13:18 this is a program that we will continue
13:21 to evaluate each pay period it has to be
13:24 spent on food here in this cloth and
13:26 we'll continue to do that the last the
13:30 last area that our economic development
13:31 manager Jenny Davis Hayes's focused on
13:34 is the reviews of the holiday yet as I
13:37 know you are aware King County has a
13:39 one-year lease of now former Holiday Inn
13:42 site and they are working to reduce that
13:47 facility as a care facility we have had
13:50 discussions with King County just a
13:52 couple of days ago they continue to map
13:55 with their plans for that facility they
13:58 have committed as posted we are going to
14:00 be working on having additional
14:03 community dialogue as they decide what
14:05 they would like to use that facility for
14:07 their early estimates at this point is
14:10 that there's still a minimum three weeks
14:11 away from using the Holiday Inn site and
14:14 so we will keep the community and the
14:16 City Council apprised and then the last
14:19 area that it's a focus is infrastructure
14:22 working with our Public Works operations
14:24 staff water sewer stormwater of Street
14:28 infrastructure is very important we have
14:30 split our Public Works operations staff
14:33 into two teams and eight team and P team
14:35 one working on two weeks off two weeks
14:38 this is to make sure that there there's
14:41 any illness among that the teams that
14:44 there is no sharing of that illness that
14:47 would have an impact on our providing
14:50 critical municipal services so that is
14:53 going very well we continue to maintain
14:55 our water source our Water Street
14:58 infrastructure as we did throughout the
15:00 community so those are the five areas of
15:04 that that really as municipal government
15:06 have been focusing on these are
15:08 supported of course by our other
15:10 operating departments our human
15:11 resources department our information
15:13 technology department you have been so
15:16 fortunate to be so well staffed and the
15:20 prepared by our information technology
15:22 department that our transition to a work
15:25 at home administrative staff has really
15:27 been aided by the work of our
15:29 information technology staff
15:31 and our I danced as we move forward and
15:33 looked toward the coming weeks I am
15:35 concerned that we make sure that we are
15:38 looking at our expenditures that we are
15:40 spending money in keeping with the
15:42 current environment and the current
15:44 emergency and will continue to report to
15:47 the City Council as we move forward on
15:49 finance issues our our plan currently is
15:52 to have a presentation at your next
15:54 counts regular council meeting on April
15:56 2 6 where we will talk more specifically
15:59 of our estimates for our current
16:01 financial condition as we move forward
16:03 so madam mayor members of council I
16:05 cannot tell you how proud I am to be
16:08 working with such a challenge of group
16:10 of dedicated individuals of people who
16:13 are are still continuing to work very
16:15 diligently for the city of this COIs of
16:17 also dealing with the Cova 19 crisis and
16:22 their own families but continuing to
16:24 come to work very proud of that and that
16:27 very happy to answer any questions that
16:28 you or the council may have Oh Thank You
16:31 administrator bockris does the council
16:33 have any questions on the city
16:36 administrator's report there Polly I
16:42 would like to ask a question there's as
16:44 far as a farthing Michelle yes
16:46 once entirety Michelle and have you got
16:49 opened the messaging portion of your
16:52 Skype feeding I do and I just put I have
16:56 a question but I don't know if it showed
16:58 up let's see I did it did show up now
17:03 yes okay so there's not a celebrity
17:06 Michelle I am just wondering about the
17:13 childcare that was something on Friday
17:14 how is that going and are we providing
17:18 that for for our employees free or are
17:23 they helping to offset the cost of that
17:27 again it's the city administrator babka

17:32 council this is something we are
17:34 provided free of charge to our employees
17:36 and the employees the site Fire and
17:37 Rescue Department we it is a slower
17:41 start than we can hoped we've discovered
17:44 that a number of our employees have made
17:45 alternate plans and so we are seeing a
17:48 slower pickup of that but we're very
17:52 pleased with the initial response that
17:54 we've received we also continue to work
17:56 with the school district if they are
17:59 transitioning into daycare themselves we
18:02 hope to then transition the employees of
18:04 the city staff as well as the site fire
18:06 and recipe to its classical district
18:08 program does that answer your question

18:21 is councilmember Goodman um my question
18:24 is I would assume that we would have
18:26 well I don't want to assume but I would
18:28 have thought we would have heard but I
18:29 haven't heard anything so I'll ask the
18:31 question do we have any employees who
18:34 have tested positive or any who are in
18:37 quarantine we are unaware of any that
18:42 have tested positive
18:43 there are several employees for various
18:46 circumstances of reasons that are in a
18:50 self quarantine we continue to monitor
18:53 of their conditions in our human
18:55 resources staff has regular check-ins
18:58 with them and follow-up question please
19:01 if we I guess I would think that if we
19:07 got into a position where we had some
19:08 staffing issues because of quarantines
19:11 then the council would be made aware of
19:13 that currently we have no we have no
19:18 issues we're able to cover appropriate
19:20 shifts but as I've said we get there
19:23 there are different circumstances
19:24 involving several employees and we're
19:27 monitoring those muscley thank you

19:53 and
19:53 the request before you this evening is
19:55 to authorize the program season is
19:58 greater babka will be introducing this
20:00 item and I would like council members to
20:03 hold questions until the end of the
20:05 presentation you will have enough to ask
20:08 questions of both of the administrator
20:10 and all the agency reps that are waiting
20:14 on the line as well so if you just want
20:16 to send me an education by message that
20:19 you have a question I'll start keeping a
20:21 list of the queue and city administrator

20:25 yes madam mayor members of the City
20:27 Council we're here this evening with a
20:31 proposal for a program that would
20:34 provide housing assistance for both
20:37 homeowners and renters 87 nine four
20:43 eight of the requested action before you
20:46 is to establish the Issaquah rental and
20:49 mortgage emergency assistance program
20:51 and authorized funding of $100,000 for
20:54 those affected by the Cova 19 crisis
20:56 number two authorizing the bear execute
20:59 contract amendments with its Community
21:01 Services st. Vincent DePaul st. Joseph
21:04 conference is spa and hopefully to
21:07 provide emergency funds to spa residents
21:09 in need of assistance and to authorize
21:11 the finance director to move with
21:12 $100,000 from the general fund in a
21:15 subsequent 2020 budget amendment the
21:18 agenda bill outlines of the proposed
21:23 program in addition today I provided the
21:26 City Council with two summary documents
21:30 which have been added to the agenda
21:32 packet a1 is a document that summarizes
21:35 the assistance program has is outlined
21:38 in the agenda bill that is found on page
21:42 15 of the Rajan revised agenda packet
21:45 which is currently online and then I a
21:47 question-and-answer she that is also
21:50 provided and that is found beginning on
21:52 page 17 of the agenda packet so bad
21:56 mayor what I'd like to do is to for the
21:58 purposes of those individuals who are
22:00 listening in to walk through the
22:04 proposed program as outlined on page
22:07 fifteen and then also to walk through
22:08 the questions and answers numbers of the
22:12 City Council have provided some
22:14 questions over the course of several
22:16 days and so the questions and answer
22:18 document focuses on that but first the
22:21 program that is being proposed we are
22:24 asking that the council allocate
22:26 $100,000 toward this program for rental
22:29 and mortgage assistance residents of
22:31 Issaquah meeting income requirements at
22:34 or below 120 percent of the area meeting
22:36 and median income or 114 thousand
22:40 dollars per year for household of four
22:41 who need temporary financial assistance
22:44 this assistance would be up to $500 a
22:46 month for up to three months within one
22:49 12-month period we're proposing that
22:51 this assistance be distributed by three
22:54 nonprofits that we the city of a spa or
22:56 he has contracts with to provide these
23:00 types of services the Issaquah community
23:02 services the st. Vincent DePaul st.
23:04 Joseph conference is spa and hope link
23:07 the process for receiving the simpler of
23:10 monies would be as follows that the
23:13 organization's would receive requests
23:14 for services conduct screening by phone
23:17 and an application process determine
23:19 eligibility and provide assistance to
23:21 the property manager or bankers program
23:23 the requirements of the contract if the
23:27 council were to move forward with this
23:29 program of the mayor would be authorized
23:31 to amend existing agreements the funds
23:35 would be provided using a service for
23:37 you burst and model the city will not
23:39 pay upfront organizations will provide
23:41 invoices to the city and the city will
23:43 reimburse them invoices will include the
23:45 number of residents served
23:46 type of assistance provided demographic
23:49 information regarding residents served
23:50 to include the minimum age household
23:52 information income level and resident
23:54 status the administration recommends
23:57 that the distribution of the hundred
23:58 thousand dollars to these organizations
23:59 be based on agency capacity and local
24:02 presence for easy access for residents
24:04 that approved the administration will
24:06 work on a budget and contract amendments
24:08 with the organization at this time to
24:10 allow for flexibility the administration
24:12 proposes not setting an exact amount for
24:15 each organization rather following compo
24:17 authorization of the administration
24:19 would proceed
24:19 to split the funding between the three
24:21 agencies based on the agency's capacity
24:23 they distribute the funds and
24:25 accessibility discs for residents so
24:29 from that proposal have come at a number
24:31 of questions from the City Council
24:33 and we have detailed the answers in
24:36 writing beginning on page 17 of the
24:38 revised package so I'd like to go
24:39 through them the first question is how
24:42 did this item come before the City
24:43 Council it came it sprung out of a
24:46 discussion on March 18th the weekly
24:49 council leadership meeting the mayor
24:51 myself the deputy city administrative
24:53 accounts president's council deputy
24:55 president and councilmember hall
24:57 discussed urgent next up the city could
25:00 take to respond to needs resulting from
25:02 the Cova 19 emergency the consensus of
25:04 the group was for the administration to
25:06 look into a rental assistance relief
25:08 program staff was that given a couple of
25:11 days to come up with a proposal of which
25:13 we did at the end of last week and that
25:15 is the item here before you the agenda
25:19 bill indicates that council directed
25:21 that but I wanted to make sure that it
25:23 was clear but this came from a
25:25 discussion not of any one member of the
25:27 council but really came from a
25:29 discussion of the leadership team that
25:31 met last week question number two is how
25:35 does this program or late to state
25:36 county funds similar areas when they
25:38 come up is it additive that would it be
25:41 replaced by those programs that they're
25:42 created we check to see if there are any
25:45 existing programs that have been newly
25:48 created or existing that would reimburse
25:51 for this and we've not been able to
25:53 identify any of those such programs so
25:55 as we are presenting this program to you
25:57 tonight we are assuming that this
25:59 $100,000 disavow city of this club money
26:02 that will not be reimbursed by another
26:04 level of government
26:05 if such opportunities would be available
26:07 we would seek reimbursement question
26:09 three dealt with the term of the program
26:13 there was a question if the term could
26:15 be sharp shorter and yes the length of
26:18 the time of the program is flexible per
26:19 council direction question number four
26:22 how will the funds be allocated among
26:24 the three organizations as we get
26:27 indicated we would like some flexibility
26:29 if the council would prefer that there
26:32 be a specific allocate
26:33 we would recommend that it would be
26:36 $40,000 for of the Issaquah community
26:39 services $40,000 for st. Vincent DePaul
26:42 at $20,000 for Hope link as the
26:45 information we provided earlier both
26:48 this quad Community Services and st.
26:49 Vincent DePaul I think have a longer
26:52 track record here once we figured that
26:54 there would be a greater need for those
26:57 two organizations versus Hope link but
26:59 again our recommendation remains that
27:01 there be flexibility provided to the
27:03 mayor for the allocation of those
27:05 dollars to those organizations not to
27:07 exceed $100,000 question five in the
27:10 program he clarified the more clearly
27:12 status as an emergency temporary
27:13 response to Coba 19 focusing on the 15 s
27:16 residence with the greatest need
27:18 certainly if this has approved our
27:20 messaging how the program would clearly
27:22 state that question six this is probably
27:26 the question that has been the most of
27:28 most interest to remembers the council
27:30 and that is the the median income
27:32 requirement
27:33 staff is originally proposing a hundred
27:35 and twenty percent and the question was
27:37 could this be at a different income
27:40 level and so what this document shows is

28:24 determine ami if someone has lost their
28:26 job or work hours during screening the
28:29 applicants need to provide income and
28:31 employment status in the last 30 days
28:33 so they can account for recent changes
28:34 in their fiscal situation job or wage
28:37 loss etc a person becomes eligible
28:39 automatically in this case is long as
28:41 their income under normal circumstances
28:43 will be below the ami levels
28:46 question eight can we stipulate that a
28:48 hundred percent of funds go only
28:49 discordant and the answer is yes that
28:52 that's already a part of all of our
28:54 existing contracts and we are proposing
28:57 that this program would only pay for
28:59 Issaquah residents not the residents of
29:01 any other jurisdiction question nine but
29:04 the counts require reporting update when
29:06 fifty percent of funds have been
29:07 expended can reporting the expander to
29:09 include employment status and date when
29:11 employment stat has changed and the
29:13 answer is yes that we're recommending
29:15 monthly reporting and reporting can't
29:17 contain whatever factors the City
29:19 Council requests question ten do we have
29:22 a sense of the rent mortgage breakdown
29:23 to funding that these organizations
29:24 provide and in working with the three
29:28 organizations we have learned that they
29:32 have not previously provided mortgage
29:34 assistance ICS and st. Vincent DePaul
29:39 have the capacity to provide mortgage
29:40 assistance no requests that were made at
29:42 2019 and that the squad community
29:46 services reported less than three
29:47 requests made in 2019 hope link had not
29:50 provided any mortgage assistance as far
29:53 as rental assistance of 2019 it squats
29:56 community services served 218 household
29:59 in this car I think that's at DePaul st.
30:01 Joseph bespeak Conference 122 in supply
30:04 households and hope like 36 muscles
30:08 question 11th in the current situation
30:11 included if emergency is it possible to
30:13 prioritize were specifically allocate
30:16 support funding to specific groups first
30:18 responders medical professionals et
30:21 cetera could we allocate to those
30:23 specifically impacted by Kovac 19 under
30:25 usual circumstances but this is for
30:28 unusual circumstances rather this is
30:30 prohibited by housing fairness laws but
30:32 this is an option to address specific
30:34 circumstances fact staff confer with
30:37 city attorney Jim Haney and mr. Haney
30:39 let us know as it's detailed here the
30:44 Federal Fair Housing Act prohibits
30:45 discrimination and sale rental or
30:47 financing of housing based on race color
30:49 religion national origin sex sexual
30:52 orientation gender identity familias
30:54 through disability the city has no
30:57 authority under emergency circumstances
30:59 or otherwise to violate the Fair Housing
31:01 Act or to suspend its application to any
31:04 particular action however the city
31:07 attorney believes it should be possible
31:09 to prioritize the use of funds for
31:11 persons impacted by coab at 19 an event
31:13 a virus attacks all the protected
31:15 classes equally it gives opinion
31:17 therefore it unlikely to assisting those
31:20 impacted by Kovan 19 would run afoul of
31:22 fair housing laws
31:24 that's for prioritizing funding for
31:26 those particular groups such as first
31:27 responders medical professionals etc the
31:30 question is whether this would have a
31:31 discriminatory effect for example could
31:33 one argue that people with disabilities
31:35 are probably not included in the
31:36 category of first responders in
31:38 proportion to their presence of the
31:40 general population that this may have a
31:42 discriminatory effect on the disabled by
31:44 including them from this program there
31:46 may be other arguments that can be made
31:48 for or against discriminatory effect the
31:50 council should be cautious in any
31:52 priority it's said that you consider
31:54 whether whether any of those priorities
31:56 would have a discriminatory effect on
31:58 any one of the protected classes number
32:01 twelve how does this program compare to
32:04 other programs like utility assistance
32:05 or grocery vouchers and it's a city
32:08 going to be considering those again the
32:10 answer mayor Poli council leadership
32:12 believe that providing direct assistance
32:14 for shelter was an appropriate first
32:16 step there are many other options for
32:18 providing assistance to our residents at
32:20 this time the administration is not
32:22 proposing other programs until we have a
32:24 better idea since its current immediate
32:26 financial position and then finally
32:28 question number 13 could we work with
32:30 arch which sure that their own units
32:33 don't go into foreclosure and caused the
32:35 loss of properties to the program with
32:37 that mine could we shift any responses
32:39 where those residents the answer arch
32:41 currently monitors for foreclosure and
32:43 loss of properties and staff can work
32:45 with arch to continue to binary units
32:47 these proposed funds could be shifted
32:49 for that purpose the administration
32:51 would suggest we monitor the situation
32:53 or report back to the City Council the
32:55 additional funds are needed so bad aver
32:57 members the council we believe this is
33:00 an important program a clearly a first
33:02 step to provide relief to our residents
33:05 number of staff
33:06 and representatives from these
33:08 organizations are also on the call this
33:10 evening and we're all ready to answer
33:12 any questions you may have

34:30 put out information about helping folks
34:33 with mortgages I would like to know what
34:37 Assad is behind that and why we would
34:39 include mortgages and not just vents
34:40 with other it appears as though other
34:42 opportunities are available for folks
34:45 who are impacted by Cobie 19 that may
34:47 have an issue with their mortgage
34:48 payments coming up pretty soon

34:59 were working on this the the thought was
35:01 to make the program of be available to
35:04 as many as if our residents as possible
35:06 and through those discussions mortgage

35:15 available for homeowners which may be
35:17 different than rental but RIT care was
35:19 to provide the City Council with the
35:22 broadest program for it to consider was
35:26 there any is there has there been any

35:43 I don't think of American has been out
35:45 there it imagined that other banks I'm
35:47 just trying to get a sense of you know

36:56 are the what are the financial impacts
36:59 that are leading to the need for this
37:01 funding and I'm wondering if you could
37:03 if you can if you can actually collect
37:06 that kind of information that's great

40:21 process of how we arrived at the figure

40:35 looking at the numbers 218 and 122 the
40:41 last year and 36 and thinking now
40:46 hundred thousand isn't going to go very
40:48 far but if let's start with how did you
40:51 originally arrive at that number and
40:53 then did you think this is going to be
40:56 adequate thank you thanks city
40:59 administrator Bob quest since we're
41:04 about a week and a half or two weeks
41:07 into this you know the the the the
41:11 selection of the hundred thousand
41:13 dollars was a best guesstimate of a
41:17 significant amount of money that we
41:19 could put into the community but also
41:22 recognizing that we don't know the
41:24 fiscal impacts that Cova 90 is going to
41:27 mean to the city government or the city
41:29 of Issaquah we don't know if this is
41:32 sufficient or not sufficient but it
41:34 don't like the right amount to get
41:37 started to make at least some sort of
41:39 meaningful impact right away can I ask a
41:43 follow-up then sure councilmember G
41:45 Michelle so we talked about this before
41:49 and I so I just want to be clear that
41:53 yes it looks like we need additional
41:58 funds to need what I have a feeling it's
42:02 going to be an overwhelming number of
42:05 applicants will be able to visit this am

42:17 revisit this in the future I think
42:18 talking with members of the council
42:20 there's interest in doing other types of
42:22 programs again my recommendation to the
42:25 mayor and the City Council is that we
42:27 get a better sense of our fiscal
42:29 position before we would take on any
42:30 other and

42:48 as I would likely anticipate have more
42:53 applicants than the funding would allow

43:02 that would be about 66 people that
43:05 shorter if they only go for one month
43:08 that would be about 200 people so if
43:10 you've got more applicants than you have
43:13 funding how do the providers choose or
43:16 prioritize who gets funded is it a
43:19 first-come first-serve most need hasn't
43:25 been served before how are those
43:26 decisions made so thank you for that

47:37 tweak it then we wanted to give you that
47:39 ability but it did not come from the
47:43 providers that is correct it did not

48:51 in 70 Gaiden percent range from what
48:54 I've seen

49:05 financial assistance currently is 200%
49:09 of the federal federal poverty level or
49:12 50% AMI and as you get higher in the
49:17 number of members per household the
49:19 threshold shifts from 200% qualifying to
49:23 50% qualifying so to keep it as open as
49:26 possible that's our current policy thank
49:30 you very much and Laurie with its
49:32 community services yes this is Laurie we
49:36 currently do not have an ami level
49:39 however we do operate at pretty much
49:42 below the 80% and my left level thank
49:48 you where we talk about the eligibility
50:02 for up to 3 months and $500 over a
50:06 12-month period I'm curious I mean I saw
50:09 you respond so we could set that
50:10 threshold and whatever we wanted to but
50:13 I'm curious why we picked a 12-month
50:14 threshold are we thinking this is a 12
50:17 month problem or what was the rationale
50:21 there straight about Chris and I'd like
50:27 to phone a friend Monica the gorilla who
50:31 is our from our Recreation Services
50:33 Department Monica could you talk a
50:35 little bit about that I believe it came
50:38 from looking at what our existing
50:41 program is is that correct yes so yes we
50:49 were trying to existing programs in
50:56 place
50:57 and organizations currently have the
51:02 possibility of helping residents twice
51:06 per year or once per year due to the
51:09 melt finding they don't have the
51:11 capacity to help residents multiple
51:14 times so we just put that church hold of
51:17 12 months so basically knowing that our
51:20 fans were limited also we said that they
51:23 could help residents up to three months
51:25 within a 12-month period so the
51:28 expectation was not necessary that the
51:31 program will last 12 months but just to
51:33 put that in residence would be eligible
51:38 for it for about three months three
51:49 months program or is a 12-month program
51:51 but thank you for that clarification

52:51 question about mortgage assistance and I
52:53 heard from council administrator about
52:56 Kuwait's and that's why I was wondering
52:57 if I could hear from the providers about
53:00 the what we heard during the
53:04 presentation was that I believe there
53:07 were at least a couple who haven't
53:09 or don't provide mortgage assistance or
53:11 haven't provided mortgage assistance so
53:13 they're gonna hear from the providers
53:15 about what their thoughts are about
53:19 including mortgage assistance in mrs.
53:23 money thank you I will work through the
53:27 list again and if we can have Lucy with
53:32 Oakland unmute and provide some
53:33 information yeah so we currently do not
53:38 provide mortgage assistance a lot of
53:40 that was routed at one point and in
53:42 federal funding just did not allow
53:47 direct assistance to go towards assets
53:50 and so depending on what funding source
53:53 agencies had it could not go towards
53:56 mortgage payments or car payments for
53:58 example at Hope link we made workaround
54:01 by raising our own funds and applying
54:03 them to financial assistance for our
54:05 flexible financial assistance programs
54:08 but we have not had mortgage payments at
54:10 this time I will say from previous
54:13 agencies that I've worked at providing
54:15 rental assistance in other states the
54:19 documentation process and pledge process
54:22 with mortgage servicers it's much more
54:24 complicated from a service standpoint
54:27 and also typically you also want to
54:32 connect a person who's at risk with
54:35 mortgages to different service providers
54:37 HUD approved housing counselors are
54:41 really the best resource for that time
54:43 and that is a certification process and
54:46 they work with the clients to work with
54:48 their servicers and so it's kind of a
54:51 both divide and conquer mentality of
54:54 let's get them so the programs that will
54:56 be most efficient and most knowledgeable
54:59 to support them and also knowing with
55:02 various funders the restrictions on
55:05 asset payments and and and the
55:10 difficulties on the service end with
55:12 payments to service providers so that's
55:15 that's where we are we're not ruling it
55:17 out with our flexible financial
55:18 assistance but
55:19 that's been the case this long Thank You
55:22 Lucy um can I get Laurie to come off
55:25 mute from it's about community services
55:27 the same question yes this is Laurie we
55:32 very rarely get a phone call for
55:35 mortgage assistance but we did have
55:38 three and total all of last year and I
55:40 think even left the year before it's
55:43 just very rare that a client comes and
55:45 asks for mortgage assistance we handle
55:48 them exactly like our clients for rent
55:52 assistance we work with the banker and
55:55 and the client and we just do the same
56:00 thing we find out what their late
56:02 payment is how much they owe and then we
56:05 work with a client to understand you
56:07 know their circumstances then we approve
56:11 it and we stand our check directly to
56:14 the bank thank you and can I get Jim
56:19 from stinkin Santa Paul to come off me
56:20 and answer the question yeah so very
56:26 similar to ICS very rarely do we get
56:30 requests but it on a case by case basis
56:33 we we may approve them I've been doing
56:35 this for about that's covered three
56:38 fiscal years I've seen four instances of
56:42 mortgage payments to the tune of about a
56:45 thousand dollars maybe twelve hundred
56:48 out of roughly a hundred and eighty
56:50 thousand dollars over those three years
56:52 one hundred ninety thousand so it's uh
56:54 we do but the very small percentage of
56:57 our of our annual expenditures

1:00:04 from Steve Pereira and he he commented
1:00:09 that he likes the compassionate response
1:00:11 to need and he likes that we used a
1:00:14 recommended list of service providers
1:00:15 with local knowledge and local
1:00:17 connections he thought it should be

1:01:08 enough to be in the average or above
1:01:09 average am I need to share some of the
1:01:12 responsibility for this crisis if rents
1:01:14 are not reduced we will see a huge surge
1:01:16 in homelessness as soon as evictions are
1:01:18 allowed for non-payment of rent end

1:01:21 she also said that this sort of
1:01:24 assistance will ease the pinch for a
1:01:27 moment but does not address the root of
1:01:29 the inequities and then lastly we
1:01:31 received a letter from right Nowell an
1:01:34 attorney of personal
1:01:36 and he wrote to us as the incoming chair
1:01:39 of the Chamber of Commerce his email was
1:01:42 not specific to this agenda bill but it
1:01:44 was more broadly about the response of
1:01:46 the city to Kovan 19 he expressed
1:01:49 concerns for businesses and for the city
1:01:52 to support businesses and business
1:01:54 recovery and then most relevant to this
1:01:57 agenda bill he did provide the following
1:01:59 thoughts on landlords he said many
1:02:03 landlords have mortgages to pay and
1:02:05 expenses associated with owning a rental
1:02:07 that they have to pay they are a
1:02:09 business just like a local rental local
1:02:11 retail store and shifting shifting the
1:02:14 burden to landlords puts them in a place
1:02:16 where they will be in defaulting on
1:02:17 loans etc so he said we should wait ere
1:02:20 Filiz doing anything that will shift
1:02:21 financial burden to landlords and that
1:02:24 concludes the public comments that we
1:02:25 received relevant to this item Thank You

1:02:31 those were received by all council via
1:02:33 email this week before the next part of

1:05:45 amend for a couple of reasons one is
1:05:52 for folks who own a home as we heard
1:05:55 from the service providers that's
1:05:56 considered an asset it's a fairly
1:05:58 significant asset and there certainly
1:06:03 are more resources for most people who
1:06:06 own homes who may find themselves in
1:06:10 some financially challenging times such
1:06:12 as they'll have equity in a home they
1:06:15 might have an ongoing line of credit or
1:06:17 equity line of credit they could also
1:06:20 get help from their lender I'm I'm quite
1:06:24 sure that the lenders are going to be
1:06:27 stepping up here to help the last thing
1:06:29 that they want right now is a flood of
1:06:31 foreclosures which would take several
1:06:34 months to get to that position anyway
1:06:36 where they were before closing but I
1:06:37 think there are a lot of options and
1:06:39 programs that are available for for
1:06:42 folks who have mortgages and I really
1:06:44 think that those should be exhausted
1:06:46 first as indicated people with homes
1:06:50 generally tend to have more assets the
1:06:53 city I think needs to be concerned about
1:06:55 its own financial health as well at this
1:06:57 point we're at the beginning really the
1:06:59 beginning of this and so I think we
1:07:02 should probably move I don't think I
1:07:08 don't want to say slowly I just think we
1:07:10 need to move prudently and be careful
1:07:12 about what resources particularly cash
1:07:17 we we put out there right now certainly
1:07:20 random rental assistance makes sense I'm
1:07:23 not sure at this point that that
1:07:25 mortgage assistance makes sense we can
1:07:28 always revisit we also heard from the
1:07:31 service providers that it's extremely
1:07:33 rare for folks he need mortgage
1:07:36 assistance so could there be more than
1:07:39 that in a normal last three or four
1:07:41 years years when we've had a really
1:07:42 really good economy certainly but I
1:07:45 think the vast majority of people who
1:07:47 are going to be calling the provider
1:07:49 service providers are going to need
1:07:50 rental assistance so that's the reason
1:07:52 that I made the motion thank you I am

1:08:00 wished to comment on this amendment to

1:08:36 ongoing process but I'm supportive of

1:08:51 supportive of the idea of providing
1:08:52 support but I also think we need to
1:08:55 temper that with the fact that we have
1:08:57 all sorts of financial obligations and
1:08:59 challenges on the future in the future
1:09:01 and on the horizon so this will take
1:09:04 care of the most important need and when
1:09:06 this bill was first contemplated we were
1:09:10 cashing in or taking advantage of the
1:09:11 fact that we as a city can move very
1:09:13 quickly and very nimbly to get something
1:09:16 out early in the program while we wait
1:09:18 for other sources to come through so
1:09:20 this really focuses on us meeting those
1:09:23 with the greatest needs in doing it in
1:09:24 the most expeditious manner possible

1:23:25 to partner with organizations in the
1:23:29 community that know our community so
1:23:31 well and to provide a measure of support
1:23:35 and sustenance to to folks in need in
1:23:40 our community I believe there will be
1:23:42 other opportunities going forward both
1:23:45 monetary and organizationally it's tried
1:23:49 to ease this burden in our community
1:23:51 which I consider to be sort of the
1:23:53 highest calling that that I've had in 10
1:23:57 and a half years on council so a big
1:23:59 thumbs up for this and thank you to the
1:24:01 staff for putting this together and
1:24:03 putting together the community support
1:24:07 that allowed us to get additional
1:24:08 information and craft a better bill this

1:25:40 crisis so quickly and with the help of
1:25:44 city staff and also many things to
1:25:48 council leadership for bringing this
1:25:50 forward and so I can't thank everybody
1:25:54 enough but I mean I think I think I just
1:25:57 had pointed out that if we didn't have
1:26:01 these organizations in place in Issaquah
1:26:03 we wouldn't be able to do that they are
1:26:05 there and we're able to access them and
1:26:08 I think it's really important let's

1:26:16 amplify what councilmember Dee Michelle
1:26:20 said and that is we couldn't do this
1:26:22 without the excellent work of ICS st.

1:29:01 of the emergency that the mayor made on
1:29:04 March 6 but we were notified by stores
1:29:07 as well as the graters about Chamber of
1:29:09 Commerce that grocers and retailers had
1:29:12 suspended the use of custom provided
1:29:14 reusable bags in order to prevent
1:29:16 contact they could spread the Cova 19
1:29:18 virus the impact of this is the
1:29:20 customers who required to pay the city's
1:29:22 pastor charge for recycled paper carry
1:29:25 out backs in reviewing the ordinance as
1:29:28 well as discussion with the mayor staff
1:29:32 were proposed to the mayor that she
1:29:34 issue a proclamation of suspending the
1:29:37 charge of the fee which was done last
1:29:40 week in reviewing this with City
1:29:43 Attorney
1:29:44 he also recommended that the council
1:29:46 consider the ordinance before you to
1:29:49 suspend the collection of the fee for
1:29:52 the duration of the civil emergency that
1:29:55 was declared on March 6 so madam mayor
1:29:57 members of council we have the ordinance
1:29:59 before you happy to answer any questions

1:32:00 provided for in this ordinance shall
1:32:02 remain in effect for the duration of the
1:32:05 civil emergency proclaimed by me or

1:32:57 reduce the use of paper bags was a
1:33:00 really important measure for many
1:33:02 residents in Issaquah
1:33:04 I know it was part of the discussion and
1:33:07 I remember that the ordinance just a
1:33:09 long time to negotiate into its final
1:33:11 form and it took time for residents to
1:33:14 add brochures to accept the ordinance so
1:33:18 while it is completely understandable
1:33:20 that we are suspending the five cent
1:33:22 charge on paper base while we're
1:33:25 operating under emergency Proclamation
1:33:27 and a natural health directives I think
1:33:31 our community with bonnets to ensure
1:33:33 that the council will revisit that
1:33:35 suspension should the state of emergency
1:33:37 endure for an extended period I can
1:33:41 think of many good reasons what city
1:33:43 would maintain state of emergency
1:33:45 even after most businesses and agencies
1:33:48 have returned to normal operations the
1:33:52 economic social and operational impacts
1:33:55 of the tow business in crisis bucatini
1:33:57 for many months if not years and so my
1:34:02 worry is that this suspension meaning
1:34:05 the loss our communities will mentum on
1:34:07 an important environmental initiative by
1:34:11 making this amendment lotion I advised
1:34:16 the suggestiveness amendment I I was
1:34:22 trying to not get in the way of the
1:34:26 emergency Proclamation but instead
1:34:29 provided time for the council to review
1:34:32 and consider this if the emergency
1:34:37 Proclamation is extended for a long
1:34:41 period of time just to make sure that
1:34:43 the council has a chance there we do it
1:34:47 again terminates at suspension
1:34:50 we could use to continue the suspension
1:34:52 or review the program in its entirety
1:34:55 which was an option offered by one of
1:34:58 arts now correspondents but date of
1:35:01 January 18th 2022 is the date of the
1:35:04 Second Council meeting in January after
1:35:08 the next election and that's why I chose
1:35:10 that date and so that was my rationale
1:35:15 for proposing this amendment Thank You
1:35:17 councilmember David Shaw we have a
1:35:19 question from councilmember Goodman so
1:35:23 maybe this is a dumb question but that
1:35:25 civil emergency doesn't have a
1:35:30 termination date correct
1:35:32 it's how does that what's the procedure
1:35:35 for ending a civil emergency 30 minutes
1:35:40 30 pop quiz remembers the council the
1:35:45 the mayor would make a similar
1:35:48 proclamation determining that the
1:35:50 emergency has passed
1:35:52 okay so right now we are just under a
1:35:54 civil emergency there's no end date for
1:35:57 obvious reasons that's correct that's
1:36:00 correct okay thank you question members
1:36:03 from councilmember Walsh thank you I
1:36:09 noticed that one of the points in the in
1:36:15 discussing the alternatives if we don't
1:36:17 adopt the it's car shoppers will
1:36:20 continue to bear the cost burden of the
1:36:21 carry out bag fee as long as reusable
1:36:24 shopping bags are prohibited and I
1:36:26 wanted to get into that idea of reusable
1:36:29 shopping bags being prohibited first of
1:36:31 all is there any i I don't understand
1:36:36 how whether it comes along with the
1:36:40 civil emergency how a company would have
1:36:43 the ability to ban reusable prohibit
1:36:48 them in their in their location and it
1:36:53 also seems that this fee is not
1:36:56 necessarily tied to the prohibition but
1:37:00 tied to the emergency Proclamation so
1:37:03 I'm trying to under
1:37:04 and that connection sure city
1:37:07 administrator Bob Krist you want to
1:37:08 probably provide some more background on
1:37:10 where this request to waive she came
1:37:14 from and the request to not have grocery
1:37:20 stores have to handle reusable bags yes
1:37:25 madam mayor councilmember Walsh the the
1:37:28 grocery store industry I think made a
1:37:33 decision without consultation based on
1:37:36 their concern for health and safety to
1:37:39 prohibit the use of reusable bags do we
1:37:43 have the ability to question that
1:37:45 certainly my recommendation to the mayor
1:37:49 and the council is they've given given
1:37:52 the current situation that it's not
1:37:54 productive for us to question that so
1:37:56 since that operation has changed in the
1:37:59 midst of this civil emergency people no
1:38:02 longer had the ability to use those bags
1:38:04 based on the decision of the grocers
1:38:07 therefore there was no ability to avoid
1:38:11 the fee by bringing your own back so
1:38:14 this was brought to our attention by
1:38:16 several members of the community by this
1:38:18 quad Chamber of Commerce and so this
1:38:21 organ is first approximation for the
1:38:23 mayor and now this ordinance really
1:38:24 comes out of a matter of practicality we
1:38:29 feel that it's not fair to penalize our
1:38:32 residents who are no longer able to use
1:38:35 the reusable bag based on what I was
1:38:37 their legitimate health and safety
1:38:39 concerns of the grocery industry and so
1:38:42 we would like to relieve the residents
1:38:45 from the fee by by doing this certainly
1:38:47 as the situation changes this ordinance
1:38:52 could then be put back into place even
1:38:54 if the civil emergency remains I think
1:38:57 that's the mayor's prerogative to bring
1:38:59 that information back to the council for
1:39:00 consideration thank you so down here

1:39:07 what I'm trying to get at well no what
1:39:11 I'm trying to get at is is there another
1:39:15 end dates that we could put on this
1:39:17 related to the end of prohibition of
1:39:24 reusable shopping bags it sounds like
1:39:27 that wouldn't be possible because this
1:39:29 is something coming from individual
1:39:32 retailers I'm just trying to see if
1:39:36 there's any anything that we could do
1:39:37 rather than set a specific date do you
1:39:43 mean it's very about quick so the best
1:39:46 of our our figuring the answer is no if
1:39:50 there is great concern about this you
1:39:54 could set a fixed date somewhere in the
1:39:56 future either for this to be revisited
1:39:59 or if if that fixed date is approaching
1:40:04 then the mayor could bring a ordinance
1:40:06 back to the council to continue the the
1:40:10 prohibition of the fee again where we
1:40:14 stand right now I don't have a good
1:40:16 answer for you on a specific other
1:40:18 specific date that the earliest carry
1:40:29 out bag ban if that's what we want to
1:40:31 call it as impose could end is at the
1:40:33 end of the emergency declaration and by
1:40:37 that time we're following everything
1:40:39 that Washington stayed in King County
1:40:41 House is advising and so I'm not sure
1:40:44 that we would have all that much
1:40:45 pushback from the grocery stories about
1:40:47 going back to the system that we had so
1:40:50 that would be the earliest days I think
1:40:53 councilmember de Michelle wants to make
1:40:54 sure that if the emergency days extended
1:40:58 there's at least some point that we
1:41:00 revisit in the future and that's why she
1:41:01 selected January 18th to 2022

1:41:12 clarifying question for my colleague
1:41:15 councilmember Dean Michelle that's
1:41:17 appropriate I'm just curious about the
1:41:22 intent for the snap
1:41:25 provisions being all the way in 2022 and
1:41:29 what your thought was about putting the
1:41:35 date there instead of potentially sooner
1:41:42 thank you this is hell so every TV show
1:41:47 thinking through what could be possible
1:41:50 outcomes and right now we are all in new
1:41:54 territory and have no idea how long the
1:41:58 impacts of this current crisis are going
1:42:02 to continue like to continue for a long
1:42:05 time I'm thinking of other national
1:42:07 issues like nine and one where there
1:42:10 were emergency proclamations that
1:42:12 continued for many years afterwards in
1:42:15 order to be able to get the resources
1:42:17 that we needed and so forth so I didn't
1:42:20 want it to be too close but I didn't
1:42:22 want to said that said it too far away
1:42:24 and again I thought that if they knew
1:42:28 after the elections of 2021
1:42:31 this could be a question that we could
1:42:34 take up if the emergency Proclamation is
1:42:37 still in effect now the emergency
1:42:39 Proclamation is no longer in effect and
1:42:44 it becomes a moot point I just want to
1:42:46 make sure that we're not in a situation
1:42:49 where this just kind of drops through
1:42:52 the cracks

1:43:06 madam mayor this was a some folks may
1:43:10 remember councilmember Goodman and I
1:43:12 were both on council when this issue
1:43:15 came before us it was a divisive issue
1:43:18 whose the subject of a repeal effort by
1:43:22 some members of the community but it was
1:43:24 an important piece of environmental
1:43:27 legislation and it's somehow horribly if
1:43:31 we still have to be in an emergency
1:43:33 situation 20 months from now or whatever
1:43:38 the exact number is I would hope that we
1:43:42 would have figured out another
1:43:44 alternative to using plastic bags just I
1:43:48 don't know what what that alternative
1:43:49 would look like but we have some time
1:43:52 hopefully this would be a moot point and
1:43:54 we'll be out of emergency long before
1:43:55 then but this was an important piece of
1:43:58 environmental legislation that was
1:44:00 subsequently adopted by many many other
1:44:02 communities and it's important to
1:44:05 continue to push for the removal of
1:44:08 plastic bags from the waste stream thank

1:44:22 Administrator pop quiz is there anything
1:44:24 that would stop or would not allow
1:44:28 Council to revisit the sooner is for

1:44:39 than the emergency Proclamation and
1:44:42 could we just revisit as a council the

1:45:33 are we looking at repealing all of this
1:45:36 legislation and going back to disposable
1:45:39 plastic bags in our shopping experience

1:45:47 or this is just about the fee thank you
1:45:52 I am seeing a question from council
1:45:57 president hon this is counsel for the
1:46:03 hunt I already asked my question I have
1:46:05 I just have a comment which is that I
1:46:07 think I think that we can revisit this
1:46:11 at any time and given that we don't know
1:46:13 what what the situation will be I think
1:46:17 that my my preference would be that as
1:46:21 the council we commit to monitoring the
1:46:24 situation around grocery stores and and
1:46:26 that we can revisit this ordinance at a
1:46:30 time when in a timely fashion and so
1:46:34 that we don't need to tie it to the
1:46:36 emergency emergency Proclamation but we
1:46:41 also don't need to tie it to the to the
1:46:45 elections and to a 2022 date I think we
1:46:49 can commit to revisiting this when it's
1:46:53 appropriate thank you and I meant if you
1:46:56 I'm a little bit out of order
1:46:58 councilmember Walsh I was just
1:47:01 clarifying whether the amendment was for
1:47:04 2021 or 2022 did it I mean this is for
1:47:09 2022 Thank You councilmember de Machaut
1:47:13 I just wanted to respond to tell some
1:47:18 number rates comments right this doesn't
1:47:22 really relate to plastic-based this is
1:47:25 the five cent fee is meant to reduce the
1:47:28 number of paper bags that people are
1:47:31 using and encourage the use of reusable
1:47:33 bags so so of the entire intent really
1:47:42 is to encourage reusable bags and right
1:47:46 now we can't do that because of Kovach
1:47:48 19 in the health concerns but there will
1:47:52 come a time again when you will want to
1:47:55 encourage people to use reusable bags
1:47:59 and so
1:48:00 you would want to I presume we would
1:48:03 want to put in place with this 570 which
1:48:07 is meant to encourage that and so that's
1:48:10 the intent of this and in terms of
1:48:13 visiting the this issue at anytime
1:48:18 that's correct
1:48:20 could do it at any time probably would
1:48:23 be to I think we would need to write an
1:48:26 amendment that says we can we we will
1:48:29 commit to revisiting the issue because
1:48:33 if we leave the motion ends of stands
1:48:36 the only option we have is for the end
1:48:40 of the emergency period that's my
1:48:42 understanding and the city of when
1:48:46 straighter fought to it to correct me on
1:48:48 that but the way that the ordinance
1:48:53 reads or the way that the motion reach
1:48:55 at this point we have no other options
1:48:57 than waiting for the emergency

1:50:56 in there is just to have it
1:50:59 automatically expire and the bag feet

1:51:06 emergency but if the council at any time

1:51:12 support for this it can come back and
1:51:14 amend an ordinance so I'm not sure if or
1:51:22 quite close to resolution that it

1:51:26 there is an amendment on the table to
1:51:29 add or no later date of January 18th but
1:51:33 the council also has the ability to come
1:51:37 back to this at whatever time they want

1:55:08 as written and as we are voting on

1:55:20 retail locations to assess a
1:55:25 pass-through charge it just allows them
1:55:27 to eliminate it if they so choose am I

1:55:58 a stopgap for that but section 1 of the
1:56:02 ordinance reads that grocers and other
1:56:05 retailers shall not charge customers the
1:56:07 pass-through charge during the period of
1:56:09 the suspension and shall not be required
1:56:11 to remit fees from recycled paper
1:56:13 carry-on bags supplied to a customer
1:56:15 during the period of suspension for
1:56:17 which no pass-through charge was
1:56:18 collected so if the council by the
1:56:21 adoption of this ordinance is adopting
1:56:23 that language again I think as we have
1:56:26 transitioned through these several days
1:56:30 the City Attorney had a greater
1:56:32 opportunity
1:56:33 to scrub the language of the ordinance
1:56:35 so that would be the master language one
1:56:38 adopted by the council okay this is
1:56:44 Lindsey Welsh again I appreciate that
1:56:47 clarification now my concern is if this
1:56:52 is dated as of March 6 and brochures and
1:57:00 other retailers haven't necessarily

1:57:19 impact from not having suspended that
1:57:23 fee are we putting them in in a
1:57:26 situation about crunch I don't believe

1:58:25 diligent as they practically could be to
1:58:28 suspend the bag fee under the mayor's

1:59:26 was signed we reached out by phone and
1:59:29 also by email to the large grocery
1:59:33 stores that had initially raised their
1:59:35 concerns and informed them of this rule
1:59:39 change and we also shared the
1:59:42 information through the Chamber of
1:59:44 Commerce and the Washington state
1:59:47 Retailers Association sent messages out
1:59:50 to their members which included large
1:59:53 with small retailers I'm in a different
1:59:55 the staff in pwe also called some of the
2:00:02 small retailers and inform them from
2:00:05 previous outreach that was done for the
2:00:08 original fee for the paper bag so we
2:00:12 continue to inform businesses as they
2:00:15 speak to them about this change in the
2:00:17 collection so the ones who have
2:00:20 originally asked for this change are
2:00:22 aware of it as well comes under Wolf's
2:00:26 any other questions no thank you thank

2:00:35 comment on the main motion I think it
2:00:40 makes a lot of sense I think that the
2:00:42 intent of the five cent fee used to

2:04:42 Washington State was going to
2:04:44 potentially suspend the act we were
2:04:47 advised today in a briefing with the
2:04:51 state that they are a few days away from
2:04:54 coming up with recommendations for what
2:04:57 to do with the open public meetings Act
2:04:59 so while I'm City mr. beckwith I'm not
2:05:04 sure how we should proceed with this the
2:05:07 same thing we're not quite at the
2:05:09 circumstance we thought we would be
2:05:10 today so you have some thoughts members
2:05:14 of the council yes as you indicated
2:05:17 madam mayor we don't have additional
2:05:18 information from the Washington Attorney
2:05:22 General on their thoughts nor from the
2:05:25 governor I know that when this was
2:05:27 discussed a few days ago I think the the
2:05:30 primary piece of this was our desire in
2:05:34 the city of mr. paws desire to let the
2:05:35 community know that we're committed to
2:05:38 maintaining as much of the open public
2:05:41 meetings act requirements as possible
2:05:43 the one requirement that many
2:05:45 communities around Washington State are
2:05:48 hoping that will be adjusted is this
2:05:51 requirement that a physical person need
2:05:53 to be sitting in the council chambers as
2:05:55 the city clerk is this evening so we
2:05:58 will keep the community posted as we get
2:06:02 additional direction from the governor
2:06:03 in the Attorney General but I think it's
2:06:06 safe to say that the city of Issaquah
2:06:08 remains committed to open meetings and
2:06:10 we'll do everything in our power to
2:06:12 sure the public has as much impact
2:06:15 during this civil emergency as they
2:06:18 would during any other time to comment
2:06:20 and communicate with the council Thank

2:06:30 you'd like to now I think the
2:06:32 administrators did a good job pointing
2:06:34 out that one of the aspects that is
2:06:36 likely to change if OPM is suspended is

2:06:45 if anyone has any thoughts or comments
2:06:46 on it we'll definitely have an update

2:06:50 told that additional information was
2:06:52 coming up but if you have comments I'll
