Staff report:
After PFOS (one of the PFASs) was detected in the City water supply in 2015, the City has responded in multiple ways, including installing a treatment system on Well 4 which has consistently produced high quality drinking water. In 2018, the City entered into an Interlocal Agreement (ILA) with Eastside Fire and Rescue (EFR), in partnership with Ecology to complete a Phase 1 investigation of the nature and extent of PFAS in the Issaquah Valley Area. In December 2019, another ILA with EFR and an Interagency Agreement (IAA) with Ecology were approved formalizing the Partnership and establishing an Executive Committee and Scope of Phase 2 of the investigation. These phases of work are now complete and have been almost completely funded through various state agencies. Phase 3 work, led by EFR, which involved a field scale pilot remediation trial, was also recently completed.

3:38 hello i am holly lebron i'm originally
3:41 from south carolina
3:43 my husband and i honeymooned in seattle
3:45 and we just fell in love with washington
3:47 immediately and inevitably my entire
3:50 family has followed me here my brother
3:51 my mom
3:53 having a baby will do that
3:57 love issaquah because it's beautiful and
3:59 picturesque it reminds me exactly when i
4:01 think of washington this is exactly what
4:02 i think of is here and i enjoy working
4:05 for issaquah being a part of positive
4:08 change and something bigger than myself
4:10 and fun fact i have four dogs
4:18 my name is rachel brown i've been
4:20 working for the city physique since
4:22 october
4:23 i joined issaquah because i really
4:25 valued the commitment that the city had
4:28 to its citizens
4:29 and a fun fact about myself is that i'm
4:31 a single mom and my kid loves to play in
4:33 the parks here
4:38 hey i'm grace ballach i joined estoqual
4:41 just because how wonderful everybody was
4:43 um i'm entry level and this was kind of
4:45 one of my first interviews that i did
4:47 and just fell in love with the people
4:48 and how wonderful everybody was
4:51 i'm originally from california and fun
4:53 fact about me is i love to travel thank
4:56 you
5:00 hi there i'm karina keen
5:02 born and raised in anchorage alaska i
5:04 moved down to washington to go to
5:06 university where i met my husband
5:08 we have three sons and two great danes
5:12 i came to issaquah following several
5:15 other previous employees i spent 12
5:17 years at snohomish county
5:20 dispatching there as well
5:22 i find
5:24 i was looking for an agency whose values
5:26 more aligned with my own and i found
5:29 that in issaquah
5:31 my goal is to be a catalyst in the
5:33 rebuild and
5:35 be a positive
5:37 changed moving forward
5:38 and my fun fact is that i've run a
5:40 marathon
5:45 thank you ladies
5:47 mayor pro tem now will give the
5:48 proclamation as well as the swearing-in
5:53 excellent
5:56 these things around i'm not as tall as
5:58 mayor paulias so you know
6:02 so i know that we've got several other
6:05 hires who
6:06 are previous hires who weren't here
6:07 tonight so we will welcome them at that
6:10 point
6:11 but
6:12 this week
6:15 national
6:16 public safety telecommunications week
6:19 and so we have a proclamation which i'm
6:21 going to read and then give to the chief
6:23 and each of you will also get copies
6:25 so whereas emergencies can occur at any
6:28 time that require police services and
6:31 whereas when an emergency occurs the
6:33 prompt response of police officers is
6:35 critical to the protection of life and
6:38 preservation of property and whereas the
6:40 safety of our police officers is
6:42 dependent on upon the quality and
6:44 accuracy of information obtained from
6:47 citizens who telephone the issaquah
6:49 communications center
6:51 and whereas
6:52 professional public safety
6:54 telecommunicators are a vital link for
6:56 our community and are the first and most
6:58 critical contact our citizens have with
7:01 emergency services
7:02 and whereas public safety
7:04 telecommunicators are the single vital
7:06 link for our police officers by
7:08 monitoring their activities by radio
7:10 providing them information and ensuring
7:12 their safety and whereas public safety
7:15 telecommunicators of the issaquah
7:17 communications center have contributed
7:19 substantially to the apprehension of
7:21 criminals and whereas each dispatcher
7:24 has exhibited compassion understanding
7:27 and professionalism during the
7:29 performance of their job in the past
7:30 year
7:31 now therefore mary lou paulie mayor of
7:34 the city of issaquah does hereby
7:35 proclaim the week of april 10th to 16th
7:38 2022 to be national public safety
7:41 telecommunications week

14:18 wanted to appreciate the council and
14:20 recognition of
14:22 the sexual assault awareness month in
14:25 partnership with the king county sexual
14:27 assault resource center it's so
14:29 important to the work that we do
14:31 that we have the support of our
14:32 leadership in all of our municipalities
14:34 and so i appreciate that you are being
14:37 intentional about recognizing this
14:39 important activity and supporting all of
14:41 i've been the vice president of the
14:43 board here at k-star for three years and
14:46 i can tell you that
14:48 issaquah is a good place to be knowing
14:50 that we have your support and our
14:52 community support behind this important
14:53 work

16:09 agenda item but given we only have the
16:10 one item we have not received any emails
16:13 on that since the last time
16:17 we summarized comments so
16:20 the next item of business is committee
16:22 and regional reports so council member

16:29 the ltch committee is working on the
16:32 application for the spring 2022
16:37 projects and we're currently
16:39 wordsmithing that our next meeting is
16:41 may 20th
16:43 for that
16:46 also the
16:47 cascade water alliance board met on
16:49 wednesday the 23rd the mayor attended
16:53 i did not attend so i'll we'll have to
16:55 circle back with the mayor to get some
16:57 notes on that meeting
16:59 but we'll fill you in on that i did send
17:01 out a newsletter that was sent to us by
17:04 the staff
17:05 if you have questions about that

17:08 after you hear the mayor's report if you
17:10 have any questions of course we would be
17:12 happy to answer those that concludes my

17:18 thank you very briefly the healthier
17:20 here governing board will hold a meeting
17:22 this thursday afternoon
17:24 and east side transportation partnership
17:26 will meet friday morning and that
17:29 concludes my report
17:31 thank you council member hun
17:34 um thank you i have one upcoming meeting
17:36 and um two reports
17:38 upcoming meeting this wednesday at april
17:40 6th at 3 p.m there will be a rwqc
17:43 regional water quality committee meeting
17:45 and the agenda includes briefings on the
17:47 sewer rate capacity charge status and
17:49 decennial flow monitoring conveyance
17:51 system improvement programs
17:54 then i have two reports the kokanee ila
17:57 management committee met on march 23rd
18:00 kokane is an endangered
18:02 kind of salmon that spawns in lake
18:04 spanish or around lake sammamish and
18:07 there was a request at this meeting to
18:09 fund an additional fifty thousand
18:12 dollars
18:13 in the inter-local agreement so this
18:15 would affect the city's budget it
18:17 affects
18:19 the city's portion of the ila by about
18:21 ten thousand dollars so this increases
18:24 the amount that we would pay into the
18:25 ila from thirty five thousand dollars
18:28 annually to about forty five thousand
18:30 dollars annually um this would support
18:33 part of the uh kokanee recovery manager
18:37 position who chairs this meeting and who
18:39 i think does an excellent job leading
18:41 the work for kokanee recovery
18:44 so i am generally supportive we did in
18:46 the meeting talk about needing to bring
18:47 this to our council since it does affect
18:49 the uh budget so i wanted to let all my
18:53 fellow council members know about this
18:55 but i will be supportive of that and if
18:57 you have any questions or comments
18:59 for me

19:01 i also wanted to report that we did see
19:03 good signs that the work of this group
19:05 is having an impact in 2017 there were
19:08 fewer than 20 kokanee returned to the
19:10 creeks around lake sammamish so 20 to
19:13 zero
19:14 and this past year the kokanee work
19:16 group counts at about 2 000. so this is
19:19 a big increase and this is really a good
19:21 sign because they are a very endangered
19:24 population and salmon are so important
19:26 to us in this region
19:28 uh i also
19:30 uh wanted to let this group know that we
19:32 also heard a presentation from
19:34 issaquah's planning manager lucy sloman
19:36 on the dock lighting work that the city
19:37 has been doing as part of title 18 and
19:40 title 18 is our land use code update and
19:42 this presentation was very well received
19:44 by the group and um i just wanted to
19:47 thank lucy for presenting on this
19:51 other cities will probably be able to
19:52 use our work in their cities with along
19:54 lake sammamish to improve their dock
19:56 lighting for salmon survival which is
19:58 great the next meeting of the kokanee
20:00 ila work group has not been set but will
20:02 be in april
20:04 and then lastly the council rules ad hoc
20:06 committee met on march 30th from 2 to 3
20:09 p.m this is the first of what will be
20:11 two meetings that the ad hoc has
20:14 council members ray martz and i
20:17 met and we are the three members of the
20:18 counselor on committee we also met with
20:20 city administrator bob quits and clerk
20:22 grabowski and clerk geezer
20:24 and we made a number of recommendations
20:26 including that appointments will be
20:28 appointments for committees will be made
20:30 by council president
20:31 the committee chairs will serve on only
20:33 one committee and that leadership won't
20:35 serve as standing committee chairs these
20:38 were summarized in an email that went
20:39 out and then this and other
20:41 recommendations that we have will be
20:43 formalized in the rules and then we will
20:45 review that at our next meeting which
20:48 will be wednesday april 6th let's be the
20:50 second and final
20:52 planned committee meeting for this
20:53 committee so we will report back
20:55 with our final recommendation after that
20:58 that concludes my report

21:06 and rescue board of directors will be
21:07 held on april 14th at 4 pm at
21:10 east side fire and rescue headquarters
21:12 this meeting will be held in person and

21:18 a strategic plan this year and the
21:20 process is going to involve a series of
21:22 public meetings the first of which is
21:24 this wednesday april 6th that will
21:26 occur at station 73 which is in issaquah
21:29 island there will be a meeting on april
21:31 20th in
21:34 north bend a meeting on april 13th in
21:37 incarnation a meeting on april 26th in
21:40 some amish and a meeting on
21:43 april 19th in woodenville in a meeting
21:45 on april 27th in
21:48 may valley
21:50 deputy council president hall council
21:51 member marks and i will be attending the
21:53 meeting this wednesday at station 73 and
21:56 that concludes my report

22:21 although as it's not in king county
22:23 i would be surprised if anyone has an
22:25 opinion on that

22:36 meeting is next wednesday from 7 till 9

23:15 housing committee meeting on thursday

23:20 4 pm it's a virtual meeting and we're
23:23 going to get it the first
23:25 overview of the accountability freedom
23:28 work that we owe to the growth
23:30 management planning council gmpc
23:34 we'll discuss that and then we also have
23:36 a state legislative session wrap up to
23:39 hear about the bills related to
23:40 affordable housing and which ones passed
23:43 and didn't and understanding the
23:45 outcomes of that legislation
23:47 and so that concludes my report
23:50 the
23:51 next item is the mayor's report which i
23:55 will also give
23:56 there will be an executive session this
23:58 evening to discuss potential litigation

24:25 victims heal from their trauma help is
24:28 available for anyone who has experienced
24:30 sexual abuse the non-profit king county
24:33 sexual assault resource center operates
24:35 a 24-hour resource line at 1-888-99
24:40 voice that's v-o-i-c-e

24:51 earlier this evening we heard um
24:53 kaysark's board vice president dianna
24:56 shoots
24:57 to acknowledge the proclamation and so

25:07 next the lifetime achievement award
25:10 proclamation the city of issaquah
25:12 partnered with the greater issaquah
25:14 chamber of commerce to present the 2021
25:16 lifetime achievement award this award
25:19 recognizes individuals who have made a
25:21 significant contribution to our
25:23 community through leadership service
25:26 economic growth and sustainability
25:28 the 2021 award winner is rob hunt since
25:33 1979 rob has worked tirelessly to grow
25:36 village theater and make it into the
25:38 cultural and artistic powerhouse that it
25:41 is today issaquah's economic vitality
25:43 and downtown core has been greatly
25:46 enhanced by robb's career of service so
25:48 please join me in honoring him and
25:50 thanking rob hunt
25:53 last week the city of issaquah also
25:55 presented its hall of fame award to
25:57 former count city council member stacy
25:59 goodman and former issaquah history

26:12 next the 2022 down home 4th of july so
26:16 we're delighted to announce that this
26:18 year the down-home 4th of july parade
26:21 and family activities are back so mark

26:26 fun on the 4th of july from 11am to 2pm
26:30 we've got a few upcoming community
26:32 events the cascade gardener spring

26:37 cascade water alliance is sponsoring a

27:31 keep our favorite town clean and

27:41 pizza at the historic shell station

27:51 association is hosting a market with

30:23 um yes i have my little lamp here but
30:26 anyway i can still guide you through
30:28 this because i've worked a lot on it so
30:30 i know it well and i have it in front of
30:33 um as we discussed at the
30:37 city council study session last tuesday
30:40 the 29th
30:41 this is a complete overhaul of chapter
30:46 5.02 of the issaquah municipal code
30:49 which sets forth the general regulations
30:52 for the city's
30:54 general business licenses
30:56 the city uses the state's
30:59 business licensing services
31:03 regulate business licenses or i guess
31:05 regulate isn't exactly the right word
31:07 but to process business license
31:09 applications in other words when folks
31:12 go to
31:13 apply for a business license they
31:15 essentially
31:16 use the same portal that they do to get
31:18 their state business license but they
31:20 request an endorsement that gives them a
31:23 city of issaquah business license in
31:26 addition to the state business license
31:28 requirement the state then sends their
31:31 application to the city to review and
31:33 for the city to essentially sign off on
31:36 for the state bls
31:38 and then the city of course can set its
31:40 own fees
31:41 and have its own criteria for
31:44 how to review
31:47 applicants for licenses
31:50 the old chapter hadn't been
31:52 uh updated in quite some time a lot of
31:55 it had been written in
31:57 the mid or early 80s
31:59 and it hadn't been updated
32:02 thoroughly since the city switched to
32:04 the bls system around 20
32:08 2019
32:10 there were certain parts that were
32:12 required to be updated and those
32:14 portions had been had been done properly
32:17 but there were some areas in the code
32:19 where it reflected old processes
32:22 for instance
32:23 paper applications that the city no
32:25 longer uses
32:27 temporary licenses that
32:29 are actually not available through bls
32:32 and so the city hasn't been issuing
32:33 those for several years so we wanted to
32:37 make sure that we were actually
32:39 we had a code that really reflected what
32:42 the processes are that the city
32:43 currently uses
32:45 and while we did that we also looked at
32:48 the
32:49 revocation
32:50 and suspension criteria more closely
32:53 following our conversation in january
32:57 regarding the amendments to those
32:59 criteria that were made then as
33:02 the council and community may recall
33:05 when those amendments were adopted in
33:08 january they were adopted with a sunset
33:11 provision
33:12 that uh means that the ordinance
33:15 and the those amendments expire
33:18 on april 18th
33:20 so coming up soon and so unless the
33:22 council adopts
33:24 new
33:25 regulations prior to that date the code
33:28 will revert to how it was written prior
33:30 to then
33:33 we worked extensively myself and jen
33:35 davis hayes in economic development with
33:39 the business community and as well as
33:41 staff who administer this code
33:45 find a code that would be
33:47 workable for staff but that would also
33:49 be more appealing to the business
33:52 community we had several meetings with
33:53 the economic vitality commission
33:56 we received input from the chamber of
33:59 commerce
34:00 and we then
34:02 received more input from the city
34:03 council at the study session and
34:07 that input was
34:09 was
34:10 taken into account
34:12 in the drafting of the version that is
34:14 in front of you this evening and i'm
34:16 happy to answer any questions that you
34:17 have about
34:18 it thank you rachel um does council have
34:22 any questions

34:27 thank you um i had a question about the
34:30 rental properties
34:33 part of the business license code so
34:36 this is
34:37 something that we talked about at the
34:39 study session which was that we have a
34:43 exemption for any residential rental or
34:45 leasing activity which does not involve
34:47 more than
34:48 nine residential units at any one
34:50 location with the city
34:52 um so first of all i wanted to ask you
34:55 about
34:57 if you had a chance to look at what
34:58 other cities codes
35:00 do for this and how how does our code
35:03 compare
35:05 yes i actually looked very extensively
35:07 at what other cities do and
35:10 there are
35:11 very few cities that have
35:14 any form of exemption actually
35:17 there i found that
35:21 renton
35:22 rented has an exemption for rental
35:25 units
35:27 that
35:28 are registered through their
35:31 uh their rental
35:33 licensing program so they have they have
35:35 a separate
35:37 rental registration and uh inspection
35:41 program so a totally separate rental
35:44 housing
35:45 licensing program like some
35:47 jurisdictions have implemented and so if
35:52 if a unit has already been
35:55 kind of permitted through that that
35:57 takes the place of the business license
35:59 requirement essentially so that they
36:01 don't require a separate business
36:02 license then
36:05 redmond exempts four units or fewer
36:09 from the requirement to have a business
36:11 license
36:12 those are residential units and then
36:14 maple valley has some strange language
36:17 it says it exempts persons whose sole
36:20 activity
36:22 the rental of real property
36:25 i i don't think that's very great
36:27 drafting but i i can only assume that
36:29 means that their sole activity
36:32 in the city of maple valley is rental
36:36 activity not that that's their sole
36:38 occupation period it's not exactly the
36:41 wording i would have used but i think
36:43 that's what it means so i think that i
36:45 would interpret that to be a
36:48 a blanket
36:50 exemption for rental activity as long as
36:52 that's
36:53 all you do but once again it's kind of
36:55 hard to tell because that language isn't
36:57 isn't really very clear but other than
37:00 that i did not see
37:02 any other cities and i looked at
37:06 seattle world view snoqualmie sammamish
37:10 kirkland
37:11 um bothell
37:14 let's see i have wrote them all down
37:16 here too there were i looked at quite a
37:18 few
37:20 it was
37:23 new castle was another one yeah i looked
37:26 at every pretty much everyone that was
37:27 kind of in our general area and
37:30 nobody else did those were the only
37:32 three
37:33 okay
37:34 um well thank you for doing that
37:36 research and and my other question was
37:38 the way i
37:40 read the exemption is you could have an
37:42 unlimited number of residential units
37:45 within the city
37:46 as long as they aren't nine more than
37:49 nine at any one
37:50 spot in the city any one location in the
37:53 city is that correct
37:55 that is correct yeah that that is
37:57 correct and that just comes directly
37:58 from the existing code
38:01 okay and does location here mean one
38:03 address
38:06 yes that is what the intent is to mean
38:08 one address they actually used
38:10 contiguous
38:12 parcels or parcel or contiguous parcels
38:16 in the existing code but
38:18 i didn't like that because
38:22 i think that becomes it gets a little
38:23 bit
38:24 i think they can get a little bit too
38:26 broad
38:27 an address can actually encompass
38:29 multiple parcels so i thought that that
38:31 made made more sense to use rather than
38:35 you know multiple parcels which could
38:38 start to kind of get carried away
38:41 okay thank you so i guess my question is
38:45 um i i understand that this wasn't the
38:47 main
38:48 this exemption came up as something
38:50 that's different than most of our
38:52 neighboring cities but it wasn't the
38:54 purpose of this particular review to
38:56 it's just something that we found so i
38:58 wondered if you could give me a sense of
39:00 how we might
39:02 address this issue perhaps get feedback
39:04 on it and revisit this particular part
39:06 of the code to
39:07 if we were to to consider making changes
39:10 to this what that timeline could look
39:12 like
39:13 yeah actually i do have a recommendation
39:15 for that
39:16 so this when this came up i brought this
39:18 up at the economic vitality commission
39:20 and there was really mixed
39:22 uh feedback on it
39:24 um some folks felt like we should just
39:27 i'd say in general they kind of just
39:29 didn't want to touch it and wanted to
39:31 defer to council which is why
39:33 i really just left it the way it is and
39:36 deferred to the council on it but there
39:39 seemed to be a sense that
39:41 short-term rentals at least should be
39:44 included
39:46 however
39:48 the reasoning for the inclusion of the
39:50 short-term rentals
39:52 was
39:54 to be able to control the behavior of
39:56 short-term rentals and the problem with
39:58 that is that a business license alone is
40:01 not going to have that effect
40:03 if the city wants to regulate short-term
40:06 rentals
40:07 it's going to have to do that through
40:09 separate
40:10 short-term rental regulations which is a
40:13 topic that has already come up in
40:15 community planning and development
40:19 i think that the city should
40:22 look at short-term rental regulations in
40:26 the future
40:27 whether it's as part of title 18
40:30 or as a separate project either
40:34 you know
40:34 contemporaneously with or shortly
40:37 thereafter
40:38 and that you should address this whole
40:41 topic of rentals
40:43 at that time
40:45 because
40:46 you will want to make some changes to
40:49 the business
40:50 licensing code depending on what you
40:53 decide to do
40:54 with short-term rentals but it probably
40:57 doesn't make a lot of sense to
41:00 mess around too much with the business
41:02 license code until you figure out what
41:05 you want to do with short-term rentals
41:07 because what will happen is
41:10 residents will
41:12 be upset because they will want you to
41:14 be able to do more
41:16 with
41:17 the business license and to be able to
41:19 take action against these short-term
41:21 rentals but you really won't be able you
41:23 won't have any means to unless you have
41:25 regulations that they are
41:27 supposed to follow and they are not
41:33 thank you does that make sense yeah that
41:35 does make sense thank you that's the end
41:36 of my questions but the very thorough
41:39 answer is thanks

42:42 this chapter of our code with
42:43 readability and public safety in mind
42:46 i think that this update gets us what we
42:48 want which is you know a mechanism to
42:51 manage public safety issues that can't
42:53 already uh be addressed through
42:55 or resolved through collaboration and of
42:58 course just to reiterate our first step
43:00 when issues like this arise will always
43:02 be to connect and problem solve directly
43:05 with our businesses
43:07 i'm definitely pleased with how this
43:09 turned out
43:10 how this turned out but given some
43:11 additional feedback from the chamber in
43:13 the downtown isquar association i'm
43:15 offering a small amendment um after and
43:18 i'll offer that after some initial
43:20 initial comments from council this
43:21 evening and that amendment would simply
43:23 change the amount of time businesses can
43:25 file an appeal after they've received an
43:27 official notice from 10 days to 14 days
43:29 so a full two weeks
43:31 and that language has been shared with
43:33 you all and i think there's a paper copy
43:34 in front of you as well
43:36 with that i will be supporting this
43:38 motion tonight and those are my comments

43:50 comments by deputy council president
43:52 hall and on the specific issue of the
43:55 rental properties i think anytime we're
43:58 looking at code and do come across some
44:00 part of the code that in this case it uh
44:03 doesn't align with our neighboring
44:05 cities
44:06 and there are potential issues with the
44:08 existing code that have been flagged by
44:10 our city attorney i think it is
44:12 best practice to
44:15 make sure that we put a
44:17 time frame on when we're going to
44:18 revisit it even if it isn't exactly
44:20 tonight because we don't have enough
44:22 feedback or information about what all
44:24 would be in that process of updating in
44:26 a more holistic way
44:28 as city attorney turpin um described
44:32 looking at the regulations more broadly
44:33 for rentals so i would urge council to
44:37 consider this as part of the work plan
44:39 to make sure that we do revisit the
44:41 rental issue aside from that i
44:44 agree
44:45 with all of the previous comments about
44:47 you know thank you to the commissions
44:49 and thank you to the business community
44:51 who provided feedback that i think
44:52 really strengthens this
44:54 code

45:01 i'll just chime in real quickly to say i
45:03 think this was a very smooth process and
45:06 something where we brought together
45:08 quite a few elements from
45:11 the
45:11 commissions to the business community
45:14 staff members who are involved in all of
45:16 the process
45:17 and really just
45:19 all work together with a goal of making
45:22 something better easier to use
45:25 and so i do appreciate identifying some
45:29 key areas that we want to follow up on
45:32 but to get
45:34 a whole section of code rewritten
45:37 in a way that
45:39 everyone checks everyone's boxes in
45:42 under 90 days is
45:44 impressive and deserves kudos and really
45:48 shows what we can accomplish as a group
45:51 so i will definitely be supporting this
45:55 and any other comment deputy council

49:53 the work plan to be sunsetted this year

49:57 cable tv commission and so i wanted to
49:59 ask the administration about what the
50:01 process is for the city council to be um
50:04 involved in that
50:06 decision making and also what are
50:09 how we can be involved in thanking this
50:10 commission and and
50:12 making sure that they're sunset in a way
50:14 that respects the hard work that they've
50:16 done
